BELMONT, N.C. (QUEEN CITY NEWS) – The manager of a popular restaurant that happens to be connected to the Jonas Brothers in Belmont is facing charges after investigators said she embezzled hundreds of thousands of dollars from the restaurant
The investigation centers around Nellie’s Southern Kitchen on Belmont’s North Main Street
Officers started looking into the restaurant’s manager back in 2020
53-year-old Belmont resident Joy Nichols Auten was charged with five counts of embezzlement by an employee

Belmont Police said an investigation into financial discrepancies was launched regarding sales of food and alcoholic beverages between 2016 and 2020. Auten was the manager at Nellie’s Southern Kitchen and is the aunt of the Jonas Brothers, who are in a popular band. Their father, Kevin Jonas Sr. opened the restaurant, named after the musical trio’s great-grandmother, in downtown Belmont in 2016.
These accusations are related to financial inconsistencies regarding the sales of food and alcoholic beverages. Authorities said Auten withdrew more than $251,000 when only $28,798.47 was needed to cover unpaid tips. After looking into it more, they found more than $93,000 was deposited into Auten’s personal bank account. It’s unclear what happened to the rest of the money.
Queen City News called Auten Monday afternoon to see if she wanted to comment on the allegations. Auten didn’t answer but sent a text reading, “This is Joy Auten and yes I have a lot I would like to say but at this time I will defer all comments to my attorney, Rick Beam.”
Beam told us he’s ethically prohibited from commenting on any pending litigation.
“In this particular case, someone had legal access to the money I imagine by being an officer of the company but just basically stole it and put it in their account,” said Michael Tabman, a retired FBI special agent in charge. “Basically embezzlement by the nature of them being in a trusted position.”
Tabman used to investigate embezzlement crimes and said this case isn’t a complicated one.
“I don’t see this going anywhere other than to a plea agreement and that’s the end of it,” he said.
As for why it took so long to bring these charges against Auten, officers said investigating this type of crime is very tedious and it takes a while to get all the proper subpoenas needed to obtain the bank statements.
“This was a deliberate and calculated act that significantly impacted a beloved business in our community,” Belmont Police Chief Falls said in a written statement. “The Belmont Police Department is committed to thoroughly investigating financial crimes like this to ensure justice is served.”
Queen City News reached out to Nellie’s on Monday for comment. The restaurant is not open on Mondays, so we were unable to get ahold of anyone.
Auten posted a $25,000 bond, according to the Gaston County Sheriff’s Office.

They lived in a two-room building, which remains to the side of the house, before the main home was completed in 1976.
The property has gone largely unchanged since, apart from essentials such as a sealed driveway, running water and electricity.
"He sourced a lot of the materials second-hand from demolition people - the bricks are sandstock bricks from the old Belmont Gunyah Hotel.
"There's a front door from Rohallion (a historic mansion in The Hill which was demolished in 1968).
"There was no water so we had tankwater, for the first couple of weeks we didn't even have electricity and the road was a dirt road - there was no street name, we used to be called 'off Violet Town Road'.
"A lot of people wouldn't come to visit us, or they'd park and walk the kilometre because they didn't like the muddy dirt road."
The property looks out onto Bangalay Reserve. Later, the block was subdivided and Mr Beeton donated an acre to what is now Tingira Community Church.
He took a year off work to build the church, which remains today, at his own expense.
In more recent years, the home has been the hub of major family milestones.
"There's been weddings, engagements, 21sts, funerals ... we've had the big combined Christmas days there," Mrs Hirst said.
"It's been very special, it's an amazing gathering spot, it's had so many happy memories."
Altitude Newcastle and Lake Macquarie's Daniel Irwin said the property had been bookmarked 130 times online and was attracting mainly local buyers.
"It's one of those magical properties - every single time someone comes through they just go 'wow' - it's very unique," Mr Irwin said.
"I think the grounds are what captures everyone ... that acreage lifestyle in Lake Macquarie doesn't come around too often and I think it will be one of the first sales in this cul-de-sac for three or four years.
"It's a property that's got really good energy around it ... it's an amazing history and legacy [of Mr Beeton's] that will live on."
The home goes to auction on December 10 with a price guide of $1.5 million.

WASHINGTON (OSV News) — Belmont Abbey College has announced plans to expand its footprint in the nation’s capital in a project aimed to amplify faithful Catholic voices in media

said Feb 28 it would expand its Belmont House in the Capitol Hill neighborhood
The school also said it has plans for an Intentional Catholic Student Residency Program as well as new academic programs “dedicated to promoting the transformation of political life and discourse.”

Back in the 1950s, Pommy Town was the place to be.
That was the nickname for Belmont North in Newcastle where 50 Nissan huts were put up to house British migrants.
Now, 70 years later, more than half of that temporary accommodation has been knocked down. But a few people reckon there's a place for this history alongside liveable modern housing.
Laurise Dickson hit the streets with Darlene Cameron who grew up in a tin can home on Somerset St and spoke with Susan Sedgwick, who helped revitalise and renovate one of these houses.

A Bryson City man recently bought a life-changing lottery ticket in Belmont.
Terry Millsaps bought a lucky $10 Million Spectacular ticket from Times Turn Around on Beatty Drive in Belmont.
He tried his luck on a $50 scratch-off and won a $10 million prize.
When Millsaps arrived to collect his winnings, he had a decision to make. He could choose to receive his prize as an annuity of $500,000 a year over 20 years or take a lump sum of $6 million.
Millsaps chose the annuity and, after state and federal tax withholdings on his first $500,000 payment, he received his first payment of $358,764. For the next 19 years, he will get annually a payment of $500,000 until he has received the full $10 million prize.
The $10 Million Spectacular game debuted in December 2023 with five top prizes of $10 million, 20 prizes of $1 million and 20 prizes of $100,000. Two $10 million prizes, five $1 million prizes and six $100,000 prizes remain to be claimed.

Picture: Nicole DavisThe Nissen hut at 4 Somerset Street, Belmont North's only local heritage-listed hut, is likely to outlast the lot after it was transformed by Sydney Living Museums (formerly known as the Historic Houses Trust of NSW).
The organisation, which aims to restore significant at-risk properties and return them to the marketplace, listed their eye-catching renovation for sale last Friday.
"It's really stylishly and beautifully renovated," Sydney Living Museums' Susan Sedgwick said.
"We've done all the things that people would expect in a modern home, but it still acknowledges the history of the site and the importance of the Nissen huts.
"Our intention was really to show how you can conserve and keep a lot of that original fabric, but still have modern living facilities."

They could be erected in a matter of hours, but provided little insulation from the weather in their most basic form.
"They weren't insulated, they were terrible in winter, really hot in summer - they weren't built for that," Ms Sedgwick said.
"So there aren't many of them around that are still being lived in, or [if they are] they've been adapted a lot."

That sale, and the $615,000 transaction of another Arlington Street hut that sold as a knockdown in April, has Mr Georgalas expecting a price of $700,000-plus.
"When I look at my recent sales I feel like we're north of that figure, how far north we're trying to figure out.
"They've done a fantastic job, it's a really interesting home."
Astonishing Nissen hut renovation preserves Belmont North historyThe Somerset Street hut was built in 1953 and sold by the Commonwealth of Australia in 1982.
It had just one owner between 1982 and 2008, when SLM picked it up for a price CoreLogic reveals to be $190,000.
The renovation, which began in 2021 as something of a landmark for SLM, involved extensive structural and cosmetic improvements and the addition of a second bedroom and bathroom.
Ms Sedgwick said the organisation had mainly tackled colonial homes before taking on the Nissen hut, which she considers an important part of the local history.
"That was why we took on the challenge to take it from a semi-industrial building into a residential building and turn it into something that's your loved family home."
The home will go to auction on September 6.

Mr Hayward-Powell was still processing what had happened when he spoke with the Newcastle Herald on Sunday
He returned to the scene of the crash as soon as he was discharged from hospital
firefighters and traffic control officers - remained at the scene throughout Sunday morning
The crash investigation unit scoured the site for clues to the cause of the incident
before a crane crew was brought in to remove the vehicle
The busy section of road was closed for several hours and onlookers were moved a safe distance away while crews hooked the bus up to the crane and flipped it back onto the road
It was a delicate operation as NSW Fire and Rescue were concerned the bus may have hit a nearby suspended gas line
so firefighters monitored the situation until the vehicle could be taken away
was taken to hospital where he underwent mandatory testing
A spokeswoman for bus operator Keolis Downer said the incident was under investigation and that the company would be working with the driver
passengers and their families following the incident
"While the circumstances surrounding the single-vehicle crash are still under investigation
today's incident has prompted police to remind motorists to take care when travelling on NSW roads

Emergency services rushed to the scene near the intersection of Avonlea Street at around 7:30 on Monday morning, after reports a southbound Ford Falcon had collided head on with a Mitsubishi Colt.
The driver of the Mitsubishi died at the scene, while the woman behind the wheel of the Falcon was taken to Newcastle’s John Hunter Hospital.
The highway is expected to remain closed for some time, as crash investigators work to determine what led to the crash.
City bound traffic is reduced to one lane, while motorists heading south are being diverted via Ntaba Road.

A woman has been charged following an investigation into a fatal two-car crash in Lake Macquarie earlier this year.
About 7.25am on Monday 13 May 2019, emergency services were called to the intersection of Avonlea Street and the Pacific Highway, Belmont North, following reports a Mitsubishi Colt and Ford Falcon collided head-on.
The 50-year-old female driver of the Mitsubishi died at the scene and the 32-year-old female driver of the Ford Falcon was taken to John Hunter Hospital for treatment.
Officers from the Crash Investigation Unit commenced an investigation and following inquiries, a 32-year-old woman was arrested at Newcastle Police Station today (Wednesday 23 October 2019).
Police will allege the Ford was travelling southbound when it crossed into the northbound lanes and collided with the Mitsubishi Colt.
The woman was charged with dangerous driving occasioning death (DUI), dangerous driving occasioning death (manner dangerous), negligent driving cause death, driver under the Influence of a drug, drive with illicit drug present in blood and not keep left of median strip.
She was granted conditional bail to appear before Newcastle Local Court on Thursday 14 November 2019
Lake Macquarie locals have been left outraged after the Super Radio Network erected a telecommunications tower in Belmont without seeking council approval.
Super Radio Network, who operates Newcastle Stations 2HD and NEWFM, erected the 25-metre monopole in the front yard of 14 Eagles Nest Close at Belmont North in September 2019.
Super Radio Network says the tower is “not anticipated to have any significant adverse impacts” on the nearby area.
But locals aren’t buying it – today, meeting with Lake Macquarie Councillor Adam Shultz.
More than a dozen concerned residents have already lodged objections to the pole.
Elected Lake Macquarie councillors say they will now go over a development application, submitted by the property owner and Super Radio Network in March, with a fine tooth comb to determine whether the pole stays.

In a response to NBN News today, 2HD said it “has responded to a multitude of complaints over the years from listeners who experience poor reception of the main 1143AM frequency in the Eastern suburbs of Lake Macquarie by applying for a low powered in-fill translator to the ACMA.”
They also assured NBN News the “required radiation reports and tests have been undertaken and submitted to council.”
2HD stated “the facility is not transmitting and has no connection to Mount Sugarloaf facilities.”

“The 2HD relay facility at Belmont North is similar to television transmitters that NBN have at Mosbri Crescent, Highfields and Belmont North to fill black spots in the signal. However the television facilities transmit at a much higher frequency & power. All of which are surrounded by residential properties similar to 2HD Translator at Belmont,” said a 2HD spokesperson.

has been charged with taking $93,039 from the restaurant during that time period
Auten is a former manager at the restaurant
Belmont police issued a press release on Monday explaining that during that time
when only $28,798.47 needed to be taken out
leaving more than $223,000 in unaccounted cash withdrawals
An investigation revealed that more than $93,000 in cash was deposited into her personal bank account during that time
“This was a deliberate and calculated act that significantly impacted a beloved business in our community,” police Chief Boyce Falls said in a press release
Records show Auten was booked into the Gaston County Jail early on Monday
She was later released after posting a $25,000 bond
