The so called “ugly duckling” suburb – because its market potential holds more than meets the eye – is also set to benefit from the state government investment into the region

Darling Heights has absorbed the surrounding cities’ natural beauty and peaceful aura and made it its own
“Far less tempered is the interest of investors
who see Darling Heights as a prime location to snap up a rental property – and it’s all thanks to the bustling University of Southern Queensland campus,” Ms Hill said
Home prices in the region shot up nearly 20 per cent over the past year
Darling Heights’ median home value remains at around $513,500
with this figure dropping to $315,000 for units
rental yields for homes sit at 4.4 per cent from an average rent of $440 per week
Darling Heights is also just a stone’s throw away from the CBD
Its youthful vibe makes it a possible destination for first home buyers
A fast-growing suburb on the outskirts of Ballarat
Ms Hill said a $50 million master plan developed by the state government would add “more than 100 new modern and energy-efficient dwellings”
sparking the construction of high-quality streets and open public spaces

in the bustling and ever-growing Logan region
is one to watch out for thanks to the forecasted population growth in the surrounding region of 500,000 by 2034
“It also boasts exceptional connectivity to both Brisbane and the Gold Coast,” Ms Hill said
“The median house price of $524,000 has risen by 6.9 per cent in the past year,” she added
expressing her belief that the region “remains undervalued given its appealing attributes”

These 17 ‘high conviction’ suburbs were nominated by at least two independent industry experts in the annual realestate.com.au Hot 100 list
And only two of these suburbs - Mandurah in WA and Armidale NSW - were nominated by three experts for their desirability

It was Friday night and I was staring at the conveyor belt at Sydney airport urging my bags to come out
Everyone else in my group has their bags and have peeled away to their respective homes
Teddy and Milo are waiting for me in the car and we make the drive home
I calculate that I have exactly 9 minutes to wipe any trace of the flight off me and change into something else
Nine minutes later we are headed to Holy Basil. We first visited the Laotian restaurant in 2013 when it was just a single restaurant in Canley Heights
I remember the long queue to get a table and how much we enjoyed their signature dish
It was a large triangular block of creamy vanilla ice cream with a thin and crispy pastry outer (I have spent far too much time trying to figure out how they make it)
In the decade between visits they've now got 3 restaurants including one at Darling Square which is much closer for us
The restaurant has an al fresco vibe thanks to the open design and has a more upmarket feel to it
Another good thing about the Darling Square location is that you can book a table
A few weeks earlier I had booked it for my birthday with Monica
We are sitting in one of the purple booths and it is positively heaving this Friday evening with a large crowd outside waiting for tables
Service is a little hard to flag down but is friendly and efficient once we get a hold of someone
We order drinks-a strawberry fruit shake for me and a durian fruit shake for Mr NQN
My strawberry fruit shake is quite good and not overly sweet while Mr NQN loves his durian shake that has quite a pronounced "stinkiness" once you take a sip
"It's your birthday so you get to choose what we order," says Monica which is music to my ears
But Peter has a request for the Penang curry so I add this to the list
The menu is a mix of Laotian and Thai dishes with lots of classics
It's also really well priced which is a nice surprise since the online menu doesn't have prices
The food doesn't take long at all to arrive
The beef is lusciously soft and melt in the mouth and the sauce is rich and sweet but balanced with tamarind
It's also aromatic with spices like star anise
This definitely looks to be the most popular dish of the night as it disappears quickly
There are two types of pork belly dishes on the menu and we went for the spicier one. This is pork belly pieces, stir fried with pineapple, capsicum, beans
It's a nice dish although I tend to prefer slower cooked pork belly where the fat is more rendered down
However even pork belly phobic Mr NQN really enjoys this dish perhaps because of the sweet
It's a nice enough curry but it's hard to beat the massaman curry
I love any sort of crispy rice so I ordered the Nem Khao fried rice balls that are paired with cured pork balls
onion and mint and this has a lovely textural contrast with each bite
The cured pork balls are quite mild in flavour and I thought that they might be stronger or more flavourful
Most of us love ox tongue and it was recommended to us by the waitress
grilled and served in slices with a sweet and spicy dipping sauce
The ox tongue is quite chewy in texture rather than the soft
melting ox tongue that we all really like with very thinly sliced ox tongue and I think this is the only dish that wasn't finished
My other favourite dish apart from the beef massaman curry is the Thai papaya salad (there is a Laotian version of this with anchovies which is saltier in case you're interested in that)
This papaya salad has a generous pile of shredded green papaya
chillies and beans although I like more peanuts and the garlic is only really on top of the salad so that you don't get any of the nice crunch and flavour from both if you don't get the salad on the top layer
Still I love the fiery spice of this and go back several times for this
The last dish to arrive takes up the last remaining gap of space on the tabletop
It's a deep fried snapper with a sweet and sour tamarind sauce with chunks of pineapple and tomato with basil and chilli
The fish is removed from the bones so that it's easy to eat
I tried a couple of pieces and neither of them had the sauce and I found that this was a touch dry too
Admittedly I rarely really enjoy a whole fried fish in Thai or Chinese restaurants as I find them quite dry and I prefer steamed or grilled
The menu describes this fried ice cream dish as "the one that started it all"
I've seen this imitated at a few places but it's never quite as good
It's vanilla ice cream wrapped in pastry and then fried and served with a salted caramel sauce and caramelised coconut
We are quite full from the main meals so we end up sharing just one
This is just as delicious as it was 10 years ago but this version has the addition of the caramelised coconut added to it which gives it even more textural crunch
Monica and Mr NQN have told me that their idea of hell is being sung Happy Birthday to in public but I don't mind one bit and am beaming ear to ear while they sing it to me

Today, the High Court of Australia dramatically altered the previously understood scope of the Commonwealth’s power to spend money and enter into contracts. This decision has immediate repercussions for many Commonwealth funding agreements
many of which will require quick restructuring to be saved
Williams v Commonwealth involved a challenge to the National School Chaplaincy Program (NSCP) brought by Ronald Williams
a parent of children who attended the Darling Heights State Primary School in Queensland
Williams challenged a funding agreement entered into between the Commonwealth and Scripture Union of Queensland
the group who provided chaplaincy services at the School
So how can a case about school chaplains now affect how the government in Canberra funds programs
There were several bases for the constitutional challenge. One of the most publicised was the argument that it breached section 116 of the Constitution by requiring a religious test for an office under the Commonwealth
At Darling Heights State Primary School the chaplain was employed by Scripture Union of Queensland
The High Court unanimously dismissed this argument
and held that the connection between the chaplain and the Commonwealth was not sufficient to render the chaplain an “office under the Commonwealth”
The point the case turned on then involved the breadth of the Commonwealth government’s power to spend money and enter into contracts
This power is governed by the breadth of the Commonwealth’s executive power but this power is ill-defined
Section 51 lists the legislative “heads of power” – specific areas of power. But executive power is not spelled out in the same way under section 61
Prior to this case there had been a long-held assumption that the Commonwealth executive power extended to entering into contracts and funding agreements in
areas that fell within the Commonwealth’s legislative heads of power – even where the Parliament had not passed legislation authorising those contracts and agreements
If that was correct, the question would have been whether the funding agreement between the Commonwealth and the Scripture Union fell within the legislative heads of power, argued in this case under section 51(xx) and section 51(xxiiiA) of the Constitution with respect to trading corporations and the provision of benefits to students
four of the judges (Chief Justice French and Justices Gummow
Bell and Crennan) expressly rejected this position
Two judges (Justices Hayne and Kiefel) did not determine this issue because they found the funding agreement did not fall within ss 51(xx) or (xxiiiA)
The main reasons advanced by the majority centred on the federal nature of our constitutional system
and the importance of responsible and representative government (and therefore the role of Parliament) in it
Chief Justice French notes that if the Commonwealth had a wide executive power to spend money
there are “consequences for the Federation” which would flow from that
funding is an essential tool of public administration and for government policy
If the Commonwealth had power to enter into such agreements without legislative backing
policies could be implemented in the absence of scrutiny from the Parliament
it appears that the Commonwealth will need statutory authority to enter into contracts and spend public money
This exposes funding agreements to the scrutiny of the Houses of Parliament
However, the majority indicated there will be some exceptions to this position, for example, contracts required to administer the departments of the Commonwealth pursuant to section 64 of the Constitution
The funding agreement for the chaplaincy program was held by the majority not to fall within these exceptions and was
There are many other funding agreements made by the Commonwealth
many of the grants paid directly to local governments
The Commonwealth must act quickly if it wants to save these types of agreements
including the agreements under the school chaplaincy program
Commonwealth funding agreements must be divided into two types: those that are with respect to the Commonwealth’s legislative specific areas of power but have no legislative backing at the moment; and those that are not with respect to the Commonwealth’s legislative specific areas of power
The first type can probably be saved relatively easily by legislation that retrospectively validates and provides authority to enter into these contracts
This could say that the the Commonwealth Executive is and has been authorised to enter into any particular contract or agreement the entry into which could be or could have been authorised by any law made pursuant to any of the heads of legislative power in ss 51
For the agreements under the NSCP this would then raise the question of whether they are “with respect to” any of the heads of legislative power
Justices Hayne and Kiefel have already expressly found that they are not
The other judges did not decide the question
Those agreements that are not referable to a head of legislative power cannot be saved in this way
That’s not to say these funding arrangements cannot be saved at all
The Commonwealth Parliament has an (almost) unlimited power to make grants to States
many of these funding agreements might simply be restructured as funding paid through the States
Given the conclusions of Justices Hayne and Kiefel that the school chapains funding would not be referable to the legislative heads of power
this is perhaps the safest option for this program
