The Hills Shire Council has responded to the Land and Environment Court’s decision for a mosque to be built on Larapinta Place, Glenhaven, claiming the verdict is incredibly disappointing.
The decision was handed down on March 28 by Court Commissioner Joanne Gray after the development was deemed “acceptable having regard to the absences of adverse impacts, the objectives of the zone and the character of the area.”
The Hills Shire Mayor Peter Gangemi says the verdict to approve the mosque by the court is short sighted.
“The State Government talks about putting locals first and including them in the decision making process, but this outcome just proves how out of touch they are with local community issues,” Mayor Gangemi said.
“This proposal fails to adequately deal with the RU6 Transition Zone objectives, as well as the noise, traffic and parking this type of development will generate. It also has little regard to the rural landscape and will unacceptably impact on the natural environment, as well as the neighbouring properties located within the quiet cul-de-sac.
“It’s unsatisfactory that our rural land is being exploited in this way because it’s a cheaper alternative to building on urban zoned land - the more appropriate location for a development of this size.
“The outcome could have been prevented if the Department of Planning allowed Council to stop this sort of development in our RU6 Transition Zone much earlier on in the process.
"I'm calling on the Minister for Planning to cut the bureaucracy and let councils get on with looking after their own local planning matters.”
Gangemi says his issue is not with places of public worship, but the location of the mosque.
“Given the intensity and scale, Council wanted to see this type of development located in our urbanised areas – where there is adequate pedestrian access, public transport, roads and a sewer network," he says.
"We have attempted to meet with the applicant on a number of occasions to discuss alternative sites, however, they've remained unchanged in their decision and adamant on this site.”
Hills Shire Councillor and former Friends of Glenhaven Chairperson Mitchell Blue says the requests of the local community have fallen on deaf ears.
“Glenhaven residents spoke as one on this issue," he says.
"Residents agreed that the site was not conducive to a place of public worship, due to the scale and intensity that this facility will bring. Time after time, the applicant was provided with opportunities to amend plans and details to make this facility fit.
"I do not believe this facility is in keeping with the land zone objectives and intentions. This decision by the Court is in stark contrast to the thousand plus submissions from the Glenhaven community and that is highly disappointing.”
Gangemi says residents should be thanked for their support, and that Council will look to ensure further urbanisation of rural areas within the shire will be prevented.
"I thank residents for their submissions during the DA process and their efforts in highlighting the many issues this proposal has,” he says.
“It's disheartening that Council is unable to be the consent authority on developments over $5 million as a result of State Government imposed planning panels, but we have sought to find alternative solutions to protecting our rural lands.
“In 2020, we were successful at prohibiting places of public worship in our RU6 Transition Zone thanks to changes that were approved as part of our Local Environmental Plan (LEP).
“While the Larapinta Place DA was lodged before these changes were implemented, this Council has continued to work hard and campaign successfully against urban sprawl in our rural areas, and this is not limited to places of public worship, but also seniors living.”
The approval to demolish a number of existing structures and works were also given the green light as part of the Court’s decision. An updated Plan of Management and Traffic Management Plan were submitted to address requirements of the judgement.

Authorities say that as of 5:15 p.m., 25 engines, five dozers, four hand crews, and five helicopters.
CAL FIRE says the biggest concern right now is the wind which has started to pick up. They say crews are having a hard time controlling the "right flank" of the fire due to spotting.

A wind-driven wildfire burned hundreds of acres Friday on the northeastern shore of Clear Lake

What was once a home with a big wrapping deck is now just rebar and foundation, a twisted bedframe, burned-out barbecue and other appliances sticking out of the rubble — a casualty of the Glenhaven Fire that started Friday in the hills off Harvey Boulevard in Lake County’s Glenhaven and spread east
“It’s crazy to see it like this,” said District 3 County Supervisor Eddie Crandell
who’d once taken campaign pictures on the deck
He was there now to help collect the seven dogs penned nearby

“It is what it is,” said Bill McIntyre who works at Oak’s Red & White Store and has seen much of the county burn in his two-decades-plus living in the area

And it’s not surprising things are tough when they spend 75 per cent of their farm income on fodder
They’ve applied for fodder relief a month ago but have heard nothing back
“I guess there must be a big line up,” Mrs Good laments

They’ve heard that their contractor Lion may increase the farmgate dairy price by 10 cents a litre

We cannot source feed for our cattle and our normal avenues of fodder are out of our reach financially and geographically.
“Our estimate is that at least 75% of our farm income is being eaten up by fodder costs
when in normal times that might be around 35% of our farm income
We are feeding concentrates and bi products in an attempt to keep our dairy cattle healthy
We cannot afford to purchase hay at present
however the real issue is milk price.Ten years ago when we settled in Kangaroo Valley we were paid 56c per litre and since that time our milk price has been reduced to 49c
Dairy farmers' standard of living has decreased due to supermarket and manufacturing forces driving the value of our product to historical lows
We have been forced to milk more cows on the same acreage and this in turn puts great pressure on our pastures
this is all without taking into consideration our current climatic conditions
“For farmers who often work 7 days a week at all hours
the constant struggle with debt and keeping up with bills can take a mental toll on them
and I for one as a partner work hard to keep the family mentally and emotionally on top of things
Every year when we recontract our milk price we plead to our milk company for an extra few cents
however we find we are just small voices who cannot make a difference in the face of supermarkets and multi national companies
The current drought conditions just help to further deepen our plight
but if these combined circumstances continue to prevail
dairy farmers in Kangaroo Valley and indeed nation wide will be closing their dairies for good and as a nation we will be much poorer for it.”

A vegetation fire broke out at approximately 11:45 a.m
today in the Glenhaven area of Lake County
quickly spreading to 50 acres by 12:32 p.m.
according to scanner reports from the Incident Commander
as firefighters work to contain the rapidly growing blaze
Crews are battling not only the main fire but also several spot fires
including one two ridges out that threatens a nearby structure
and CAL FIRE’s LNU unit has mobilized significant resources to the scene
with Lake County OES warning of very low humidity and gusty westerly winds creating critical fire weather conditions
As the fire continues to spread through the dry
Highway 20 has been shut down in both directions
Evacuations are in progress down Highway 20 to High Valley Road and Cerrito Road
Traffic is expected to be slow as residents evacuate
The Incident Commander has requested Highway 20 be closed but it hasn’t yet been closed as of 12:58 p.m
and details are being updated as more information becomes available

UPDATE 1:06 p.m.: Spot fires continue to be an issue for fire fighters with a new spot fire discovered off the 11000 block of Pingree Road
First reports indicate the spot fire is approximately 100 feet x 100 feet

Scanner traffic indicates that fire personnel have requested High Valley Road be closed by Public Works employees due to the fire.
UPDATE 1:14 p.m.: Update from the intel aircraft maps the fire at 123 acres as of 1:14 p.m
Scanner traffic indicates that the left flank is making a run for it and two structures are immediately threatened near the left heel of the fire.
Incident command is making requests for nighttime air support to make sure support is available if needed later.
UPDATE 1:23 p.m.: According to scanner traffic and the Caltrans QuickMap
Highway 20 has a hard closure in place from the intersection of High Valley Road and the Hwy 53 round-a-bout
there are not enough units to man the closures.
Additional aircraft have been requested to the right heel of the fire that is flaring up.
UPDATE 1:39 p.m.: Scanner traffic indicates fervent fire activity with fire personnel alerting command that a dozer line had to be abandoned due to fire activity
suggesting that a subsequent line should be plowed on the next ridgeline
Two additional spots were reported in that area
Tankers have been requested to target the spot fires

the fire is now estimated to be 200 acres in size as of 1:49 p.m

Spot fires continue to be a problem for firefighters with an earlier column had fiery debris falling from it
a spot fire was reported in a backyard off Lakeview Drive
with residents attempting to battle the blaze as personnel were diverted to the spot for immediate structure protection
Aircraft support was requested with the pilot encouraging the ground crews to continue “keep spraying until you us come by”
highlighting the immediate threat to structures and the effort to prevent property and life loss
