claimed workplace discrimination related to his Italian heritage and a second in 2022 claiming he was denied a promotion because of the previous lawsuit The most recent lawsuit said Kiely is holding a grudge against Costagliola because he won a settlement from the 2022 lawsuit when Kiely was promoted over the sergeant despite being "the inferior candidate." Harrington Park Township Administrator Kunjesh Trivedi said the borough had no comment at this time and Police Chief Robert Murphy did not immediately respond to request for comment Lawsuits Bergen woman claims funeral home lost mother's ashes and cremated belongings The lawsuit claims Kiely cannot do his job listing a variety of complaints such as lack of self-control anger management issues and not following the rules set by the Harrington Park Police Department The suit also accuses Murphy of lacking "courage foresight and ability to control [...] Kiely" and allowing Kiely to make decisions about what is best for the police department Costagliola claimed in the lawsuit that the reason the police department and the borough never want to promote or protect him is because "he follows the letter of the law 100% and makes no allowances for unlawful acts committed by fellow officers." The suit said none of Costagliola's past protected actions is being sought as part of the damages in the current lawsuit The lawsuit said two Internal Affairs matters have been filed against Costagliola since "his whistleblowing protected activity" happened and the Conscientious Employee Protection Act claims come out of the activity that happened between Jan The suit claims Costagliola was a victim of a hostile work environment since 2023 and the hostile work claims stem from handicaps and disabilities he's had from injuries and illnesses while on the job especially related to new shaving restrictions Costagliola said he has a dermatological condition he's had accommodations for for years and can't shave every day The lawsuit said the first incident occurred when officers were called out to a home for a disturbed person call and that person was well-known to the police department The suit said the person was not a physical threat to the officers on scene nor his parents or himself and at one point after the situation was de-escalated an officer was sitting with the person on the couch keeping him calm The suit claims another officer who is a favorite of Kiely's "unconscionably and unlawfully" took out her taser and "brandished it and pointed it" at the emotionally disturbed person for four minutes in a "threatening manner." According to the lawsuit another officer reported the actions to Costagliola and body camera footage led him to believe that the officer violated use-of-force guidelines and had written a false police report Costagliola said he reported the incident to Kiely who was required to open an Internal Affairs file but refused to do so The lawsuit said Kiely became "verbally aggressive" with Costagliola and failed in his duty to investigate the other officer for violating the department's use of force regulations Costagliola expressed concern to Murphy that the chief Eric Flyge would not investigate objectively The second whistleblower incident is regarding a prolonged mold problem at the station The lawsuit said Costagliola filed a complaint with OSHA in March about an "unsafe" amount of mold spores and fungus at the police station to "protect the health He said he told Murphy about the OSHA report and it angered all the defendants excluding Flyge because the borough was forced to spend money for remediation The lawsuit claims Murphy and Kiely hindered his ability to be a supervisor by removing his ability to review body-worn camera footage have required him to conduct two 30-minute on-site traffic details each shift which Costagliola was exempt from until his CEPA activity and retaliated against him by fabricating a complaint from IA claiming Costagliola conducted an unauthorized investigation into another officer Costagliola said Murphy and Kiely used Flyge as an IA investigator to retaliate against him for doing his job and suspended him days without pay The suit accused the defendants of suspending him to confuse his retirement date and deny him his full rights to retire after 25 years of service on a job which was a side settlement agreement from a consulting with the community in early 2016 on the next stages of the project including corridor options for an extension of the future rail line south of Narellan and north to the T1 Main Western The Borough of Harrington Park is mourning the loss of longtime mayor Paul A. Hoelscher, who died Thursday.
