(ABC News) Link copiedShareShare articleA 17-year-old girl has been charged with attempted murder after a man was shot at North Lakes, north of Brisbane. Emergency services were called to a car park on Lakefield Drive about 9:40pm on Monday to reports a man had been shot in the arm, impacting his chest. Queensland Police said the 42-year-old was shot after an interaction with a group of four people, who they will allege were three men and a teenage girl.  He was taken to Royal Brisbane and Women's Hospital in a serious but stable condition. "A crime scene was declared and investigations led police to arrest a teenage girl in Riverview around 2am this morning," Queensland Police said in a statement.  A 17-year-old Windsor girl has been charged with one count each of attempted murder, possessing dangerous drugs, unlawful possession of weapons and authority required to possess explosives. The matter was briefly mentioned in the Ipswich Childrens Court this afternoon, where the matter was adjourned to the Brisbane Childrens Court next Tuesday.  The girl, who remains in custody, is expected to apply for bail on that date. "The three men, who police believe were also allegedly involved in the incident, remain outstanding, however investigations indicate there is no threat to public safety," Queensland Police said.  Police have seized an Audi Q5 which they believe was driven by the alleged offenders.  Investigations are ongoing and anyone with information is urged to contact the police. a knife throughout the evening in which they roamed the streets of Brisbane’s outer northern suburbs with at least two others The crown prosecutor David Nardone himself had conceded a murder conviction rested entirely upon the fact that the accused knew his companion was armed He told the court that CCTV footage showed it was “unavoidable” that the accused saw his companion’s blade and given the two teenagers had already formed a common purpose to steal from the Lovell home he was therefore “jointly liable for possession of the knife” But Reece argued during the trial that the infrared footage used as evidence against her client did not show him looking in the direction of the blade held by his companion and did not accurately reflect the gloom even if he did know his companion was armed audio and video captured of the violent melee showed her client exhorting him to stop his violence and flee the scene Cruiseabout celebrated the grand opening of its fourth store assault The fate of an alleged accomplice in the December 2022 stabbing murder of Emma Lovell that shocked Queensland now rests in the hands of a judge after a three-day trial ended on Wednesday Prosecutors did not argue that the accused teenager – who cannot be named for legal reasons as he was 17 years old on the night Lovell died of a stab wound to the chest on the front lawn of her home in North Lakes north of Brisbane’s CBD – ever wielded that fatal knife including murder and assault occasioning bodily harm on Monday But crown prosecutor David Nardone said CCTV footage which captured the two-minute and 16-second struggle between Emma also clearly revealed the accused’s companion showing – or even offering him – the 11.5cm serrated blade as the pair stood poised at the front door Given the two teenagers had already formed a common purpose to steal from the brick bungalow the fact it was “unavoidable” that the accused saw his companion’s blade meant he was “jointly liable for possession of the knife” “The killing was a probable consequence of the unlawful purpose to steal property from the dwelling while armed with a knife,” Nardone told Justice Michael Copley KC in his closing submission on Tuesday afternoon “The liability [of the accused] arises as either an aider or an encourager of the act completed by [his companion].” But the prosecutor conceded a murder conviction rested entirely upon the fact that the accused knew his companion was armed Defence barrister Laura Reece argued that the CCTV footage did not prove beyond reasonable doubt that her client did see a knife that his companion may have been concealing in a Calvin Klein satchel bag throughout the evening in which they roamed the streets of Brisbane’s outer northern suburbs with at least two other companions Reece argued the infrared CCTV footage which the prosecution claimed showed the accused’s companion holding the knife centimetres from his face did not accurately reflect the gloom in the Lovell’s door well which was not fully captured in the footage was not looking in the direction of the blade or may have had the knife in peripheral vision but only in peripheral vision – and only for a short period of time,” she said that he in fact turned his face towards the knife at any point.” even if the pair had formed a common intention to steal while armed the evidence also proved her client withdrew that consent by attempting to prevent his companion’s violence Earlier Tuesday afternoon the prosecution had attempted to match audio taken from a neighbour’s CCTV with the Lovell’s vision-only footage to argue “logic demanded” that it was the accused’s companion who uttered the words “I’ll kill you I’ll kill you too” during the violent struggle on the front lawn contended the word “too” was not clearly discernible and that the audio also captured her client saying words to the effect of “nah bra” immediately afterwards She played a clip which appeared to show her client running over to his companion kicking Lee Lovell as he lay on the ground Lee Lovell talks to the media outside the supreme court of Queensland in Brisbane. Photograph: Darren England/AAP“Stop, stop, stop,” she contends her client exhorted his companion at this point. The pair then fled the scene, leaving both Emma and Lee Lovell slumped upon their lawn – he stabbed and beaten, she with her head in her knees, fatally wounded. Nardone had argued the purpose of bringing a knife to the home invasion could only have been to use it “should a confrontation arise”, either to scare off a person “or in fact to cause them serious harm so as to escape”. He conceded that the actions of both teenagers captured by the CCTV “suggest that their motivation was to escape” the scene once the Lovells’ dogs alerted them to the intruders and they confronted the pair. “That was not able to be easily achieved by [the accused] because of the persistence of Mr and Mrs Lovell during that confrontation,” the prosecutor said. “Failing to make good his escape the actions of [his companion] involve using the knife to penetrate Mrs Lovell’s body. The location of that penetration was in a position where it would achieve most harm. said that although it appeared that Lee Lovell – who told the court on Monday it had been his intention to detain the intruders until police arrived – was attempting to put her client in a headlock kicked Lee after he was dazed and prone and after – he would later learn – he had been stabbed demonstrating that her client’s companion had now entered “the realms of gratuitous violence” So even if there had been a shared intention of “meting out violence to make good an escape” her client’s words and actions demonstrated he had withdrawn from any such “common plan” “He did not use violence himself to the Lovells after breaking free from Mr Lovell,” she said of her client “He cannot at any time be heard to encourage [his companion] to use a knife or force of any kind and the evidence is in fact quite the opposite “That he reacted when he heard the threats to kill and that he acted when he saw [his companion] kick Mr Lovell on the ground.” While she argued her client may be found guilty of breaking into the Lovell’s home he ought be found not guilty of the charges of murder and assault with Justice Copley alone to determine the verdict Garda Property Group has sold an industrial investment worth 22 per cent of its local portfolio The funds through deal for the North Lakes business park (artist’s impression top) with an ESR managed fund is worth $114 million – a touch lower than the recently completed valuation of the built-out project ($116.8m) it still reflects a windfall for Garda which outlaid $16m for the 25 hectare land making way for the site in June Another $11.2m is being spent on infrastructure works Following settlement – which needs Foreign Investment Review Board approval with the parties expecting any settlement at least five months from now – Garda will repay all variable debt and reduce its gearing from 36pc to 22pc The deal comes after a more devastating in Melbourne’s Burnley earlier this year – where nearby offices in the Botanicca business park traded for a dramatic discount to book value and previous campaign asking prices North Lakes will contain c100,000 sqm of net lettable area “When fully developed…it will be one of Queensland’s leading industrial estates an we are disappointed not to be developing it out,” managing director However he added “the scale…is simply too large for Garda to deliver in the current environment” “This transaction places Garda into a strong financial position…our owners should benefit from any improvement in the property markets or broader economic conditions and we also have scope to be opportunistic in the event of continued weakness” according to the executive The manager will wear capital gains tax on the deal Unitholders will receive a one-off special distribution following it North Lakes is about 26 kilometres north of Brisbane’s CBD Also today we are reporting Fife Capital and Gibb Group secured Sydney industrial investments for a total $86.5m Add articles to your saved list and come back to them any time A teenage girl is accused of the overnight shooting of a man north of Brisbane The 42-year-old victim was found in a car park on Lakefield Drive in North Lakes Moreton Bay with chest wounds about 9.40pm on Monday He was taken to Royal Brisbane and Women’s Hospital in a “serious but stable” condition A 42-year-old man has been shot in the chest at North Lakes On Tuesday morning police announced they had arrested a 17-year-old girl from Windsor and charged her with attempted murder A string of other charges including possessing dangerous drugs and keeping a weapon were also laid She was arrested in the Ipswich suburb of Riverview about 2am Police believe the shooting followed a confrontation with the victim Three other males are believed to have been involved An Audi Q5 allegedly driven by the three men and girl has been seized by police The 17-year-old has been refused bail and will appear at Ipswich Children’s Court today Start the day with a summary of the day’s most important and interesting stories, analysis and insights.
