choice but to confront a bear over the weekend He says the bear broke into parent's home in Oakhurst he says the placement of this washer and dryer that were next to the back door porch that gave him more time He believes it was this same bear terrorizing others in the neighborhood The first time he got an unexpected visit from the bear this past weekend was Friday night "He circled the house a couple of times and left the back porch alone “If it wasn't for my fiancé telling me to move the washer and dryer out in front of the laundry room door.. would have would have really cost," he said His fiancé said the idea came to her mind so if there was movement while they were sleeping "my biggest fear was like us being asleep and not being able to know Smith says he heard scratching sounds coming from the back porch door he saw the bear and thought to himself he only had a few seconds before the bear reached him only his 6-month-old baby and toddler were home “The best I could do is try and I did," he said he says he fell and hurt his foot while fighting off the bear with a shovel who was stuck in the laundry room He says he swung the shovel like a baseball bat and got him on the The sale of the historic Oakhurst Manor, which suffered a devastating fire last year Damages from the March 1 fire amounted to $500,000 Clarence Risher bought the manor in 2021 for $1.35 million according to the state Department of Fire Services because investigators can’t pinpoint one potential cause and the cause remains undetermined unless new evidence appears Risher said two investigators – one with the Town of Northbridge the other with a private company – theorize that a cigarette was thrown from a second-floor window onto the first-floor roof Lawsuit detailsRisher signed a purchase and sale agreement in June to sell the manor and its 25 acres for $1.6 million to Atlantic Solutions LLC a Maryland-based limited liability company whose managing member is Lee Jundanian Jundanian planned to tear down the manor and develop several homes on the site The sale called for $800,000 at closing and the balance a seller finance at an 8% interest rate The balance would be paid down when each developed home was sold Historic elements salvaged from the manor were to be part of the new homes Jundanian claimed in a filing last month in Worcester Superior Court that Risher violated the sale’s agreement on a number of counts One is that Risher allegedly has another buyer lined up and refused to sell to Jundanian Risher hasn’t made “reasonable efforts” to evict two tenants living in other buildings on the property The sales agreement states all tenants will be evicted before the property changes hands there would be a mutually agreed “holdback” on the sale price The lawsuit says Risher also failed to remove trash and debris from the property and made “unreasonable demands.” Those include staying on the property for six months after the closing Risher also allegedly took the unauthorized step of removing items from the property Jundanian wants the court to see that the June sales agreement is honored and that Risher pay for any damages and legal fees connected to the complaint Risher said the months since the fire have been “by far the worst year of my life .. it’s been a roller coaster.” Beyond the fire and lawsuit he lost his job in September in software development so Risher subdivided the lot into three parts to make the site more appealing to prospective buyers the second includes two homes on the property Risher said he subsequently accepted offers from two buyers One would pay $200,000 for the manor and restore it the other agreed to pay $750,000 for the forestland Lis pendens: a game-changerThose agreements are likely dead because Jundanian succeeded in getting a judge to grant a so-called lis pendens that gives Jundanian a claim to the property’s title Risher also said he received verbal offers – one for the entire property and another for the manor – that went nowhere because the two nonpaying tenants refuse to leave The court documents pertaining to Jundanian’s request for lis pendens name the tenants as Lisa Pepin and Matthew Carr Risher posted a video on his Facebook page of a verbal confrontation with a man that he identified as Carr The video shows the man threatening to break Risher’s jaw Risher said Carr refused his offer of $33,000 as compensation for tools stored in the manor that were destroyed in the fire A man who identified himself as Matthew Carr was featured in a Telegram & Gazette story days after the fire he didn't have insurance to cover the loss and he was under the impression that Risher had insurance to cover any unforeseen contingencies Risher said he didn’t have insurance at the time of the fire and owes $50,000 to Millbury National Bank Risher said he’s planning to evict her through Housing Court He also said the judge hasn’t told him that Jundanian's lawsuit stops him from selling the property he believes it’s a moot point because the lis pendens means no title insurance company or mortgage bank will want anything to do with a sale When asked what he thinks will happen next Risher said the cash sale for the manor will continue despite the lawsuit no one will buy the forest until the lawsuit is resolved and the other buildings won’t sell until the two tenants are evicted “I think that’s the most likely outcome,” he said The manor was built in 1890 by the Whitin family who built the first textile mill in Northbridge The Catholic Archdiocese of Boston owned the property from 1973 to 1990 then passed it on to the Catholic Diocese of Worcester which used the mansion for its House of Affirmation and later converted it into the Oakhurst Retreat and Conference Lou Milkowski recused himself from the Oakhurst Drive matter as his residence is less than 500 feet from the premises The plan for the property is to build a new eight-story 52-unit multifamily residential building on a double-jurisdictional property located in both Beverly Hills and Los Angeles six of which are as a result of the Density Bonus The R-4 Permit allows for an additional walkway Two of the three affordable housing units would be set aside for very low-income households and one for a low-income household Associate Planner Minjee Hahm presented the project to the commission providing analysis regarding everything from the dual jurisdiction to the allotment of parking spaces per unit with eighteen proposed for Beverly Hills-based units The city of Los Angeles already approved their portion of the project including finding the project to be exempt from California Environmental Quality Act (CEQA) regulations Hahm emphasized that pursuant to state density bonus laws cities are required to provide concessions for projects that qualify for a density bonus a reduction in minimum unit size and an additional walkway in the front including deviations from code in building height and side setbacks Hahm also noted the project qualifies for a Class 32 CEQA exemption as an in-fill development project as represented by Avi Stieglitz and architect Zoltan Pali known for designing the Wallis Annenberg Center for the Performing Arts spoke to the project’s aesthetic appeal and the challenge of working on a dual jurisdiction project Comments from current residents and families of residents as well as concerned neighbors discussed the sense of community shared at 412 N the lack of financial and physical mobility of many of the more senior residents and the need for the space to remain as is Demolition is expected to begin in October of 2025 Construction is expected to last 32 months “Even if help is offered to find new affordable housing our building community would be lost,” 78-year-old resident Jenny Ford said Ford resides at the location with her 86-year-old sister “Since the day the project sign appeared in front of our building in 2022 mental stress has added to our daily lives.” As a building with many units under rent control it was pointed out by several commenters that it would be nearly impossible to find equivalent living quarters for all current residents at the rate they pay now especially as many of them have lived there for years going on decades speaking on behalf of themselves and two others while Community Development Commission Specialist Karen Myron read out many submitted written comments “I was very deeply moved on a personal level by the input from current tenants,” Planning Commission Chair Terri Kaplan said “And I hate feeling like I am the instrument of delivery for something like that But the state of California has enacted laws that give us and every other city in the state little to really no discretion in situations like this and projects that are proposed under the state housing law.”  Following a period of commissioner questions and rebuttal the four remaining commissioners took a roll call vote to approve the project There is an appeal period of fourteen days the commission reconvened to discuss the project at 9737 Wilshire Blvd Associate Planner Philip Coronel presented the project to the commission explaining the nature of the lot in the city’s Business Triangle as a luxury exotic vehicle retailer on the ground floor of an existing multi-tenant building request for a Conditional Use Permit by discussing its appointment-only business model and no test drive policy The project sought a Class 1 Categorical Exemption from CEQA discussed his previous dealings with RD Whittington of Wires Only and his lack of knowledge surrounding Whittington’s alleged improper business practices in the city Ersoff was a sublessee at 9030 Wilshire Blvd and has since disentangled himself from Whittington He has since moved his inventory to its current location Commissioners asked about the movement of vehicles to and from the facility as it pertains to local rights of way as Xiong was arrested on multiple felony arson charges. Xiong is currently being held on $1 million bail. The investigation has been referred to the Madera County DA Office. CAL FIRE would like to take this opportunity to remind the public, that crimes of this nature take significant time, not only for the arrest, but for the evidence collection and processing.
