The man appeared in the Rockingham Magistrates Court last week via video link from Albany Regional Prison where he is serving a sentence on unrelated matters.
The court heard an RSPCA WA inspector attended the man’s home in September 2022 and saw the four-month-old dog, Milly, hiding down the side of the sofa.
When she asked if the puppy was friendly, the offender said the dog would try to bite him ever since he gave her ‘a smack’ for toileting inside.
Milly was friendly but timid with the inspector who saw the dog was in pain.
She then instructed the offender to seek treatment for the puppy.
Later that day, a vet examined Milly and told the inspector the puppy had a right eye haemorrhage that suggested blunt trauma; short and curled whiskers which indicated they had been burnt; a shattered right femur and femoral head with a significant degree of bone remodelling which indicated the injury was four to six weeks old; and a fractured left fore foot.
Further examination uncovered she had fractures which were not healing and chronic rib fractures.
The puppy was euthanised on humane grounds due to a poor prognosis for long-term comfort as a result of multiple fractures affecting all limbs, her pelvis and her growth plates.
In sentencing, Magistrate Brian Mahon said he was “absolutely satisfied that (Milly) did suffer” and that the offender “exposed an animal to pain and unnecessary suffering”.
The man was fined $7500 and banned from owning an animal for five years.
RSPCA WA Inspector Manager Kylie Green said it’s dreadful to think how much pain Milly was in.
“The poor little thing had spent at least a quarter of her short life with untreated fractures and in pain,” she said.
“A dog should be treated with love, care and respect. Despite her life being short and tragic, I’m pleased we got some justice for Milly today.”

He is due to appear before the Rockingham Magistrates Court today
The 51-year-old was sentenced in the Rockingham Magistrates Court last week after his dog named Alethea was found to have been suffering multiple painful conditions
The court heard Alethea was picked up by City of Rockingham rangers as a stray and taken to Baldivis Vet Hospital in October last year
RSPCA WA inspectors contacted her owner who claimed she must have escaped his backyard during a storm
He declined to surrender Alethea to RSPCA WA saying he owned and was responsible for her and her skin condition had started three months earlier
Alethea's entire body was covered in crusty lumps and open
The inspector seized the dog due to suspected animal cruelty offences
The offender said he realised the lumps were tumours and he had been treating them with Betadine
He also said he noticed Alethea had been bloated on her side but she had not been to a vet for two years
He explained he had not taken her to the vet about her lumps as she was old and there would be nothing the vet could do other than pain management.
The inspector transported Alethea to RSPCA WA where a vet examination found she had a severe generalised skin disease covering the majority of her body
which was causing significant pain and discomfort
painful osteoarthritis and spinal arthritis
and concurrent pulmonary parenchymal changes and increased respiratory rate
which indicated that the cancer had metastasised.
Alethea was provided with pain relief in an attempt to manage her chronic pain but was ultimately humanely euthanised as her quality of life was deemed unacceptable.
Magistrate Steven Malley told the offender as an animal owner
his responsibility was “strict”.
“[Alethea] wasn’t in great shape and can’t have been in great shape for some time,” he said.
RSPCA WA Inspector Manager Kylie Green said it was important for pet owners to understand that animal cruelty isn’t just deliberate acts of violence but also
“Alethea was in obvious pain with her skin condition and
in even more pain with cancer and arthritis,” she said
“It was her owner’s responsibility to take care of her and in this instance that meant taking her to the vet and he failed her miserably.”

Financial Crimes Squad detectives travelled to the UK to extradite Annie Melanie Lucas back to WA following an extensive investigation
Ms Lucas was employed in an administrative role at a contracting company when
she allegedly deposited several business cheques into her personal bank account and also used business cheques to pay for personal bills and services.
She also allegedly made several transactions depositing money from the business bank accounts directly into her personal account.
Ms Lucas appeared before the Perth Magistrates Court on Saturday
February 22 where she faces 103 charges of stealing as a servant
She will reappear in court again today where she is expected to apply for bail
“Financial crime matters are taken very seriously and are thoroughly investigated
Complex investigations often involve years of work," a WA Police spokesperson said
“This sends a message to the community that no matter the length of time or distance involved
WA Police Force investigators will not give up until they bring those responsible before the court to face justice.
“People who commit offences like these while in a position of trust should expect police to come knocking at their door at any time.”

"This development reiterates our dedication to establishing valued amenities that elevate the Kennedy Bay region
The brewery will not only provide a boost to the local economy
but it will also serve as a cultural hub and destination driver, attracting tourists and providing a unique space for community gatherings," he said

The man was allegedly behind the wheel of a white Ford Falcon sedan when he started doing burnouts along Laguardia Loop around 6.20pm on Wednesday
the man crashed into a tree outside a residence on the intersection of San Sebastian Boulevard and Toledo Court," a WA Police spokesperson said
The driver and his teenage passenger were not injured
The vehicle suffered extensive damage and a surrender notice was issued
has been charged with one count of reckless driving
He is due to appear before the Rockingham Magistrates Court on January 8
An RSPCA WA inspector attended the man's property back in September 2022 after receiving a report his puppy had been injured
When they arrived they found the four-month-old puppy was timid and hiding from its owner
"He stated the puppy was not friendly toward him," an RSPCA WA spokesperson said
"He explained the puppy would try to bite him after he gave her a ‘smack’ for toileting inside and that she had a ‘sore leg’ after he had stepped on her when she ran through his legs."
The inspector instructed the man to take the puppy to a vet which he did later that day
It was then discovered the husky had an eye haemorrhage consistent with blunt trauma
short and curled whiskers which indicated they had been burnt
a shattered femur and femoral head which was about four to six weeks old and a fractured fore foot
The accused surrendered the puppy and she was transported to the RSPCA WA Animal Care Centre
The puppy was euthanised on humane grounds due to a poor prognosis for long-term comfort as a result of multiple fractures affecting all limbs
The accused has been charged with failing to alleviate harm and will appear in the Rockingham Magistrates Court on October 7
The maximum penalty for a charge of animal cruelty is a $50,000 fine and five years in prison.

A brazen serial groper who preyed upon 18 women in an Australian nightclub has avoided jail time after a judge found his risk of reoffending was low
was facing up to 10 years in prison but was instead sentenced to a two-year community corrections order on Monday
He dodged reporters' questions as he left the Victorian County Court
The former PwC IT worker pleaded guilty to 17 charges of sexual assault and one count of attempted sexual assault over the attacks at Revolver Upstairs in Melbourne's inner east
CCTV footage from the nightclub showed Rayan groping his victims on the buttocks
stroking their backs and kissing them on the arms and shoulders
The attacks happened on three separate occasions in September and October 2023
Rayan admitted to police he touched one of the women accidentally but claimed he could not remember the other incidents because he was too drunk
Victorian County Court Judge Peter Rozen said he held reservations about those claims as he sentenced Rayan over the "brazen" attacks
"Your offending was deliberate and you knew what you were doing," he said
Judge Rozen said the women were entitled to feel safe in the nightclub and the scale of Rayan's crimes was concerning
He noted that three victim impact statements were read to the court
where the women described their ongoing anxiety and shattered sense of security
Judge Rozen also decided Rayan's moral culpability was considerable and said the 34-year-old lacked insight into his offending
But the judge accepted the sexual assaults were at the lower end of seriousness
given Rayan's victims were adults and the attacks were fleeting
no pending charges and no diagnosed mental health conditions
"I accept this offending was out of character for you," the judge said
Rayan was sentenced to a two-year community corrections order with 180 hours of unpaid community work
He will also have to complete treatment for alcohol abuse and programs to reduce his risk of reoffending
A leading Australian pollster says the coalition will be forced to carry out a "fundamental reorganisation" of its party structure to ensure ongoing relevance to voters after facing a wipeout in Saturday's election
As votes continue to be counted after Saturday's poll
figures show the coalition could slump to its lowest percentage of seats in parliament since the formation of the Liberal Party in the 1940s
the Australian Labor Party has claimed 86 seats in the House of Representatives compared to the coalition's 39
While Anthony Albanese has claimed an expanded mandate as PM with a larger majority in his second term
questions are being raised as to where the coalition will go
But it could be some time before a new leader is appointed by the Liberals
Deputy leader Sussan Ley said the party room would meet to elect an opposition leader and deputy
After consulting with the party's senior leadership
Ley said several seats where preferential counting was continuing would have to be decided before the meeting could take place
She said her party was reflecting on the results with humility
YouGov director of public data Paul Smith said the election was a referendum on the leadership of Peter Dutton
"The Liberal Party result was devastating and requires a fundamental reorganisation of who they are ..
they are not representative of Australians," he told AAP
"This is a situation where if they were a company
you would call in the administrators and look for a new business owner
After the opposition leader lost his seat of Dickson in Labor's biggest scalp of the election
a vacuum has emerged for the leadership of the coalition
Frontrunners include shadow treasurer Angus Taylor
along with opposition frontbenchers Dan Tehan and Andrew Hastie
Smith said the loss by the coalition was a "self-inflicted defeat"
"Their strategy was to win working-class votes in Sydney and Melbourne
but the problem was their strategy was at odds with their policies," he said
"They now hold no seats in Perth or Adelaide and hardly any in Sydney or Melbourne
Albanese has aimed for a tone of humility in his landslide win
thanking supporters in his inner-western Sydney seat of Grayndler
before pledging to get back to the job at hand

"We've been given a great honour of serving the Australian people

Federal Nationals MP Barnaby Joyce has been praised for being "very brave" after revealing he will undergo surgery for prostate cancer
The one-time Australian deputy prime minister
who comfortably won his regional NSW seat of New England in Saturday's election
received the diagnosis following a prostate-specific antigen (PSA) blood test
The test came back with an elevated result and a subsequent MRI and biopsy revealed he had prostate cancer

Federal Labor frontbencher Tanya Plibersek praised Joyce for going public with his diagnosis
"It's very brave of Barnaby to share his experience," she told Seven
"I really do think that having high-profile people like Barnaby talk about their health challenges is really important to encourage other men to get the test."
Plibersek noted that Labor Party national president Wayne Swan
was diagnosed with prostate cancer at the age of 48
"Wayne had surgery decades ago and his health is terrific," she said
Prostate cancer was generally very treatable if caught early

A large-scale Southland farming company has been fined $82,500 for discharging effluent in a manner which could have entered waterways
Gladvale Farms Ltd committed the offending on two occasions in October 2019 at an Oreti Plains farm
The company was sentenced on Monday after being found guilty in February following an August 2024 judge-alone trial
Legal action against the company began when Environment Southland alleged the Resource Management Act had been breached through effluent discharge on or into land which could have resulted in the contaminant entering water
It was alleged the defendant irrigated at night without monitoring due to employees being off duty
The judgement said although it was not necessary to prove the contaminant had entered or impacted the waterway
there was sufficient evidence to show it had
Steps taken to mitigate against the discharge were not sufficient
including using a digger to move effluent further into a paddock
Judge Steven told the court that 90 percent of the fine would go to the council

President Donald Trump says he is directing his government to reopen and expand Alcatraz
the notorious former prison on a hard-to-reach California island off San Francisco that has been closed for more than 60 years
who will never contribute anything other than Misery and Suffering
we did not hesitate to lock up the most dangerous criminals
and keep them far away from anyone they could harm
to reopen a substantially enlarged and rebuilt ALCATRAZ
to house America’s most ruthless and violent Offenders," he wrote
adding "The reopening of ALCATRAZ will serve as a symbol of Law
Trump's directive to rebuild and reopen the long-shuttered penitentiary was the latest salvo in his effort to overhaul how and where federal prisoners and immigration detainees are locked up
But such a move would likely be an expensive and challenging proposition
The prison was closed in 1963 due to crumbling infrastructure and the high costs of repairing and supplying the island facility
because everything from fuel to food had to be transported by boat
Bringing the facility up to modern-day standards would require massive investments at a time when the Bureau of Prisons has been shuttering prisons for similar infrastructure issues
The prison — infamously inescapable due to the strong ocean currents and cold Pacific waters that surround it — was known as the The Rock and housed some of the nation's most notorious criminals
including gangster Al Capone and George 'Machine Gun' Kelly
It has long been part of the cultural imagination and the subject of numerous movies
including The Rock starring Sean Connery and Nicolas Cage
Nearly all were caught or didn't survive the attempt
The fate of three particular inmates — John Anglin
his brother Clarence and Frank Morris — is of some debate and was dramatised in the 1979 film Escape from Alcatraz starring Clinton Eastwood
Alcatraz Island is now a major tourist site that is operate by the National Park Service and is a designated National Historic Landmark
returning to the White House on Sunday night after a weekend in Florida
said he'd come up with the idea because of frustrations with "radicalised judges" who have insisted those being deported receive due process
has long been a "symbol of law and order
A spokesperson for the Bureau of Prisons said in a statement that the agency "will comply with all Presidential Orders"
The spokesperson did not immediately answer questions from The Associated Press regarding the practicality and feasibility of reopening Alcatraz or the agency's role in the future of the former prison given the National Park Service's control of the island
a California Democrat whose district includes the island
questioned the feasibility of reopening the prison after so many years
"It is now a very popular national park and major tourist attraction
The President's proposal is not a serious one," she wrote on X
Alcatraz closed as a federal penitentiary more than sixty years ago. It is now a very popular national park and major tourist attraction. The President’s proposal is not a serious one. https://t.co/ALKXZLWlzO
The island serves as a veritable time machine to a bygone era of corrections
The Bureau of Prisons currently has 16 penitentiaries performing the same high-security functions as Alcatraz
including its maximum security facility in Florence
which is home to the federal death chamber
The order comes as Trump has been clashing with the courts as he tries to send accused gang members to a maximum-security prison in El Salvador
Trump has also floated the legally dubious idea of sending some federal US prisoners to the Terrorism Confinement Center
Trump has also directed the opening of a detention centre at Guantanamo Bay
to hold up to 30,000 of what he has labelled the "worst criminal aliens"
One of the best meteor showers in the Southern Hemisphere
Here's how you can catch a glimpse of it and what you need to know
The Eta Aquariids is a meteor shower caused by the Earth passing through a trail of debris orbiting the Sun that's left behind by Halley's Comet
and rock fall into our atmosphere and high speeds
commonly known as shooting stars," says Stardome Observatory and Planetarium's Josh Aoraki
The annual meteor shower takes place in early May each year
Aoraki says it's one of the best and most reliable meteor showers for us in the Southern Hemisphere "so it's a great time to see a celestial light show"
While you should be able to catch a glimpse of the celestial light show throughout the week
Thursday will likely be the best day - but prepare for an early morning
peak viewing time is after the Moon has set
"All you need is a clear sky and an unobstructed view of the north-eastern sky looking toward the constellation Aquarius," Aoraki says
MetService is forecasting chilly nights and mornings this week so you'll want to wrap up warm if you're heading outside
While it'll be visible to anyone in New Zealand
anyone living in a city should head out to somewhere with clear
dark skies for the best viewing experience
Under dark skies you could see between 10 and 50 meteors per hour but patience will be key
Unfortunately this is probably not one of those experiences you'll be able to capture on your phone
unless you're able to take a decent long exposure photo
"You will need a professional camera or DSLR camera to capture this
Smartphones are not good in low light and most do not have great long-exposure settings
"Any camera that has a long exposure setting of around 30 seconds should be able to capture a few meteors streaking across the sky if you set up a timelapse."

Lady Gaga gave a free concert Saturday night in front of 2 million fans who poured onto Copacabana Beach for the biggest show of her career
(...) Thank you for making history with me,” Lady Gaga told a screaming crowd
kicked off the show at around 22.10pm local time with her 2011 song Bloody Mary
Cries of joy rose from the tightly-packed fans who sang and danced shoulder-to-shoulder on the vast stretch of sand
Concert organisers said 2.1 million people attended the show
switching between an array of dresses including one with the colours of the Brazilian flag
Some fans – many of them young – arrived on the beach at the crack of dawn to secure a good spot
“Today is the best day of my life,” said Manoela Dobes
a 27-year-old designer who was wearing a dress plastered with a photograph from when she met Lady Gaga in the United States in 2019
Madonna also turned Copacabana Beach into a massive dance floor last year
The large-scale performances are part of an effort led by City Hall to boost economic activity after Carnival and New Years’ Eve festivities and the upcoming month-long Saint John’s Day celebrations in June
“It brings activity to the city during what was previously considered the low season – filling hotels and increasing spending in bars
generating jobs and income for the population,” said Osmar Lima
the city’s secretary of economic development
in a statement released by Rio City Hall’s tourism department last month
Rio’s City Hall said in a recent report that around 1.6 million people were expected to attend Lady Gaga's concert and that the show should inject at least 600 million reais (NZ$178.3 million) into Rio’s economy
Similar concerts are scheduled to take place every year in May at least until 2028
Lady Gaga arrived in Rio in the early hours of Tuesday
The city has been alive with Gaga-mania since
as it geared up to welcome the pop star for her first show in the country since 2012
Rio’s metro employees danced to Lady Gaga’s 2008 hit song LoveGame and gave instructions for today in a video
A free exhibition celebrating her career sold out
While the vast majority of attendees were from Rio
the event also attracted Brazilians from across the country and international visitors
More than 500,000 tourists poured into the city in the days leading up to the show
according to data from the local bus station and Tom Jobim airport
Rio’s City Hall said in a statement yesterday
made a cross-continent trip from Colombia to Brazil to attend the show
“I’ve been a 100% fan of Lady Gaga my whole life,” said Serrano
who was wearing a T-shirt featuring Lady Gaga’s outlandish costumes over the years
the mega-star represents “total freedom of expression – being who one wants without shame”
Rio officials have a history of organising huge concerts on Copacabana Beach
Madonna’s show drew an estimated 1.6 million fans last year
while 4 million people flooded onto the beach for a 1994 New Year’s Eve show by Rod Stewart in 1994
that was the biggest free rock concert in history
sixteen sound towers were spread along the beach
Rio state’s security plan included the presence of 3300 military and 1500 police officers
Among those present were Lady Gaga admirers who remember their disappointment in 2017
when the artist cancelled a performance scheduled in Rio at the last minute due to health issues
“She's the best artist in the world,” the 25-year-old said
I love you” in Portuguese rose from the crowd behind him
whose real name is Ella Yelich O'Connor
which also displayed what appears to be the album cover art — an X-ray of a pelvis
"100% written in blood," the website read
The new album's announcement came a week after she released her latest single What Was That
The song's music video was filmed at a mysterious pop-up event in New York City's Washington Square Park that was initially shut down by police. The event ended up going ahead after all, and fans who stayed got to hear the new song for the first time.

Lorde has dropped her new single What Was That after weeks of cryptic posts and teases that set fans buzzing
It's the lead single from her upcoming fourth album and her first original solo release since 2021's Solar Power
which is three minutes and 28 seconds in length
Some fans had been lucky enough to hear the track in full earlier this week.
On Wednesday, Lorde posted a picture of Washington Square Park yesterday with the caption "tonight 7pm".
Fans flooded the park an hour before she was supposed to appear, with photos shared of eager fans scaling trees to catch a glimpse of the singer.
Shortly before she was to perform, the Royals singer took to social media to tell fans police had shut the event down.
"Omg @thepark the cops are shutting us down," the message read.
"I am truly amazed by how many of you showed !!!
"But they’re telling me you gotta disperse ... I’m so sorry."
However, the pop-up event ended up going ahead after all, with fans who stayed getting their first full airing of Lorde's new single.

Lorde, real name Ella Yelich O'Connor, announced the single last week

Earlier this month, she dropped a 15-second snippet of the unreleased song.
In the video posted to TikTok on April 10, Lorde was seen wearing a white shirt and jeans while walking through New York City.
"Since I was 17, I gave you everything/Now we wake from a dream, well baby, what was that? What was that?” she sings over a synth beat.
It was the first sign of a follow up to Lorde's previous album, 2021's Solar Power. Her other albums were 2013's Pure Heroine and 2017's Melodrama.
Last year, she collaborated with British singer Charli XCX on a remix of Girl, so confusing — on a re-release of the Grammy award-winning Brat.
The men broke into Andy McCall's home on Montpellier Mews around 5.45am on April 3
stealing the keys to his Isuzu D-Max ute which was parked in the driveway
The 59-year-old tried to stop the thieves stealing his car
The vehicle was later found abandoned in bushland in Medina
Mr McCall's daughter Chelsea said her her dad remains in hospital
“He’s actually sustained quite serious injuries
and a minor bleed on the brain," she said
“These are the injuries that will follow for the rest of his life.”
Ms McCall said it has been a tough year after her mum died of breast cancer last year
so it’s just hard to get used to our new reality without my mum
it’s just shaken us to our core,” Ms McCall said
The 29-year-old is urging the offenders to come forward
“I think it would just give him that sense of peace knowing that these people have been brought to justice
and just knowing for the community that my dad has been given the justice that he deserves
“My message (to the offenders) would be to just have a heart and to come to your senses
just think about how what you’re actually doing can impact a whole range of people

Over $22,000 has been raised via a GoFundMe page to help the family cover the cost of his funeral
The teenager lost his life on Tuesday night after his Holden Commodore slammed into a tree on Warnbro Sound Avenue before bursting into flames
A member of the public pulled him from the vehicle before it exploded
Josh was then rushed to hospital but sadly died a short time later
"Hayley and Chris lost their youngest son
tragically on the 22nd of August 2023," GoFundMe page organiser Amorie Van Den Heuvel wrote
we know that there will be a lot that the family will have to deal with and they will need time together to process what has happened
"We would like to help relieve some of the financial burden that they might be faced with in the weeks to come and allow the family time together to grieve the emptiness that they will be feeling
it is just so unnatural to have to think about organising a funeral for a child
"Please show Hayley and Chris support with a donation
to give Josh the send-off he deserves."
