The Amazonas Environmental Protection Institute (IPAAM) has come under harsh scrutiny by authorities and Indigenous leaders for granting installation licenses to the Canadian-backed mining company Potássio do Brasil without considering the affected Indigenous communities or the environmental consequences of the project
which is seeking to reduce the country’s reliance on imported fertilizers
as Russia’s share of global potash exports increased from 16% in 2022 to 20% in 2023
The federal prosecutors said the licenses granted by IPAAM authorizing the project’s implementation
as well as the construction of a road and shipping port
were issued despite irregularities in the environmental licensing process and violations committed by the company
the mine overlaps with several Indigenous lands
which are either demarcated or in the process of being demarcated by Brazil’s Indigenous affairs agency
According to the prosecutors, the company did not consult all the affected communities and co-opted leaders and communities
told Mongabay over WhatsApp voice messages that his community has a consultation protocol that was not respected by the company
the company co-opted some leaders from the municipality of Autazes and these leaders stand up today saying they are in favor of the project
some even claiming that there was a consultation
There was even a falsification of documents
of meeting minutes saying that they were consulted
Potássio do Brasil wrote in a press release that it did obtain local Indigenous peoples’ free
The company did not respond to Mongabay’s requests for comment by the time of publication
IPAAM told Mongabay “the entire licensing procedure was conducted based on the necessary environmental studies
as established by current environmental legislation.”
“These studies provided the essential foundations for decisions in the licensing process,” it added
“ensuring the implementation of the necessary mitigating measures and the adequate management of impacts on the environment and directly affected populations.”
Filgueira also added that there are audio recordings of Indigenous leaders talking about dividing resources that most likely came from the Potássio do Brasil
does not have the type of money discussed in the recordings
some Indigenous leaders who were completely against mining suddenly changed their minds
This was repeated by other members of the Indigenous community
president and coordinator of the Mura Indigenous Women’s Organization
who told Mongabay over WhatsApp messages that Potássio do Brasil “influenced other leaders to accept the company

Nevertheless, the company obtained all the licenses needed and, by late September, it started building on the Autazes site
Funai told Mongabay in an email that it has established a technical group to carry out the land studies necessary for the identification and delimitation of Lago do Soares and Urucurituba
this land overlaps with the areas of deposits subject to explorative demand by the company
“In accordance with the decision of the Funai Board of Directors
a request was made to suspend the licensing process until the studies that support Funai’s statement to the competent licensing body are completed,” a Funai spokesperson wrote in an email
The licensor and company did not respond to their requests
and they were “surprised” to learn “through the press” about the issuance of the licenses
Correa is concerned that the project will bring invaders

as crude salt extracted underground during the mining process is often discharged into nearby water sources
This can change the chemical composition of these water sources
leading to land and biological degradation
The MPF wrote in a press release that the risk of salinization “could generate unpredictable consequences.” In the lawsuit
the federal prosecutors also argued that the waste pile was designed to be located in a flood-prone area

Autazes in the heart of Brazil’s Amazonas state is a municipality that’s six times the size of Rio de Janeiro
This corner of the rainforest is so remote that the easiest way to reach and move around the area is along the rivers that feed into the Amazon River
the area has had a long history of natural resource extraction
beginning with a gold rush in the 18th century
followed by a rubber boom during the Industrial Revolution
which drove a new wave of colonization of the region
The wealth generated from this extraction led to the expansion of trade routes
including the construction of a railway line
the Brazilian rubber industry slowly began to die
giving rise to a search for new commodities
the region has is a major industrial and agricultural center
Even though roads play a key role in reaching and bringing resources to previously isolated places
they also open up the forest to illegal activities
Thanks to Global Forest Watch’s (GFW) forest monitoring and alert system
Mongabay contributor Ana Ionova became aware of a spike in deforestation in the region
more than 48,600 deforestation alerts had been recorded from Autazes’s primary forest
according to satellite data from the University of Maryland
Ionova traveled to the area and found shocking levels of devastation in the middle of the Trincheira Indigenous Reserve
a protected territory that’s supposed to be off-limits to outsiders
Deforestation in the area is driven by livestock ranching
Ranchers clear the forest to transform the land into pasture for their water buffaloes
which are more profitable than cows and better suited to the floodplain forests of Autazes
buffalo ranching has had devastating consequences on the area
Indigenous leaders say the buffaloes pollute the water

Potash: Canadian mining giant rides roughshod over Amazon communities
Potássio do Brasil failed to properly consult Autazes’ communities about the impacts of a $2 billion potash project
Potássio do Brasil (PDB), a mining company controlled by the Canadian giant Forbes & Manhattan, has signed an agreement with the Chinese construction company CITIC to build a potash exploration complex in Autazes
the US$1.94 billion contract was signed in the twilight of 2020 without any consultation with affected communities
As part of this joint investigation, Diálogo Chino and InfoAmazonia found the contract among a series of documents that PDB sent to the Securities Exchange Commission (SEC)
the US government agency in charge of the financial markets where the mining company hopes to raise US$50 million in investment
PDB’s plans to exploit potash in Autazes have already been blighted by local conflicts. As a result, a conciliation hearing in 2017 led the company to sign an agreement with the Federal Public Ministry
preventing it from taking further steps “without prior judicial authorisation”
That decision included the suspension of environmental licensing until the completion of a consultation with the Mura people
a population of 14,000 who inhabit 44 villages in the region
It also established that the company would provide financial support for the indigenous people to draw up their consultation protocol
The bill argues that it could make Brazil’s economic growth unviable
Barred from any activity without judicial authorisation
PDB neglected to submit both the billion-dollar contract with CITIC and the intention to seek investors in the US to Brazil’s Federal Public Ministry
“The Federal Public Ministry at no time was communicated,” said a surprised Fernando Merloto Soave
a prosecutor who learned of the negotiation on being contacted for this report
which envisages investments of around US$2.3 billion
intends to extract a total of 770 million tons of potash
potassium-rich ores that are essential in the production of fertilizers
The contract reveals that this huge undertaking includes a mine nearly 1,000 metres deep
This includes a road and a port on the Madeira river basin
A company video shows that the soil drilling site is also eight kilometres from the Jauary Indigenous Land
recognised by the National Indian Foundation (Funai) in 2012
which is still in the process of demarcation
More than a third of the area of the complex overlaps with the Jauary land. Information in the case file shows five mining requests for the Autazes Potash complex. Four of them have stretches that overlap with the Jauary land, as shown by Amazônia Minada
an InfoAmazonia project that maps mining requests to the Brazilian government in protected areas
A Federal Court report also states that the company even asked that the areas over the territory be removed from the mining request
but the data at the National Mining Agency (ANM) continue to indicate an illegal overlap
The billion-dollar project would mainly serve Brazilian agribusiness
which imports over of the Brazilian demand for the ore
The complex in the Madeira River basin is strategic for soy producers in the states of Mato Grosso and Rondônia
The ferries that load with grain crops destined for ports in the Northern region
from where they are exported to Europe and China
would return to producing states full of fertilizers
Yet, the promise of attracting high investments for the project relegated the consideration of socio-environmental damage to second place, as shown in a PDB statement to the agency ANM
in which it indicates that its plans to exploit the subsoil in Jauary Land
that this would be minimal since the exploration is underground and noise from the activity would be “practically nil”
The water impact would be contained within a specific area
A 2018 study by researchers from Brazil and the US
shows that the Autazes complex poses risks to the soil
but we know it’s not quite like that
but we know that they can enter the indigenous land from underground
The production of the fertilizer releases sodium chloride (the same compound as table salt)
part of this waste would be dissolved in the open air by rain
Local communities fear that the process would lead to the salinisation of rivers
Because of the risks associated with the work
the agreement stated that the environmental license would not be granted until the consultation with the Mura people had been concluded
which would require numerous rounda and holding a vote
Bruno Caporrino, who was appointed by the Federal Court to prepare the consultation protocol
explains: “The methodology they chose was three spheres of meetings: local
only indigenous Mura people were able to participate
This way it was possible to ensure that there was no external interference”
The consultation was to begin in 2020 but was suspended because of the Covid-19 pandemic
The seriousness of virus’ impact on Brazil may yet postpone the process further
who is responsible for the action in the Federal Court
plausible and minimally reasonable to promote face-to-face meetings at this time”
In the documents forwarded to the SEC, PDB provided inaccurate information to the regulatory agency, such as the forecast of three months for the conclusion of the consultation with the indigenous people to ensure the start of the work. This could result in a fine and incurs a risk to potential investors
“They don’t have any security about this project,” said Soave
Consultation with indigenous people has been one of the most sensitive points in the process. In April last year, the SEC demanded clarification from the mining company
writing to PDB to “Provide updated information and explain in more detail the manner in which the consultations are underway”
The group responded that it had held “several rounds of consultations“
according to the filings in the Federal Court
these were promoted by the company in 2015
and therefore cannot be considered among the prior consultations that the Mura set out in the 2019 protocol
The company still claims to have suspended the environmental licensing of the project “in a voluntary way”
But Soave says this occurred because of the conciliation hearing
stating only that the opposition by indigenous people “may
require modification of the project”
The company made its intention not to consider consultation with the Mura as an impediment to the project even more explicit before the Amazonas Federal Court in 2016
“It is important to stress that ILO Convention 169 at no time established that consultation with indigenous communities would involve a veto power on environmental licensing,” Potassio do Brasil said
Soave argues that the decision of the indigenous people does imply veto power
“The Mura people have autonomy over the consultation
the company agreed that the decision is binding,” says the prosecutor
The prosecutor also expressed concern over the information given by the company to the SEC and possible non-compliance with the agreement
as it may represent both erroneous data brought to potential investors
and a potential non-compliance with the requirements for consultation
Brazil Potash put down roots in Autazes in 2009
The mining company got permission to search for ore even though Funai had already been identifying Jauary indigenous land for almost a year
drilling wells on indigenous land [without authorisation],” Soave says
As it is an indigenous area in the process of demarcation, PDB would have to apply for an environmental license at the federal level. However, Ipaam, the state environmental agency of Amazonas, granted a preliminary license
stating that the enterprise “is not inserted and does not contemplate the use of natural resources on indigenous lands”
They didn’t ask anyone anything,” José Claudio Pereira Yuaka recalls
we learned on television about the disasters in other mining projects and sought to learn more about this mine.”
the Canadians have been drilling in Autazes in search of potash
at a cost of around R$250 million [US$47 million]
they have detected the mineral and say that their exploration does not impact the region occupied by the Mura people because it occurs underground
They report that mine shafts will be three and a half metres thick and up to 900 metres deep
it is not clear whether subsoil exploration will be directed towards the indigenous territory
where the company has already identified potash
the indigenous people even threatened to set fire to the company’s equipment to derail drilling
Funai requested the paralysis of the studies “because they are affecting the Jauary indigenous land”
within a few months of opening an enquiry
the company accepted a conciliation hearing
MPF was designated more control over process and managed to suspend the earlier environmental license
PDB breached the agreement on at least two occasions
the company took four months to justify excavations that worried the indigenous communities and in 2019
it studies to identify the local flora to speed up the licensing
In 2017, the mining agency gave a technical report favourable to mining in the subsoil of the indigenous land
but made reservations about the legal issues
Currently, there is no legal provision for mineral exploration on indigenous lands in Brazil. However, the Jair Bolsonaro government has been pushing to legalise it
It is on these possible changes of course that mining companies rely when filing requests with the ANM
the Office of the Federal Advocate General states that the agency does not accept requests for mineral research on indigenous territories
even if they are still in the demarcation phase
in 2019 the Federal Court overturned all applications in indigenous lands in Amazonas
PDB still has 19 active requests that overlap with indigenous territories in the state
In addition to the company’s advances
the indigenous people have to resist pressure and threats from within the city of Autazes
“Sometimes we hear complaints from people saying that the region could be rich
I’ve seen graffiti in a bar bathroom in the city saying ‘death to the Mura people’
We just want the law to be enforced,” says Herton Mura
an advisor to the Mura Indigenous Leadership Organisation in Careiro da Várzea
PDB did not respond to a May 7 request for comment on the series of legal breaches
Nor did the SEC respond on the issue of the information provided to it by PDB
IPAAM did not reply to requests about the environmental license blocked by the courts and
The ANM denied that there are mining requirements in effect within indigenous lands in Amazonas
a statement from its advisory office appears contradictory
“The fact that an application appears in SIGMINE [the ANM’s Geographical Information System for Mining] in an indigenous area has no practical effect.”
The regulatory agency ignored a question about non-compliance with a 2009 ruling by the Federal Advocate General that prevents the authorisation of mineral research or mining within already identified indigenous lands

Brazil Potash is working on a project to enable Brazil to source a significant portion of its potash domestically with the Autazes project

Brazil relies heavily on the fertilizer potash from countries like the U.S
Digital Journal: Can you tell us about Brazil Potash and the Autazes Project
(NYSE-American: GRO) is a sustainable fertilizer company developing Brazil’s largest potash project to support the country’s domestic agriculture industry while also reducing its approximately 98% reliance on imported potash
Brazil is one of the largest net exporters of agricultural products in the world at ~$167B per year
but the majority of potash used in the country today comes from mines that are located up to 12,000 miles away in Canada
Brazil Potash’s Autazes project is being developed in the Amazonas State of Brazil on cattle farmland
which is adjacent to the largest farming region in Brazil
Matto Grosso State. Autazes is slated to produce 2.4 million tons per year out of the about 14 million tons consumed annually by Brazilian farmers at an all in cost that is projected to be lower than just the transportation cost alone for imported potash
The deposits’ unique position along the Madeira River allows for low-cost barge transport to Brazil’s agricultural hubs
providing great flexibility to reach customers and avoid congested import ports
DJ: What is potash and why is it important to the global market
Simpson: Potash is a source of soluble potassium
which is one of the three main nutrients plants need to efficiently grow
The principal use of potash is as an agricultural fertilizer as it improves plants’ water efficiency
and provides resistance to pests and disease
It’s formed by failed oceans that dried up leaving salts behind so deposits tend to be massive in size but limited in number globally. As plants grow
they adsorb nutrients such as potash from the soil needing for them to be replenished over time. Brazilian farms typically grow three crops per year
resulting in the soil being particularly nutrient stressed and that’s why it’s necessary to regularly add potash in the form of fertilizer
DJ: Where does your project currently stand and when could the potash be expected to be mined
Simpson: Construction on the Autazes Project has already started and will take approximately four years to complete and begin initial production
the Autazes potash deposit is capable of providing ~17% of the potash Brazil needs every year for the next 23 years
Our team is committed to a fully permitted
modular construction to minimally impact trees and the environment around the project site
The current land over the project site has primarily been used for livestock with the primary deforestation occurring decades ago by prior landowners
Our vision for the site includes an underground mine and processing plant with dry stacked tailing to minimize the surface footprint
is there concern for the import and export of potash and agricultural products globally
Simpson: Brazil is the largest net exporter of agricultural products in the world
and warm year-round climate making it a prime candidate to help boost global food security
which has had a renewed spotlight on it due to recent geopolitical events
like the global tariff discussion and other armed conflicts
that have created massive volatility in potash prices and limited exports of key food staples such as wheat
While our team is working to supply a large percentage of the necessary potash for Brazil’s agricultural industry domestically
much of the necessary potash to ensure Brazil’s role as a global food supplier continues
will need to be imported from elsewhere including the Russia
This makes it a key target that should be exempt from any extended trade dispute in order to ensure global food security and avoid unnecessary food price hikes

this further highlights the importance of our work to ensure that Brazil can source its potash without being affected by larger geopolitical events
DJ: Why is it so important for Brazil to begin sourcing potash domestically
Simpson: Brazil is the world’s largest importer of potash at ~22% of market share projected to grow 6.8% annually from 2023-2027
according to the CRU Group’s market outlook in November 2022
with the country being responsible for the majority of the South American potash consumption
Given ~50% of the world’s potash is produced in countries that are sanctioned or at war coupled with risks of rail and port strikes
it is imperative Brazil source such a critical mineral as potash to feed its population along with $167 billion of exports when viable
the Autazes project has the opportunity to reduce greenhouse gas emissions significantly through a combination of using primarily renewable sourced electricity supplied by Brazil’s national electricity grid and avoiding substantial
unnecessary international transportation of potash
Beyond sustainability and geopolitical concerns
there is a key economic opportunity as well
With strong domestic support from the Brazil Federal Government
which has designated the Autazes project as a development of national importance
and the opportunity to reduce risk and boost agricultural productivity
The Autazes Project will be an economic stalwart for the local community
