This comes after the City of Scottsdale cut off water to the Rio Verde foothills as part of its water conservation plans It left hundreds of homeowners high and dry without any drinkable water. Governor Katie Hobbs stepped in and signed a bill last summer forcing Scottsdale to keep supplying water to the foothills for the next three years until water utility company EPCOR could take over “They were originally getting water from a standpipe in Scottsdale which is still the case today on temporary basis until we build the infrastructure needed to support them,” said Rebecca Stenholm with EPCOR In addition to the 1,273 existing homeowners who switched utilities to EPCOR water, the Arizona Corporation Commission said they can only take on another 150 customers who are planning to build there “We obviously didn’t want to be in the position of picking and choosing and we know there’s a lot of people out there,” Stenholm said Two hundred and thirty property owners applied for the lottery but residents like David Weber were not selected and it’s just really unfortunate and it was totally unnecessary,” Weber said Weber has owned his property for three years and had dreams of building on the property even with people with wells and people that are like me that weren’t really running out there to build anything right away But I certainly didn’t want the rug pulled out from underneath me as far as potential to build anything on it,” Weber said EPCOR said the project for the new standpipe can take 24 to 36 months Those selected in the lottery will have to pay a $24,000 hook-up fee to offset construction costs Those not selected will have to find a third party to get water. Katie Hobbs’ administration says it has sent a cease and desist letter to a developer trying to get around water regulations in the unincorporated community of Rio Verde Foothills To build a house in most urban parts of Arizona developers first need a certification from the state saying there is enough water to last that property 100 years known as “wildcat subdivisions,” are not subject to the rule the Hobbs administration said the state Attorney General’s Office and the Arizona Department of Real Estate recently investigated a developer they say was trying to use that loophole to skirt the 100-year assured water supply rule in Rio Verde Foothills ADRE will prevent the final sale of homes until a reliable 100-year water supply has been identified and proven as a part of the project’s public report,” the press release said Hundreds of homes in Rio Verde Foothills were cut off from their water supply in 2023 due to drought restrictions in neighboring Scottsdale. The community's new standpipe will be located about a mile south of Rio Verde Drive on 176th Street It will be fed by groundwater from a well near the Verde River That water will be treated for arsenic and other contaminants before being piped to the standpipe which is connected to Epcor's existing water system "There's more than enough physical water resources to serve that area well beyond any build-out that we could conceive of," Loquvam said adding that the well is "very productive" and not currently being used to serve other customers A traffic study commissioned by the utility shows the standpipe will generate an average of 174 trips per day Epcor officials intend to construct turn lanes on Rio Verde Drive They said they also intend to pave 176th Street The community's previous predicament was largely predicated on a unique quirk in state law Most homes in the Phoenix area are covered by the state’s Groundwater Management Act which requires proof of a 100-year water supply before construction But when landowners split property into five or fewer contiguous lots That means homes can be built without an assured water supply State regulators hoped to limit further growth in the area by instituting an enrollment period that would allow sign-ups for standpipe service until June — and by capping the number of new homes that would be able to get service Epcor officials hoped they wouldn't have to run a lottery But as they began sorting through requests for standpipe access they found enrollment request for homes that had yet to be built mixed in with applications from current residents Loquvam said the choosing will be "entirely random." The lottery will be conducted by a third party in October Customers will then be informed of whether they were selected to gain standpipe access "We don't want anyone saying that we threw our thumb on the scale," Loquvam said The plan approved by the Corporation Commission last year imposed an initial water rate of $16.38 per 1,000 gallons property owners intending to build new homes in the community will also be charged a $24,000 hookup fee Loquvam said that fee will be due 45 days after customers are chosen via the lottery "It just goes straight to buy down the cost of the overall infrastructure." Loquvam said those intending to build homes in the area shouldn't put their hat in the ring if they can't afford the hookup fee The state Corporation Commission directed that there would only be one lottery drawing — so if someone backs out at the last minute We just don't want to crowd out people when they get selected I was just kind of waiting to see what happened.'
