a top government scientist who led the making of the atomic bomb in World War II but fell under suspicion of being a Soviet spy at the height of the McCarthy era.” Granholm had issued a press release explaining that her department had been “entrusted with the responsibility to correct the historical record and honor Dr
Oppenheimer’s ‘profound contributions to our national defense and scientific enterprise at large.’ ” She said that she was pleased to announce the nullification
So why now, sixty-eight years after the infamous security hearing, and fifty-five years after Oppenheimer’s death, did the Biden Administration find the courage to do the right thing? Governments rarely apologize for their errors. How did this decision happen? True, the director Christopher Nolan has a major motion picture coming out this summer called “Oppenheimer.” But
Hollywood’s influence in Washington is limited
particularly when it comes to the nuclear-security establishment
I was brought aboard the project only in 2000
and Marty was inspired by the notion that perhaps we could sue the government to revoke the 1954 decision
We wrote a four-thousand-word memo delineating how the Atomic Energy Commission
had violated its own regulations governing security reviews
they had illegally wiretapped Oppenheimer’s home and the office of his lawyer during the course of the security trial
They allowed the three-member security panel access to Oppenheimer’s F.B.I
which ran to several thousand pages—but denied his own lawyer a security clearance
so he was not allowed to read the material being used selectively against his client
They blackmailed otherwise friendly witnesses to turn against Oppenheimer
we approached a senior partner at WilmerHale
and persuaded him to take on the case pro bono
A young associate was assigned to research whether there was any legal recourse in the courts
explaining that it had to drop the matter due to personal objections from one of its partners
who had formerly served as White House counsel during the Presidency of George H
the man who had chaired the three-member security-hearing panel that ruled against Oppenheimer
Marty Sherwin and I were at a crowded book party in Georgetown
a son of the late career politician Paul Nitze
introduced himself as Oppenheimer’s biographer
and proceeded to explain why what Gray’s father had done in 1954 was a travesty
and they argued vehemently for a few minutes
but Marty walked away pleased that he had spoken truth to power
they had come to the conclusion that the courts could not be used to reverse the 1954 decision
The lawyers advised that such a reversal could only be achieved by executive order
(WilmerHale did not respond to requests for comment.)
we therefore approached the Obama White House
the newly appointed White House counsel was Robert Bauer
who happened to be one of my high-school friends from Cairo
where both of our fathers were stationed as Foreign Service officers in the nineteen-sixties
Marty and I drafted yet another memo making the argument for nullification and sent it to Bauer—and he was sympathetic
Bauer encouraged us to get a few senators or historians to sign a letter urging nullification
we soon learned that Senator Jeff Bingaman
which paralleled many of our own arguments
and was replaced by Senator Martin Heinrich
Marty and I later persuaded Heinrich to write a letter to Obama’s new Energy Secretary
who was himself a trained physicist and someone whom we thought would be aware of
But in response to Heinrich’s pleading that he “issue a declaratory order vacating the decision,” Moniz offered bureaucratic pablum
saying merely that he was “keenly aware of Dr
Oppenheimer’s unquestionable scientific contribution to U.S
he could not reinstate Oppenheimer’s security clearance
(Moniz did not respond to a request for comment.)
Not until the spring of 2016 did we get some momentum for our redemption campaign
Marty and I drafted a two-page appeal to President Obama
who was a longtime aide to Vermont’s Democratic senator
can you think of any current senators who have been particularly outspoken about nuclear arms control
he/she could find a way to get it to Obama
the injustice that had been inflicted on Oppenheimer was also personal
Rieser persuaded Senator Leahy and three other Democratic senators—Martin Heinrich; Edward J
of Oregon—to sign a letter to President Obama urging nullification
We knew the clock was running out on the Obama Administration
But we still hoped that the appeal of four senators could persuade the President to issue an executive order
had a meeting with Secretary Moniz in early July
Moniz said that the Department of Energy would create a student fellowship in Oppenheimer’s name
Things were not looking good. Senator Heinrich said that he had repeatedly talked to Moniz but the Energy Secretary was not moving from his position. Marty and I still hoped that Obama could be persuaded to issue an executive order as he left the White House, in early 2017. But nothing happened. And then Donald Trump won the November election
Nothing happened on the Oppenheimer case for the next four years
I happened to run into Ernest Moniz at the memorial service for the former national-security adviser Zbigniew Brzezinski
I asked him why he had refused to nullify the ’54 decision—and he unapologetically insisted
“My legal counsel said it was not possible.” We argued briefly
the same four senators who had sent the 2016 letter signed a similar one to President Biden
Rieser called a friend who had recently been appointed Assistant Secretary for Congressional and Intergovernmental Affairs at the Department of Energy
Rieser had bought a Ping-Pong table from him that had been advertised on Craigslist
Rieser asked his friend about the status of the letter to President Biden
The Assistant Secretary looked into the matter and told Rieser that the answer was likely going to be negative
Rieser decided that it was time to back off the White House and to instead appeal to the newly installed Energy Secretary
So he went back to his office and substantially revised the original letter signed by the four senators in 2016
though it called on the Secretary to vacate the 1954 A.E.C
she would not be reinstating Oppenheimer’s security clearance
That would require a whole new security review
Rieser then began reaching out to Senate staff
and Senator Leahy spoke directly to his Senate colleagues
recruiting new signatories for the letter addressed to Granholm
but by the spring of 2022 they had forty-three Senate signatures
But Rieser was still worried that this would not be enough political capital
He expanded his campaign by reaching out to the director of the Los Alamos National Laboratory
but skeptical of nullifying the 1954 decision if that meant restoring Oppenheimer’s security clearance
He felt that what was needed was a formal apology for the wrong that had been done to Oppenheimer
and said that he would write his own letter to the Energy Secretary
I was visiting Los Alamos in March of 2022
the director of the forthcoming film “Oppenheimer,” had invited me to visit the set
Nolan had written the script based on “American Prometheus.” Not surprisingly
Rieser contacted Mason and asked if he would see me
Mason and I had an entirely civil debate about the merits of nullification versus an official “apology” for what had been done to Oppenheimer
I argued that an apology was not sufficient and that nullification was required precisely to restore the integrity of the security-review system
Mason came around to this argument once he was persuaded that “nullification” would not restore Oppenheimer’s security clearance
He not only agreed to rewrite his letter—he then obtained the signatures of the eight surviving former directors of the Los Alamos lab
Here was the director of a science-and-weapons lab
the man ultimately responsible for managing thousands of scientists on classified projects
urging nullification of the 1954 Oppenheimer verdict
Robert Norris (the biographer of General Leslie R
Robert Oppenheimer Memorial Committee weighed in
and the Los Alamos County Council adopted a resolution urging nullification
Rieser bicycled down to the Department of Energy and hand-delivered a binder with all the correspondence and supporting materials
Secretary Granholm and her staff read it all
and they conducted their own review of the historical record
She also took the time to read “American Prometheus.”
Marty Sherwin had succumbed to lung cancer in October
Rieser and I thought that we had done everything possible to lay the groundwork for a nullification decision
But we were painfully aware that the ethos of the national-security bureaucracy stood in our way
There were still those in the Energy Department who argued that vacating the decision against Oppenheimer could appear to create a double standard on behalf of politically powerful individuals
decision was not only necessary to correct a grave injustice but was also important to the integrity of the security-review process
At the end of her six-page memo justifying her decision
William Fulbright took to the Senate floor and said
‘Let us remember not only what his special genius did for us; let us remember what we did to him.’ ”
Granholm’s decision is a stunning reversal
It took tireless persistence and a measure of serendipitous good luck
It is important not just for students who will now be able to read the last chapter and learn that what was done to Oppenheimer in that kangaroo-court proceeding was not the last word
and the victim of a gross miscarriage of justice
we can blame the legacy of the flawed Oppenheimer security trial for this distrust
America’s most celebrated scientist was falsely accused and publicly humiliated
sending a warning to all scientists not to engage in the political arena as public intellectuals
This was the real tragedy of the Oppenheimer case
What happened to him damaged our ability as a society to debate honestly about scientific theory—the very foundation of our modern world
Granholm’s courageous decision has reaffirmed not only that the federal government is capable of correcting its mistakes but that government employees
can express opinions that challenge the conventional wisdom without fear that they will be falsely branded as disloyal

Brazil — Everything is growing in Perpétua’s grove now
This is a pigeon pea; we make a very tasty farofa with it
This row is for passion fruit; we also plant corn on it
But not much lettuce — we feed on it first
The proudest producer in the Serra da Besta community
Where once lay barren land that caused anything planted on it to wither now grows a prosperous and diverse farm in a space measuring just 30 by 40 meters (100 by 130 feet)
So rare in these rain-deprived backlands that it earned a sign at the entrance: “Agrocaatinga,” it says
In other words, an agroforest adapted to the Caatinga
“We thought about agroecological solutions that included techniques that allowed coexisting with the semiarid climate,” explains agronomist Egidio Trindade
general coordinator of the Agrocaatinga project
Coopercuc (the Family Agricultural Cooperative of Canudos
this means maximizing rainwater harvesting in a region where it rains only for four to five months per year
the relative humidity was 14% here in Uauá

given that the umbu tree is difficult to cultivate
If it doesn’t have the complete rainfall cycle
it won’t develop,” says Egidio
giving examples of umbu trees that Coopercuc planted 20 years ago and have not yet borne fruit
the entire cooperative’s production depends solely on extractivism
who have the umbu leaves as their favorite food — precisely the younger plants within reach of their mouths
Coopercuc technicians thought about creating cultivation areas that would have as an immediate focus the wild passion fruit — which bears fruit in less than a year — but with umbu trees in mind in the long term
as much organic food as possible to grow to keep families’ refrigerators full and provide them with extra income
There are now 33 Agrocaatingas spread across northern Bahia state
of an Agrocaatinga lies in the ability to keep the field always moist — what Egidio calls techniques for coexisting with the semiarid climate
The basic technique is contour planting: parallel rows of land that rise a few centimeters above the ground
where a hose drips the rainwater it received
This same water flows into the hollows between the contour lines
accumulates there and slowly infiltrates the soil
a microlandscape of valleys and ridges that never lets the farmland dry out
they resort to so-called salvation irrigation: Every Agrocaatinga has a 36,000-liter (9,500-gallon) cistern
which ensures water during the long dry months
it’s as if they were in paradise,” Egidio summarizes
they are also continuously nourished by organic fertilizer
And by themselves: In an agroforestry system
it is essential to prune the plants so that leaves and branches are returned to the soil in the form of organic matter — this helps fix carbon and also covers the soil
protecting it from the harsh sun of the backlands
Usually implemented as a collective effort
Agrocaatingas take a maximum of three days to be ready; sizes vary from 1,200-2,000 square meters (13,000-21,500 square feet)

It’s no coincidence that many Agrocaatingas are located in communities that also practice “Recaatingamento,” an initiative that seeks to reserve areas of native vegetation to allow the Caatinga to recover on its own

No endemic species, however, is more important in these agroforests than the maracujá-da-caatinga
as its purchase is guaranteed by L’Occitane
which uses its seed oil to make shampoos and conditioners
a recipe invented right there in Serra da Besta by a community member
But this wild passion fruit has also proven to be an excellent alternative to the adverse semiarid climate
sweeter and more acidic than the common passion fruit
“You can pass a tractor through a field and leave it
it’s a lot of passion fruit,” says Perpétua
it’s an excellent complement to the umbu harvest
“The passion fruit ripens when the umbu doesn’t,” she says
That’s why every Agrocaatinga has at least one row just for it
the fruits all hanging from a wire that stretches from end to end
While in the forest the maracujá-da-caatinga grows closer to the ground
here it has been elevated to the status of a vine
“The native passion fruit provides a good income,” says Egidio
“Some producers make 2,000 or 3,000 reais per harvest.” That’s $400-$600
four times the local monthly per capita income
He mentions the case of a producer in Uauá who set a record: In two months
he sold more than $240 worth of maracujá-da-caatinga
an entire field irrigated with water used for bathing and washing dishes — a step further in the effort to make the project even more sustainable

It’s there that, every week, Perpétua takes her production surplus — largely made up of the cassava flour that she is now able to produce on a large scale, a result of the efficiency of the agroforestry system combined with the presence of a mobile flour mill
that now circulates through rural communities
“Dona Perpétua makes an average of 300 reais ($60) per week at the market
apart from the fruit she sells to Coopercuc
And there are savings on groceries since she no longer buys cassava
“Agrocaatinga is the most viable and sustainable project for our region,” summarizes Taiane
“As we encourage families to produce
income generation and the continued presence of women and young people in the countryside
it will help conserve native species of the Caatinga.”

But the administration is starting 2016 with a bang: with a nationwide wave of immigration raids
The administration’s motivations are complicated. The plan is in part a response to a new surge of children and families into the US from Central America, after a year-long lull. But it’s also a continuation of the 2014 border crisis
which created deep political frustrations with the Obama administration on the left and right that still haven’t been resolved
Even before the plan was leaked to the public
it was extremely controversial within the Obama administration (which is typically unified on immigration policy)
and may be a last-ditch bid to keep the Supreme Court on its side
It’s getting tremendous heat from immigrant rights activists
And it’s almost certainly going to become a problem for the Hillary Clinton campaign
about 100,000 families (mostly mothers with children) have arrived in the US from Guatemala
Most of them have tried to get asylum in the US — these are among the most violent countries in the world
and many of them are being targeted by gangs
While some of these families have been granted asylum
many have not — either because they’ve made their case in immigration court and lost or because they simply didn’t show up for their scheduled hearing before a judge
Some families (as many as 15,000) have stayed in the country after being ordered to leave
The Obama administration has launched a big effort to deport those families to begin 2016
And it’s raiding residential neighborhoods to find and arrest the families — a tactic that a lot of immigrants and immigration advocates have traumatic associations with
The “border crisis” basically ended in late summer and early fall of 2014
when the number of children and families entering the US dropped precipitously — thanks largely to the efforts of the Mexican government
which (with significant US assistance) caught many Central American children and families before they could get to the US
and the issue kind of drifted to the sidelines
this spike is even more alarming than the 2014 one — that “crisis” happened during a time of year that’s typically a high season for migration to the US from Latin America
while this is happening in the middle of winter
typically a slow time for migrations everywhere
The Obama administration’s reaction to the new wave of Central American families appears to be to step up deportations of the last wave
if they’re not really legitimate asylum seekers in fear for their lives
but people trying to take advantage of the US immigration system to come here
Is that true of the people trying to come to the US now
Border Patrol agents think so: They’re circulating reports that most of the newcomers from Central America say they’re coming to the US because they think they can get legal status here
not because they’re afraid for their lives
But there’s a reason Border Patrol agents aren’t in charge of evaluating asylum claims; they can be too dismissive of legitimate danger
And there is evidence that the “Northern Triangle” countries of Guatemala
Honduras and El Salvador are legitimately dangerous — even more so than they’ve been in the past
The families who have been caught in raids and could be deported have had a chance to receive asylum from an immigration judge
and have been ordered to leave the US instead
That means they don’t automatically get another hearing before a judge before being deported
But there’s an irony in the fact that they could be deported because of a new wave of entries into the US
If the new wave of entries is because Central America is getting more dangerous
the families denied asylum will be deported to countries where their lives could be more threatened than when they left
This is particularly upsetting to immigration advocates
many of whom feel that many of these families shouldn’t have been denied asylum to begin with — and that the administration has mistreated them from the very beginning
While the border crisis had national attention
the Obama administration struggled mightily to find a policy response that would please its critics on the right and left
were enraged by the administration’s response — they felt the administration was treating asylum seekers who hadn’t actually broken any laws as if they were criminals
Advocates dragged the government into a messy legal battle over detention of immigrant families; the courts have sided with advocates time after time
and ordered the government to release the families who are still being detained as quickly as possible
the government’s inability to keep families locked up in detention while their immigration cases are heard is one reason they’re planning to start using raids to find and deport families instead
But the new deportation plan is enraging immigration advocates anew
the Obama administration is in the exact same political bind it was in in 2014: Inaction risked criticism from the right over “border security”; action creates criticism from the left
The complaints of advocates might make it seem like the Obama administration is making some sort of huge change from its current immigration policy in order to crack down on this particular group of people
In terms of who the Obama administration chooses to deport
going after Central American families who’ve lost their asylum cases is totally in line with existing policy
But in terms of how they’re being deported
Under the policy guidelines the Obama administration has used for the president’s second term — and certainly for the past year — most unauthorized immigrants aren’t targets for deportation
But immigrants who have been ordered deported from the US since January 2014
According to the Post, the Obama administration is only planning to deport Central American families who have been ordered to leave the US — in other words, families who would be a priority for deportation anyway. According to the Transactional Records Access Clearinghouse
about 15,500 mothers with children from Guatemala
and El Salvador have been ordered deported since July 2014 (when the Obama administration started speeding up court hearings for new arrivals)
Some of those have probably already been deported or left on their own
The real number of Central American families who are still in the US
and therefore vulnerable to deportation under the new plan
is probably closer to 12,500: the number of Central American mothers with children who were ordered to be deported because they didn’t show up to a court hearing
Many immigration advocates don’t have a problem with the administration’s current deportation priorities in general
And while they may believe that many of the Central American families who’ve been ordered deported should have gotten asylum instead
that’s only part of the reason they’re so alarmed by the administration’s new plan
The other cause for alarm is that the administration is planning to use raids to track down the families
The Obama administration has conducted occasional immigration raids in the past
to round up convicted criminals or “immigration fugitives” (people who’ve been ordered deported but are still in the US)
the administration’s modus operandi hasn’t been to actively hunt down unauthorized immigrants
it’s used local law enforcement as a net: Immigrants who come into contact with law enforcement
especially those who fit one of the priorities
get gathered up by the federal government for deportation
Because there’s so much more coordination between local and federal agents about immigrants under the Obama administration than there was in the past
this has allowed the government to deport a lot of people (especially during Obama’s first term) relatively quietly
immigration raids — whether on residential neighborhoods or in workplaces — were the centerpiece of immigration enforcement
They weren’t as efficient in scooping up hundreds of thousands of immigrants as the later Obama tactics were (those programs were still being developed)
But they were another way local law enforcement could help federal agents enforce immigration laws
media-friendly demonstrations that the Bush administration cared about tracking down unauthorized immigrants
Raids also traumatized immigrant communities — decreasing trust in local police
Unauthorized immigrants got the message the raids were designed to send: They weren’t safe anywhere
And people who lived alongside unauthorized immigrants worried that in the chaos of an ICE raid
the 2016 raids won’t result in immigrants who’ve lived in the US for years getting rounded up and deported
including those who would qualify for protection from deportation if the administration’s 2014 executive actions get upheld by the Supreme Court
But the administration has historically gotten a lot of resistance from ICE agents on the ground when agents apprehend unauthorized immigrants and then get told to let them go
And while the Obama administration appears to have gotten more control over recalcitrant field agents
it’s not at all clear whether it will be able to keep that control when it’s sending agents out on raids
Every time the Obama administration has cracked down on immigration enforcement and infuriated advocates
the administration was trying to persuade Republicans in Congress that it could be trusted to enforce immigration laws
so that Republicans would come to the table and pass comprehensive immigration reform
the harsh response to the “border crisis” was motivated in part by fear of the midterm elections — Democrats in the federal government were very afraid of being seen as unable to protect the country’s borders
the court case has gone against the Obama administration
Both the district court judge and the Fifth Circuit put the administration’s plans to protect millions more unauthorized immigrants from deportation on hold while the courts consider whether those plans are constitutional (which is a hint that
The Supreme Court has always been more likely to side with the federal government in this case than the lower courts are
but that doesn’t mean the case is a slam dunk for the administration — or that the Court will decide to take it up this year at all
rather than taking it up next session when Obama is already out of office
One of the biggest legal questions about the administration’s immigration policy is whether there’s a “limiting principle” — in other words
whether there are any unauthorized immigrants the government actually feels it has to enforce the law against
Deporting thousands of mothers with children is certainly one way to demonstrate that the Obama administration really does feel it has to enforce the law in some cases
the 2014 memo that made immigrants with deportation orders a priority was part of the same set of executive actions as the programs the Obama administration is currently challenging in court
By making a big show of enforcing the priorities it set for itself
the administration is demonstrating that it takes that whole set of policies seriously — not just the parts that are nice to unauthorized immigrants
If the Obama administration’s plan succeeds at deporting the Central American families it’s targeting
it’s going to be a political success only insofar as it keeps border security off the table in the 2016 election — exactly what the administration failed to do in 2014
But it’s very difficult to predict how things will shake out: not just how the policy itself will work
And since we don’t yet know who will receive the nomination of at least one major party in 2016
you almost certainly shouldn’t trust anyone who makes claims about the administration’s plan being good for Democrats or for Republicans in the general election — though there are definitely particular variables to watch for
Attention and outrage to the raids in Latino and Spanish-language media
could be a warning sign that the raids could depress Latinos from turning out for Democrats in the general election
they’re definitely having an effect on the primaries
the administration’s raid plan has become another thing Donald Trump has taken credit for (although he of course mischaracterizes the policy)
Does everyone see that the Democrats and President Obama are now
starting to deport people who are here illegally
the raids are something that all three remaining candidates clearly feel the need to come out against
As I’ve written, the immigrant rights movement firmly believes that the 2016 Democratic nominee ought to be to the left of President Obama on immigration
That’s not the standard for their support — it’s the minimum requirement for them
Bernie Sanders have surpassed that expectation with policy platforms that read like a wish list for immigration advocates
Hillary Clinton has at times struggled to meet the minimum expectation of staying to Obama’s left — particularly when it comes to immigration enforcement and deportations
and especially when being to Obama’s left means directly criticizing the administration
And the last time she really upset immigrant rights advocates was talking about Central American children and families in the summer of 2014
when she said that most of the children coming to the US
even if they were unsafe in Central America
The new raids will inevitably remind advocates about Clinton’s 2014 comment
That will only increase their pressure on Clinton to take a strong stand against the new raids
Clinton’s campaign has issued a statement saying she has “concerns” about the Obama administration’s plan
It’s not clear if advocates will find that acceptable (it is pretty likely many will not)
O’Malley and Sanders have both come out strongly against the plan
and both of them — particularly O’Malley — are likely to start criticizing Clinton for not denouncing it outright
Clinton demonstrated at the most recent Democratic debate that she’s already looking toward the general election
and is no longer focused on running against opponents in a Democratic primary
But the immigration raids are exactly the sort of issue that could feed resentment of Clinton among one segment of the progressive base
at exactly the time when she wants Democrats to start rallying around her — and make Latino voters bitter about the general election right when she needs them to start getting excited
It’s not clear whether that segment of the base matters enough to the Clinton campaign for them to take a stronger position against the Obama administration — but it’s a situation the campaign almost certainly didn’t want to be in to begin with
