A Louisiana judge this week set aside the first-degree murder conviction and death sentence of Jimmie Chris Duncan, whose 1998 conviction for killing his girlfriend’s 23-month-old daughter was based in part on bite mark evidence that experts now say is junk science
The decision comes after a Verite News and ProPublica investigation in March examined the questions surrounding Duncan’s conviction as Gov
made moves to expedite executions after a 15-year pause
of the 4th Judicial District in Ouachita Parish
pointed to new testimony during a September appeals hearing that such bite mark analysis presented by a once-heralded forensics team is “no longer valid” and “not scientifically defensible.”
The original analysis came from forensic dentist Michael West and pathologist Dr. Steven Hayne, whose longtime partnership as state experts fell under legal scrutiny after questions emerged about the validity of their techniques
nine prisoners have been set free after being convicted in part on inaccurate evidence given by West and Hayne
Duncan was the last person awaiting an execution based on the pair’s work
which Sharp said in his ruling appeared “questionable at best.”
Other expert witnesses said that Hayne’s autopsy and his findings were “sloppy in practice” and “inadequate overall.”
“It is worth noting that the qualifications of Dr
Hayne were lacking in certain ways to an extent that called into serious question” the pathologist’s “expert designation,” Sharp wrote in his ruling
Sharp also stated in his ruling that he found “very compelling” the September testimony of an expert medical witness who said that the child’s death was not the result of a homicide but of an accidental drowning
It remains unclear when — or if — Duncan will walk free

Tew did not respond to requests for comment
Louisiana has a long record of convicting and sentencing to death people later found to be innocent. In the past three decades, the state has exonerated 11 people facing execution, among the highest such numbers in the country, according to The National Registry of Exonerations
has maintained his innocence for more than three decades
while prosecutors continued to insist that Duncan committed the murder and should be executed without delay
He said he had left her alone in the bathtub while he washed dishes
he said he heard a loud noise from the bathroom
he found her floating face down in the water
While Duncan claimed it was a tragic accident
authorities charged him with first-degree murder after Hayne and West examined the girl’s body and determined there was evidence she was sexually assaulted and intentionally drowned
After about two weeks of testimony in 1998
the jury found Duncan guilty and sentenced him to death
Duncan’s post-conviction attorneys uncovered evidence that was not presented at trial that
This includes a jailhouse informant who wrote to prosecutors offering to share Duncan’s confession to the crime in what the defense claims was an exchange for leniency (the informant later recanted his trial testimony); past head injuries Haley suffered that might explain her death; and a video in which West can be seen grinding a cast of Duncan’s teeth into Haley’s body
which the defense says the forensic dentist manufactured
West did not immediately respond to requests for comment on the ruling
West has previously said he was simply using what he called a “direct comparison” technique, in which he presses a mold of a person’s teeth directly onto the location of suspected bite marks because it provides the most accurate results, according to a 2020 interview with Oxygen.com
West said he no longer believed in bite mark analysis in a 2011 deposition in a different post-conviction appeal
“I don’t believe it’s a system that’s reliable enough to be used in court” and admitted to making mistakes in previous cases
But he told The New Republic in a 2023 interview that his methods are valid because other people have used them
Sharp also noted the September testimony of Detective Chris Sasser
no cleaning rags and no cleaning agents” in the bathroom or house where the alleged crime occurred
This undermined the state’s assertion that there was “massive blood loss,” the ruling said
Sharp pointed to a witness who testified that Scott failed to “investigate or present evidence that was available at the time of the trial,” that he did not “develop a coherent theory of defense,” and that he failed to disclose a conflict of interest
Scott’s wife told Verite News and ProPublica that he has suffered significant health problems including memory and speech impairment and declined to comment on the judge’s ruling
Duncan is among 55 people on death row in Louisiana
though until very recently he and the others were not in imminent danger of being executed as the state hadn’t put anyone to death since 2010 due to the unavailability of execution drugs
Landry has made clear his intention to carry out these death sentences as soon as possible
having recently approved the use of nitrogen gas
a controversial method allowed in only three other states

The City of Duncan has received more than $3 million from ChildCareBC to build a new childcare centre in McAdam Park
CAO Peter de Verteuil told council at its meeting on April 14 that the provincial grant will enable the city to build a new childcare centre that will be constructed adjacent to the existing preschool/daycare in the park
He said the new facility will provide 12 spaces for infants and toddlers
and 24 spaces for children aged three to five
B.C.’s Minister of Education and Child Care Lisa Beare made the funding announcement for 36 new childcare spaces while visiting Duncan on March 25
but the exact amount of the grant and the specifics of what it would be used for were not made available at the time
The funding from ChildCareBC’s New Spaces Fund is intended to provide new childcare spaces at a new facility which will be operated by the Parkside Academy Child Care Society in conjunction with the City of Duncan
the 36 new child-care spaces will be eligible for the government’s fee-reduction program
ensuring that they will be affordable for families
Tom Duncan asked de Verteuil when he expects construction of the new daycare will begin as the childcare spaces are badly needed in the region
De Verteuil said that when construction will begin has yet to be determined
“We still have a ways to go that one,” he said
the final designs on engineering have to be completed and there’s still servicing issues
so we have lots of work ahead of us before we can put shovels in the ground.”

President Donald Trump as the main reason behind his party’s campaign faltering and pointed out the impacts were much worse on the NDP
Duncan has held various key roles within the Conservative caucus
He’s served as question period liaison (or co-ordinator) under multiple leaders and had served as the critic for democratic institutions under former leader Erin O’Toole
It’s widely expected Duncan will retain a prominent role within the Conservative caucus
as the party is set to form official opposition with an increased number of seats
he’s been a big supporter of mine,” said Duncan
“I’m not even going to consider that he’s going anywhere.”
Duncan served as mayor of North Dundas Township and worked with MP Guy Lauzon until his retirement
Duncan secured the nomination for the Conservative electoral district association in what was then called Stormont—Dundas—South Glengarry and ran in the 2019 election to replace Lauzon
He was re-elected with 55 per cent of the vote in 2021

Poet was honoured in 1921 for contributions to literature
The University of Toronto is de-recognizing the late Duncan Campbell Scott
who was awarded an honorary degree in 1921
following the submission of a formal petition
The standing committee unanimously recommended that Scott be de-recognized through a process identified under its principles and processes as “contextualization” – illuminating the contentious or problematic legacy of the honoree
It further recommended that the university acknowledge its own complicity in awarding the honorary degree in 1921
staff and alumni – including Indigenous and legal scholars – who serve on the standing committee for their careful research
diligent deliberations and thoughtful advice,” said Meric Gertler
“Taking this step acknowledges the horrific impact of residential schools
the individual role of Scott and the collective failures of the university
the federal government and Canadian society.”

“Scott served 19 years as the highest unelected official in the department: deputy superintendent general,” said Shannon Simpson

As part of the de-recognition, a statement contextualizing Scott’s legacy was read into the record at U of T’s Governing Council meeting on Feb. 27. It has been added to the records of the Governing Council Secretariat and the public record of honorary degree recipients:
Duncan Campbell Scott’s legacy is fundamentally at odds with the University’s mission and values
in particular its commitment to human rights
His life’s work is inextricably intertwined with the devastating history of Canada’s residential schools
He presided over the expansion of the residential school system
authorizing the use of coercion and force in defiance of both legal opinion and court ruling
Despite the clear evidence of the terrible conditions and ‘startling death rolls’ in the schools
Scott and others in the government took insufficient measures to protect the health and wellbeing of the children in their care
These actions reveal an abhorrent disregard on the part of Scott (and Canada) for the fundamental human rights of Indigenous populations
the University of Toronto also failed to respect the human rights of Indigenous peoples and was complicit in the harms inflicted upon them
The University acknowledges and profoundly regrets its complicity
The University also recognizes that the effects of this odious history are still being felt today and it recommits to reconciliation
On the recommendation of the standing committee
de-recognition will consist of contextualizing Scott’s honorary degree rather than rescinding it
The approach calls attention to the horrific history of residential schools and acknowledges the university’s complicity in the harm they created
“The university will establish a working group by spring 2025 that will carry out several educational initiatives about this de-recognition
such as an archival or artistic exhibition
This is an opportunity for reflection and action – and this work will be carried out in collaboration with U of T’s Office of Indigenous Initiatives,” said Trevor Young
“De-recognition is a significant measure,” said Wes Hall
U of T chancellor and chair of the Committee for Honorary Degrees
“Individuals who receive honorary degrees from U of T are meant to inspire our graduates
and their legacy should be one of honour and distinction to the university
This decision reflects our commitment to reconciliation and upholding the values that define our institution.”

He will and is as always be held in soft sacred love
Duncan will be deeply missed by his beloved wife
as well as by many family members and friends who cherished him

Elaine was happiest when she was in her home with the lake and woods around her
She was a well known and treasured member of the Housey’s Rapids community where she lived for 40 plus years
She was grateful for the support of family and friends that made it possible for her to live there in her later years
her adventurous spirit and her zest for life she was a familiar sight at the Summerland store drinking coffee with friends.
A proud veteran of the Canadian Women’s Army Corp (CWAC) she delighted friends with her stories of midnight motorcycle rides
She met her soulmate Garnet(predeceased) a handsome Airforce Sargent while serving and was married to him for 59 years
Dawn and Cathy and several great grandchildren.
An independent woman she lived her life with passion and spirit
She was a powerful swimmer and avid snowmachine rider
She loved music--she played the organ as a child in her father’s church on Lake on the Mountain
enjoyed reading and created many art works that hang on the walls in her house
She made it known she wanted us all to share a laugh and raise a glass in celebration of her journey home.
There will be a Celebration of her Life in the spring 2025.
