What’s the home of UEFA’s HQ like
If you were driving between Geneva and Lausanne
Switzerland’s second- and fourth-largest cities
you might pass through or at least see signs for Nyon
It is a small municipality north east of Geneva
located on the banks of Lac Leman (Lake Geneva) in the Francophone west side of Switzerland
They are not the kind of statistics for a governing body that you would expect to find located at the foothills of the Jura mountain range
is also the country’s highest peak outside of the Alps
with swathes of fields stretching from the mountains down to the lake

two months to the day before five FlyNYON passengers were killed on a doors-off helicopter photo tour
a pilot for Liberty Helicopters accurately predicted their deaths.
The pilot was speaking during a safety meeting attended by representatives from FlyNYON and Liberty Helicopters
which routinely conducted doors-off flights for FlyNYON and its parent company
He was venting his frustration with FlyNYON’s delay in procuring high-quality
aviation-grade safety harnesses for its passengers
instead continuing to rely on inexpensive yellow fall protection harnesses that he dubbed “Home Depot specials.”
“The next big problem that we’re going to have going forward with this entire thing is
what happens when people need to emergency evacuate the aircraft?” he said
according to a transcript of the meeting included in court filings
“With your carabiner being hard attached to the upper D-ring on that yellow harness you cannot
trapped in the bottom of the Hudson f***ing River to get that.”
drowned in New York City’s East River
but for the same reason the pilot foresaw: they were unable to free themselves from their supplemental harnesses after the Airbus AS350 B2 they were riding in made an emergency landing to the river and overturned in the water.
The recorded audio from this meeting was key evidence in a lawsuit brought by the family of one of the passengers
That six-year legal odyssey culminated on Sept
19 after a New York jury awarded approximately $116 million in damages to Cadigan’s family — reportedly the largest jury verdict for a single wrongful death in the history of New York state.
which reviewed evidence over the course of a two-and-a-half months
awarded $113 million in compensatory damages
allocating 42% fault to FlyNYON and NYONair
38% to Liberty and 20% to emergency float manufacturer DART Aerospace
An additional $3 million in punitive damages — meant to punish a defendant that has acted in a particularly harmful way — was awarded against the NYON enterprises
No blame was assigned to Airbus Helicopters
the manufacturer of the accident aircraft.
“I think the jury did an excellent job sorting through the evidence and arriving at a verdict that fairly and justly compensates this family,” Gary Robb
“The evidence was overwhelming that [the defendants] knew that the passengers could not escape
They had warnings from pilots that that would be the case
but they scoffed and mocked in horrible language the pilots who came forward and ended up actually being whistleblowers.”
The mishap occurred during a doors-off helicopter photo flight in a B2 operated by Liberty on behalf of FlyNYON. As previously established by the U.S
National Transportation Safety Board (NTSB)
Cadigan was riding in the front seat of the helicopter when the tether used to connect his harness to the aircraft caught on the floor-mounted fuel shutoff lever
resulting in a loss of power to the engine.
The pilot performed a successful autorotative descent to the East River
when he activated the aircraft’s optionally-equipped emergency floats
they inflated partially and asymmetrically
causing the helicopter to overturn in the water
who was wearing only the aircraft’s installed four-point seat belt with a quick-release buckle
was able to escape from the submerged aircraft
but the five passengers were unable to free themselves from their supplemental harnesses and drowned.
In 2018, Vertical broke the story of how Liberty pilots had raised multiple safety concerns with the FlyNYON harness and tether system in the months leading up to the fatal accident
only to have their concerns angrily dismissed by FlyNYON CEO Patrick K
Day (referred to in some testimony as “Junior” to distinguish him from his father
Liberty Director of Operations Patrick Day
who nominally served in the same role for FlyNYON).
Liberty should have had final say over how they were conducted — a foundational aviation principle known as operational control that is intended to separate safety of flight decisions from financial or scheduling ones
the NTSB found that Liberty’s managers improperly allowed Patrick K
Day and other FlyNYON personnel to influence core aspects of Liberty’s operational control
including decisions around whether or not it was safe to fly on a given day.
but FlyNYON continues to operate the same types of doors-off photo tours as the accident flight
encouraging passengers to dangle their feet outside the aircraft for “shoe selfies.” Cadigan was leaning back to take a shoe selfie when his tether caught on the helicopter’s fuel shut-off lever.
He spent nearly an hour of the two hours allotted for his closing arguments making a vigorous case against the aircraft manufacturer
arguing that the floor-mounted fuel controls were known to be susceptible to inadvertent activation by passengers
as illustrated by multiple previous accidents involving the fuel flow control lever positioned next to the fuel shut-off lever
Robb asked the jury to award at least $140 million in damages and assign 40 percent of the fault to Airbus.
which was very smart and dedicated and attentive
Airbus did not immediately provide comment on the verdict.
FlyNYON’s attorneys attempted during the trial to shift most of the blame onto the pilot of the accident helicopter
They argued that he gave Cadigan an inadequate safety briefing and failed to guard the fuel control levers from his tether
presenting video evidence that showed Cadigan’s tether loop was present in the engine control quadrant area for about a minute before it snagged on the fuel shut-off lever.
The pilot had just 65 seconds from the time the engine lost power until the helicopter contacted the water
during which time he entered an autorotation
attempted to relight the engine both before and after he realized that the fuel shut-off lever had been moved
transmitted a mayday call to air traffic control and activated the emergency floats
FlyNYON attorney Anthony Battista faulted the pilot for not also instructing the passengers to begin disconnecting their tethers during the emergency descent.
Yet that argument was undermined by FlyNYON’s former lead pilot
whose recorded deposition was replayed by Robb during closing arguments
The lead pilot was being paid by NYON to provide her deposition on the company’s behalf and responded to many questions with “I don’t know” or “I don’t recall” during her cross examination by Robb
But when Robb asked if she blamed the pilot of the accident flight
“How many hours did we spend watching NYON blame [the pilot]
I guess she didn’t get the memo that they were going to blame [the pilot],” Robb said during his closing arguments
Battista did not respond to a request for comment.
Vertical previously reported that Liberty pilots had demonstrated well before the accident that the cutting tools FlyNYON was supplying to passengers to aid in an emergency egress were ineffective on the thick climbing tethers it was using
2017 — more than four months before the accident — in which pilots and FlyNYON customer service representatives demonstrated that the cutters did not slice easily through the tethers
as well as evidence that FlyNYON managers including Patrick K
Day had seen and commented on the video.
Eric Adams, a journalist for Wired who was on another FlyNYON photo tour at the same time as the accident flight, published his own video demonstration in April 2018
showing that the cutters did not readily slice through the tether even with great force applied
FlyNYON’s attorneys called expert witness Gregory Feith
who attempted to demonstrate that the cutters were in fact effective.
with Feith taking close to a minute by Robb’s estimation to cut through the tether
Although Battista insisted to the judge that “it was not a timed simulation
It was just a demonstration to show how it would be done,” Feith acknowledged before the jury: “Yeah
but it is an effective means of actually disengaging yourself with time.”
“The issue is that those cutters weren’t put there in the event of a perfect landing
They were put there in the event of an absolute emergency where you’re in the water or a helicopter is on fire,” another Liberty pilot testified in a deposition
“That’s my issue with all of it
is that you gave someone a gun in the event there’s a gun fight
They had no chance in the event they had to get themselves out with the knife
Day said: “We respect the jury’s verdict and very much appreciate its significance to us as a company and to the industry as a whole
The introspection and self-critical analysis we have undertaken in the last six-and-a-half years have shaped our view of what it means to be an industry leader
He cited a number of improvements that NYON has made since the accident
including changing to a new Federal Aviation Administration (FAA)-approved harness and quick-release tether system; bringing all operations in-house; adding a safety management system; using Bell 206 helicopters that have a fuel shut-off switch on the panel away from the passengers; providing pilots with helicopter underwater escape training; and hiring a new safety officer
each of whom has three decades of experience or more.
Vertical also reached out to an attorney for Liberty Helicopters but did not immediately receive a response.
the NTSB made a number of recommendations to the FAA and others
Some of these have been acted on to the NTSB’s satisfaction
Investigators determined that only one of the two gas reservoirs in the DART emergency flotation system discharged due to the high forces required to pull the activation handle
yet the sound of the single-reservoir discharge and visual indications of inflation led the pilot to mistakenly believe that he had successfully pulled the handle fully aft to completely inflate the floats
The NTSB faulted the FAA for failing to identify the lack of an activation handle pull-force limitation when it certified the DART flotation system and warned that other emergency flotation system designs could have similar omissions.
Asked by Vertical for comment on the verdict
an attorney for DART did not immediately respond.
The NTSB also recommended that Airbus modify the floor-mounted fuel shut-off lever in AS350 series helicopters to protect it from inadvertent activation. As detailed in a safety information notice
leading the NTSB to declare the status of that recommendation “closed – acceptable action.”
the NTSB has been less satisfied with the responses to other recommendations
including the FAA’s failure to develop guidance for air taxi
and other non-airline operators on how to identify intoxicated or impaired passengers
Toxicology results indicated that Cadigan was intoxicated by alcohol at the time of his death
although the NTSB concluded that his actions in the helicopter were “all behaviors that could have been performed by an enthusiastic but sober passenger,” and the jury was precluded from hearing testimony that Cadigan had been drinking before the flight.
a response the board deemed “unacceptable.”
In August of this year, the FAA published a final rule on the use of supplemental restraint systems (SRS) in civil aircraft
Directly motivated by the accident in the East River
the rule prohibits the use of such harnesses and tethers unless the wearer can release themselves quickly
and without the use of a knife or other tool.
However, the FAA rejected both suggestions. With respect to the age minimum of 15, the FAA pointed to the same age requirement in its existing exit row seating rule, stating “there is no precedent for individuals younger than 15 to act in an emergency and in a high-stress environment where critical decisions must be made in a matter of seconds.”
As for the flightdeck prohibition, “inadvertent activation of the fuel shutoff lever is only one type of accidental interference with flight controls that warrants concern,” the FAA stated. “With an SRS, an individual in the flightdeck has a greater range of motion, allowing many more potential actions that could interfere with the controls as compared to an individual restrained only by the FAA-approved safety belt.”

On the outskirts of every great city across the world are the towns
villages and communities that complete the character of a region and
such cities perhaps would not be quite so great
Los Angeles has the sun-soaked coasts of Santa Monica and Malibu
Paris has the densely populated Levallois-Perret and Geneva has the placid beauty of Terre Sainte and Nyon
Clouds pass over vineyards on the north shore of Lake Geneva in the La Côte wine producing area
or “the Coast,” the small territories known as Terre Sainte and Nyon are set against a backdrop of gently sloping hills off the western banks of Lake Geneva in the canton of Vaud
The two regions consist of a number of small villages and municipalities
a handful of which have populations under 3,500
Though only a brief train ride away from Geneva’s center
the two regions remain mostly undisturbed by traffic and commercial congestion
preserving their natural beauty and historic charm

“Basically, it’s a question of do you want more space, less traffic and easier access to the airport all for the same budget. If so, then Terre Sainte is the perfect choice,” says Gentilini.
While more space and practicality may imply lesser pedigree, the picturesque hills and impressive homes of Terre Sainte and Nyon prove otherwise.
Traditional architecture lovers will find plenty of treasures in and around Nyon and Terre Sainte
“These old properties are in some ways better because you can keep the traditional beauty of the architecture but with a renovated inside. You rarely see someone building a modern property here when they could keep the original style,” added Gentilini.
For older properties dating back centuries

In Nyon, buyers will find a market with more high-end residences, including some of the sought-after waterfront properties on the western coast of the lake. Due, in part, to the presence of businesses like Hublot and the UEFA, however, there is comparably less residential space than Terre Sainte.

The Paléo Festival Nyon 2024 reports that all 200,000 tickets for the July 23-28 event sold out in just 21 minutes March 20
