That led him to create and release the app GradePoint, which is available on the iO App Store: tinyurl.com/fontemgpaapp Fontem said GradePoint is designed to make school more bearable by helping students calculate their GPA or final grade and track assignment due dates and allowing notes or photos to be attached each assignment He said GradePoint solves many of the problems he has had as he makes his way through high school GPA is only available at the end of the semester and students can't track their academic progress throughout the semester," Fontem said "The GPA apps already available are very hard to use GradePoint allows you to adjust the scales to any college (or) high school's grading system." no longer the whites on one side I want to embrace the challenge of bringing forward in my own life the powerful reality of unity that we experienced here in Fontem.”   Biagio Sparapano SILVER SPRING, Md. — The U.S. Food and Drug Administration (FDA) recently denied premarket tobacco product applications (PMTAs) for several myblu electronic nicotine delivery system (ENDS) products But ITG Brands is hoping to keep the devices on the market while an administrative appeal is ongoing The FDA issued marketing denial orders (MDOs) to Fontem U.S LLC for myblu products because their PMTAs lacked sufficient evidence to show that permitting the marketing of these products would be appropriate for the protection of the public health “We are disappointed with the FDA’s decision and disagree with the scientific evaluation and conclusions they reached,” said Alexandra Wich ITG Brands director of external communications “We believe our products meet the regulatory requirements and plan to use the administrative appeals process to convince the agency that approval should be granted we expect the FDA will not seek to enforce the MDOs while this appeal remains ongoing and we therefore expect the products to remain in the market during this period We do not believe that there will be any short-term impact on the business.” Products that received an MDO may not be sold, distributed or marketed in the United States, according to the FDA. But the agency has reversed or paused its decisions in at least 15 other cases CSP asked the FDA if it would refrain from enforcing MDOs while an administrative appeal is pending said the FDA makes enforcement decisions “on a case-by-case basis.” “All new tobacco products without premarket authorization are marketed unlawfully and subject to enforcement at the FDA’s discretion consistent with the priorities outlined by the FDA,” Hunt said “Retailers can contact their suppliers for clarity on the current status of any particular tobacco product’s application or any product’s marketing authorization including whether specific products are subject to a marketing denial order The FDA intends to follow its usual enforcement practices and will send warning letters before taking enforcement action.” Fontem filed a petition for review today in the U.S. Circuit Court of Appeals for the District of Columbia. The company joins about 40 other vaping manufacturers challenging MDOs in federal courts around the country The FDA today issued a Marketing Denial Order (MDO) to Fontem US for its myblu pod vape device and multiple flavors of refill pods The rejection of the myblu Premarket Tobacco Application (PMTA) is the first announced MDO issued for a pod-based vape product made by a major tobacco company the vape product arm of Imperial Brands (formerly known as Imperial Tobacco)—a major international tobacco company valued at more than $20 billion The denial is significant because the FDA is still reviewing PMTAs submitted by other large companies for pod-based devices—including Juul Labs’ JUUL device and pods, British American Tobacco’s Vuse Alto, and NJOY's Ace device Those devices (and their refill pods) make up a majority of the convenience store/gas station segment of the vaping market The myblu denials could indicate that the FDA will reject those other pod-based products too, perhaps because their nicotine delivery is more effective than the older-generation Vuse Solo and the two Logic products that have received marketing authorization The rationale for the denials, the FDA said in a press release included Fontem’s myblu applications lacking "sufficient evidence regarding design features and stability.” No one can be certain what that means without seeing the actual denial orders but it could involve almost anything related to the performance or physical structure of the device These are the myblu products receiving publicly announced MDOs: myblu Intense Tobacco Chill 2.5% nicotine strength but said at the time it had submitted “a wide range.” including Blu’s disposable cigalikes and rechargeable PLUS+ cigalikes two menthol myblu pods also remain under review although they would be entirely useless without the already-denied device required to vape them Fontem must stop selling the products immediately or face possible enforcement action. The company now has 30 days to file a legal challenge to the myblu MDOs. appropriate for the protection of the public health Products on the market that received MDOs include: The FDA released this product information because the agency determined the products are currently marketed The submission of a premarket application and intent to commercially market a new tobacco product that has never been marketed would be considered confidential commercial information (CCI) which the FDA would not disclose; therefore the FDA issued MDOs for additional myblu products but those will not appear on the publicly available list Retailers should contact the company directly with questions about their products that may have received MDOs but are not listed above the FDA evaluates the risk and benefits of the products to the population including users and nonusers of the product “Based on the information provided in the applications submitted by Fontem for these myblu products and the available evidence the applications lacked sufficient evidence regarding design features the applications did not demonstrate that the potential benefit to smokers who switch completely or significantly reduce their cigarette use would outweigh the risk to
