Court of Justice of the European Union (CJEU) restricts access to public contracts for contractors from third countries
the Court of Justice of the European Union (“CJEU”) issued a precedent-setting ruling in the Kolin Inşaat Turizm Sanayi ve Ticaret case (C-652/22 – the “Kolin case”)
This is of crucial importance to contractors engaging or aiming to engage in the public procurement market of the European Union (“EU”)
who originate from countries outside of the EU that are not party to international agreements with the EU which would formally admit such contractors to public tenders in the EU
The Kolin case concerned a request for a preliminary ruling directed to the CJEU by a Croatian court during proceedings to assess the legality of a decision to award a contract for the construction of railway infrastructure to a competitor of Kolin Inşaat Turizm Sanayi ve Ticaret based in Turkey (“Kolin”) after said competitor was permitted to amend and clarify its bid in wide scope after the deadline for submission of bids
The Croatian court expressed uncertainty as to whether this decision was compliant with the provisions of EU Directive 2014/25 on procurement by entities operating in the water
transport and postal services sectors (the ”Directive”)
The CJEU refused to answer the questions posed by the Croatian court
The consequences of this judgement for the public procurement market in the EU are monumental
The Kolin ruling makes it clear that in the absence of an international agreement on public procurement between the EU and a third country
the participation of contractors from said country in EU public tenders on equal terms with EU bidders and those from countries bound by such agreements
The Kolin case ruling is just one of several measures adopted in recent years within the EU which may substantially affect the situation of contractors from third countries in the area of public procurement
2016 – entry into force of the last generation of EU public procurement directives (2014/24
2014/25) promoting the protection of security
labour and environmental standards in public contracts and introducing measures such as the possibility of preferring EU products in sectoral procurement and a new regulation on preventing selection of bids with abnormally low prices
2019 – issuance of the EU Commission’s extensive guidance on non-EU participation in the EU procurement market
focused on the tools in the then-current public procurement legal framework which may be used to protect against distortions of the EU internal market caused by contractors originating from outside of the EU
2022 – introduction of the EU’s International Procurement Instrument (the “IPI”) laying down procedures for the EU Commission to investigate alleged measures or practices negatively affecting the access of EU businesses
goods and services to non-EU procurement markets
and consult with the non-EU countries concerned as well as impose measures to restrict access to EU public procurement procedures for businesses
goods and services from the non-EU countries concerned
2023 – entry into force of the first provisions included in the Regulation on foreign subsidies distorting the internal market (the “FSR”) introducing a wide range of legal tools enabling the EU Commission to address distortions of the EU internal market caused by subsidies provided by countries outside of the EU
2024 – CJEU ruling in the Kolin case
While the above measures do not exclude outright the possibility of a third-country contractor competing for the award of public contracts in the EU
they introduce additional legal issues which cannot be overlooked if the goal of such a contractor is to successfully bid for a contract

Saudi Arabia’s Neom has awarded contracts for the infrastructure development at Oxagon industrial city
The gigaproject developer awarded the contracts to local firms including Al-Ayuni Investment & Contracting Company and Saudi Pan Kingdom (Sapac)
MEED understands that the Oxagon Interchanges 4 and 5 contract was awarded to Al-Ayuni
Neom appointed Sapac as the contractor for Interchange 2 and the Sharma Interchange
Neom has awarded significant infrastructure development contracts recently
Earlier this week, MEED reported that Neom had awarded an estimated SR1.8bn ($500m) contract to the joint venture of Turkish contractor Kolin Construction and local firm Saudi Structures Contracting Company for an infrastructure development package at Trojena

Ceren Baktimur: Can you share your journey into advanced air mobility (AAM) and what attracted you to this field
Kolin Schunck: My journey into AAM began with a fascination for technology and innovation
I joined Airbus and looked at technology trends
The potential to revolutionize urban transportation and create a more seamless and efficient mobility ecosystem attracted me to this field later on
The opportunity to be part of a transformational shift in the way we move people and goods were key drivers in my pursuit of AAM
Ceren Baktimur: How would you describe the current state of the AAM sector
Kolin Schunck: The AAM sector has seen rapid growth in past years but has arrived at the level of realism
and mobility firms have and still invest in the field
we are also seeing advancements in technology
it’s still in its early stages with many challenges to overcome
Ceren Baktimur: Can you elaborate on your main stage presentation topic at AIRTAXI 2023 SFO about airport/airline hub feeding
Kolin Schunck: My main stage presentation will focus on airport/airline hub feeding
Hub feeding with AAM can bridge the gaps between urban centers and airports
allowing airlines to tap into new markets and provide seamless
the concept of hub feeding can transform the way we approach air travel and create more cohesive transportation ecosystems
what emerging technologies have you identified as key to the future growth of AAM
Kolin Schunck: Emerging technologies such as electric propulsion
and 5G communication networks are key to the future growth of AAM
which are essential for the widespread adoption of AAM
Ceren Baktimur: What steps are necessary for AAM solutions to become mainstream in air travel
Kolin Schunck: For AAM solutions to become mainstream
a concerted effort in regulatory alignment
and cross-industry collaboration is necessary
and developing scalable business models will also be vital
Ceren Baktimur: Do you see the potential for major players in the air taxi market to form alliances
similar to traditional airline alliances like Star Alliance or Oneworld
These alliances could pave the way for additional revenue streams and novel business prospects
Kolin Schunck: Learning from the grand alliances in the traditional airline industry
it seems more likely that alliances within the eVTOL sector would occur between operators and ground-based mobility firms rather than the eVTOL original equipment manufacturers [OEMs] themselves
Given the competitive nature of the eVTOL manufacturing landscape
OEMs may be hesitant to engage in alliances
where operators and manufacturers are not always the same entities
make alliances among manufacturers less likely
we could witness the formation of alliances between actual operators
Such alliances could extend the network for operators and provide a seamless travel experience for passengers
Imagine a customer flying from New York City to San Francisco
and from there an on-demand shuttle to the final destination
All of this could be covered by one ticket through an alliance
offering an integrated and efficient travel solution
Ceren Baktimur: Building upon the concept of alliances
let’s delve into the potential for similar code-sharing arrangements
code-sharing agreements have been instrumental in expanding route networks and enhancing connectivity for passengers
Do you foresee similar arrangements happening in the emerging air taxi market to optimize service coverage and passenger convenience
Kolin Schunck: Code-sharing would likely remain focused on specific connections and shared operations within the emerging air taxi market
a customer might purchase a ticket from an airline that includes an eVTOL flight operated by another service
This approach would extend network reach and offer more destinations without having to operate more flights and without necessarily requiring a grand alliance of multiple stakeholders
while code-sharing arrangements could certainly play a role in the AAM sector
they would likely function within the specific partnerships between operators
whether or not those are part of broader alliances
such as the ones formed to create integrated travel experiences from start to finish
Ceren Baktimur: In the scenario where an air taxi service forms a partnership with a top airline for a selected point-to-point route
would the offering likely to be a fully integrated and seamless product
providing passengers with a unified journey experience from start to finish
would the air taxi service be liveried in the airline’s branding
creating a cohesive and branded experience
or do you think a major airline like Lufthansa might take a different approach in such partnerships
Kolin Schunck: In the scenario where an air taxi service forms a partnership with a top airline for a selected point-to-point route
it is highly conceivable that the offering would be a fully integrated and seamless product
This integration could manifest itself through code-sharing arrangements or even broader alliances
The extent to which the air taxi service would be liveried in the airline’s branding would likely depend on the nature and depth of the partnership
where the air taxi service is seen as an extension of the airline’s own services
adopting the airline’s branding could create a cohesive and branded experience for passengers
major airlines like Lufthansa might take a different approach
especially considering the complexity of the eVTOL industry
and potential allied ground-based mobility firms all have unique interests and brand identities
balancing the need for brand cohesion with the desire to maintain distinct identities
the exact branding strategy would vary depending on the specific partnership and the involved parties’ preferences and strategic goals
Ceren Baktimur: What locations in Europe do you identify as having a need for efficient and expedient transportation solutions connecting airports to their respective city centers
Based on my perspective and discussions with network analysts from leading airlines
Bodrum Milas Airport (BJV) was mentioned several times as a potential hub
direct connectivity to several convention hotels
and the challenges arising from its distance from the city center
Kolin Schunck: There are indeed areas in Europe that could benefit from efficient and expedient transportation solutions to connect airports to city centers
it’s essential to note that an in-depth analysis must be conducted to assess the viability of these routes for eVTOL services
The following cities are potential candidates
We are currently running an analysis on the top 43 global cities and assessing each city by three use cases based on six different metrics (e.g.
These detailed examinations will shed light on the best-suited locations and the particular challenges and opportunities they present
We will publish our insights at the beginning of October
and I will present the findings for the first time at the AIRTAXI World Congress
Ceren Baktimur: As the air taxi market evolves
there is an ongoing debate about the main target clientele
Do you believe the primary customer base will consist of premium and business-class passengers
given their demand for efficient and time-saving travel options
or do you see air taxis transforming into a mass transportation solution
as suggested by some of the major air taxi manufacturers
Kolin Schunck: As the air taxi market evolves
the primary focus seems to be on the luxury and premium segment
which is indeed witnessing tremendous growth
the astounding valuation of luxury firms like Hermes de Paris
now worth more than mainstream brands like Nike
This surge in the luxury market is indicative of a broader trend and demand for exclusive
The burgeoning air taxi industry promises to offer an efficient and time-saving travel solution
which is precisely what the premium and business-class passengers are seeking
These passengers are the ideal target audience for OEMs offering cutting-edge air taxi services
that doesn’t mean the potential for air taxis as a mass transportation solution should be overlooked
While the initial focus may be on the luxury segment
it’s conceivable that technological advancements
and growing acceptance of this mode of transportation could lead to more affordable options
this might spill over into the mass market
making air taxis accessible to a wider demographic
Ceren Baktimur: Do you envision scheduled air taxi operations primarily serving as regional feeders
connecting urban centers with airports and other transportation hubs to complement existing air travel infrastructure
this approach represents a logical starting point for several reasons
connecting urban centers with airports and other transportation hubs is the easiest of all use cases currently under discussion
The integration of eVTOL technology into existing air travel infrastructure does not necessitate a complete overhaul of current systems
it requires strategic coordination and collaboration with established operators
from an airline operator’s perspective
airlines have the opportunity to tap into unserved or underserved demand
They can extend their network reach and fill the gaps in transportation that exist between urban areas and airports
This can lead to a significant expansion of an airline’s network
opening up new markets and providing enhanced connectivity for passengers
focusing on regional feeders aligns with the existing travel patterns and needs of many passengers
People are already seeking efficient ways to get to and from airports
time-saving option that fits neatly into this existing demand
While regional feeder services will likely be a dominant use case in the early stages of AAM implementation
as the industry matures and regulatory environments evolve
we may see AAM expanding into other areas and serving diverse transportation needs
regional feeder services are where we anticipate significant growth and focus in the near term

has returned from retirement to serve as interim city manager for a six-month period
with likely challenges ranging from drought to labor negotiations and an extremely dangerous wildfire season
who was city manager most recently in Beverly Hills and has served in government roles for more than 35 years
agreed to step in as the city council searches for a permanent successor to Sean McGlynn
who recently departed for Southern California after seven years as city manager
“We wanted to bring in … somebody who knew the system and had done the job before and could keep the trains running while we did a much more exhaustive search,“ said Mayor Chris Rogers
Santa Rosa City Council selected Kolin to serve amid a nationwide search for a city manager they expect could last as long as six months
who returned to Santa Rosa in 2015 with his wife
after five years leading city government in Beverly Hills
will not be a candidate for the permanent position
He was selected after two days of interviews with a field of candidates
Kolin will receive McGlynn’s base hourly pay
Kolin’s second stint at Santa Rosa City Hall comes as Sonoma County is in the midst of a severe drought and at the precipice of another combustible wildfire season
The city has begun asking for voluntary 20% cuts in water use while county and state regulators ramp up wider mandatory orders
More actions are likely to be necessary with any drought relief at least half a year away
The city also is grappling with chronic budget issues
a contentious debate over policing sparked by the Santa Rosa Police Department’s troubled response to protests last summer and a homelessness crisis defined by cyclical sweeps of encampments
“It’s going to be really challenging,” Councilman Jack Tibbetts said of the coming six months
The city manager oversees a 1,250-person workforce
with day-to-day responsibility over an annual budget of about $437 million
Negotiations are underway with labor unions representing 12 units of the city’s workforce
as well as three units that do not have union representation
according to city spokeswoman Adriane Mertens
is prepared to guide the city through those rough waters until a permanent hire can be made

“You want to make sure you build a relationship with the mayor and the city council,” he said

The council is in the midst of negotiations with a consulting company to manage a nationwide hiring hunt
Kolin’s interim appointment also signals to city staff and community members who may be considering the position that no preordained path is chosen
He hoped to select a new city manager from the community
“I don’t think its helpful when we hire these roving city managers who are trying to go from big city to bigger city,” he said
adding that he wanted somebody who was “going to be part of this city for the next 10 years.”
Rogers was undecided on where the city should look for McGlynn’s permanent replacement
and said he looked forward to the coming discussion
“We’re going to have to weigh having a city manager that knows the community versus going outside and getting candidates who have a different perspective,” he said

PROVIDENCE — It's been a big summer for Rhode Island forward Kolin Sisson
The 16-year-old came into the offseason after posting over a point-per-game with South Kent School and Mount St
He attended the Chicago Steel tryout/development camp in early June and despite being a young skater and standing at just 5-foot-9
Sisson played so well that he earned a roster spot on the USHL junior hockey team for the upcoming year
the winger competed in the USA Hockey-BioSteel Boys 17 National Festival with the top skaters from his birth year
For those who didn't know who Sisson was before camp
He scored the most goals during the camp (6) and was tied for second in overall point totals (6G-3A-9PTS) throughout the week
He was subsequently named to the prestigious Hlinka Gretzky Cup Camp where he was seen by many scouts and NCAA coaches from around the country
Multiple schools came in contact with Sisson in 2023 before Aug
which is the first day players could announce a verbal commitment to a Division I program
The top three programs he eventually had to choose between were Harvard
and he decided to stay close to home and play for the Friars
"I am proud and honored to announce my commitment to play Division I hockey at Providence College
I would like to thank God for giving me this opportunity
and everyone else that has helped me along the way," Sisson posted on his Instagram page on Aug
"It's not every day you get to go to a school 10 minutes from your house
so it seemed pretty perfect," he said about committing to his hometown team
"The coaching staff is amazing and the facilities are great."
The forward also knows some of his future Friar teammates already in fellow Rhode Islander Everett Baldwin (St
Sisson said that he's grateful that so many schools reached out to him in the recruiting process
So he's glad that he's now committed to a program and can just focus on preparing for the upcoming season

Sisson can play both center and wing and says that his strengths are his skating ability and his quick release on his shot
Sisson had 42 points over 37 games with the South Kent School 16U team before playing in 27 contests for Mount St
Because of his strong showing at USHL camp this summer
Sisson plans on competing with the Chicago Steel in 2023-24
He was drafted by the Steel in the 19th round of the 2022 Phase I Draft
The forward has been working on getting stronger and gaining muscle this summer to keep up with the next level of play in the USHL
He leaves his home to join the team in late August and will be living with a billet family and taking online classes while he's there
so he won't be the youngest one on the Steel's roster
but he'll still be pretty young compared to many of the other skaters in the league
