Lee then was said to have lunged at the man and pushed him before the footage "abruptly" ends An interview was conducted by Werne with Lee on Aug Lee told the detective he responded to a call at the residence where he found the complainant with a cut on his finger Lee told police that he believed the individual was intoxicated Lee stated that the two exchanged some words before he approached the complainant "in a way that was going to tell him he needed to show some respect," Werne wrote in the affidavit prompting him to trip him and take him to the ground where he said he remained on top of him until he calmed down Based on the circumstances in which it occurred Lee said that he believed the man had spit on him intentionally.  Lee denied choking or punching the complainant at any point during the encounter The complainant was not arrested for battery on an officer after the incident based on the discretion of former officer Lee at the time He told Werne that had he arrested the man he would have had to sit with him at the hospital based on his finger injury and his alleged intoxication at the time He said in previous situations where he had been spit on he had not made arrests Lee also referenced the heated exchange between the two saying that with the situation already being tense placing the complainant in handcuffs would have been difficult for the responding officers Lee told Werne he had seen the video of the incident telling him that had he been looking to do harm he would not have had his hands in his vest at the time Statehouse roundup: What happened in the Indiana General Assembly last week.
