nearly killed by Buddy Lazier’s race car 25 years ago The two men had never met until Thursday at Indianapolis Motor Speedway Lazier’s race car streaked toward Wissen while he was doing his job on the track as chief of the IMS safety crew cleaning up debris from Tom Sneva’s wreck in turn 4 Lazier left the pits and re-entered the track after the accident accelerating to catch the field that was under the yellow flag Lazier didn’t realize Wissen’s crew was still on the track in Turn 4 The race car moved toward Wissen at more than 200 mph like a guided missile “I was standing in the high-speed groove,” recalled Wissen “It was like I watched it in slow motion.” deftly guiding the car between Wissen and the wall Wissen was so close to being hit that he was spun around and knocked to the ground by the backdraft from Lazier’s car “I’m hauling,” said Lazier ‘I’m going to stuff it into the safety truck so nobody gets hurt The safety guys are there to take care of us “It was that fraction of a second – hole and he was traumatized by the near-death experience haunted by the vision of Lazier’s race car getting closer and closer.  Wissen admitted that he was upset with Lazier in the hours after the near collision not completely understanding how the near-fatal situation had unfolded He went to Lazier’s garage after the race but Wissen said someone denied him access to the garage area who will start in the 10th row of Sunday’s race said he talked to most of the other workers on Wissen’s safety crew over the years “There isn’t a day that goes by that I don’t think about that when I’m here at the Speedway,” said Lazier the conversation that Wissen and Lazier both wanted took place Thursday 25 years after their paths nearly crossed in the worst possible way Lazier asked for a private moment with Wissen they could also talk about what didn’t happen Wissen brought the orange fire suit he wore that day in 1992 and Lazier said he was honored to autograph it the last remaining wound from the traumatic incident was healed I’m just so happy to catch up with you,” said Lazier “You guys are the unsung heroes.” Wissen has returned to IMS multiple times over the years as a spectator for the 500 including last year for the 100th running he could never bring himself to rejoin the safety crew where he continued to work until recently retiring and that weighed on his mind for months after his close call with Lazier Then the annual letter from IMS arrived in his mailbox asking Wissen if he intended to return in 1993 Several other members of Wissen’s crew were also on the track when Lazier’s car sped by them Although they didn’t come as close to getting hit as Wissen he decided it would be best for the team to find a different crew chief “I had thought about it a lot before I even got the letter,” Wissen said I was the point man and I was responsible for my crew But I couldn’t do anything to protect them with this car coming at me MORE BUDDY LAZIER: Pacers' at IMS is emotional for Wissen The event and the race track remain in his blood sharing stories about his connection to IMS that reached back to his childhood “I was born on April 18th and mom and dad had me out there for opening day that May,” Wissen said “My dad worked at IMS as a safety yellow shirt at first and then he wound up being one of the lead photographers at the track My first job at the track was as a film runner I would jump on a minibike and race over to the wreck where photographers would shoot as many pictures as they could I’d race it back to the UPI office under the grandstands and they’d get it developed and out on the wire.” Wissen knew returning to the safety crew would mean dealing with more emotional events Wissen had seen accidents that were impossible to forget “I was the first one to get to Gordon Smiley when he died (in 1982),” Wissen said “I was with the first crew to reach Danny Ongais (1981) when he had his horrifying wreck. Good grief It was clear IMS provided far more joy than pain for Wissen the 1996 Indianapolis 500 champion who will make his 20th start in the event Sunday Lazier says there are far more precautions in place now to avoid a situation like the one he had with Wissen  “The key is to never put a driver they’ve made it very clear which way they wave the drivers.” The last 25 years have been good to Wissen and he has been married to his wife Debbie for 19 years Wissen will not attend Sunday’s race because his family is traveling to Las Vegas for a wedding But Wissen and Lazier vowed to reunite at next year’s race powerful auroras are fundamentally different from Earth's northern and southern lights Those are just two of the discoveries made by NASA's Juno spacecraft during its first few close passes over Jupiter's poles mission scientists report in two studies published online today (May 25) in the journal Science "Discoveries about its core, composition, magnetosphere, and poles are as stunning as the photographs the mission is generating," added Bolton the lead author of one of the new Science studies and a co-author of the other.  The $1.1 billion Juno mission launched in August 2011 and arrived in orbit around Jupiter on July 4 the solar-powered spacecraft has been using eight instruments to study the gas giant's composition The mission's name is a nod to the Roman goddess Juno who was able to look through the clouds to see her frequently misbehaving husband Jupiter the Juno probe is peering beneath Jupiter's thick clouds to learn about the planet's formation and evolution — information that could shed light on the history of our solar system as a whole Juno makes most of the measurements relevant to this goal during its close flybys which occur once every 53.5 days and bring the probe within about 3,100 miles (5,000 kilometers) of Jupiter's poles (The original mission blueprint called for Juno to maneuver to a less elliptical orbit and make these flybys every 14 days but an issue with two helium valves in the spacecraft's propulsion system nixed that plan.) Before Juno, no spacecraft had ever gotten close-up looks at Jupiter's poles. These mysterious regions are beautiful and bizarre, the Bolton-led study reports some of which are up to 870 miles (1,400 km) wide we'll be able to watch the poles and see how they evolve," he said in the podcast Juno also has been mapping out the concentration of water and ammonia deep within Jupiter's atmosphere Data gathered during the first few passes has revealed that ammonia abundances vary quite a bit from place to place — a discovery that surprised the mission team as soon as you go down a little bit into Jupiter and we're finding that that's just not true at all," Bolton said but it doesn't seem to match the zones and belts And so we're still trying to figure it out." Juno's measurements during the first few close passes also show that Jupiter's magnetic field is nearly two times stronger than scientists had predicted And the probe's gravity data suggest that "there's a lot of strange deep motions that possibly are going on inside of Jupiter," Bolton said "What Juno's results are showing us is that our ideas of giant planets maybe are a little bit oversimplified," he added "They're more complex than we thought; the motions that are going on inside are more complicated It's possible that they formed differently than [suggested by] our simple ideas." Earth's auroras result when the solar wind — charged particles streaming from the sun — slam into the planet's atmosphere (Earth's magnetic field funnels these particles toward the poles which explains the phenomenon's other name: the northern and southern lights.) Scientists already knew that the solar wind is a major driver of Jovian auroras and that the planet's rotation is involved as well But Juno has given researchers a chance to study the phenomenon in unprecedented detail; no other spacecraft had ever flown close to the planet's auroral regions before The second newly published Science study which was led by John Connerney of the Space Research Corporation and NASA's Goddard Space Flight Center in Maryland details what the Juno team learned about the auroras and Jupiter's magnetosphere from the initial perijove passes the particles associated with Jupiter's auroras seem to be different than the ones responsible for Earth's most stunning light shows "We can see that it doesn't work exactly like we expected "We haven’t been able to see particles necessarily going up and down in both directions like we would've expected to cause the aurora So there's definitely some strange phenomena that we still need to comb through and understand better." Further close flybys should allow the Juno team to investigate such questions so these first results are sort of telling us some of our models and ideas are wrong and need to be corrected," Bolton said "And we have some ideas of which way to go but it really takes some more data to really test whatever theories we put together and see if we're right." topical issues Any creative endeavour is in theory capable of being tokenised or “NFT’d” Record prices are being reached for the sale of non-fungible tokens (NFTs) Here we unravel some of the mystery surrounding NFTs and provide an insight into the intellectual property opportunities and pitfalls that a business should be aware of While we write from an English law perspective many of the considerations have a broader reach.   NFTs have been around since as early as 2012 They gained popularity in the crypto community in 2017 when a company started selling NFTs linked to unique digital cat cartoons known as CryptoKitties and people went crazy for these cute digital kitties.   More recently, as we explain elsewhere (see NFTs’ nifty copyright issues) record prices are being reached for NFTs linked to different underlying assets And why are they being sold for so much money NFTs are blockchain-based units of value or “tokens” with a unique ID linked to an underlying asset.  The most commonly used blockchain for an NFT is the Etherium blockchain but NFTs are also held on other blockchains.  NFTs are composed of software code in the form of a so-called "smart contract” It is the smart contract that contains details of the underlying digital or physical asset(s) to which the NFT relates and also the rules and rights that attach to the NFT (for example a rule that the original creator of the NFT gets paid a percentage of any subsequent resale value).  The value in an NFT is derived from it being “non-fungible” meaning that the token cannot be replaced with an identical token (giving its inherent scarcity) This is in contrast to the fungible nature of crypto-currency or government-issued fiat currency where each unit of the currency is identical in value and therefore interchangeable with each other unit of the currency.   The easiest way to understand an NFT is by using an analogy of a limited edition print of an artwork.  In the physical world an artist would sign the physical print and include a print number (for example The artist’s signature and the print number are not the artwork but a means of authenticating the artwork.    created) the NFT of Jack Dorsey’s first tweet:  Owning any digital content can be a financial investment and create a relationship between collector and creator the NFT itself is the creator's autograph on the obvious way that an NFT can be monetised is by selling it to a third party the reality of purchasing an NFT is often not as straightforward as purchasing a physical asset While the owner of an NFT can prove it owns the NFT it does not necessarily own anything more than that An NFT is essentially metadata about an asset which is added to a blockchain while an asset is used to encode the NFT to make a unique representation of that asset the NFT is not usually - unless there are terms to the contrary in the smart contract encoded in the NFT or in any associated terms of sale - the actual asset itself.   To continue the analogy of the limited edition print of an artwork - if a collector owns a physical limited edition print the collector would own the physical print itself but would not usually own any proprietary rights in the original artwork This is an important distinction which is being missed by much of the media coverage of NFTs Such coverage tends incorrectly to suggest that ownership of an NFT amounts to some form of ownership of the underlying asset.   it is worth considering Jack Dorsey’s tweet again Valuables characterise the purchase of an NFT as purchasing “an autographed certificate of the tweet” and make it clear in the terms of sale that any such purchase does not transfer the copyright in the tweet to the buyer.   even though the buyer of Jack Dorsey’s tweet spent millions of dollars on the NFT the buyer would not be able to use the tweet itself  (e.g by printing it on a shirt) without permission as the copyright is still owned by Twitter and Jack Dorsey Those buying an NFT should carefully consider what they are getting when they purchase an NFT as the ownership of an NFT does not automatically give rise to any ownership rights in the underlying asset.  An NFT seller (assuming the NFT seller is also the owner of any intellectual property rights in the underlying asset) can transfer those intellectual property rights to the buyer.   the intellectual property must be assigned in writing Without express written terms stating otherwise this will not happen automatically on sale of an NFT.   an NFT seller can sell both the NFT and the underlying asset together.  The NFT can then be used as a digital proof of ownership.  This raises two important considerations: 1) Ownership of the underlying asset  The purchaser of the NFT should check who owns the underlying asset the sale of the NFT does not include sale of the underlying asset or any intellectual property rights that vest in it (see Buyer Beware there are certain examples where an NFT is in fact to be sold together with the underlying asset One interesting example is Nike’s patent for a system called “CryptoKicks” where Nike could tokenise ownership of shoes by linking an NFT to a physical shoe This system reportedly allows designers/businesses to have control over their shoe design - for example by limiting the number of copies that can be produced With the prevalence of fake trainers on the market this provides an innovative way to combat counterfeiting It also has the benefit of offering a limited edition product engendering brand loyalty between brand owner and customer and helps keeps the business current and relevant this system has not yet been launched by Nike but it is an interesting concept to be aware of in the retail sector.  The general approach of selling blockchain tokens with the underlying assets has, however, been used for years in the financial services sector, with a number of financial institutions using blockchain technology to trade regulated security tokens, where transactions are recorded on a blockchain (see our publication, Anatomy of an NFT).   The purchaser of the NFT should also check who has possession of the underlying asset particularly where the underlying asset is a digital file - for example either by the digital work being encoded in the NFT (which is not very common) or by the NFT containing a code that links to the digital copy of the artwork (which is the more common).     the NFT will typically contain what is known as a “hash” of the digital file The hash is produced by applying a cryptographic mathematical function to a digital file to get an alpha-numeric string of characters which acts as a unique identifier of the original file.   The hash value is used to authenticate that the NFT relates to that digital file.  It is not possible to reverse engineer the digital file from the hash so the hash in the NFT does not give the purchaser of the NFT the ability to possess the digital file that the NFT relates to The purchaser will still separately need a copy of the digital file in addition to the NFT A more common approach is for an NFT seller and IP rights owner to license use of the intellectual property rights in the underlying asset to the purchaser of the NFT for certain purposes.   Such licence should be set out in the smart contract or in a separate agreement between the NFT seller and purchaser The purchaser’s use of the underlying asset can be as open or restrictive as the rights owner chooses.   the licence for CrytoKitties permits the owner of the NFT to commercialise the “kitty” provided that such commercial use does not result in earnings of more than US$100,000 per year.  In contrast the licence for NBA TopShots grants the owner of the “moments” a licence to “use but does not permit the owner to “reproduce or otherwise commercialise” the moment.   in the case of an NFT relating to a digital asset the licence may be limited just to the right to use or display the underlying digital asset for personal use and for the purposes of re-sale of the NFT NFTs open up a potential new revenue stream for asset owners as it is possible to code an NFT’s smart contact to make a royalty payment automatically to the original NFT seller on each onward sale of the NFT The royalties are normally paid as a percentage of the secondary purchase price and open up the possibility of infinite revenue streams.   This aspect of NFTs is of particular interest to digital content creators within the gaming sector where financial benefits to creators can incentivise game developers to record their ownership of in-game items and help to fuel in-game economies.   With all the opportunities that NFTs present for a business there is also the inevitable opportunity for misuse of a business’s or brand owner’s intellectual property rights held in any underlying asset through minting of unauthorised NFTs these issues have not been tested in an English court yet.   There are two main types of infringement that may arise as a result of the unauthorised minting of an NFT relating to a digital asset: if the NFT includes a digital copy of the asset there is potential for this to amount to an unauthorised reproduction that may amount to infringement of copyright in circumstances where there is no reproduction of the underlying asset in the creation of an NFT there is arguably no infringement.   the minting of an NFT linked to an underlying asset is arguably a different act from that of making the asset available in a new forum if the NFT does include a digital copy of the asset the act of minting the asset may well amount to a communication to a new public that was not envisaged by the copyright holder At the moment there appear to be more questions (and arguments on each side) than there are answers Where this lands will ultimately depend on the individual facts of each case and also any policy drivers that a court takes into account.   Trade mark infringement may arise where an unauthorised party mints an NFT linked to the underlying asset without the asset owner’s permission offers for sale and/or sells the NFT using the asset owner’s registered trade marks The key question to consider here is whether the business owns registered trade marks that cover NFTs or similar goods/services then there may be a relatively straightforward case for trade mark infringement under trade mark law – that is to say: even if the asset owner does not hold any trade marks for relevant goods/services this does not signal the end: it may be possible to argue that use of the same or similar mark for dissimilar goods takes unfair advantage of the reputation of the asset owner’s registered trade mark and therefore amounts to infringement.   we will need to wait and see what direction a court takes on this There are certain steps that a business can take to monitor and enforce its intellectual property rights.  These include: NFTs present numerous opportunities and potential risks for businesses Clear delineation of what is permitted and what is not with respect to IP rights should be set out in the terms of sale of the NFT and/or the smart contract encoded in the NFT which will best allow a business to control its IP as well as to monetise it There should also be appropriate oversight of use of a business’s IP by third parties (be that buyers of an NFT or third parties) and steps taken where appropriate Clearly there are many issues to navigate and ultimately how the law evolves remains to be A review of The Imperial Mode of Living: Everyday Life and the Ecological Crisis of Capitalism which sees capitalist development at the core of the global system as the result of the exploitation of the periphery Brand and Wissen attempt to enhance this theory’s understanding of the political ecology of exchange relations they analyse mass consumption in the Global North and argue that its hidden social and ecological costs are externalised and displaced to the Global South This idea of externalisation is also developed by Stephan Lessenich in his Living Well at Others′ Expense: The Hidden Costs of Western Prosperity Brand and Wissen aim less at criticising individual consumption and more at the global capitalist structures in which individuals are embedded overcoming capitalism internationally is the only solution to the ecological crisis Since the book was first published, the notion of the imperial mode of living has been discussed at several international conferences.3 Among its proponents are Marxists such as Marcel van der Linden and John Smith.4 However professors in Vienna and Berlin respectively aim at a broader political audience; in Germany their ideas met with the approval of activists from the Fridays for Future climate campaign and key figures in the left-wing Die Linke party The imperial mode of living is an attractive concept because it tries to explain the seeming passivity of the working class in the Global North—where workers supposedly consume greatly and live a good life—in the face of the climate crisis and it brings into focus the suffering of the Global South it leads to a combination of various political activities: autonomous political practices the construction of left governments and individual self-reflection Brand and Wissen promise an alternative to sometimes tiresome and difficult revolutionary class politics We think that The Imperial Mode of Living is an important contribution to the debate on the climate crisis but we do not share its premisses and political implications we will first discuss class and consumption and then North-South relations and the role of geopolitics we will address Brand and Wissen’s thoughts on strategy The first problem with this view is that it runs the risk of generalising what Stefanie Hürtgen calls a “middle-class imagined average existence” that fails to accurately reflect common living conditions in the Global North, either after the Second World War or today.9 despite consumerism being more widespread there Mike Davis describes how considerable inequalities continued to pervade the “golden age” of US capitalism: Perhaps a quarter of the US population—especially white, semi-skilled workers and their families—were raised to previously middle-class or skilled-worker thresholds of home ownership and credit purchase during the 1950s. Another quarter to third, however, including most black people and all agricultural laborers, remained outside the boom, constituting that “other America” that rebelled in the 1960s.14 Brand and Wissen are seemingly aware that “capitalist accumulation always contains production and consumption”.21 Yet they avoid saying to what extent both parts are needed in the more theoretical parts of their book Their empirical analysis suggests that consumption is more important to their conception of the imperial mode of living to assume accumulation is really driven by the desires of individuals means accepting unnecessary neoclassical premises The view promoted by most Marxist political economists The capitalist is interested in the product’s use-value only inasmuch as it has (or rather, is) an exchange-value. In its turn, exchange-value is important for the capitalists only inasmuch as they can realise a profit.22 Brand and Wissen focus on the phenomenon of mass consumption which only appears to be the most pressing issue because they isolate exchange relations from the social relations of production and class Once these latter two are re-established as part of a social totality the importance of mass consumption as a discrete phenomenon disappears and the supposedly common mode of living of people in the Global North What sets Brand and Wissen apart from neoclassical economists and those on the left who criticise individual consumption is merely the introduction of ideas about ideology which actually raise more questions than they answer Similar problems are at work in their analysis of China. As demonstrated by the BRICS (Brazil, Russia, India, China, South Africa) bloc of developing economies, capitalist development is viewed as coupled with adopting the imperial mode of living. China is “the new global centre of capital accumulation” and “an outstanding example of capitalist expansion and appropriation”.28 Nonetheless Brand and Wissen do not mention how China’s rise—bringing capital accumulation militarisation and ecological destruction with it—has been driven by international dynamics international competition is mostly treated as an outward determinant and thus China only collides with other states after being dependent on externalisation: The more the Global South becomes industrialised or intensifies the neo-extractivist development model, the greater the number of countries that themselves begin to rely on the externalisation of their socio-ecological costs, thus competing with the Global North both economically and ecologically.29 it remains unclear what exactly competition means in this context Geopolitics appears to be reduced to economics with the overall aim being to maintain the class compromise at home if all classes in the Global North and the BRICS countries tend to benefit from the imperial mode of living Brand and Wissen seem to be implying that imperialist conflicts are between nations as a whole and not between ruling classes integrated into the imperial mode of living would have something to lose from the defeat of “their” country in inter-imperialist struggles Explaining the link between the imperial mode of living and dependency We have already highlighted that Brand and Wissen’s analysis of the Global North ignores the relations of production and considers class hardly relevant at all both their conception of mass consumption and their claim that Global North and South living conditions are inversely related is called into question the majority of the world population is part of the international working class; global capitalism is more complex than a zero sum game in which the losses of one half of the world system are the gains of the others people in peripheral countries also have access to cheaply produced goods; Egyptian workers living in slums in Cairo do indeed buy clothes imported from China according to the theories associated with the imperial mode of living these workers also live at the expense of others and must have an interest in maintaining the “imperial” order Brand and Wissen fail to offer a convincing mechanism that explains how living conditions of the popular classes in the Global North directly result from exploiting the Global South overall living standards have improved but inequality has increased are key to understanding the impact of climate change Capitalists are responsible for the crisis and can benefit from intensifying conflicts but it is workers and the lower classes that suffer imperialism has also actively contributed to the inability of most parts of the Global South to create the conditions for long-term investments and to assert themselves politically This does not mean that neoliberalism and wars could be derived from the immediate interests of capital fractions for cheap inputs Both are more about grand strategy and geopolitics even though they are ignored throughout the work of Brand and Wissen neoliberal structural adjustment in Africa sustains the liberal world order Political threats such as Nasserism and Pan-Africanism were successfully eliminated and durably replaced by authoritarian pro-West regimes capital is still hesitant when it comes to exploiting the African labour force and none of the dictatorships have been forced to contain the widespread cronyism that ensures some stability but contradicts the logic of neoliberalism Similar ideas are widespread among the radical left in the Global North and it is certainly a strength of Brand and Wissen that they consider it imperative to overcome capitalism internationally their strategy abandons revolutionary class politics and the self-activity of the working class on unjustified grounds in partial contrast to Horkheimer and Adorno Brand and Wissen see overcoming capitalism as feasible and desirable where does the power of the majority of the people to do so come from Certain passages imply that money might play an import role: While some people can avoid this mode of living by buying regional or seasonal products, others only have a limited ability to act, especially when it comes to the organisation of their daily work live, the things they consume or the social relations in which they live.61 Brand and Wissen recognise that this path is currently not open to the majority and that it reproduces capitalism. Most parts of the book suggest instead that power lies in great numbers: a diverse crowd of people who are self-reflectively engaged in radical politics.
