PARIS – French President Emmanuel Macron on Saturday denounced the killing of dozens of Algerians during a police crackdown on protests in Paris 60 years ago as “inexcusable” crimes

The sailor convicted of sexual assault and who faces four years in prison has asked the island's high court to order a new sentencing hearing because he didn’t have an opportunity to address the court during the last one
Supreme Court of Guam justices on Tuesday hearing oral arguments in the appeal by Quinton Bezon

Bezon was sentenced to four years incarceration in July 2017
After a night of drinking with a group of mutual friends in October 2015
Bezon fell asleep in a bed at a Tumon hotel next to a woman who he didn’t know before that night
Other people in the group had also fallen asleep in different areas of the hotel room
The woman woke up to Bezon sexually assaulting her and later that morning she was dropped home and told her wife
They went to the police and reported Bezon
At the time he was charged Bezon had been stationed in Guam, assigned to the USS Frank Cable
Not given the chance to speakBezon was convicted of third-degree criminal sexual conduct and fourth-degree criminal sexual conduct
The only person who spoke during his sentencing was his victim
Bezon’s attorneys in his appeal include Trapp and attorney Joseph Razzano
Bezon’s attorneys state Bezon was not given the chance to speak and address the court during sentencing
They asked the court to remand the case and order a new sentence
Bezon was afforded no opportunity to personally address the court and even though he may have given a statement in the (pre-sentence investigation report)
this does not fulfill the mandate imposed by (the law),” the appeal brief stated
Trapp and Razzano cited a Guam law that states before the court hands down its sentence
the judge is to let the defense lawyer speak on behalf of the defendant and the judge is to address the defendant personally and ask if he wishes to make a statement and give any information
The attorneys said Bezon’s substantial rights were affected by the trial court’s error in not asking the Bezon if he wished to make a statement
The Office of the Attorney General stated in its briefs that Bezon made statements in the pre-sentence investigation report and they believe his substantial rights were not affected
“Here Bezon was able to express himself to the trial court in a previous statement although he did not do so orally at sentencing
the error did not ‘implicate core values in the sentencing proceeding,’” the AG’s office stated in its brief
The AG’s office stated they think a reversal isn’t required
However the AG’s office agreed with Bezon’s attorney that
should the Supreme Court of Guam decide on a reversal
the high court should remand the case for resentencing
The AG’s office said the high court shouldn’t reverse Bezon’s convictions

Bordallo then sentenced Bezon to four years but suspended two of those years
This essentially meant Bezon was re-sentenced to two years.

Quinton Bezon waits to appear before Judge Michael Bordallo on Aug
The Supreme Court of Guam has ordered the resentencing of a man convicted of sexually assaulting a woman in July 2015
Quinton Bezon was sentenced to four years in prison in July 2017 after a jury found him guilty of third- and fourth-degree criminal sexual conduct
He also was ordered to pay $2,000 in court fines
The high court affirmed the conviction but reversed Bezon's sentence and remanded him for resentencing
Bezon appealed at the Supreme Court under the argument that the Superior Court of Guam did not allow him to make a statement during sentencing
He also took to social media, garnering about 1,000 signatures in an online petition for retrial and continued to maintain his innocence shortly after sentencing
Bezon did issue a written statement maintaining his innocence in a presentence investigation report
but his lawyer said he regretted some statements made in the report
The Supreme Court also ordered additional briefings on whether Bezon's attorney during his trial violated Bezon's Sixth Amendment right to make his own defense by "telling the jury that Bezon had had consensual sexual intercourse with the victim
even though Bezon insisted that he and the victim had not had sexual intercourse."
Chief Justice Katherine Maraman authored the Supreme Court's opinion in the case
The justices determined that Bezon's trial lawyer did not violate his client's Sixth Amendment rights
"Any alleged disagreement between Bezon and his trial counsel was simply over the best course to attempt to avoid conviction
the court ruled that trial counsel did not violate Bezon's right to autonomy in allegedly conceding that Bezon had had sexual intercourse with the victim," the opinion stated
the Supreme Court did determine that the trial court committed error in not providing Bezon an opportunity for allocution

RESTRICTIONS ON UNLAWFUL possession of benzodiazepines and ‘z-drugs’ have been tightened in Ireland
New rules under the Misuse of Drugs Act came into effect yesterday and mean there are now stricter prescribing procedures for certain medications
told TheJournal.ie: “We know that when changes such as these are implemented there is always the potential for unintended consequences
if there is a temporary drought in benzodiazepine and z-type drugs
The market will respond and we must also be ready to respond quickly to any new risky drug trend that may emerge
“We look forward to a time when legislation is introduced to respond to drug use as a health issue rather than a criminal justice issue
That time is not far off – there is a lot of empathy in Ireland for people who use drugs,” Duffin said
