The supplier had recorded long-term contract cost increases of +26% for propylene, +13% for methanol and +78% for sulphur compared to the year prior. After a thorough evaluation, the company, a subsidiary of China National BlueStar, announced today that it has determined that restoring the plant is no longer viable. A voluntary redundancy plan, encompassing 47 positions, from a total workforce of 335, is anticipated to take effect from April 2024. That plan will be accompanied by negotiations for a robust job protection plan with trade unions, added the animal nutrition player. The Commentry plant represented more than 10% of European methionine capacity, noted Kemiex in 2022. Adisseo stressed that the closing of the Dl-methionine unit at Commentry is designed to fortify the competitiveness of its production activities on a European scale. Efforts to centralize its production of that amino acid at Roches-Roussillon are aimed at safeguarding competitiveness amid an evolving and competitive landscape, it continued. rules about comments at public meetings are unconstitutionally vague or that the city engaged in unlawful viewpoint and content discrimination against him Federal Judge Julie Robinson in an order this week using Justin Spiehs’ self-identification as “the most infamous and outspoken public speaker,” dismissed those claims from Spiehs’ lawsuit against the city and two of its former mayors but she has allowed other claims to move forward including Spiehs’ contention that the city retaliated against him and denied him equal protection Robinson also declined to dismiss former mayors Lisa Larsen and Courtney Shipley as defendants based on their claims of qualified immunity As the Journal-World has reported Spiehs’ lawsuit against the city stems from a series of City Commission meetings in 2022 and 2023 in which Spiehs offered public comment that was deemed disruptive and not germane to the city’s business who frequently swears at public officials and calls them insulting names like “Nazi,” “idiot,” “child abuser” and “mother(f-word),” was removed from the meeting after ignoring warnings from the mayor Spiehs has contended that the city’s “germane” standard for public comment is unconstitutional because it is vague and depends too much on discretionary or arbitrary enforcement He also has challenged the city’s “decorum” standard which prohibits disruptive behavior and slanderous speech The city has argued that those standards are not impermissibly vague because they can be understood by people of ordinary intelligence The city also argued that discretion in enforcing a rule does not render it unconstitutionally vague and the court agreed on both counts in dismissing Spiehs’ claims Spiehs also argued that even if the city’s rules are constitutional on their face they were enforced against him in a discriminatory manner “Defendants’ motion to dismiss Plaintiff’s as-applied claim based on content- and viewpoint-discrimination is granted,” Robinson wrote The judge also threw out Spiehs’ claims that the city violated his free speech rights by preventing him from clapping for other speakers based on his viewpoint Robinson said that Spiehs offered no facts to support that claim Attendees at City Commission meetings are regularly requested to refrain from clapping argued that in prohibiting clapping the city was “compelling” him to thereby express disapproval allowed other claims by Spiehs to proceed to further stages of litigation including his claim that a City Commission meeting is a “designated public forum” and not a “limited public forum” as the city has argued The government’s right to restrict speech in a designated public forum is more strictly limited and scrutinized than its right to do so in a limited public forum Robinson notes in her ruling that it’s an open question of law which category city meetings fall into and allowed the litigation to proceed on that basis She also allowed to proceed Spiehs’ claim that the city retaliated against him because removal from a city meeting could have a chilling effect on a person’s willingness to engage in protected activity Plaintiff need not conclusively prove that the removals would chill speech Plaintiff need only allege sufficient facts to demonstrate entitlement to present evidence on his claim,” Robinson wrote As to qualified immunity for Larsen and Shipley Robinson wrote that neither was entitled to that “at this stage of the litigation.” She noted that the former mayors’ broad assertion of qualified immunity was not sufficient and that they would be required to separately address Spiehs’ specific allegations of violating his rights must be able to conduct “individualized analyses for each Defendant to determine whether either of them is entitled to qualified immunity.” Regarding Spiehs’ claim that his equal protection rights were violated by the city Robinson let the matter move forward because she said the city failed to address the claim in its motion to dismiss Spiehs has also filed federal lawsuits against Douglas County commissioners the Douglas County sheriff and county clerk the Lawrence school district and school board members and the Lawrence Public Library for alleged violations of his First Amendment rights Spiehs frequently protested mask requirements during the pandemic and has been convicted of criminal charges in Douglas County for an incident that took place at one of his protests he was protesting at a coronavirus vaccine clinic at West Middle School and allegedly confronted a man and his 9-year-old son Spiehs was accused of tearing the paper off of his protest sign shouting at the man and child and threatening them with the large stick that the sign was attached to He was originally charged with two felony counts of aggravated assault and one count of interference with a law enforcement officer but in 2022 he entered a plea agreement and was instead convicted of two misdemeanors Spiehs, displaying a sign that read in part “(f-word) these liberal mother(f-word),” was also arrested at a Douglas County Commission meeting in April 2022 He had filed as a Republican candidate for County Commission that year Spiehs did not face charges in that incident Spiehs appeared at the Douglas County Commission meeting with a sign calling a commissioner an obscene name and berated the commissioner in obscene language for a full three minutes regarding an issue that took place outside of a commission meeting Though she had read a statement saying that the commission reserved the right to remove any speaker This means that the real winner of each days debate is- you guessed it- up for debate Now people can argue about people arguing about sports and it turns out that people love it For the next two hours Skip and Stephen A would act as opposing legal minds in the debate over Geno Smith got punched in his jaw After they cut to there first break I got some side-eyes from the production staff for applauding but you could tell Skip was happy to have a greatfull audence for a change I was also thinking that if there would be anyplace in America that my ESPN phone would still work it would be in this very studio like when the UFO in Judgement day turned back on when it got all close to the mothership but that actualy didn't happen Being up close to two master tacticans like Skip and Stephen A allowed me to gain a greater understanding of there strategies They have two very different styles of screaming at each other that fit in perfectly within the contex of the show- nicest way possible but Stephen A Smiths rhetorical style reminds me alot of Adolf Hitler One of the Germen Chancellors favorite things to do was to start a sentence in front of a big crowd using very muted What this does is force the audeince to lean in just a bit and focus there listening on what your saying after you've got everyones attenton you gradually build and build and build until you could be screaming about whatever the hell you want whether its the foreign banking cartel or Carmelo Anthony and everyone will be drawn in and almost force to agree with you Its almost like listening to "Stairway to Heaven." New Book Details An Extensive Campaign By The Networks' PR Staffers Written by Ben Dimiero NPR media reporter David Folkenflik writes in his forthcoming book Murdoch's World that Fox News' public relations staffers used an elaborate series of dummy accounts to fill the comments sections of critical blog posts with pro-Fox arguments In a chapter focusing on how Fox utilized its notoriously ruthless public relations department in the mid-to-late 00's, Folkenflik reports that Fox's PR staffers would “post pro-Fox rants” in the comments sections of “negative and even neutral” blog posts written about the network the staffers used various tactics to cover their tracks including setting up wireless broadband connections that “could not be traced back” to the network.  A former staffer told Folkenflik that they had personally used “one hundred” fake accounts to plant Fox-friendly commentary: Fox PR staffers were expected to counter not just negative and even neutral blog postings but the anti-Fox comments beneath them One former staffer recalled using twenty different aliases to post pro-Fox rants Several employees had to acquire a cell phone thumb drive to provide a wireless broadband connection that could not be traced back to a Fox News or News Corp account even in the age of widespread broadband access on the rationale it would be harder to pinpoint its origins Old laptops were distributed for these cyber operations Even blogs with minor followings were reviewed to ensure no claim went unchecked Folkenflik explains that “four former Fox News employees told me of these practices.” It's unclear whether these tactics are ongoing.
