A Dairy Queen in Embrun has been fined $40,000 in connection with a workplace accident suffered by a 16-year-old employee whose hair was ensnarled by the spindle of the store’s Blizzard machine

The teenager suffered a serious neck injury
was hospitalized for two weeks and was forced to take online courses for a semester while she recovered with the help of neck brace
the Court of Appeal for Ontario varied the original sentence in the case and imposed a fine more than five times larger than the initial one issued by a justice of the peace under the Occupational Health and Safety Act (OHSA)

“This court has recognized that in order to achieve specific and general deterrence
the amount of a fine imposed on a corporate defendant must be sufficient that the fine will be ‘felt’ by the corporation and not merely a ‘slap on the wrist,’” the appeal court said
a high school student employed at the Embrun Dairy Queen was in the process of using the Blizzard machine when she was confused by something on the restaurant’s order board
She took her foot off the Blizzard machine’s pedal
and turned to ask a co-worker a question when her long hair caught in its spindle
but her foot accidentally tapped the pedal
powering the machine again and wrenching more of her hair around the spindle
she then heard “a loud cracking sound” in her neck
The young employee was stuck in the machine for seven minutes until the shift leader managed to untangle her hair from the spindle
the protective guard had been removed by the shift leader in contravention of the OHSA
for some employees to remove the guard in order to save time
particularly during the store’s busiest periods
The 16-year-old had once asked why some employees used the plastic guard and some didn’t
and was told by her boss that it was not required
The employee received no specific training about how to safely operate the machine or about occupational health and safety awareness in general
Dairy Queen had an employee handbook that addressed the machine guard system and other health and safety issues
but the employee did not receive a copy of it
The injured employee took physiotherapy for a year-and-a-half
but continued to suffer long-term effects from the incident
The Embrun Dairy Queen was charged under the province’s health and safety act with failing to ensure the employee’s hair was suitably confined and with failing to ensure the machine’s spindle was guarded
The initial trial lasted two days with a significant portion of evidence submitted through an agreed statement of facts
a justice of the peace found the Dairy Queen guilty of failing to ensure the machine was guarded
The Crown appealed the sentence to the Ontario Court of Justice
and then to the Court of Appeal for Ontario
The province’s highest court said the lower courts failed to properly consider the size and economic scope of the corporate defendant
The company operated seven Dairy Queen stores with the equivalent of 84 full-time employees

Stage 19 of the 2024 Tour de France ascends into the lofty heights of the Alps
The three climbs of this 144.6-kilometer stage from Embrun to Isola 2000 all rise above 2,000 meters
making the “thin air” an additional challenge for the riders
The highlight of this toughest Alpine stage is the Cime de la Bonnette
the battle for the Yellow Jersey will likely culminate on the final climb to the Isola 2000 ski resort
Over half of the day will be spent climbing as the riders make their way from Embrun to the mountain finish at Isola 2000
The 144.6-kilometer stage includes three major climbs
all of which reach over 2,000 meters in altitude
with the first sprint point located in Guillestre at kilometer 21.1 on undulating terrain
the road ascends to the first climb of the day
The Col de Vars is an 18.8-kilometer Hors Categorie climb with an average gradient of 5.7 percent
and there is a short descent before the incline increases to six to eight percent
the riders descend for 20 kilometers to the small town of Jausiers
At the base of the next Hors Categorie climb
they will begin the seemingly endless ascent over the Col de la Bonnette Restefond (2,703 meters) to 2,802 meters
where they will do a “loop” on the Cime de la Bonnette – the highest paved road in France
The climb is 22.9 kilometers long with an average gradient of 6.9 percent
including three steeper sections with gradients over nine percent
The last of these ramps is between Col de la Bonnette Restefond and Cime de la Bonnette
Whether the riders will enjoy the 360-degree panorama at nearly 3,000 meters or be focused on more pressing matters remains to be seen
the road descends for 40 kilometers to Isola (904 meters)
the final climb to the Isola 2000 ski resort begins
This climb is 16.1 kilometers long with an average gradient of 7.1 percent
The first part of the climb includes particularly steep ramps
Will Stage 19 bring another showdown for the Yellow Jersey

or will Remco Evenepoel (Soudal-Quick Step) seize the opportunity

His body’s “altitude memory” has surely improved over the past year
he showed no signs of weakness on climbs over 2,000 meters
Few would have bet on that at the start of the Tour
and it’s uncertain what form Vingegaard is in or who still has the power to challenge the Yellow Jersey
but whether it will succeed is up in the air
but going in a breakaway three days in a row might be too much even for the Ecuadorian Olympic champion
has his own view on Stage 19: “We will think defensively first and then see how the legs feel on the last climb
But we have to be prepared for something; it is the Queen stage
We will see fireworks and maybe some changes in the standings.”

Ontario Provincial Police are seeking public assistance to locate an alleged repeat gasoline thief in the town of Embrun
Police say in a release they were called Thursday afternoon for a report of a theft of gas at a station in the town about 45 kilometres southeast of Ottawa
Employees told police that when they attempted to confront the person
he intentionally “drove at them with his vehicle.”
“This is the fourth time the person has stolen gas in the past two weeks,” police said
The person of interest is described as an older Caucasian male
The vehicle was described as a silver Dodge Caravan with no front plate
large dents along the passenger side and Ontario dealer plate 093 DSV
The plate had been previously reported to the Ministry of Transportation as missing
Anyone who knows the person’s identity or has other information on the case is asked to contact the Russell County OPP at 613-443-4499 or the OPP Communication Centre at 1-888-310-1122

The Township of Russell released a statement letting residents know that they have been made aware of the “inappropriate behaviour” and that although the individuals were registered in the parade
“their actions were not approved by the parade organizers
and do not reflect the values of our community.”

Lapalme confesses that her love for food and making a variety of dishes for her customers – often from family recipes like her mother’s shepherd’s pie – is satisfying

which was “common practice” for some employees and shift leaders
During one of the high school student’s early shifts
she was told by one of her shift leaders that she was not required to use the guard
She said to have not received training about machine guarding or about occupational health and safety awareness in general
but the student said she did not receive a copy
nor did she see the operator’s manual for the machine
The accident caused the teenager to be hospitalized for two weeks
she says she still suffers long-term effects such as numbness
headaches and certain limitations on her usual activities
the Dairy Queen was charged with failing to ensure the employee’s hair was confined and failing to ensure the machine was guarded
the Court of Appeal revisited a decision made
The initial argument made was that the restaurant “must be considered at the local level when the offence is a local offence” which places the fine range from $5,000 to $10,000
The justice of the peace sentenced a fine for $7,500
the appeal court pointed out that the judgement “erred in law in restricting its consideration of the size of the corporation to the location operation” and should instead fall under the fine range from $40,000 to $90,000
a fine of $40,000 plus a victim fine surcharge “is appropriate in the circumstances of this case to achieve the relevant sentencing objectives.”
Both the Embrun Dairy Queen franchise as well as the PR firm that represents Dairy Queen chose not to comment for this story

Both individuals entered the store and browsed the merchandise
The male left and the female grabbed a box containing the saw and left the store without attempting to pay
a female matching the description of the hardware store suspect entered an Embrun grocery store
filled a beige bag with meat products and left without paying
A loss prevention officer attempted to stop her
As she punched and kicked the loss prevention officer
an unknown male intervened and the two suspects escaped
Police have provided a description of the two suspects seen to be driving a newer model black four door Chevrolet Malibu
adding that they believe the two individuals are also involved in similar incidents in North Grenville and Pembroke
The male from the hardware store is described as white with a slim build
He is clean shaven with black hair styled with a fade
Security camera images show he has a tattoo on the back of his right hand and left arm
The female in question is described as white with a medium build and blonde hair
During the theft at the hardware store she was wearing a black tank top
She has a tattoo on her upper back and right forearm ending above the elbow
she had her hair up with a red crop top and black pants

Russell Township Fire Services hosted the Ontario Fire Marshal’s Office (OFM) Mobile Live Fire Training Unit (MLFTU) at Station 11 in Embrun last week
giving local firefighters a new set of skills for keeping the community safe
The MLFTU is a propane-fueled live-fire simulator
The simulator is designed to build on crucial firefighting skills
the mobile training unit moves from municipality to municipality to ensure accessible training throughout the 441 fire stations across Ontario
with adjustable walls and configurations to simulate various scenarios
The goal is to give firefighters the ability to train at home with familiar equipment and team members
the firefighters on Station 11 and 12 were able to run multiple simulations over the course of the week
it’s the best way to get training in your backyard for your firefighters,” said Fire Chief Brian McBain
but I can’t send 50 firefighters over there at the same time
And we need people to stay and take care of the trucks if they need to leave
Having this simulator in Embrun for a week allowed other fire departments to attend the same training
Ottawa and South Glengarry Fire Departments took part over the week
Equipped with an on-board generator and a supply of gas cylinders
the MLFTU can operate without external supplies
The second story of the training unit can be hydraulically raised during operation and lowered for transport
firefighters are placed in front of real flames
This allows them to train for an emergency as realistically as possible while being monitored in case of an emergency
the MLFTU is designed for safety during training
Safety devices are installed within the unit to monitor gas and temperature in accordance with the National Fire Protection Association and Canadian Standards Association codes and guidelines
If the limits set in place are exceeded or the emergency cut-off switch is operated

Station 11 and 12 must apply this year in the hopes of obtaining one of the two available units in 2025

Police responded to a call at approximately 2:15 p.m
Employees told officers that when they attempted to confront the suspect
he intentionally drove his vehicle toward them
This marks the fourth reported gas theft involving the same individual in the past two weeks
The suspect is described as an older Caucasian man with grey hair and glasses
The vehicle involved is a silver Dodge Caravan with no front plate
and an Ontario dealer plate with the number 093 DSV
The plate had been reported missing to the Ministry of Transportation

The Ontario Ministry of Education has approved $11.3 million in funding for an expansion at Cambridge Public School
a project that will add 427 new pupil spaces to accommodate the region’s growing student population
The Upper Canada District School Board (UCDSB) confirmed the funding approval this week
announcing that the expansion will include five new kindergarten classrooms
and a dedicated space for special education programs and support
The project also includes upgrades to the school’s parking area
UCDSB Trustee Corina Parisien welcomed the funding announcement
emphasizing the importance of the expansion for the Embrun community
and we are looking forward to providing a larger and enhanced learning environment for students and families,” Parisien said
I know they are going to be just as thrilled about this news as we are.”
UCDSB Chair Jamie Schoular echoed that sentiment
thanking the provincial government and local MPP Stéphane Sarrazin for their support
“This $11.3 million expansion will provide much-needed learning spaces and resources

A media release said officers from the OPP’s Russell County detachment were called to Notre Dame Street
after a man was reported to be walking around armed with a large knife and behaving threateningly
Officers arrested the man without incident
The release said the officers made other unsuccessful attempts to subdue the dog

an officer made the decision to utilize their firearm to put the dog down.”
No serious injuries were reported by individuals in the area

Armstrong believes that the key element to his candidacy
“I think that the current councillors came in with ‘let’s get the Recreation Complex done’
There’s construction going on there today on the site
But there was very little else beyond that
This is where we have to look at now,” he said
Armstrong acknowledges that although it’s a midterm
“That’s a legally mandated process in the Planning Act
That’s going to be done in the very short term
it’s now time to influence the old Council.”
Armstrong’s priorities are to help with affordable housing
with the issue of water and sewer capacity
and the transportation system – in other words

Armstrong acknowledges that affordable housing is not the municipality’s priority as it is under the United Counties of Prescott and Russell (UCPR)
“But that doesn’t mean we don’t have anything that we can’t do
which is our council representative on the County’s council,” he adds
Concerning the issue of the water and sewer capacity
Armstrong said its probably the biggest and most expensive issue he’s looking to tackle
He refers to the Water & Wastewater Master Plan Update published May 8
as the cost about $19 million for the two sewage lagoons for the next less than 10 years
but the one which worries Armstrong the most
is the trucks travelling through the villages
all of the available truck routes travel through the village of Russell
That means that we’ve got the five schools that have all of these students mixed with heavy trucks making those turns through the village of Russell,” said Armstrong
It’s something he plans to look at carefully as he feels the village must do more to ensure the safety of students and other

The event kicked off Pride month with speakers
Russell’s first flag raising ceremony began in 2021 when Richard Thain
the now co-organizer of the Russell Township Pride Flag Raising Committee
noticed there was no pride flag at the Township of Russell city hall during the month of June
because I know some communities fly a rainbow flag

The meeting also saw $500 bursaries awarded to Bruce Porteous and Philippe Denis Vignola
The bursary recognizes post-secondary students who are passionate about the dairy industry and are committed to the future of agriculture in Ontario

The Embrun Panthers suffered a loss against the Ottawa Junior Canadians on Friday
but bounced back with a win against the Athens Aeros on Sunday
both teams managed to score two goals each
but Marc-Antoine Petrut (assisted by Yanick Blanchard) quickly equalized for the Panthers just three and a half minutes into the period
Xavier Boulanger (assisted by Liam Murdoch and Petrut) gave the Panthers their second goal
the Junior Canadians tied the game less than a minute later
Boulanger (Blanchard and Ryan Pomerleau) reclaimed the lead for the Panthers less than two minutes in
only for the Junior Canadians to tie it again
Cameron Grant (Blanchard and Justin Raymond) scored a fourth goal for the Panthers at 13:07
but the Junior Canadians responded once more
the Panthers faced the Aeros and came out victorious with a 4-3 win
but the Panthers tied the game with a goal by Jackson Hamelin (assisted by Ryan Pomerleau and Cameron Grant) at 19:45
Hamelin (Murdoch) struck again just 31 seconds into the second period
but the Panthers regained the lead with a goal by Murdoch (Simon Lemieux and Blanchard) at 16:12
The Aeros managed to tie the game again in the third period
the Panthers secured the win on their third attempt
The Panthers remain in fourth place in the Martin Division with a record of 19-14-3-2
now trailing the Ottawa Junior Canadians by four points
Their next match is against the Arnprior Packers on Friday
followed by a game against the Glengarry Brigades on Saturday

is Russell Township’s latest councillor following the Monday
the unofficial vote count stood at 1278 for Armstrong
789 for Julian Hunt and 772 for Jevon Rudder
of the 16,407 eligible voters came out to cast their ballots
who voted for a change in the focus of the Township — from a recreation complex project to the significant challenges related to future development of the municipality,’’ said Armstrong
through much consultation with the public.’’
Armstrong presented himself as a candidate focusing on transparency in procedures and updating the municipality’s infrastructure
looking at how to ensure community safety in regard to the heavy trucks travelling through Russell and Embrun
He voiced concern over the effectiveness of more punitive traffic control measures like speed cameras
stating that reduced speeding and increased safety is the goal
‘‘The Township is facing significant challenges related urban growth
including safe roads and managing our wastewater
I am looking forward to addressing these major concerns in the upcoming Official Plan review and the initiation of a wastewater treatment project,’’ said Armstrong
The by-election was held due to the resignation of former Mayor Pierre Leroux after 14 years as serving Russell Township council
Councillor Mike Tarnowski was nominated as Mayor following the resignation
leaving his councillor seat open for an election
Leroux currently serves as the Chief Administrative Officer of neighbouring municipality The Nation
His inaugural council meeting will be on Oct
