Hungary’s top court on Friday struck down several provisions of the law that regulates the ownership and operation of Hungarian castles
The 2023 law establishes significantly lighter regulations for some of the specially protected property than the 2011 law on national assets
and rules on the transfer of such property “do not correspond to the provisions of the Fundamental Law”
The court said legislators must take the interest of the state related to the protection of national assets into consideration and ensure transparent management
It added that the public interest should be taken into account when national property is transferred to a private entity and should be made use of in the spirit of a national property
which assets may fall under the scope of the regulation
and who may obtain the right to acquire them
tenders related to property acquisition should be made public
the new law allowed lighter regulation for specially protected assets
The court sent back the legislation to MPs for reconsideration

A new bill allows construction and transport minister János Lázár to distribute the state’s castles
Lázár’s ministry may give the ownership or asset management rights of the monuments concerned to natural and legal persons
including even private individuals for free
Pécel and Iszkaszentgyörgy in their article
Lázár defended his idea by saying the Hungarian state is not a good owner
Only private or church owners can take care of those assets
The bill appeared on the ministry’s website, and the report stage ended on 2 June. If the parliament accepts it (and Lázár’s Fidesz had a supermajority in the Hungarian legislation)
all state-owned castles can be privatised this summer
companies or churches) will be allowed to submit a plea to the minister for the castles’ ownership or asset management rights
everybody can get a castle who can maintain it
If the asset management right owner breaks the contract
dies without an heir or ceases operation without a successor
the bill’s first draft had an annex listing the castles concerned
The new version does not include that document
There are 50 castles under Lázár’s ministry
the new owners will not have to open the castle buildings to the public
The castle has to remain open only if it hosts a public collection
That means there will be some castles with new owners who get that right for free
But they will not have to allow any visitors
That means they may use the property as their own castle
Válasz Online wrote that it would depend on deals between the new owner(s) and János Lázár who will get a castle and under what conditions
they can rewrite each law and modify the aforementioned conditions

That asset is not concerned in the new “program” because it is no longer under Lázár’s ministery but belongs to the local government of Szabolcs-Szatmár-Bereg County
The opposition Momentum Movement is turning to the European Union’s anti-graft body (OLAF)
asking for measures to stop the sale of state-owned
revamped Hungarian castles to private buyers
Momentum earlier organised a series of petitions and demonstrations to save castles nationwide
Those buildings should be kept and operated by the state
Dávid Bedő
Momentum’s deputy parliamentary group leader
noted that 12 castles had been reconstructed using EU funds as well as government support
The EU contracts for such funding bar the government from privatising the buildings in question
and so Momentum is asking OLAF to review the draft legislation and “help us prevent this marauders’ privatisation,” he said
We wrote about the new bill that would make buying castles easier for private individuals HERE
So Fidesz has been using EU money and the money of Hungarian taxpayers to refurbish castles not for the public but for themselves after the government sells the castles for peanuts to Fidesz elite members
The EU was fraudulently led to believe it was funding projects for the benefit of the public not to Fidesz oligarchs
Corruption doesn’t get much worse than this
