The forging of parts of the reactor pressure vessel for unit six of Hungary's Paks nuclear power plant - the second unit of the Paks II project - has begun in Russia
Workers at the AEM-Spetsstal plant in St Petersburg - part of Rosatom's Machine-Building Division - have begun forging a batch of blanks with a total weight of about 600 tonnes
from which elements of the reactor vessel will be produced
The rings that make up the reactor vessel and the bottom of the vessel are formed under a pressure of about 12,000 tonnes during forging
After the blanks have been given the required shape
the parts will be transferred to another part of the plant for mechanical processing
The finished weight of the equipment will be nearly 330 tonnes
and its maximum wall thickness will be 285 millimeters
"We have started work on manufacturing the 'heart' of the nuclear power plant - a generation III+ reactor - for another power unit in Hungary," said Igor Kotov

"Russian metallurgists and machine builders have reached high rates of equipment production for the Paks II NPP
blanks for reactors of power units 5 and 6 are in production
and in the future we will begin manufacturing steam generators
safety system tanks and other products of the first circuit of the nuclear island of the plant
as well as the turbine hall. In order to ensure timely and high-quality production of NPP equipment

Columbia University’s Ryan Pak is doing something nearly unheard of at the Division I level: competing as both a swimmer and a diver
A sophomore breaststroker on the Lions’ swimming team
Pak competed this season not just between the lane lines
The dual commitment is almost unprecedented in modern collegiate athletics
where athletes typically dedicate themselves fully to a single discipline
While back in his home state of Washington last summer
Ryan Pak decided on a whim to try out diving
He was having fun learning new dives and experiencing a level of danger and excitement that swim practices don’t deliver
he decided he wanted to keep practicing and see where the sport takes him
Upon returning to New York for his sophomore year
Pak texted the divers on the team and inquired about coming into their practice and playing around on the boards
They were impressed with his ability after entering into the sport so recently
Columbia diving coach Scott Donie talked to Pak after that practice and invited him to keep coming in and developing his diving abilities
Pak noted that a reason he pursued it at the collegiate level was that Columbia had only two male divers on the team
so he knew there would be an opportunity for him to score points for his team on the boards as well
Ryan Pak was stepping into unfamiliar territory as he was about to compete a dive list for the first time while also having to juggle the logistics of warming up for his race
and warming down all in the span of a few hours
Pak noted that even after competing a full six dive NCAA list
improving on his freshman year in-season times
He attributed this success to the boost of adrenaline he got because of trying something new
then moving on to something he’s more comfortable with which boosted his confidence

Something Pak appreciates about the diving community is just how tight-knit it is
He was able to see first-hand everyone supporting and cheering for opposing teams
which he said is rare in the swimming world
that certainly would have relay potential at a smaller school

Ryan Pak is looking forward to his future in the sport
he’ll return to Federal Way to keep practicing and working on expanding his dive list

Pahalgam in India-controlled Jammu and Kashmir (JK) has raised possibility of the two heading for a war
Terrorists’ strike led to death of 26 tourists on April 22
India has held Pakistan as responsible for the Pahalgam terror attack while Pakistan has denied the charges
there is no denying that two countries have taken several steps suggesting that they are close to “war.” This includes India holding Indus Water Treaty in abeyance as per which the water of River Indus is shared by the two
Pakistan has responded by closing its air space to Indian airlines and suspending all trade with India
There has also been minor exchange between their soldiers along Line-of-Control (LoC)
On the Indian side high-level security meetings being held also suggest that it is considering all options of a conflict with Pakistan
India and Pakistan have hardly been ever at peace with each other
“Pakistan-Card” has time and again been used by Indian politicians to gain support and votes of Indians
Anti-Pakistan “war-cry” is still considered to be fairly popular and appealing for public by Indian leaders
They are guided by the assumption that this will contribute to enhancing their popularity among the people at large
The fact that present Indian government led by Bharatiya Janata Party (BJP) gives a lot of importance to its extremist religious card as well as it anti-Muslim communal propaganda cannot be ignored
With Pakistan being constitutionally an Islamic State
there prevails a communal bias in India of linking Muslims settled here with Pakistan
A similar bias prevails for Muslims here even though India has the second largest population of Muslims
usage of anti-Pak card by India cannot be politically de-linked from politicians’ attempt to play on several cards simultaneously; that of exciting anti-Muslim as well as anti-Pak passion among primarily the Indian Hindus
eighty percent of Indian population is of Hindus
Notwithstanding the reality that Indian public has come a long way from easily being entrapped by these political signals
it is possible that the present government is trying its best to make the most of Pahalgam-tragedy
Pahalgam has raised several questions about security lapses on the part of India
A leader has reportedly said that the valley- where terrorists struck- should not have been open to tourists
tourists should not have been permitted to visit it
And security arrangements should have been made from the moment they started stepped in
as Pahalgam falls enroute an annual Hindu pilgrimage
which is scheduled to begin a few weeks from now
security preparations are expected to begin from around this time
the authorities are apparently well aware that terrorists can strike at any place in India
Adequate security arrangements are naturally expected at the tourist spots in JK
majority of tourists-who survived the terrorists’ strike at Pahalgam- are raising the question as to why weren’t there any security arrangement there
the terrorists spent at least 20-30 minutes in their strikes
Or they would not have openly targeted the tourists but would have fired from a hidden spot and tried rushing away within minutes
the Pahalgam-tragedy has been strongly criticized and has won India sympathy from greater part of the world
India has also received the “green” signal or would be supported if it heads for an open war with Pakistan
India and Pakistan have been asked to exercise “restraint” by United Nations and China
Saudi Arabia and Iran are trying to prevent an “escalation.” United States also prefers a “diplomatic” solution to the present war-like stage reached by India and Pakistan
Prospects of either India or Pakistan being totally oblivious to these diplomatic signals may be viewed as minimal
Diplomatic ties between India and Pakistan have for the greater part bordered around the stage of tension they have entertained over various issues
Their differences over Kashmir remain far from being ever resolved
they have refrained from an open conflict from the day they stepped onto the nuclear path and chose to give greater importance to their nuclear diplomacy deterring them from this stage
heading for an open conflict would be equivalent to inviting criticism from opponents of their nuclear proliferation drive
This would spell a major setback to nuclear diplomacy entertained by the two shrewdly against apprehensions entertained by its opponents stating that this was equivalent to their heading towards MAD (Mutually Assured Destruction)
however antagonist they may be towards each other
But then what should be interpreted from signals suggesting that they are “really” heading towards “war?” Given that India and Pakistan have never entertained “friendly” ties
their not being engaged in war may be viewed as a positive
though hardly suggestive of cordial relations between the two
The fact that actors and singers of the two countries are fairly popular among the people of India and Pakistan only suggests that entertainment has helped bring them together
The fact that this has been affected to a degree cannot be ignored as Indian movies starring Pakistani actors have not been permitted release
channels with Pakistani dramas have been suspended for the time being and so forth
These may also be viewed as signals conveying the Indian leaders’ message to their public about their anti-Pak stand
Rushing towards war would also amount to their ignoring diplomacy being exercised by United States and other powers keen for their exercising restraint
Leaders on both sides are probably also weighing options of how are their respective citizens and other countries reacting to the present Indo-Pak tension
War is certainly not going to ease the present tension or contribute in any way to resolving their long-standing disputes
Indian Prime Minister Narendra Modi would probably love to emerge as the winner and perhaps so would his Pakistani counterpart Shehbaz Sharif
War-diplomacy is likely to be given top-most priority by both the countries for a little more time
There is a difference between actually engaging in war or going for minor/selective war-strikes and opting for war-like diplomacy
The present stand being exercised by both is suggestive of their being engaged in war-like diplomacy by opting for strategic moves suggestive of their heading for war
the question is for how long can such war-diplomacy be stretched
it suggests failure of their nuclear diplomacy

An International Atomic Energy Agency (IAEA) team of experts stated that the operator of Paks Nuclear Power Plant (NPP) in Hungary has demonstrated a commitment to operational safety
The team also encouraged the operator to continue improvements in areas such as training on preventative measures and documentation to reduce the risk of human error
The Operational Safety Review Team (OSART) concluded today an 18-day mission to the Paks NPP
conducted at the request of the Government of Hungary
took place from 4 November to 21 November 2024
This was followed by subsequent OSART missions in 2001 and 2014
OSART missions independently assess safety performance against IAEA safety standards
The aim is to advance operational safety by proposing recommendations and
is located about 100 kilometres southwest of Budapest
The plant is Hungary’s first and only nuclear power plant
and it has four 506 MWe pressurized water reactor units that were commissioned between 1982 and 1987
Paks NPP generated almost half of Hungary's electricity
The team made daily visits to Paks NPP to observe regular plant activities in areas such as: maintenance and surveillance
The 13-member team comprised experts from Argentina
“The team was pleased to see that the plant was very well prepared and cooperated fully and openly with IAEA experts during the mission,” said team leader Yury Martynenko
“The managers and staff of Paks NPP are committed to improving the operational safety and reliability of their plant
and we were pleased to see many actions in progress.”
The team identified good practices to be shared with the nuclear industry globally
The mission also provided some suggestions to further improve safety
“It was in the spirit of continuous learning that we had requested the IAEA review
The OSART mission has allowed us to make an in-depth assessment of our work
The recommendations and suggestions will help us to continuously improve the plant's operational safety
we can also contribute to the enrichment of global best practices," said Péter János Horváth
The team provided a draft report of the mission to the plant management
They will have the opportunity to make factual comments on the draft
These comments will be reviewed by the IAEA
and the final report will be submitted to the Government of Hungary within three months

An OSART mission is designed as a review of programmes and activities essential to operational safety
nor is it a design review or a substitute for an exhaustive assessment of the plant’s overall safety status
Follow-up missions are standard components of the OSART programme and are typically conducted within two years of the initial mission
The IAEA Safety Standards provide a robust framework of fundamental principles
They reflect an international consensus and serve as a global reference for protecting people and the environment from the harmful effects of ionizing radiation
Hungary's Foreign Affairs and Trade Minister Péter Szijjártó says first concrete is to be poured for the Paks II new nuclear plant early in 2025 after the country's National Atomic Energy Agency approved the preliminary safety report
Szijjártó said that the regulator's lifting of the retention point was one of the most important milestones for the construction project
saying "this is a serious document with a total volume of half a million pages
which meets the standards of the International Atomic Energy Agency"
He also noted that the site officially gets the status of a nuclear facility under construction once first concrete is poured
Excavation of soil to a depth of 23 metres is under way and 39,000 of the 75,000 piles that need to be drilled into the ground during soil consolidation are in place he said
adding: "There are already thousands of people working in the work area."
The first large-scale nuclear power plant equipment - the core catcher - was delivered to the site in August
the core catcher is a container in the form of a cone made of thermally resistant steel which in the unlikely event of an emergency will securely hold the melt of the core and not allow radioactive substances to leave the containment of the reactor

the National Atomic Energy Agency (Országos Atomenergia Hivatal
OAH) said it had "decided to lift the retention point specified in the construction permit for new nuclear power plant blocks
it is possible to start significant activities (but requiring additional permits)
such as the so-called first concrete pouring
during which the first concreting works of the new block's nuclear island are carried out"
"There are a number of technical and administrative conditions for the start of this activity
one of which was the lifting of the holding point specified in the establishment permit - in this procedure
The first concrete pouring has additional conditions prescribed in other permits
obtaining a permit for use of soil consolidation. During construction
the OAH constantly checks compliance with the legal requirements and the conditions laid down in the permits in the framework of ad hoc
as well as comprehensive inspections."
The Paks II project was launched in early 2014 by an intergovernmental agreement between Hungary and Russia for two VVER-1200 reactors to be supplied by Rosatom
with the contract supported by a Russian state loan to finance the majority of the project
The construction licence application was submitted in July 2020 to build Paks II alongside the existing Paks plant
100 kilometres southwest of Budapest on the banks of the Danube River
The construction licence was issued in August 2022 and a construction timetable agreed last year which set out plans to connect the new units to the grid at the beginning of the 2030s
The existing four units at Paks are VVER-440 reactors that started up between 1982 and 1987 and they produce about half of the country's electricity
Their design lifetime was for 30 years but that was extended in 2005 by 20 years to between 2032 and 2037
The Hungarian Parliament approved a proposal in 2022 to further extend their lifespan
which means preparations can begin on operating the plant into the 2050s

But according to a report by Russia's Tass news agency that timeline has "had to be adjusted following soil fracture somewhere inside the pit
Rosatom said the incident had no effect on the foundation pit’s technical specifications
but work in that area was suspended in accordance with the Hungarian watchdog’s decision" and the authority "requested a report on additional checks and measures taken in connection with the soil fracture
but has not yet issued permission for first concreting

Paks II's report on the session says that they explained that the "working pit did not collapse
but two corners on the prominent 'peninsula' in the southern section broke off
affecting half a percent of the more than 700-metre perimeter wall"
That section is around 400 metres from Paks' unit 4 "and the incident did not affect the operating power plant at all"
The condition of the wall section in question and its surroundings is continuously monitored
He said that following the corner detachment on 30 January
work in the area immediately stopped and the area was fenced off and an investigation begun into what had happened
He emphasised that the company "was under no time pressure regarding the investigation
In the nuclear industry preventive measures must be taken and we have done that"
The February update also added that "groundwater and the technological water generated from the construction activities are present in controlled conditions thanks to the cut-off wall
in an amount corresponding to the size of the working pit and in a smaller amount compared with the design parameters"
He added "safety continues to be the first priority in the decisions of Paks II Ltd"

The ministry of home affairs (MHA) on Monday directed several states to conduct mock drills on May 7 to enhance civil defence preparedness

Theratechnologies could no longer entertain it because it was “under exclusivity” with the other “potential acquiror.” Once the exclusivity period expired
Theratechnologies tried to enter into a non-disclosure pact with Future Pak to discuss its acquisition proposal—but Future Pak “would not sign such an agreement unless they were provided exclusivity,” the biotech noted
“When Future Pak was finally prepared to sign a non-disclosure agreement
the Company had already renewed exclusivity” with the other potential acquiror
which Theratechnologies has yet to disclose
The biotech informed Future Pak that it would still be able to engage with Theratechnologies in the future
“The Future Pak non-binding proposals have been made without Future Pak having completed any due diligence on the Company other than publicly available information,” Theratechnologies claimed
whereas the potential acquiror “has performed excessive due diligence on the biotech.”
Theratechnologies has formed an independent committee to review these proposals
with its board contending that the offers undervalued the company
Future Pak returned a few months later offering a similar price range, but with additional contingent value rights. Vanda also turned down this offer in June 2024
noting that it was “not in the best interests” of the company and its shareholders
that gets separated from fiber during carton recycling is a key material for the new transport crates made by Schoeller Allibert
PolyAl itself is a newer material recognized more widely just within the last few years
although beverage carton recycling has been occurring for decades
The ability to separate and recycle all of the materials from a carton’s multiple layers has proven challenging
only the paperboard — which comprises 70% of an aseptic beverage carton
on average — had been recovered at scale and the polyAl typically ended up in landfills or incinerators
Tetra Pak described its increase in polyAl work in its most recent sustainability report
It says the global volume of polyAl sent for recycling in 2023 increased by 14% compared to 2022
The company works with 66 polyAl recyclers
who turn the material into pellets for use in manufacturing new plastic products
There are 38 integrated recyclers globally that can recycle both the fiber and polyAl
Other companies working in this space include Bausano and Plastigram Industries for polyAl processing equipment and Alier and Axjo for end markets
Besides advancing polyAl solutions, Tetra Pak has worked to enhance its cartons’ recyclability in other ways. In 2023, for example, it partnered with Portuguese dairy company Lactogal to create an aseptic carton with a paper-based barrier that nearly eliminates the aluminum layer
The new crates have the potential for a lower carbon footprint than competing products due to various factors
Product reusability cuts down on the need to manufacture new products
And the incorporation of recycled materials reduces virgin material use
Scholler Allibert touts the sustainability its reusable transport packaging can bring to supply chains
Scholler Allibert also is engaging with other partners besides Tetra Pak for polyAl logistics packaging adoption

Austria contested that Commission decision
but in 2022 the General Court of the European Union dismissed their case
The advocate-general has now said there was an "inextricable link" between the aid and the construction contract's award and "the Commission is required to take into account
in assessing the compatibility of State aid with the internal market
a possible infringement of provisions of EU law other than those relating to aid"
Although the Commission "may fulfil its obligation to carry out such an examination by referring to infringement proceedings that it has initiated against the Member State concerned and that it has closed after finding that there was no infringement of the relevant provisions" it had "made a mere reference
the considerations which had led it to find that there had been no infringement
that decision did not provide a sufficient statement of reasons on that issue"
The General Court ruling 2022 had said the commission was justified in its view that "it had found that the direct award of the task of constructing the two new reactors to JSC NIAEP did not infringe EU public procurement law"
It also launched legal action against the Commission in 2015 over its approval of the UK's support for the Hinkley Point C nuclear power plant project in Somerset
The General Court dismissed that lawsuit in July 2018 saying the Commission "did not err" in accepting the UK's stance that construction of the plant was in the British public's interest
Foreign Minister Peter Szijjarto posted on Facebook on Thursday afternoon that he had spoken on the phone with Rosatom's Director General Alexei Likhachev and said the project was of "critical importance to Hungarian energy security" and was going on "despite constant difficulties and obstacles"

The expansion of Hungary’s Paks NPP (Paks II) is progressing
The production of the reactor vessel for unit 6 (Paks II unit 2) has begun in Russia
while the first turbine components for unit 5 (Paks II unit 1) are being manufactured in France

The Hungarian parliament earlier approved the extension of the life of the four existing VVER-440 power units at the Paks NPP for another 20 years
These units are now expected to operate until at least 2052-2057
Paks currently provides half of all generated and one third of the consumed electricity in Hungary
at Europe’s largest automated forging plant
production had started of the reactor pressure vessel (RPV) for Paks 6
He emphasised that it is being manufactured to the highest possible European and Hungarian standards
“There will be 700 quality checks during the production period

we will be able to produce large amounts of electricity in a sustainable manner for the Hungarian economy until the end of this century

The Nature Conservancy is working to preserve Pak Nai's natural beauty and sensitive biodiversity in Hong Kong.
From iconic skyscrapers to sandy beaches and lush mountains, Hong Kong offers a striking balance where people and nature co-exist. This is especially evident in Deep Bay, a strip of shallow bay uniquely located between two bustling cities in the Greater Bay Area, Hong Kong and Shenzhen.
Dotted with mangroves, seagrass beds and oyster farms, the mudflats of Deep Bay are critical nursing grounds for endangered horseshoe crabs, foraging grounds for birds and a wide range of other plant and animal species. However, rapid coastal development has led to degradation of these habitats, jeopardizing the future of these critical mudflats and the species that depend on them for survival.
Pak Nai, located in Deep Bay, is a focal point of The Nature Conservancy's (TNC) restoration efforts in Hong Kong. Renowned for its beautiful sunset and biodiversity, this area features a mosaic of vital habitats— mudflats, oyster reefs, mangroves and seagrass beds—that supports abundant wildlife and endangered species.
The mudflats of Pak Nai are facing a myriad of threats such as invasive cordgrass, sedimentchanges, marine litter and oyster aquaculture debris from nearby active and abandoned farms. Tourism to Pak Nai is also increasing, thanks to its breath-taking scenery and proximity to Hong Kong’s 700-year-old oyster aquaculture industry. But without any restrictions or protection to ensure that the area remains pristine, its mudflats and other habitats have degraded over the years.
Pak Nai is also one of the few places where the two endangered horseshoe crab species native to Hong Kong can be found. Horseshoe crabs often get tangled in abandoned fishing equipment known as “ghost nets.” Without intervention, the chance of these crabs escaping is slim.
Fortunately for Pak Nai’s horseshoe crabs, TNC's increased habitat management efforts create opportunities for scientists, staff and volunteers to rehabilitate horseshoe crab habitat and find and release trapped horseshoe crabs. TNC is a member of the IUCN Horseshoe Crab Species Specialist Group and the data we share with this group contributes to global efforts to save horseshoe crabs from extinction.
Historically, Pak Nai was a site for traditional benthic oyster farms cultivated by local villagers. Though this traditional method of oyster farming is no longer in use, the mudflats of Pak Nai remain an ecological hotspot where endangered horseshoe crab and seagrass species can be found. However, Pak Nai is currently statutorily unprotected and unmanaged, leaving it exposed to increasing threats such as unsustainable tourism and rampant spreading of invasive species.
And while oysters continue to grow in artificial rows on the abandoned oyster farms, these spaced out poles does not promote denser, more natural reef growth.
TNC is committed to understanding, managing and restoring the various ecosystems in Pak Nai and other areas around Deep Bay. Our research and monitoring indicate that oyster reefs support six times more species than soft shores. This insight has led us to engage volunteers in transforming abandoned oyster farms into new natural oyster reefs, bringing these biodiversity benefits to Pak Nai.
Volunteers are the driving force behind our efforts to restore Pak Nai’s ecological health. We partner with our supporters on various initiatives, including biodiversity surveys, invasive cordgrass removal and aquaculture debris and marine litter clean-ups.
Invited by the communities to help restore and protect Pak Nai, TNC’s strategy is to work with local partners to revitalize Pak Nai’s unique mudflats and increase public awareness of its cultural and ecological importance. Taking a scientific approach, our research on Hong Kong’s estuaries and coastal habitat restoration may also assist in the decision-making process for preserving coastal ecosystems and promoting marine conservation and coastal resilience in the Greater Bay Area.

organization or other entity; “Billing Start Date” means the date identified on the subscription order form or subscription invoice as the date from which the Fees shall be calculated (provided that the Fees will be calculated beginning with the EI Services Start Date if such date precedes the Billing Start Date); the “EI Service(s)” means the Energy Intelligence publications
archives and/or databases listed on the subscription order form
or other associated order form or agreement
or such as granted for complimentary access
specifications or other content provided by Energy Intelligence under the Standard Terms and Conditions; “EI Services Start Date” means the date from which Subscriber first receives the applicable EI Services; “Energy Intelligence” means Energy Intelligence Group
and Energy Intelligence Group (UK) Limited; “Fees” means the annual fees referenced in the subscription order form
Global License or Named User License or other associated order form and/or subscription invoice
as payable pursuant to Section 3 herein; “Subscriber” means the entity or entities and/or individual(s) identified as such on the subscription order form
or as agreed to by Energy Intelligence for complimentary access
that control and are responsible for the Authorized Users; and “Term” means the subscription period specified in the subscription order form
or other associated order form and/or subscription invoice
or the stated period as agreed by Energy Intelligence for complimentary access
Except in the case of complimentary access as granted by Energy Intelligence
in exchange for the licenses granted herein
Subscriber shall pay Energy Intelligence the Fees for the first annual period on the Billing Start Date
Unless otherwise expressly defined on the subscription order form and/or subscription invoice
Global License or Named User License executed by and between Energy Intelligence and Subscriber
the Fees for any subsequent annual period shall be due on the anniversary of the Billing Start Date
The Fees are non-refundable with the exception of the limited circumstances detailed herein
If Subscriber fails to pay the Fees as provided in Section 3 herein
Energy Intelligence shall be entitled to interest from the day on which the Fees are due at the rate of 1.5 per cent per month
Subscriber will pay Energy Intelligence or the relevant taxing authority
including withholding tax excluding income taxes imposed on Energy Intelligence’s income
the amounts due will be paid by Subscriber to Energy Intelligence in full without any right of set-off or deduction and the amount received by Energy Intelligence shall not be less than the aggregate Fees
The terms and conditions herein must be agreed to and accepted by any and all Authorized Users as a condition to receiving
except as may otherwise be provided by Energy Intelligence
The Standard Terms and Conditions shall become effective when Subscriber and/or any Authorized User(s) pays the Fees
or otherwise obtains access to EI Services
or unless access to the EI Services is terminated earlier in accordance with Subsection 4(b)
and shall (i) continue from the Billing Start Date for one year
or such other period as may be specified in the subscription order form and /or subscription invoice
Global License or Named User License or other order form
or the stated conditions of complimentary access; and (ii) after receipt of any subscription renewal shall automatically renew for subsequent annual periods upon the expiration of the then current Term
subject to Subscriber’s right to terminate pursuant to Subsection 4(b)(i)
in the event Subscriber pays the Fees or “Accepts” the Standard Terms and Conditions after the Billing Start Date
then the Standard Terms and Conditions will be deemed effective from the Billing Start Date
and in the event Subscriber receives the EI Services before the Fees are paid or the Standard Terms and Conditions are “Accepted,” then the Standard Terms and Conditions shall be deemed effective from the EI Services Start Date
The EI Services licensed hereunder may be terminated or suspended as follows: (i) by Subscriber within thirty (30) days after receiving a subscription renewal or notice of revision(s) to these terms and conditions
In addition to Energy Intelligence’s right to terminate under Subsection 4(b)(ii) above
if Subscriber commits a material breach of the Standard Terms and Conditions (including but not limited to late payment of Fees and breach of license terms)
provided Energy Intelligence gives Subscriber notice of the details of such breach
Energy Intelligence may suspend access to any or all EI Service(s) with immediate effect
If any EI Services are terminated hereunder by Subscriber under Subsection 4(b)(ii) or (iii)
then Energy Intelligence will pay Subscriber a prorated refund of Fees representing the amount of such unused EI Services
If any EI Services are terminated hereunder other than by Subscriber under Subsection 4(b)(ii) or (iii)
then Subscriber will promptly pay Energy Intelligence any unpaid Fees for the balance of the then-current initial subscription period or renewal period
All licenses granted hereunder shall automatically terminate upon any termination or expiration of the license hereunder to the EI Services
For the purpose of verifying compliance with the Standard Terms and Conditions
Energy Intelligence (and Energy Intelligence’s authorized representatives) shall have the right
during normal business hours upon reasonable advance notice and without material disruption to Subscriber’s business
to audit and inspect from time to time Subscriber’s records (including back-up storage tapes) relevant to the EI Services and to verify the use made of and the number of Authorized Users given access to the EI Services
THE EI SERVICES ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS AND ENERGY INTELLIGENCE DOES NOT MAKE AND HEREBY SPECIFICALLY DISCLAIMS ANY REPRESENTATIONS
OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS
ENERGY INTELLIGENCE MAKES NO REPRESENTATION THAT THE EI SERVICES WILL BE ERROR FREE OR THAT IT WILL OPERATE WITHOUT INTERRUPTION
NO PART OF THE EI SERVICES CONSTITUTES ANY FORM OF ADVICE (INVESTMENT
OR ENDORSEMENT OR SHOULD BE RELIED UPON BY ANY PERSON FOR ANY REASON
IN CONNECTION WITH ANY INVESTMENT DECISION
THE EI SERVICES MAY CONTAIN LINKS TO WEBSITES OPERATED BY THIRD PARTIES (“THIRD PARTY SITES”)
THESE LINKS ARE PROVIDED FOR YOUR CONVENIENCE ONLY AND DO NOT IMPLY ANY OFFICIAL ENDORSEMENT OF
PRODUCTS OR SERVICES CONTAINED IN ANY THIRD PARTY SITES
YOU AGREE THAT SUCH THIRD PARTIES ARE RESPONSIBLE FOR THE OPERATION AND CONTENTS OF THIRD PARTY SITES
AND THAT ENERGY INTELLIGENCE HAS NO LIABILITY TO YOU OR ANY OTHER PERSON FOR THE USE OF SUCH THIRD PARTY SITES

AND IRRESPECTIVE OF ANY FAILURE OF AN ESSENTIAL PURPOSE OF A LIMITED REMEDY
IN NO EVENT WILL THE LIABILITY OF THE ENERGY INTELLIGENCE PARTIES ARISING OUT OF ANY CLAIM RELATED TO ANY AGREEMENT BETWEEN ENERGY INTELLIGENCE AND SUBSCRIBER (INCLUDING

SUBSCRIBER HEREBY FURTHER AGREES THAT ANY CAUSE OF ACTION THAT SUBSCRIBER MAY HAVE WITH RESPECT TO ENERGY INTELLIGENCE MUST BE FILED WITHIN TWO MONTHS OF THE TIME IN WHICH THE EVENTS GIVING RISE TO SUCH CLAIM BEGAN
defend and hold harmless the Energy Intelligence Parties for any loss
damage or cost in connection with (i) any breaches of the Standard Terms and Conditions
any breach by the Subscriber or an Authorized User
and (ii) any claim or action which may be brought by any third party against the Energy Intelligence Parties arising out of any violation and/or breach by Subscriber or an Authorized User under the Standard Terms and Conditions
All notices or communications between Energy Intelligence and Subscriber shall be in writing and delivered by mail
facsimile or electronic mail either to the receiving party’s contact address on the subscription order form and/or subscription invoice
or as designated by the receiving party for such purposes in writing
Such notices will be deemed delivered and received on the date two business days after they were posted
or on the date actually received if sent by facsimile or electronic mail
Energy Intelligence may revise the Standard Terms and Conditions of use of the EI Services from time to time
Subscriber shall be provided with notice of
and asked to “Accept” any such revision(s) by Energy Intelligence when such revisions take effect
Should Subscriber be unwilling or unable to agree to or comply with any term and condition so revised
Subscriber may contact Energy Intelligence Customer Service to cancel its subscription and request a pro-rated refund
Continued use of the EI Services upon receiving notification of such revision(s) shall constitute your agreement to be bound by those revision(s)
Access to the EI Services shall not be transferable
or sublicenseable by Subscriber in whole or in part
without the prior written permission of Energy Intelligence in each instance
Any assignment made without the written consent of Energy Intelligence shall be void and of no effect
order of any court or pursuant to any plan of merger
consolidation or liquidation shall be deemed an assignment for which prior written consent is required
No third party is a beneficiary of the licenses to the EI Services
The Standard Terms and Conditions will be binding upon and inure to the benefit of the parties and their respective successors
The following obligations of the parties herein will survive termination or expiration of the EI Services for any reason: Sections 1(c)
and any payment obligations of Subscriber that accrue prior to such termination or expiration
Any failure of either party at any time to require full performance by the other party of any provision hereof will not constitute a waiver or otherwise adversely affect the right to require full performance at any time thereafter
If Subscriber is in ongoing violation of any provision of the Standard Terms and Conditions
in addition to any other rights available under the Standard Terms and Conditions
to apply for immediate injunctive relief without any requirement to post a bond or other security and Subscriber acknowledges and agrees that compensatory damages are not an adequate remedy in such circumstances and covenants not to claim otherwise in response to such an action
The rights and remedies under the Standard Terms and Conditions are intended to be cumulative and non-exclusive of any legal
Any failure or delay by either Energy Intelligence or Subscriber in the performance of its obligations pursuant to the Standard Terms and Conditions (other than in respect of payment of Fees) will not be deemed a default or breach of the Standard Terms and Conditions or a ground for termination to the extent such failure or delay is due to computer or Internet or telecommunications breakdowns
or any similar cause beyond the reasonable control of that party
If any term or condition herein (in whole or in part) is found to be illegal or unenforceable
this will not affect the validity and enforceability of the remainder of the Standard Terms and Conditions
and each provision shall be valid and enforced to the fullest extent permitted by law
as well as any and all tort claims arising from the Standard Terms and Conditions or arising from any of the proposals
communications or understandings regarding the Standard Terms and Conditions
will be governed by and construed in accordance with the laws the United States of America
Jurisdiction and venue for any litigation arising herefrom
will be appropriate in any federal or state court located in New York or other proper jurisdiction as determined under the Federal Rules of Civil Procedure
or other applicable state laws or regulations
Subscriber hereby agrees and consents to personal jurisdiction in any court located within the State of New York
you indicate that you agree to and accept these Standard Terms and Conditions
