The 30-kilometer-long sea barrier was first reported early this year after local fishermen filed complaints over the bamboo fence restricting access to their traditional fishing grounds
The Indonesian Ombudsman estimated that around 4,000 fishers incurred income losses totaling up to at least Rp 24 billion (US$14 million)
The National Police’s Criminal Investigation Agency (Bareskrim) has declared four low-key suspects related to the case
All of whom were apprehended strictly for the falsification of right-to-build (HGB) certificates
The person or party responsible for the establishment of the sea barrier
Bareskrim said there were no indications of corruption or state losses in the construction of the sea barrier
reducing the months-long investigation to a simple case of document forgery

The police have not yet investigated allegations of bribery in the issuing of a permit for the Tangerang sea barrier

AFTER three months, the investigation into the sea barrier in Tangerang Regency
Instead of going after the main perpetrators in this case
the police are only focusing on alleged falsification of documents by village officials
The National Police’s Criminal Investigation Department has named four suspects for alleged falsification of documentation in the area of the sea barrier in Tangerang
They are Kohod Village Head Arsin bin Asip and Village Secretary Ujang Karta
But the Attorney General’s Office (AGO) has twice refused to take over the case
and has asked the investigation into the alleged corruption to be included
The police should uncover the various legal violations in this major case
not simply localize the investigation by targeting the falsification of documents by low-ranking officials
there are indications of bribery in the granting of permits
and police should also look into possible losses to the state resulting from environmental damage caused by the sea barrier
it is possible that the land grab case involving the sea areas of 16 villages in six regencies will spread to money laundering and embroil many officials and businesspeople
We all know that it is not possible that the 30-kilometer sea barrier was built on the initiative of and on a voluntary basis by local villagers
There are very strong indications of abuses of authority by public officials and payments being made to smooth the way for certain individuals
suspicions have arisen that there is a scenario to obscure this case
the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency said that some of the certificates were ‘legal.’ Whereas it is clear that the sea

There is a major corporation that asked and paid for people to build the barrier
there is collusion allowing certificates to be issued

But the police seem reluctant to uncover the name of the mastermind behind the sea barrier
it is only natural that the people are asking why the investigation is proceeding at a snail’s pace and why there are many unanswered questions
President Prabowo Subianto explicitly ordered a thorough investigation into the sea barrier case in line with legal procedures
If the police are reluctant to do their job
the AGO should not hesitate to take over the case
There have been no more loud proclamations that the government will use the sea barrier case to spur on an evaluation of national strategic projects (PSN). It is no secret that the construction of the sea barrier, which is a large-scale environmental crime, is closely linked to the Pantai Indah Kapuk 2 project

setiap orang yang memanfaatkan ruang laut di perairan pesisir
dan/atau wilayah yurisdiksi secara menetap di sebagian ruang laut wajib memiliki Kesesuaian Kegiatan Pemanfaatan Ruang Laut (KKPRL)
Pagar laut itu juga mengganggu ekonomi warga nelayan
ada 3.888 nelayan dan 502 pembudidaya laut di sekitar terdampak pagar laut ini
mereka harus hati-hati melewati pagar laut itu aga tak menabraknya
nelayan memutar jauh dengan konsekuensi waktu dan biaya operasional membengkak
Ikan di pinggiran kerap bersembunyi di area pagar
Nelayan gak ada yang mau berangkat daripada buang-buang biaya beli solar
Heru sempat mencoba menebar alat tangkap bubu di dekat pagar
ikan di pinggiran sebenarnya ada tetapi mereka sulit menebar jaring karena ada pagar
Beberapa perahu nelayan juga rusak karena menabrak pagar
Dia mau belok hindari pagar malah dihantam ombak
Mulai dari perairan Kecamatan Teluknaga hingga Kronjo yang baru rampung sekitar dua bulan lalu

Beberapa nelayan yang Mongabay temui menyebut
pagar itu dibuat pekerja pengembang Pantai Indah Kapuk 2 (PIK 2)
Nelayan di Krojo bahkan sempat dapat tawaran ikut bekerja memasang pagar dengan upah Rp125.000 per hari
laut Tangerang dalam kuasa PIK 2 yang akhirnya nelayan tak bisa lagi melaut
Pengalaman nelayan di Kosambi tak bisa mendekati perairan 500 meter dari bibir pantai area PIK 2

Lokasi itu akan jadi pusat bisnis dan hunian premium dengan pengembang
Kementerian Kelautan dan Perikanan turun ke lokasi dan menyegel pagar laut pada 9 Januari

“Di lapangan hanya berjumpa dengan mandor yang tidak mengetahui untuk keperluan apa pemagaran,” kata Suharyanto

KKP juga harus mengevaluasi kebijakan dan peraturan yang melegitimasi perusakan
seperti kebijakan persetujuan kesesuaian kegiatan pemanfaatan ruang laut (PKKPRL) yang melegitimasi perampasan ruang laut
Ketua Departemen Ilmu dan Teknologi Kelautan Fakultas Perikanan dan Ilmu Kelautan IPB University mengatakan
pemagaran laut siratkan lemahnya koordinasi lintas sektor pembangunan
terkait pengelolaan ruang yang mendorong pengelolaan perikanan dan keseimbangan ekosistem di wilayah pesisir

Jakarta - The Ministry of Marine Affairs and Fisheries sealed an illegal sea fence in the waters of Tangerang Regency
The unauthorized sea fence had been in place since 2023 until it was finally sealed by ministry officers on Thursday
The sea fence made of bamboo slats stretched for more than 30 kilometers. The fence crosses the coastal areas of 16 villages in six sub-districts in Tangerang Regency
“We are halting the fencing activities while resuming the investigation to search for the responsible parties,” said the director general of Marine Resource and Fisheries Surveillance Pung Nugroho Saksono
Ipung said the sea fencing was illegal based on the lack of suitability of the marine space use (KKPRL) permit.
The fence is located in the Capture Fisheries Zone and Energy Management Zone regulated by the Banten Provincial DKP Spatial Plan Regional Regulation Number 2 of 2023.
