Since then, the only answer from the Minister has been that she will respond to the petition “in due course” Brian McNally and Mick Plunkett (since deceased)) detained and interrogated following the Sallins train robbery in 1976 Four of the men signed alleged confessions and all six of them had extensive bruising and injuries after their arrests which they said were inflicted by members of the Gardaí Three of the men were tried before the Special Criminal Court They were all subsequently acquitted or pardoned There has never been a public inquiry into the case ICCL and the petition’s supporting organisations maintain that the arrest prosecution and conviction of the Sallins Men and their continued ill-treatment by the State is of significant public concern and that a statutory inquiry is required to vindicate their rights “KRW LAW LLP is assisting all the Sallins Men – Osgur Breatnach John Fitzpatrick and Michael Barrett – in their continuing demands for truth justice and accountability as a result of their wrongful arrest detention and conviction arising from the Garda response to the Sallins train robbery in 1976 KRW assisted in preparing the joint civil society petition delivered to the Minister for Justice by ICCL and other human rights NGOs we support the message made clear in ICCL’s letter to the Minister that the government’s failure to address the human rights abuses arising from the Sallins Case is both an indictment of and indicative of the position of successive Irish governments to fail to investigate conflict-related violations in accordance with standards demanded by the European Convention on Human Rights That is a human rights deficit that must be accounted for “We call on the Minister to acknowledge and reply to this letter with a fulsome response to the petition and a public inquiry.”  “The human rights violations inflicted upon the Sallins Men by An Garda Síochána and accepted by other parts of the Irish criminal justice system were part of a systemic pattern of human rights violations endemic across many years in Ireland’s history The Irish State has systematically failed to address their treatment and the systems which enabled this treatment to occur “14 months ago we petitioned the Minister for Justice and government to establish a public inquiry into the case the only response we’ve received is that the Minister will respond to the petition "in due course" “The impact of this case lives on for the five surviving Sallins Men and their families all of which can only be achieved through a fully independent statutory inquiry We hope the Minister and government will respond to this request with the urgency it merits including so that similar violations can never happen again Available for comment: Christopher Stanley Re: Civil Society Petition to the Minister for Justice on the Sallins Case I am writing to you on behalf of the Irish Council for Civil Liberties the Committee for the Administration of Justice the Pat Finucane Centre and Fair Trials concerning our joint Petition submitted to you on 18 September 2023 (attached herewith for reference) The Petition calls for a public inquiry into the Sallins Case and the continuing human rights violations presented by that case in line with Article 3 of the European Convention on Human Rights (‘ECHR’) A commitment was made by you to respond to this Petition ‘in due course’ This commitment has been repeated by you on a number of occasions in the Dáil in response to parliamentary questions on this matter some fourteen months after submission of our Petition we have not received any substantive response The Irish Government has since initiated legal proceedings at the European Court of Human Rights (ECtHR) against the United Kingdom concerning the Northern Ireland Troubles (Legacy and Reconciliation) Act 2023 and attempts by the United Kingdom Government to suppress investigations and legal proceedings concerning human rights violations in Northern Ireland during the period of conflict We support the Irish Government in securing justice for the victims of human rights violations during the conflict in Northern Ireland we consider it imperative that the Irish Government also ensure effective investigation and accountability for serious human rights violations which occurred in this jurisdiction during the same period including but not limited to the Sallins Case The Sallins Case is not unique regarding the use of torture and the miscarriage of justice The continuing failure of the Irish State to fulfil its obligations to investigate in line with Article 3 of the ECHR presents a grave and continuing stain on Ireland’s human rights record It is now fourteen months since you first committed to respond to our Petition We reiterate our request that steps are taken to fulfil the State’s human rights obligations as a matter of urgency ICCL cannot provide legal advice. All rights reserved. Cllrs Carmel Kelly and Bill Clear brought almost identical motions to the recent meeting of the Naas MD to upgrade the current crossing between the GAA grounds and the new pedestrian bridge into a zebra crossing “as a matter of priority”, and because “cars often drive through while (children) are crossing”.  However, both councillors were given exactly the same answer by the Council’s senior traffic engineer Donal Hodgins. “It is not proposed to change the unsignalised crossings along the Kerdiffstown Road (Church Avenue – south) and the Sherlockstown Road (Canal View – north),” he said in his formal reply. “To upgrade them involves the purchase of third-party lands, the removal of mature trees and an upgrade to the public lighting at the crossings.  There is neither the financial nor staff resources to undertake this work,” he explained.  “It should be noted that there are sufficient forward sightlines to these crossings and the main concern at this location is driver behaviour.  "Furthermore, the implementation of the Grand Canal Greenway link across the vehicular ramp and the R407 (the main road through the village) will assist in dissuading traffic that it has alternate routes to using the Sherlockstown Road. Finally, Type B zebra crossings - those without belisha beacons (flashing yellow lollipops) - are not authorised for use in County Kildare." “Look, we were advised to wait for these designs,” said cllr Kelly after the meeting. “I’m willing to wait to see these designs, and based on that, I’ll see where I go from there,” she said. “He (Donal Hodgins) said there will be more measures to slow traffic around Lock 13, but the bottom line is we need to see the designs for this." “The new pedestrian bridge has made life so easy for children going to school from the north side of the canal, and parents are so much happier letting the children walk to school over the bridge rather than run the gauntlet of cars and trucks on the canal (main) bridge,” she pointed out. “However, this crossing is a raised table, and looks like a ramp to traffic, rather than a crossing which it technically is,” she commented. “Did you know the two white lines on top of this make it a crossing? Neither did I,” she said. “He (Donal Hodgins) argued that the council would have to install electricity for crossing poles and beacons, and I’m going ‘have you never heard of solar?’,” she argued not unreasonably. The (vehicular) down ramp at Lock 13 is to be narrowed for just pedestrians and cyclists, and when they do that, the awful turn around Lock 13 will be widened, and this is what we’re being advised to wait for. I’ll wait, but I’ll still be going for a proper crossing,” she declared. “I’ve seen a number of cars on the school run ramping over this tabletop crossing in a hurry to get their kids to school, while children are trying to walk across to school,” he said. “We need that crossing." long-felt want supplied" as it previewed the ceremonial opening of the new church in Sallins the following day Unlike other churches built from brick and stone this church arrived months prior in what we would consider a flat-pack Carefully dimensioned metal and wood planks was manufactured by the firm of Harrison and Company in south London and arrived to Sallins for it to be assembled Tradesmen from London also arrived with the flat-pack soon-to-be church Mr Kenny noted the surname Laxton continues in the locality Only one other Catholic church in Tipperary is made entirely of tin and is still open for daily prayers The assembly of the Sallins church was completed in the spring of 1924 and in the following months was filled with internal furnishing which was the gift of a Miss Condron of Eadestown The external bell which predates the church by 60 years also came from Eadestown direction being gifted by its parish priest V Rev Fr Lockhart Hourihane of Sallins National School donated paintings of St Patrick and St Brigid Additional carpentry was done by Mr D.Smyth and renowned Naas Builders' Denis Corcoran erected the bell on its external gantry blessed the new chapel having received authorisation from Bishop Foley of Kildare and Leighlin Other tin churches later appeared in the suburbs of Dublin city but all were short-lived and have since been replaced by block-built took an early lead. This was to be short lived as Sallins soon responded with Ella Flanagan pointing within sixty seconds. After this it was from the next kick of the ball, Sallins took the lead. Gathering Kali Mulhall’s kick out Aoife Kenny blasted into the back of the net to send Sallins into the lead. Sallins Captain Claire Nugent recieves the Junior B Cup from AYU representative Zoe Casbolt Photo: Aisling HylandThey looked to build on this immediately with Lia Reilly claiming Mulhall’s kick out from Hodson’s goal to chip over and leave Sallins four clear with seven minutes on the clock. Sallins Haley McCormack passes onto to Aoife Kenny Photo: Aisling HylandCastlemitchell were struggling to get the ball out of their own half and All-Star goalkeeper Mary Hulgraine was a virtual spectator between the Sallins’ posts. Aoife Kenny’s goal on the stroke of ten minutes left eight between the sides. Four Hodson points, one from play and three frees in the run in to half time looked to take the Sallins advantage to twelve before a late point from Zoe Harris against the run of play narrowed this advantage slightly as the half drew to a close. As soon as the ball was thrown in for the start of the second half, Sallins continued where they had left off. They pushed forward hoping to seal their place as champions early on. And with Sophie Lawlor netting they got the result they had hoped for before Claire a Nugent added a point to leave them fifteen clear. Sallins' Lia Reilly under pressure from Castlemitchell's Amy O'Brien and Laoise Langton Photo: Aisling HylandWith time wearing on the tempo that Sallins had brought to the tie had begun to take its toll on them and with that the pace of the tie began to slacken mid way through the second half. A Brereton Foley free followed by a point from a Chloe Walsh on her return from the sin bin sought to keep the Castlemitchell challenge alive. Yet unable to add to this they were unable to stage a comeback as time quickly ticked towards full time. With the tie into the final four minutes of action Sallins looked to show the waiting crowds they were not just done as a long ball over the shoulder of Kenny sat up for her to gather on the turn to put a fourth past Mulhall in the Castlemitchell goals to complete a brilliant hat-trick of goals and round off a long day for the south Kildare side who were resigned to their fate early on and even a late Brereton Foley free could not lift them. The Naas feeder of the Grand Canal from Tandy's Bridge towards Sallins. This was ratified at a special meeting of the Naas Municipal District last week, despite there being 135 letters of disagreement – and only one in favour - from the general public. The meeting was called to ratify S38 Road Traffic Act 1994, “where a local authority may, in the interest of the safety and convenience of road users, provide such traffic calming measures as they consider desirable in respect of public roads in their charge”. “The scheme is proposed as a high-quality segregated cycle and walking facility linking Naas and Sallins,” said Celina Barrett, Acting Director of Services at the Roads Section. “Whilst local vehicular access for property owners will be maintained, the scheme seeks to minimise conflict between pedestrian and cycle traffic and vehicular traffic. Without significant, and cost-prohibitive land acquisition, it would not be possible to provide such a scheme along with a facility for vehicular traffic between Tandys Bridge and Sallins. “The scheme would therefore not achieve its objective of providing a dedicated pedestrian/cycle facility between Naas and Sallins and therefore an alternative option of maintaining vehicular traffic on one side of the canal has been discounted.Vehicular access to the existing Leinster Mills Café is to be maintained from Osberstown Road. “I am very supportive of this, and have been promoting this with the Naas Greenway Group since before I was a councillor, I saw this as a perfect route between our towns,” said Cllr Bill Clear. “There are 2,500kms of roads in Kildare and we’re just taking two,” he said, with regard to the protests. “Nobody is being blocked from going anywhere, and this has been on the LAP [Local Area Plan for Naas] since 2013,” he added. His colleague Cllr Seamie Moore confirmed: “it’s always been an objective of the Council’s to remove vehicular traffic off this road ever since I was first elected to the Town Council 30 years ago, loads of people in Sallins and Monread use it as a rat run”. “This is all about getting children to school walking, cycling or scooting,” said Cllr Clear. “People driving their kids to school every day are afraid to let them cycle because they think it’s too dangerous. (Statistically, road deaths in Ireland in 2020 are one-quarter what they were in 1980 [581 down to 146]). “Really, this stretch of the Canal is like a linear park between Sallins and Naas, especially with the deBurgh Gardens opening up soon,” said Cllr Clear. “This meeting was letting us know the Council was doing something very controversial,” said Cllr Moore. “The area in question is known locally as The Ramp, and I had proposed a trial closure for 12 months, but Roads [Section] didn’t go for that. “The members of the MD [Municipal District] gave the go-ahead before the election to go ahead and close it, however, at this week’s meeting they told us they won’t close it immediately, as they need to do more surveys, more observations, for when they’re back at school. I believe closure of this canal bank would be problematic until this junction gets traffic lights,” asserted Cllr Moore. “I came away from that meeting mostly a happy camper because not closing The Ramp is the correct decision until proper traffic management is in place,” said Sallins native Cllr Carmel Kelly. The development would see residents of the Naas and Kilcock areas brought into the commuter rail network. Minister James Lawless said the proposed extension would "turbo charge commuting options for the north Kildare public.” He further indicated that a brand new station for Naas commuters is being considered in the vicinity of Millennium Park. Mr Lawless told The Leinster Leader that funding has been secured to prepare for the future rollout of DART to Sallins/Naas on the southwest line, and to Kilcock on the west line. This will being the DART services even further than the already agreed extensions to Hazelhatch and Maynooth on the respective lines. The rail link would bring unprecedented fast and efficient travel to and from the heart of Dublin city centre into the heart of north Kildare. It would make it easier for the people of Kildare to get into the Capital for work, shopping, visiting friends and family or any other reasons. Mr Lawless told the Leader: “I’m delighted to announce that as part of Budget 2025 I have instructed the National Transport Authority (NTA) to commence the rollout of the DART+ project to Sallins station on the Dart Southwest line and to Kilcock on the DART West line. “The DART+ projects involve a major upgrade of the current commuter rail services in Kildare, we’re also bringing them into Wicklow and up to Drogheda on the Northern line. “The benefit of the DART+, as opposed to what we already have, is that it is fully electrified, highly regular, highly reliable service, much better capacity, far greater service levels and effectively a ten minute service on your doorstep. “In terms of the Sallis connection, the trains already coming to Hazelhatch and Celbridge as part of the DART+ project, I’ve asked them to bring it further down to Sallins…. and as part of that we may see a second station around Millennium Park.” A 23-year-old has been charged with murdering his brother-in-law in Co Kildare on Sunday. Valeriu Melnic (23), of Calliaghstown Lower, Rathcoole, Co Dublin, appeared before Naas District Court late on Monday over the death of Ion Daghi (39) at The Close, Sallins Park. Det Garda Enda Coleman said Mr Melnic, a stone mason, remained silent after being cautioned and charged. He said it would be alleged that the fatal incident happened at a family gathering attended by five adults and three children. It is alleged that some of those present went to bed and a dispute arose between the accused and the deceased, who had been drinking whiskey. The court heard the row calmed down but reignited at about 3am. Det Garda Coleman said it will be alleged that the defendant went to the kitchen and took a knife. Mr Daghi then went to the kitchen and an altercation took place and he was stabbed once in the chest with a 30cm-long knife, he said. The deceased’s 12-year-old daughter called the emergency services, the court heard. The defendant was granted free legal aid and this was extended to cover the services of a Russian translator. The proceedings were translated on Monday night for the defendant by an interpreter. Mr Melnic was remanded in custody to appear in court again on Thursday by video-link. The judge also ordered a psychological report at the request of a defence solicitor.
