over his shirt and trousers and a faint trace of dark paint on his right cheek He shifts his gaze from Norman to Gina as if waiting for them to tell him it’s a gag “I’ve never seen this man stuck for words,” says Norman He’s been a regular at Norman’s shop for over 20 years  travelling from Clondalkin to buy painting supplies and other bits who let his customers curate and redefine his hardware shop by stocking whatever they stumbled in and asked for readying to lose himself in the long docket of fun things to do –  which includes plenty of travelling –  drawn up by his wife I want to get out and do things,” says Norman He’s opened his shop on Orwell Park Glen six days a week for nearly half a century But for the community in Templeogue and his customers all over Dublin “I’d never It follows an award of nearly €40,000 to another teacher who was penalised for putting her name to a staff grievance. The resolution was announced at the Workplace Relations Commission (WRC) on Tuesday morning as the tribunal was set to begin two days of hearings into a series of statutory complaints by the teacher, Darren O’Sullivan. “I understand the parties have reached a compromise,” said adjudicator Penelope McGrath. Owen Keany, appearing for the complainant, said: “The matter has been resolved. Both parties are very happy with the resolution.” The school’s barrister, Rosemary Mallon, said there was “no difficulty” with a proposal that the complaints “remain alive” for five weeks pending implementation of the compromise arrangement. No particulars of Mr O’Sullivan’s complaints against Templeogue College, nor the legislation under which they were brought, were made public at the brief hearing. Mr O’Sullivan is the fourth teacher at the South Dublin secondary school to bring a claim in the last two years. In November 2022, the school resolved claims of victimisation with two of its longest-serving teachers, Patricia O’Connell and Bríd Stack. The complaints were withdrawn before its former principal Niamh Quinn was called upon to give evidence. They had alleged they were subjected to exclusionary treatment by the senior management team at the school because they made complaints of ageist discrimination. Ms O’Connell gave evidence that Ms Quinn had been “dismissive” to her and that she was “frozen out” for bringing her complaint. This was denied by the school. Last month, the WRC awarded nearly €40,000 to a part-time Spanish teacher, Jennifer Clancy, after concluding that she had suffered “multiple and sustained acts of penalisation” for putting her name to a protected disclosure in the form of a collective staff grievance in early 2022. The staff group had voiced concern about health and safety, the loss of staff facilities and student discipline at the South Dublin boys’ secondary school, the WRC heard. These included an alleged assault on one teacher and claims that a student had filmed another teacher’s “backside”. Templeogue College has been ordered to pay nearly €40,000 to a teacher who was subjected to “multiple and sustained acts of penalisation” for putting her name to a collective staff grievance. The Workplace Relations Commission (WRC) made the award after ruling that Jenny Clancy, who taught Spanish part-time at the South Dublin boys secondary school run by the Spiritan Education Trust, was “intimidated” by principal Niamh Quinn at a meeting in August 2022 – as well as being subject to unfair treatment, changes to her working hours and having disciplinary proceedings instigated against her. The employment tribunal awarded €39,912 on foot of Ms Clancy’s complaint under the Protected Disclosures Act 2014 – a sum worth 15 months’ salary – in a decision released to the parties on Monday. The ruling was made after the school closed its case last week without presenting any witness evidence – its lawyers having previously told the Commission that the principal, Ms Quinn, would give evidence denying and disputing claims of indiscipline at the school as well as her own alleged conduct towards Ms Clancy. Teachers lodged a collective grievance in the spring of 2022 raising concerns about health and safety, the loss of staff facilities and about student discipline. These included an alleged assault on one teacher and claims that a student had filmed another teacher’s “backside”. In evidence to the tribunal in February, Ms Clancy had likened the school under Ms Quinn’s leadership to a “ticking time-bomb”, where students had begun to feel they had “the run of the place” due to the way the principal had handled certain incidents. Ms Clancy had argued she was penalised for putting her name to the grievance when her timetable for the term starting in September 2022 was changed, requiring her to teach in the afternoons and upending childcare arrangements she said had been agreed with Ms Quinn’s predecessor before she agreed to teach at the school. Ms Clancy’s case as that when she went to a meeting in a bid to address the matter with Ms Clancy Ms Quinn became “frenzied” and shouted at her. Later, she said, she was informed that disciplinary proceedings were being brought against her. Ms Clancy’s barrister, Conor Duff BL, appearing instructed by Doyle Legal, said that despite his client repeatedly asking Ms Quinn to tell her what she was being accused of – to the point of having her solicitors issue a legal letter – the charge was never forthcoming, he said. Although adjudicating officer Breiffní O’Neill considered the school board’s handling of a grievance brought by Ms Clancy in September 2022, which was rejected, to be “inadequate and lazy”, its handling of the matter had not amounted to penalisation, he wrote. He added that Ms Clancy “was not penalised” by the school when an independent panel rejected her grievance following a hearing in November that year. Mr O’Neill ruled Ms Clancy’s complaint well-founded. He wrote that he could not take into account Ms Clancy’s “significant legal costs” in bringing the complaint, and accepted arguments from the school’s barrister Rosemary Mallon BL that any “stress or emotional toll” Ms Clancy had suffered should have been brought to another legal forum. I’m not going to be calling the principal,” the school’s barrister told the Workplace Relations Commission (WRC) on Friday. The school’s lawyers had previously said the principal, Niamh Quinn, would give evidence denying and disputing claims of indiscipline at the school, as well as disputing alleged claims about her conduct towards a former part-time Spanish teacher Jennifer Clancy, who has accused the school of whistleblower penalisation. The teacher’s barrister sharply criticised the school’s management on Friday, claiming its “tactics” in the case were an attempt to “wear down the complainant” and drive up her legal bills. These included an alleged assault on one teacher and claims that a student had filmed another teacher’s “backside”. Teachers lodged a collective grievance in the spring of 2022 raising concerns about health and safety, the loss of staff facilities and student discipline. Ms Clancy maintains she was penalised for putting her name to the grievance when her timetable for the term starting in September 2022 was changed, requiring her to teach in the afternoons and upending childcare arrangements she said had been agreed with Ms Quinn’s predecessor before she agreed to teach at the school. Cross-examining Ms Clancy earlier this year, the school’s barrister, Rosemary Mallon, said that Ms Quinn would tell the tribunal herself that although she found the collective grievance difficult, she “didn’t take it personally and didn’t do anything to specifically target you”. The cross-examination of three witnesses called by Ms Clancy’s lawyers was deferred on April 25th this year as the principal was “unable to attend” on that date. The principal had gone to each previous hearing of the matter – with the school’s barrister putting it to Ms Clancy under cross-examination in February that various allegations she had made would be contradicted by the principal when she testified. “I think the manner in which the respondent board of management has conducted this litigation has been nothing short of appalling ... The tactics employed have had the effect of attempting to wear down the complainant and incur exceptional legal expense through all this back and forth,” Ms Clancy’s barrister, Conor Duff, told the hearing. The tribunal is now set to hear evidence next Tuesday from the final witness in the case. The tribunal will then hear closing arguments.
