State officials last inspected the day care center on December 5 and the agency did not cite the facility for any violations at the time Extensive regulations govern registered or licensed day-care facilities including the requirement that pools on site must have barriers at least 48 inches high In addition to not having the proper barriers surrounding its pool the facility where the drowning occurred racked up several other violations during its most recent inspection.According to the OCFS website other offenses included not maintaining daily attendance records; not having written permission from parents for sleeping arrangements; not keeping files of those authorized to take the children from the center; not maintaining files on children's health records and not keeping files documenting the arrival and departure times of employees and volunteers The owner of Mother Byrd could not immediately be reached for comment Battipaglia said Edward had attended the day-care center in Mariners Harbor since he was about 4 months old He was supposed to start prekindergarten at PS 26 in the fall worked at Mother Byrd for about five years and was caring for children at the daycare center when Edward drowned Battipaglia said.The victim somehow slipped into an above-ground backyard pool at the school at approximately 5:41 p.m The boy had been removed from the pool by the time responding officers arrived He was rushed to Richmond University Medical Center "It has not been easy for the family," said Mrs "I was in church yesterday with tears in my eyes -- my husband gets off work and sits outside crying."
