has won a case against Jaleel Ghana Company Limited in the Supreme Court of Ghana
The Court of Appeal had in a unanimous ruling
indicated that the 138-acre parcel of land which was the subject of litigation
granted Trasacco Furniture entry and possession of the said land
proceeded to the Supreme Court and filed a motion for an injunction and stay of execution
established unequivocally that Jaleel’s motion for stay of execution and the injunction on entry and possession of the property was ‘grossly incompetent and unmeritorious’
The court said their continuous occupation of the land belonging to Trasacco Furniture was unlawful
and that their appeal is frivolous and fails to lay out any legal canons worthy of upsetting the judgment entered in the judgment of the Court of Appeal on October 28
Pursuant to the Court of Appeal’s decision handed down in favour of Trasacco Furniture on October 28
served notice on all persons who illegally acquired parcels of land in Pantang to vacate as there will be consequences
“It will be recalled that sometime in March 2020
there was a publication in the Daily Graphic cautioning the general public about the illegal sale of land at Pantang (near head office of Micheletti & Co
The purpose of this was to serve notice that any such purchases of the said lands were not in conformity with law
these unscrupulous persons flagrantly disregarded the orders and went on with their illegality
ruling in favour of Trasacco Group,” the statement noted

THE COURT of Appeal has unanimously ruled in favour of Trasacco Group over a 48 acre land situated at Borteyman in the Tema District of the Greater Accra Region
The civil action commenced at the Accra High Court
Land Court ‘2’ in July 2013 between Trasacco Estates Development Company Limited (Plaintiff) and Woodfields Development Company Limited (1st Defendant) and Comet Roofing and Property Development Limited (2nd Defendant)
concerning some lands at Borteyman in the Tema District
The High Court upon examination ruled in favour of Trasacco Estate Development Company Limited as the true owners of the parcel of land in dispute
Woodfields Development Company Limited appealed against the High Court’s decision at the Court of Appeal
The Court of Appeal after careful examination and in consideration of the facts and evidence available
The three-member panel presided over by Justice Senyo Dzamefe and assisted by Justices Jennifer Dodoo and J.A
Bartels-Kodwo held that there are no exceptional circumstances to make the court grant the application
“In the first place as at 2003 when the land was allegedly granted to the applicant by the Nungua Stool
The grantor therefore had no title to transfer nor grant to the applicant
Based on that we dismiss the application,” the court ruled
The court also awarded a cost of GH¢3,000 for the respondent against the applicant
This was after the applicants failed to attend court proceeding to move their application and the counsel for the respondent prayed despite their absence the court goes into the merits
which it granted by allowing the respondent to respond to the application
the defendant/respondent (Trasacco Estates Development Company Limited) stated that the land was government land and given back to the stool in 2012 and for seven years now the case was pending
The judgment is unimpeachable and hardship will tilt to the respondent whose hands have been tied since 2013
The Appeals Court granted the respondent’s prayer and dismissed the application

Empire Builders Limited has responded to claims made by the Nungua Stool regarding ownership of land in Trasacco Valley
In a statement signed by its Executive Chairman
Empire Builders Limited said the “claims have been contrived to cause unnecessary apprehension amongst homeowners and to defraud them.”
the company warned Trasacco Valley residents to “please do not fall victim to fraud.”
The Nungu Mantse and Gborbu Wulomo had issued a notice to all homeowners and residents of Trassaco Valley Estate in East Legon and Adjiriganor requiring them to atone for their tenancy or risk losing their properties
The notice was issued in response to a Supreme Court decision in 2020
But Empire Builders says “We wish to assure all homeowners of the rights
title and interest of Empire Builders Limited in the land at Trasacco Valley Phases I and II (the land at phase III belongs to Trasacco Estates Development Company Limited and was never part of the subject matter of the dispute
The statement added that “We further wish to assure all homeowners that we will continue to do our utmost best to ensure your peaceful enjoyment of your property at Trasacco Valley.”

A statement signed by the Public Relations Consultant of Empire Kings
said the judgment of the Supreme Court must guide the actions of parties in the dispute and provide the path to a harmonious business environment for all
“We are calling on all sides to respect the court’s order,” the statement said
“We ask that the other party stays within the 62 acres stipulated by the courts
We ask that the land guards are called off so the intimidation and threat to property ceases
along with all the distress,” the statement further stated
“We also call on the media to carry out its mandate with fairness
guided by the truth and the ethical requirement of upholding the public interest always.”
Empire Builders sued Top Kings for allegedly trespassing on a 62-acre plot which Empire claimed to have title to
the High Court held that Top Kings was to “keep the portion of the disputed land that are already in its possession”
The statement said the Nungua Stool subsequently transferred approximately 62 acres — separate and distinct from the 62 acres declared in favour of Topkings by the High Court — to Empire Builders for valuable consideration
the government transferred 57 acres of the parcel decreed in its favour to Empire Builders
against the judgment of the Court of Appeal at the Supreme Court
the Supreme Court upheld the Court of Appeal’s order
affirming that Top Kings should maintain possession of the 62 acres it already had
“The 62 acres which the Supreme Court judgment allowed Top Kings to keep never formed part of the Trasacco Valley master scheme,” the statement said
It further claimed that Top Kings was already in possession of the 62-acre plot “as far back as 1999
and by the time of the Supreme Court’s judgment in December 2020
it had already developed the area into the Kings Cottage Estates”
Calls and text messages to a top executive of Top Kings for the company’s reaction were not answered

More than 100 contract workers of Italian construction company
protested against the firm which builds Accra’s most luxurious homes
The demonstration was against the company’s decision to pay them only 25 percent of their salaries after sacking them two months ago without pay
The company allegedly sacked them verbally
without giving them their retrenchment packages
The affected staff say they endured harsh working conditions over the years while working with Trasacco
they had worked as contract workers for eight years without their full salaries
contrary to a stated probation period of 6 months
They therefore massed up at the company’s headquarters to demand their retrenchment benefits
One of the affected workers who narrated his ordeal to Citi News said the decision to lay them off has no basis
“There is no confusion between us and the company but they told us to go for no reason
then they should give us our benefits as stipulated by law
the company is now telling us that they never knew they had casual workers.”
I am paid GHc132 instead of GHc250.We have not committed any crime
They just sacked us without giving us any compensation
management of the company has absolved itself from any wrongdoing

“Temporary workers were asked to go on vacation for two months
economic conditions and scaling down our operations which is very prominent in any construction industry

A High Court had earlier ruled in favour of Trasacco as true owners of the parcel of land which was disputed by Woodfields Development Company Limited
Woodfields had encroached on portions of the land
pushing Trasacco to take the matter to court
It is not yet clear if Woodfields Development Company Limited will want to take the matter to the Supreme Court
A civil suit was commenced at the Accra High Court
in July 2013 between Trasacco Estates Development Company Limited as the Plaintiff and Woodfields Development Company Limited as the 1st Defendant – with Comet Roofing and Property Development Limited as 2nd Defendant
concerning some lands belonging to the Plaintiff at Borteyman in the Tema district of the Greater Accra Region
The High court upon examination ruled in favour of Trasacco as true owners of the parcel of land in dispute
The matter was then appealed to the Court of Appeal by Woodfields
The Court of Appeal after careful examination and in consideration of the facts and evidence available to the court unanimously ruled in favour of Trasacco
affirming the High Court’s decision; as in the wisdom of the Court
Woodfields had encroached upon a land that belonged to Trasacco Company Limited
A conspicuous expanse of land with overgrown greenery at the Shalom Estates
near Pantang in the La Nkwantanang-Madina Municipality
has over the years has become a shelter for crime and a haven of dangerous animals
The thick stretch of green is on the property said to be owned by Trassaco
but there has been very little activity on the land for over a decade
The residents only want Trassaco to keep the land well maintained to reduce the perceived threats to their domesticity
Some of them have said they would be willing to take care of the land if Trassaco wasn’t so protective
the Assembly Member for the Pantang electoral
explained that Trassaco “won’t allow anyone to go there.”
“There is a security man working there
who first came to Shalom Estates in 2002 and has been living there since 2007
came to meet the large swathe of green that is home to animals that residents consider threats
however you find in front of us this forest,” she said summing up one-half of the community’s concerns
They have to contend with what the feel is an excessive amount of cockroaches
Everything that is supposed to be in the bush is here.”
The residents harbor a particular fear for a large python they say patrols their eroded feeder road at night
“There is a huge python in the forest which comes out every midnight
Most taxi drivers in this area have come across it
they don’t want to come to this area,” Hajia Salamatu noted
The area is fumigated about every six months to provide some relief from the rodents and poisonous animals
“In less than 30 minutes [after the last fumigation]
more than 20 scorpions [died]; the big black ones and by the following morning we couldn’t come out [of our rooms]
They were all over the yard,” Hajia Salamatu recalled
Shalom Estate Residents Association is aware of the problem
but appears to have its hands tied because there is no overt illegality being perpetrated by Trassaco
stessed his concern for the residents saying the threats were “obvious.”
But he noted that “this is somebody’s land
So I don’t see how I can complain… I don’t know where the association comes in here.”
“If you share the boundary with somebody and his place is overgrown
I don’t know what we can do… if their compound is bushy
I find it difficult telling them to weed their compound,” Emmanuel Ogoe stated
Fumigation may be able to keep some dangerous animals at bay
but the community’s fear of crime still abounds
The residents believe the state of the land makes it a perfect hiding spot for criminals
Another homeowner living across from the forest
lamented the lack of urgency towards the crime situation from the police and the Assembly
a man reportedly hanged himself in the area
prompting a rare police and assembly response according to some of the residents
But Geaton recalled that it resulted in little action
“We thought when they were going with the body; we would hear something from them [Assembly] but nothing.”
“The police came and recorded the case of a guy raping a nurse and butchering the lady; just recently
By a section of the walled land lay the ruins of what was believed to be a hang out for some criminals
The base was reportedly destroyed by some security personnel when an influential man in the area was attacked
But that appeared to be the strongest action against crime in the area
the Shalom Estates is home to a cross-section of persons from diverse backgrounds and economic classes
In between two large buildings is an uncompleted one where Bright Ampem lives with his family
While he is fortunate to have a roof over his head and has a warm relationship with some of the residents
others sometimes suspect him of the criminal activity
people think that because I live in an uncompleted building I am the one stealing
They have those negative thoughts about me.”
he has proffered his solution to the community’s problems; farming
“Even if they [Trassaco] can’t clear the land
we can clear the land and farm on it in the meantime
said he has forwarded the complaints of the concerned residents to the Municipal Assembly
He also feels allowing some of the residents to farm on the land could help keep it clearer and less conducive to criminals
we can farm there so that [the problems will be solved… It is a matter of compromising with the company.”
Attempts to reach authorities of Trassaco for comment on the matter have been unsuccessful so far

A decision by the Supreme Court in the case between Trassaco Group Limited and Jeleel Company Ghana Limited regarding a parcel of land at Pantang in the Adentan Municipality in Accra has questioned Jeleel Company Limited’s logic in bringing a case of contempt against real estate giants
It would be recalled that Trasacco Group had attempted razing down the frontage of an entrance built by Jeleel on the parcel of land at Pantang after the Court of Appeal had ruled in its favour as the legitimate owners of the parcel of land
The lawlessness that precipitated this move was eyesoric to say the least; no sooner had Trasacco set-out to demolish the structure than a group of chisel and hammer wielding thugs were unleashed on workers of Trasacco Group by Jeleel
The thugs proceeded to set ablaze an excavator belonging to Trasacco group
It took the intervention of the Ghana National Fire Service to douse the flames
This was however not enough to deter the relentless hoodlums who finally set fire to the excavator at midnight
in their own pipe dream decided to seek legal recourse by leveling contempt allegations against Trasacco in what they described as a ‘fraudulent scheme purporting to execute a ruling of the Court of Appeal’
expressly opining on this issue has quizzed the Complainant
Jeleel Company Limited if Trasacco cannot take steps to ward-off trespassers from encroaching on the aforementioned property
“Can’t a man take steps to ward trespassers off his property?” – the Judge asked
Jeleel Company Limited are seeking to overturn the Court’s ruling which declared their writ of possession as a nullity and or void in respect of the parcel of land at Pantang
despite flagrantly disregarding the initial ruling by unleashing thugs on Trasacco’s employees
The Court by questioning Jeleel Company Limited’s modus operandi makes it abundantly clear that Jeleel are uninformed and are pursuing a lost course

Kwame Owusu Danso has expressed satisfaction with the court’s ruling and fervently hopes the Police will assist them in executing the order of possession directive from the Court
