Ahead of the expected appellate verdict on Wednesday (31 January 2024) in the case of Kuwaiti Bidun activist Mohammad al-Bargash
who is being prosecuted for speaking about the human rights of Kuwait’s stateless Bidun population
Amnesty International’s Deputy Regional Director for the Middle East and North Africa
Mohammad al-Bargash has been one of the most vocal advocates calling for the Bidun’s human rights in Kuwait
It is shameful that Kuwaiti authorities are punishing al-Bargash simply for seeking to prick the conscience of the Kuwaiti government and people
in order to secure their respect for the right of the Bidun to be treated as equals in their own country
“The pursuit of this prosecution sends a chilling message to all who dare exercise their right to freedom of expression about the Biduns’ situation
His prosecution for speaking about the human rights of Kuwait’s stateless is not only unjust but should never have come to pass
Authorities must quash all charges against him and end their persistent discriminatory practices against the Bidun community
“This is not the first time Kuwaiti authorities have attempted to imprison Bidun rights activists
nor the first instance of targeting al-Bargash
It is past time that Kuwaiti authorities stopped this farce and granted stateless Bidun their rights to nationality
in plain clothes and without an arrest warrant
detained Mohammad al-Bargash at his workplace
an electronics shop in the al-Sulaibiya neighborhood of al-Jahra governorate
He is accused of “spreading false news and rumors abroad” that would “undermine the country’s prestige and standing” after he conducted an interview with Nabaa TV
a Saudi opposition channel broadcasting from Lebanon
He was held in prison for more than seven weeks and was then eventually released when a trial court acquitted him on 25 October 2023
and the appellate court is poised to issue its verdict this Wednesday
He has previously faced prison time for participating in a peaceful demonstration for Bidun rights in the Bidun neighborhood of Taima on 26 August 2022
with al-Bargash sentenced to pay a 200-dinar fine (approximately $650 USD) and given a suspended one-year prison sentence
He faces a prison sentence of three to 15 years under the current charges
with the possibility of an even longer sentence because of his previous conviction
Kuwait’s systematic discrimination against the Bidun violates its legal obligations
including under the International Convention on the Elimination of All Forms of Racial Discrimination
the Convention on the Rights of the Child and the International Covenant on Economic

Stateless Bidun Planned Memorial After Member’s Suicide
(Beirut) – Kuwait’s State Security agency arrested at least 14 activists from the stateless Bidun community over the past week
Authorities arrested the activists after they organized a peaceful sit-in at al-Hurriya Square in al- Jahra town near Kuwait City on July 12, 2019 in response to the death of Ayed Hamad Moudath. Moudath, 20, committed suicide on July 7 after the government denied him civil documentation
“Kuwaiti authorities should immediately release the detained Bidun activists, who were peacefully advocating for their fundamental rights,” said Michael Page
deputy Middle East director at Human Rights Watch
“The Kuwaiti government needs to fairly resolve the longstanding issue of stateless people in Kuwait instead of trying to silence them.”
On July 12, before the sit-in was scheduled to begin, the authorities surrounded the homes of those who had led previous sit-ins and arrested them. They include a prominent human rights defender, Abdulhakim al-Fadhli
The agents also confiscated al-Fadhli’s and his family’s cellphones and computers
A source told Human Rights Watch that al-Fadhli was beaten while in custody with the State Security agency and was not allowed to file a complaint
Authorities had previously arrested al-Fadhli several times for his peaceful activities on behalf of the Bidun community
Other activists arrested between July 11 and 13 are: Awad al-Onan
The authorities arrested activists at their homes
but did not detain people at the sit-in location
Abdelhadi and al-Saadoun were released on July 11
The general prosecutor has extended the detention of others until July 21
The source said that the charges against the activists include spreading fake news
joining a group that calls for the destruction of the country’s basic systems
and use of cellphones for abusive purposes
The Universal Declaration of Human Rights provides that “everyone,” not just citizens
has the right to freedom of expression and to peaceful assembly
the Kuwaiti government’s language to refer to the Bidun has changed
and Kuwaiti authorities now refer to them as “illegal residents.” The government claims that most of them moved to Kuwait from neighboring countries in search of a better livelihood and hid their other nationalities to claim Kuwaiti citizenship
As "illegal residents," the Bidun face obstacles to obtaining civil documentation
leaving them unable to consistently get social services or function as normal members of society and interfering with their fundamental rights to health and work
the Central System for the Remedy of Situations of Illegal Residents
the administrative body in charge of Bidun affairs
The process of determining applicants’ eligibility for services and whether they hold another nationality remains opaque
the ID cards issued to Bidun have often indicated that the cardholder possesses another nationality
but it remains unclear how the Central System determines the individual’s alleged nationality and what due process systems are available for Bidun to challenge the Central System’s decision
The updated version of this news release corrects the date Abdelhadi al-Fadhli and Alaa al-Saadoun were released
and the number and list of activists arrested
