Professor Carsten Stahn gave a presentation on the topic ‘Plus ça change
Impunity Discourse and Typologies of Victor’s (In)Justice from WWII to Ukraine’ at the Agora on Conceptualizing Fairness and International Criminal Justice on 1 September 2023
Both presentations were well-received and stimulated thought-provoking discussions both among panellists as well as with the audience
Grotius staff members and PhD researchers were also members of various ESIL interest groups
which covered a wide range of research interests
ranging from International Economic Law to Peace and Security
and the History of International Law. Dr Anna-Alexandra Marhold was the co-convenor of the workshop of the ESIL International Economic Law Interest Group in 2023
which discussed the different facets of fairness in International Trade Law
Runar Lie presented his paper in this workshop
titled 'Ghosts of the Past: The Dominance of Older Treaty Language in International Investment Arbitration'
which was subsequently awarded the ESIL Young Scholar Prize of 2023; Dr Cecily Rose chaired an interest group workshop on ‘New International Courts and Tribunals’
The first panel focused on new institutions and methods in the areas of the environment and the law of the sea
namely proposals for an international court for the environment and the dispute settlement provisions of the BBNJ Treaty
The second panel focused on new institutions in business and human rights
and trade; namely the Meta/Facebook Oversight Board
the WTO’s MPIA (multi-party interim appeal arbitration arrangement)
and the proposal for a multilateral investment court
Cecily organized the event with the other co-conveners of the ESIL interest group on international courts and tribunals
two Grotius PhD candidates presented their research on two different topics: Ms Ida Asscher LL.M
titled ‘Buck-Passing through the deprivation of nationality: an unfair practice regulated by international law’ at the Peace and Security Interest Group on 31 August 2023
‘Unequal Treaties: Revisiting China’s approaches toward colonial injustice’ at the ESIL Interest Group on the History of International Law
Both presentations showcased the wide spectrum of research conducted within the Grotius Centre to the academic audience
It also allowed early-career scholars to receive useful and constructive feedback from their academic peers and build useful connections amongst scholars based in different parts of Europe who nonetheless shared similar research interests
Apart from engaging in scholarly discussions
Grotius staff members and researchers also enjoyed a strong presence at various activities organised by the ESIL and l’université d’Aix-Marseille in the beautiful city of Aix-en-Provence
Activities included the Early-Career Drinks on the terrace of Le Vieux Tonneau on 31 August 2023 and the conference dinner at the Aquabella restaurant
located in the central part of the old town on 1 September 2023

Exploring the Frontiers of International Law
A team of faculty from the College of Engineering and Applied Science and the College of Liberal Arts and Sciences has received a $1 million National Science Foundation (NSF) S-STEM award to support the new Environmental Stewardship of Indigenous Lands (ESIL) program
This is the second NSF award for the program
which is currently enrolling students for fall 2018

ESIL students are required to meet the requirements of their home department plus those of the ESIL certificate program
which ensures that all ESIL students have a common core in STEM
cultural diversity and cross-cultural communication
this program does not require CU Denver to support any new courses and does not require ESIL students in civil engineering
or environmental sciences to take additional credit hours for graduation
because all the ESIL courses that are not major requirements can be taken as electives
in addition to a traditional four-year STEM degree
is participation in training and internships designed to provide background with nontechnical matters such as cultural awareness
environmental regulations and organizational dynamics
this educational program is designed to support recruitment of Indigenous students
“We plan to guide our students through every step of the process
through logistical advice on moving to Denver (if necessary)
and landing their first professional engagement after leaving CU Denver.”
The focus on land stewardship has been selected not only because it demands the expertise of STEM professionals but also because land stewardship is among the top motivations for Indigenous students considering STEM careers

or if you represent an organization that might be interested in partnering with the ESIL program (perhaps providing internships or extracurricular support to ESIL students)
by all means please let us know,” said Mays
the team also received an award of nearly $300,000 from the National Science Foundation to support the ESIL program
This award is one of 27 design and development launch pilots in the second round of NSF’s program for Inclusion across the Nation of Communities of Learners of Underrepresented Discoverers in Engineering and Science (INCLUDES)

The European Society of International Law (ESIL) is Europe's largest organization for researchers
teachers and students in international law
The annual conference was to be held in the autumn of 2020
the conference could take place at Stockholm University
almost 500 participants from all over the world was gathered around the theme
"Changes in international law-making: actors
impact." The conference was organized in a hybrid format: more than 200 participants were on site at Stockholm University
while other participants followed the conference digitally
Stockholm University President Astrid Söderbergh Widding expressed joy that it is now once again possible to arrange scientific conferences
and that the hybrid format will become increasingly common
Swedish Crown Princess Victoria gave an engaged opening speech in which she emphasized that Sweden has a long tradition of working with international law
She emphasized the efforts made by individuals like Dag Hammarskjöld
The Crown Princess also emphasized that Sweden has made pioneering efforts in international law
One example is the Stockholm Conference 1972 on the environment and the Stockholm Declaration
Sweden and Stockholm is an ideal place to arrange such an important conference,” said Crown Princess Victoria
and ESIL's Chair Photini Pazartzis also emphasized that Sweden is known for its work on international law
chairman of the Stockholm Center for International Law and Justice (SCILJ) and former Legal Counsel of the United Nations
spoke about the long tradition of research and external collaborations in international law at SCILJ and at Stockholm University
He stressed that international law constantly has an important role to play around the world

The forum discussions explored more general issues
while the agora discussions are more focused on established research areas
The ESIL conferences have two main purposes
one of the local organizers at Stockholm University
The first is to hear leading international law researchers discuss current issues and update participants on the latest developments in various areas of international law
or raise important questions for further reflection and research
The second purpose is to meet other researchers
establish collaboration with other universities
A particularly important aspect of this conference is that it is the first major international law conference to take place in a hybrid format with participants both on site and online

We regard international human rights law as a field that is simultaneously positioned both within public international law and across other disciplines
International human rights law is substantial but nonetheless a sub-branch of public international law as well as part of a large and growing interdisciplinary ‘field’ of human rights
Characterising international human rights law in this way is often overlooked but gives a much more textured and nuanced picture of its operation and the challenges it faces through resistance to containment as a sub-branch; internal-fragmentation; and interdisciplinary expansion
Resistance to Containment to a Sub-Field
This requires other principles of international law to be interpreted in line with international human rights law rather than public international law solely applying one-directionally to international human rights law
International human rights law routinely interacts with other sub-branches of public international law by demanding new interpretations of existing law (cf
the principle of territorial application of treaties as regulated in the Vienna Convention on the Law of the Treaties); by qualifying existing obligations under other bodies of law (cf
international human rights law and the law of occupation); or imposing procedural and substantive obligations onto other bodies of law (cf
International human rights law’s permeation of other branches of international law opens up new research agendas in bodies of law that have been studied in isolation from IHRL (cf
human rights law featured heavily in the International Law Commission’s study on the fragmentation of international law and the many commentaries the study has spawned
It is therefore common now to talk of human rights lawyers in terms of their sub-specialties whether torture or the right to water
a regional system or in relation to particular groups such as women or persons with disabilities
internal fragmentation raises serious questions about the coherence and unity of international human rights law as a sub-field
The dominant presence of international human rights law in public international law and the volume of jurisprudence coming from multi-level institutional sites leading to internal fragmentation both demands but challenges the feasibility of the ideal that one can be a generalist international human rights lawyer let alone a public international lawyer with a specialism in international human rights law
Layered on to these challenges is the recognition that international human rights law is now a sine qua non interdisciplinary field
Interdisciplinary expansion refers to the identity of human rights not only as a specific sub-branch of public international law but as a ‘field’ or ‘movement’
it is no longer sufficient to talk of human rights purely in terms of law but we also have to understand and interact with other languages of human rights from disciplines such as sociology
The emergence and creation of new human rights law is informed by political
social and economic developments and movements
The interpretation of substantive provisions of human rights law opens up a necessary dialogue with the theoretical foundations of human rights law and constantly changing social
The implementation of human rights law is infused with processes of political
economic and legal appropriations in different contexts
While internal-fragmentation and interdisciplinary expansion might seem diametrically opposed
they can converge by steering actors and institutions to view human rights thematically rather than steeped in one discipline
with some exceptions one might work thematically on torture or health or in relation to particular groups such as women
with a group of colleagues from different disciplines without necessarily focusing on the intra or interdisciplinary anchors
the examination of the wider questions of internal fragmentation; resistance to containment to a sub-field; and interdisciplinary expansion through a thematic lens might provide key insights into how to address these pressing challenges of volume and disciplinary coherence
More work might be done therefore to seize the opportunity of thematic spaces to advance thinking on the disciplinary underpinnings and future of international human rights law
The challenges for international human rights law
are not contained to its vertical relationship to public international law
its horizontal relationship to other sub-branches of international law or its relationship to multilevel interpretative communities of human rights law
International human rights law reaches both inwards and outwards
We do not always consciously think of human rights as simultaneously part of a system of law and a wider field
our view is that we will be better able to see the achievements
the challenges and opportunities for intra and interdisciplinary exchange
we need to investigate the normative and practical basis on which human rights law can maintain its dual identity as a specialised sub-branch of public international law (and other disciplines) and a wider field or discourse reaching across disciplinary boundaries both within law and beyond
If one person cannot be all things at all times
we may need to consciously shift our positions and vantage points moving between sub-specialism
generalist human rights lawyer and generalist public international lawyer and developing a language for interacting with (increasingly dominant) disciplines in the human rights ‘field’
With this significant research agenda in mind
the ESIL Interest Group on International Human Rights Law seeks to be a hub for international human rights law researchers interested in reflecting on the place of international human rights law within the general field of public international law as well as in the field of human rights studies more broadly
