MEXICO CITY — Mexican President Claudia Sheinbaum said on Saturday that U.S
President Donald Trump proposed sending American troops into Mexico to help her administration fight drug trafficking but that she rejected it
Her remarks to supporters in eastern Mexico came in response to a Wall Street Journal article published the day before
describing a tense phone call last month in which Trump reportedly pressured her to accept a bigger role for the U.S
military in combating drug cartels in Mexico
'How can we help you fight drug trafficking
I propose that the United States military come in and help you.' And you know what I said to him
White House National Security Council spokesman James Hewitt said in a statement later Saturday that Trump has worked closely with Mexico's president "to achieve the most secure southwest border in history."
"Dangerous Foreign Terrorist Organizations
continue to threaten our shared security and the drugs and crime they spread threaten American communities across the country," the statement said
"The President has been crystal clear that Mexico must do more do combat these gangs and cartels and the United States stands ready to assist and expand the already close cooperation between our two countries."

But Sheinbaum's hardline stance Saturday signaled that U.S
pressure for unilateral military intervention would put her and Trump on a collision course after months of cooperation on immigration and trade

the Wisconsin governor responded to Homan in a video statement posted online
Evers spoke in part about a memo he issued last month to Wisconsin state employees that echoes guidance given by other state and city governments
which instructs them to call a state lawyer if an ICE agent or other federal agent shows up at their workplace and questions them
It also tells workers not to give agents access to nonpublic areas

apparently threatened to arrest me for distributing guidance that asks state agency employees to consult with an attorney if federal agents show up at state buildings with legal documents
The goal of this guidance was simple: to provide clear
consistent instructions to state employees and ensure they have a lawyer to help them comply with all federal and state laws — nothing more
But Republicans and their right-wing wing allies
accused me of doing things I didn’t do or say
and fueled a fake controversy of their own creation
I’m used to Republicans and the right wing lying about me
And I’ve never encouraged or directed anyone to break any laws or commit any crimes
But when President Trump’s handpicked appointee Tom Homan was asked about me and this guidance after he apparently threatened to arrest elected officials across the country
“Wait 'til you see what's coming.” “Wait 'til you see what's coming.” Overnight
encouraging the Trump administration to arrest me
Chilling threats like this should be of concern to every Wisconsinite and every American who cares about this country and the values we hold dear
the federal government doesn’t get to abuse its power to threaten everyday Americans
the federal government doesn’t get to arrest American citizens who have not committed a crime
we don’t threaten to persecute people just because they belong to a different political party
These threats represent a concerning trajectory in this country
We now have a federal government that will threaten or arrest an elected official
committed no crimes and done nothing wrong
And as disgusted as I am about the continued actions of the Trump administration
I have never once been discouraged from doing the right thing

President Trump says he doesn’t know if he needs to uphold the Constitution or if people in the U.S

AMY GOODMAN: “Without precedent” could also describe our president
If you could first respond to this direct threat against the Wisconsin governor
this veiled threat against Governor Evers and any elected official in the United States
What Governor Evers did was issue guidance to consult lawyers
state and local officials have a right to consult lawyers when they encounter federal agents or local and state agents
what’s outrageous is the threats being made by this administration
is this escalation of attacks on pillars of civil society
as well as on the actual responsibilities under the Constitution that the president and senators and other officers take an oath to uphold
going back to Wisconsin Governor Tommy Thompson
Wisconsin often seen as a kind of model for the country
And do you see this as going back to retaliation for Elon Musk
complete defeat in Wisconsin over his support for the conservative judge that lost by not a few percentage points
unprecedented intervention by Elon Musk to basically try to buy a seat on the Wisconsin Supreme Court
while he also has litigation pending in the state of Wisconsin over his business
is just an absolute degradation of the rule of law
The Constitution requires that no person be deprived of life
liberty or property without due process of law
not retaliation for not being in the fan club of this president or the men that he has put into these roles in which they’re engaging such destruction
we have seen Wisconsin targeted in that way
obviously by Musk in this most recent Supreme Court race in which he was resoundingly defeated
but I think we’re also seeing this broader attack — the governor of Maine
defend the rights and interests of their citizens
in Social Security when they’re born in the United States
We’re seeing this assault on the idea
the requirement under the Constitution that the writ of habeas corpus not be suspended
have a right to have an independent judicial tribunal assess whether there’s evidence against them
assess whether they can be held and deprived of their liberty
But Trump and this administration has leveled an assault on that legal command that Donald Trump took an oath to uphold
I question whether that oath had any meaning anymore
after John Roberts waved away the criminal liability of Donald Trump in that disastrous immunity decision last summer without precedent — like the title of my book — but that unprecedented decision to say the president is above the law
rather than that he has a duty to faithfully uphold the law
That’s what the Constitution requires of the president
And nothing could be no more faithless than breaking those laws
Nothing could be more faithless than disregarding the command
the requirement of the Constitution of due process of law for all persons
the Supreme Court Justice Ketanji Brown Jackson appeared to forcefully rebuke President Trump and the administration’s attack on judges it deems unfavorable to its agenda
“the elephant in the room.” Justice Brown Jackson said
They seem designed to intimidate those of us who serve in this critical capacity
The threats and harassment are attacks on our democracy
And they ultimately risk undermining our Constitution and the rule of law.” Again
those are the words of a Supreme Court justice
We are seeing this assault on the independence of the judicial branch
on the notion that anyone can check the demands of this president
the idea — on the idea that the president and his attorney general can just disregard long-standing laws
that they can decide not to follow the commands
as we saw in the case of Judge Boasberg’s order involving the Trump administration’s attempts to basically evade the requirement of people getting due process in this country
not just because of the disobedience of court orders by Trump
but also by these attacks on judges for daring to do their job and enforce our laws and protect our rights
including that right to due process that everyone is entitled to
whether you’re a citizen or immigrant in the United States
to speak out and to not tolerate this outrageous disregard for the command of our Constitution to defend all of our rights against this authoritarian leadership that is expanding its efforts to control the American people
It’s dealing with the Chief Justice Roberts
who has at some points now sided with the liberal judges

You’re saying he really laid the groundwork here
I think even if he were to rule against Trump on more than a temporary basis on some of these orders
what John Roberts has done is usher in this new era
He basically signaled to the American people last summer that Trump could do no wrong
that he could not be held criminally liable for his actions
and that anything that constitutes an official act
is immune from any criminal consequences or prosecution
John Roberts really paved the way for this authoritarian era we’re in
He also did so by really systematically dismantling core voting rights protections in this country
we have a situation where there is an apparent conflict
between the Supreme Court right now and Donald Trump
but we’ve also seen John Roberts move heaven and earth
we’ll see what John Roberts does in the coming weeks
John Roberts has laid the foundation for this authoritarianism
for this aggrandizement of presidential power and for the degradation of fundamental liberties in this country
including key protections for voting rights
John Roberts has dismantled key guardrails in our democracy
AMY GOODMAN: And the Supreme Court ruling about facilitating the return of Kilmar Abrego Garcia
and the fact that Trump has been defiant in saying no
what does that mean when it comes to executive power and judiciary power
LISA GRAVES: I was concerned about that language
that order seemed to command that the president take action and return this Maryland man to his home
it seemed as though it was not the strongest language that could be issued by this court
And Donald Trump has exploited that language to basically suggest that he can’t do it — although he recently suggested that he could do it
is that this court needs to take robust action to defend the ordinary laws in this country and these norms that you just cannot ship someone out of this country
declare them a terrorist with no evidence to any independent judge to assess whether there’s any validity to that
People have been removed from this country who have not been convicted of crimes
and notwithstanding the assertions of Donald Trump on that most recent interview that there are millions of murderers roaming the streets who are immigrants
Many people who are people who are convicted of crimes are serving sentences
This is a fake crisis that he has basically tried to plant in people’s minds in order to exercise extraordinary
to stand up for the due process clause and the writ of habeas corpus
given his efforts to advance the Republican Party in numerous ways
whether he will stand with other Republican appointees to the Supreme Court and find technical ways for Donald Trump could get away with this assault on core principles of our democracy and our Constitution
given the fact that John Roberts invented immunity for the president
that has never existed in our constitutional history
I don’t have confidence that he will — that John Roberts and his fellow Republican appointees will correctly interpret the 14th Amendment when it comes to the rights of citizens
including American citizens born in this country
that is the first clause of the 14th Amendment
This court has veered away from the plain meaning of the Constitution
the American people deserve a court we can have confidence in
won’t put its thumb on the scale of justice in favor of Donald Trump or any other president because of their party or their allegiance or alignment

The idea to use the facility to expand ICE detention came after new contracts were announced with private prison companies to increase the number of beds
while the administration also used space at Guantanamo Bay in Cuba to house deportees
Trump's proposal saw backlash over the weekend
with concerns around the cost to bring the prison back into everyday use as a high-security facility
as well as the logistics of such an operation
Homan said on Monday morning that discussions are underway with additional countries—beyond El Salvador—that may be willing to accept deported migrants from the United States
he declined to specify how many nations are involved
saying only that "there's talks underway with countries."
In response to questions about the administration's recently announced plan to offer undocumented immigrants $1,000 and travel assistance to voluntarily return to their home countries

adding that migrants are "starting to get the message" that self-deportation can be a good option

WASHINGTON —The Trump administration released a look into its proposed budget for fiscal year 2026
The “skinny budget” request includes vast cuts to the majority of federal departments and large increases for the Department of Defense and Department of Homeland Security
The proposal outlines a dramatic reduction in non-defense discretionary spending — cut by $163 billion
this would represent the lowest level of non-defense discretionary funding since 2017
The administration says the savings come from eliminating programs related to diversity
climate-related initiatives and transferring certain responsibilities to state and local governments
while funding for the Department of Homeland Security would increase nearly 65%
These increases are intended to bolster military readiness and immigration enforcement
The administration emphasized that the budget would be supported by legislation referred to as the “One Big Beautiful Bill,” which it intends to pass with a simple congressional majority
In addition to defense and homeland security
the budget maintains support for veterans and law enforcement
In a more detailed budget overview
the administration specified that the “Reconciliation” funding allocated to DHS would enable the department to “to fully implement the President’s mass removal campaign
finish construction of the border wall on the Southwest border
procure advanced border security technology
modernize the fleet and facilities of the Coast Guard
and enhance Secret Service protective operations.”
The funding is also aimed at “[bolstering] State and local capacity to enhance security around key events and facilities,” including events like the 2026 World Cup and 2028 Olympics
Cuts within DHS include FEMA spending and TSA screening
nearly 40 DOJ grant programs would be eliminated
including grant programs that “are duplicative
not aligned with the President’s priorities
or are weaponized against the American people.” The budget also proposes cutting overhead funding for the FBI
The White House said it plans to reduce violent crime by “getting agents into the field” and preserving existing law enforcement officers
The ATF is also facing proposed budget cuts
which the administration says are intended to refocus the agency’s mission while supporting Second Amendment rights and enhancing efforts to combat illegal firearms trafficking
The proposal also includes increases to veterans programs
including $50 billion in mandatory funding through the Toxic Exposures Fund
The Fund is aimed at addressing health conditions linked to military service-related environmental hazards
The budget also earmarks $1.1 billion in new funding to combat veteran homelessness — described by the administration as the largest increase in a decade

all of the 39 people arrested were undocumented migrants from the countries of Guatemala
“Targeted operations occurred within multiple communities in Maine using detailed intelligence reporting to identify
Border Patrol says those arrested face immigration charges under various sections of the Immigration and Nationality Act
several of those arrested also have documented criminal histories
including offenses such as assault and battery on a family member

WASHINGTON – Some Arizona border officials have welcomed President Donald Trump’s order for a military takeover at the U.S-Mexico border

The Pentagon is preparing to deploy counter-drone capabilities around the U.S.-Mexico border as part of its ongoing support of the Trump administration’s immigration enforcement and security mandates there
two senior defense officials told lawmakers Tuesday.
“[President Donald Trump] has issued several executive orders directing the Department of Defense to take all appropriate and lawful measures to ensure the complete operational control of the border
is responding by preparing the path for employment of [counter-small uncrewed aerial system or CsUAS] activities along the border — both in support of DOD interests and in support of [the Department of Homeland Security] as the lead federal agency,” said Mark Ditlevson
acting assistant secretary of defense for homeland defense and hemispheric affairs
Ditlevson and Rear Adm. Paul Spedero Jr., Joint Chiefs of Staff vice director for operations, J3, revealed those plans in written and oral testimony during a House Military and Foreign Affairs Subcommittee hearing about recent reports of unauthorized drone activity that threaten U.S
“We know that cartels have used [uncrewed aerial systems or UAS] for unauthorized surveillance to assess our troop size
to solicit and enable attacks from other vectors
We know that they have used drones for kinetic attacks,” Spedero said
The rapid emergence, proliferation and application of drones are fundamentally shifting the way that militarized groups and other adversarial organizations conduct warfare
Ditlevson and Spedero confirmed that the Pentagon is moving to buy hardware and software assets designed to help combatant commanders better understand their operating environments and their commands’ capacity to conduct non-kinetic and kinetic defense against UAS threats.

CENTER LINE, Mich. (WXYZ) — Neighbors in Center Line are shocked after the FBI raided the home of a Customs and Border Protection officer who is accused of possessing over 4,000 images of child pornography.
Fifty-seven-year-old Border Protection Officer Scott Rocky has lived in a neighborhood off McKinley in Center Line for decades. The home is about 20 feet away from a school.
"I thought he was my friend, and that is so disgusting what he did," neighbor John Kanan said.
Residents described their disbelief when federal agents descended on their street.

"It was really a shock to see that there was FBI across the street from our house," Kanan said.
Witnesses reported seeing agents removing evidence from Rocky's home.
"We're not exactly sure what they had, but they had a big red box and they were bringing out bags of stuff," neighbor Linda Lintz said.
Lintz and Kanan recall providing positive character references when Rocky was being hired by Border Protection.
"We gave him a good recommendation. We didn't have any idea that this was ever going on," Kanan said. "Our hearts are broken, and we're sad and sickened."
Rocky is accused of possessing thousands of images of children between the ages of 4 and 10.

The Pentagon has created a second military zone in the El Paso area that U.S
soldiers will patrol as part of the Trump administration’s efforts to crack down on people crossing the southern border illegally

On Friday, President Donald Trump released his skinny budget plan for fiscal year 2026
outlining his administration’s plan to reduce the federal government’s overall spending while increasing funding for border security and the military
the budget would amount to the lowest non-defense spending since 2017 while codifying in law some of Trump’s most critical early executive orders
initial version of the federal budget proposal that details top priorities and proposed spending levels
usually submitted early in the budget process
While lacking the detailed line-item breakdowns found in the full budget
it serves as an important policy statement that helps drive final negotiations
“Over the last four years, government spending aggressively turned against the American people and trillions of our dollars were used to fund cultural Marxism, radical Green New Scams, and even our own invasion,” said Russ Vought
Director of the Office of Management and Budget
when explaining the importance of Trump’s skinny budget
“No agency was spared in the Left’s taxpayer-funded cultural revolution.”
In total, Trump’s plan would cut non-defense spending by $163 billion, or 23 percent, compared to fiscal year 2025. Defense spending would see an increase of 13 percent, with the Department of Homeland Security (DHS), which oversees border security, receiving a $43.8 billion funding increase
The breakdown in border security funding includes “$500 million for U.S
Immigration and Customs Enforcement to expedite the removal of illegal aliens through the support of 50,000 detention beds
$766 million to procure cutting-edge border security technology funding
and funding to maintain 22,000 Border Patrol Agents and hire additional Customs and Border Protection officers for a total of 26,383 officers.”
The plan additionally eliminates funding from programs and initiatives that abetted illegal immigration
These cuts include $890 million from the “English Language Acquisition” program that de-emphasized English as a primary language
$729 million from the Adult Education and Family Literacy Act grant program that provided free education and job training to illegal aliens
$650 million from the Shelter and Services Program that provided hotels to illegal aliens
and $3.5 billion from programs that facilitated migration to the United States and instructed new arrivals on how to game the asylum system
DHS Secretary Kristi Noem further praised the president’s plan for cutting funding for non-governmental organizations (NGOs) that have facilitated illegal immigration
“These NGOs spent hundreds of millions in taxpayer dollars trafficking illegal aliens across the United States
All while coaching illegal aliens on how to manipulate U.S
immigration regulations to remain in the U.S
“Their Biden-funded campaign to destroy our country ends today.”
Along with increasing funding for DHS, Trump’s budget also calls for a spending increase of $113 billion at the Department of Defense
This spending includes a “Golden Dome for America” missile defense system

This includes Trump’s efforts to eliminate far-left ideologies like Critical Race Theory and radical gender theory

Some examples of DEI spending items Trump’s budget would eliminate include $315 million for preschool development programs that promoted “racial equity” and “LGBTQIA+” lessons to toddlers
$77 million from programs that trained teachers in critical race theory
and $600 million from the Environmental Protection Agency’s “environmental justice” program
The budget would also officially cut funding from the U.S
Agency for International Development (USAID) for projects such as “‘Net Zero Cities’ in Mexico
promoting political participation in LGBTQI+ communities around the world
and ‘family planning’ abortion services in places such as Afghanistan
A major component of the budget plan is the elimination of all initiatives that promoted the “Green New Deal,” which the budget labels as the “Green New Scam.” These cuts include $15 billion “purposed for unreliable renewable energy
and other costly technologies that burden ratepayers and consumers” and $6 billion “for wasteful and ineffective EV charger programs.” Additional cuts target research grants for left-wing climate goals

Customs and Border Protection officer is facing federal child pornography charges after videos that appeared to depict children and teens engaged in sex acts were found at his Macomb County home
according to an FBI agent in a court document
Scott James Rocky of Center Line is charged with receipt and distribution of child pornography and possession of child pornography
according to a criminal complaint dated May 1 in U.S
It indicates the violations occurred April 15 and May 1 in Wayne County
Rocky was arrested May 1 as a result of an investigation by the FBI in coordination with Customs and Border Protection's Office of Professional Responsibility
He has worked for customs for 17 years, according to a LinkedIn account
Rocky was being detained and is scheduled for a detention hearing Monday
"CBP stresses honor and integrity in every aspect of our mission
and the overwhelming majority of CBP employees and officers perform their duties with honor and distinction
working tirelessly every day to keep our country safe," according to the Customs and Border Protection statement
"CBP will cooperate fully with all criminal or administrative investigations of alleged misconduct by any of our personnel
According to an affidavit in federal court
an FBI agent was signed into a BitTorrent peer-to-peer file sharing program April 29
Peer-to-peer file sharing systems allow internet users to share electronic files
The agent wrote that he identified a specific computer as a potential download candidate because about 4,141 files of investigative interest − files associated with keywords or hash values related to material consistent with the federal definition of child pornography − were observed
He identified the computer on an FBI undercover computer that monitors child pornography shared on BitTorrent
He determined a computer using that IP address shared about 530 files with the undercover computer April 15
It indicated the files contained images and videos that met the federal definition of child pornography
with many appearing to depict children between the ages of 4 and 10 engaged in sexually explicit conduct
The agent reviewed a law enforcement sensitive database that said a device with the same IP address had downloaded or made available for download the same files of interest on BitTorrent in about 500 instances between April 17-19
A subpoena to Comcast indicated the IP address during the relevant time period was assigned to Rocky
A search warrant was executed at Rocky's residence May 1
where a desktop computer was reviewed before it was seized
An external hard drive found in a drawer near the computer also was reviewed
and "several animated pornography videos that appeared to depict children and teens engaged in sex acts were observed
Some of the videos were titled with incest themes."

How Turning the Border into a Military Zone Evades Congress and Threatens Rights
The administration is trying to evade limits on domestic use of the armed forces
and detaining people who cross the border unlawfully
to a Salvadoran prison notorious for human rights violations
they underscore the urgent need for Congress and the courts to reassert their roles as checks on executive authority
The Posse Comitatus Act and the Military Purpose Doctrine
Last week, the military announced that soldiers deployed on the New Mexico–Mexico border will have “enhanced authorities” because they are on land that has now been designated part of Fort Huachuca
Arizona — a military installation located more than 100 miles away
The new authorities include the power to “temporarily detain trespassers” on the “military installation” and “conduct cursory searches of trespassers
service members and Department of Defense (DoD) property.”
Searching and apprehending migrants would ordinarily run afoul of the Posse Comitatus Act
which prohibits federal armed forces from directly participating in civilian law enforcement activities unless doing so is expressly authorized by Congress or the Constitution
The law stems from an Anglo-American tradition
of restraining military interference in civilian affairs
It serves as a critical check on presidential power and a vital safeguard for both personal liberty and democracy
In authorizing soldiers to conduct apprehensions and detentions on lands that have been newly designated as a “military installation,” the president is relying on a lesser-known loophole in the Posse Comitatus Act known as the “military purpose doctrine.”
conceived by the executive branch and endorsed by the courts
holds that an action taken primarily to further a military purpose does not violate the Posse Comitatus Act even if it provides an incidental benefit to civilian law enforcement
A textbook example is the circumstance in which a person has driven drunk onto a military base
Soldiers may legally detain the intruder until civilian law enforcement arrives to take them into custody
This does not violate the Posse Comitatus Act because the primary purpose of the military’s activity is not to enforce the laws against driving while impaired
but to maintain order on the base and protect military assets and personnel
Having turned much of the southern border into a “military installation,” the administration now takes the position that anyone crossing the border without authorization in those areas is not just violating immigration law but also trespassing on a military installation
Federal troops thus have a legitimate military reason
and detain migrants without violating the Posse Comitatus Act and without the president needing to invoke the Insurrection Act at all
Using the military purpose doctrine to justify direct military involvement in immigration enforcement is a transparent ruse to evade the Posse Comitatus Act without congressional authorization
The doctrine is meant to apply only in cases where any law enforcement benefit is purely incidental
These civilian law enforcement activities are not “incidental” — they are the reason for creating the installation
And apprehending migrants who “trespass” on the installation is the primary way in which this law enforcement mission will be furthered
This use of the military is fundamentally different from the border deployments that have occurred in recent presidential administrations
The military’s role until now has been limited to logistical support
such as assisting border agents with surveillance
Providing such support does not constitute direct participation in law enforcement
so it does not violate the Posse Comitatus Act
Having soldiers perform core law enforcement duties like apprehending or detaining people
Leaving aside the question of whether an emergency, properly defined, existed on January 20 (it didn’t)
the Trump administration has made a powerful case that there is no emergency now
Trump should be revoking the emergency declaration
not relying on it to transfer federal lands to the Department of Defense
Using the military for border enforcement is also a slippery slope
If soldiers are allowed to take on domestic policing roles at the border
it may become easier to justify uses of the military in the U.S
Our nation’s founders warned against the dangers of an army turned inward
which can all too easily be turned into an instrument of tyranny
Trump’s misuse of emergency powers similarly has larger implications. Emergency declarations unlock enhanced powers contained in 150 different provisions of law
Many of these are far more potent than the ability to transfer federal lands to the Department of Defense
They include the authority to take over or shut down communications facilities
If emergency powers can be invoked for border security at a time when unlawful border crossings have reached a historic low
there is little to prevent a president from declaring fake emergencies to invoke these alarming powers
It may not be possible to pass these reforms soon
but the fight against executive overreach is not just a short-term one
Understanding the ways in which Trump’s actions threaten the rule of law today can help build support for enacting reforms in the future

"A desktop computer was located at the residence and was manually reviewed before being seized," the FBI agent wrote
"A resident at the search location stated that Rocky was the only person who used the computer."
Investigators found the external hard drive nearby in a drawer
"Several animated pornography videos that appeared to depict children and teens engaged in sex acts were observed," the FBI agent wrote
"Some of the videos were titled with incest themes."
Rocky has worked for Customs and Border Protection since May 2008 and handled a range of duties
He worked at a customs facility on Fort Street near the Detroit River and
became a counterterrorism response officer

Rocky was among nine Customs and Border Protection officials sued in 2017 by a Wayne County man
citizen who alleged he was detained and confined in isolation in a small

The Trump administration has accused the 29-year-old Maryland man of being a member of the El Salvadoran gang
which has been designated a foreign terrorist organization
His family denies any ties to gangs and Abrego Garcia has no criminal record in the United States
accused him of domestic violence and filed paperwork to obtain a restraining order

Preliminary injunction applies to future Border Patrol operations in the Eastern District of California
in a win for civil rights amid the Trump administration’s mass deportation campaign
a federal district court in California issued a preliminary injunction barring U.S
Border Patrol from using stop-and-arrest practices that violate federal law and the U.S
District Judge Jennifer Thurston’s ruling in United Farm Workers v
Noem applies to future Border Patrol operations conducted in the Eastern District of California
which stretches inland from Bakersfield to the Oregon border
Judge Thurston noted: "practices employed by Border Patrol agents during ‘Operation Return to Sender’— including detentive stops on foot patrols and vehicular stops without reasonable suspicion—the plans of Border Patrol to perform additional
similar operations in this District and the seeming position of the government that Border Patrol agents are not currently trained on their obligations under the Fourth Amendment” demonstrated imminent
irreparable harm to the people affected by Border Patrol’s actions
The preliminary injunction prohibits Border Patrol agents from:
the court ruled that Border Patrol must document all facts and circumstances related to stops and warrantless arrests in the Eastern District and issue guidance to ensure that its agents comply with the Fourth Amendment and federal law
“Today’s order affirms the dignity and constitutional rights of all people,” said Bree Bernwanger

“Border Patrol must end their illegal stop and arrest practices now.”
Border Patrol agents from the El Centro Sector traveled to Kern County where they stopped and arrested people
transported them 300 miles south to El Centro
As a result of “Operation Return to Sender,” at least 40 long-term Kern County residents remain stranded in Mexico
separated from their families and community
Border Patrol can’t just wade into communities snatching up hardworking people without due process
just for being brown and working class,” said Teresa Romero
“We will continue to fight together for the civil rights of every farm worker and every immigrant community
This agency and this administration will not keep terrorizing our union members
The order also provisionally certifies the case as a class action by certifying two proposed classes
the Suspicionless Stop Class and the Warrantless Arrest Class
All people in the Eastern District of California who meet the class definitions will be class members protected by orders issued in this lawsuit
“All residents of the Eastern District of California are entitled to live their lives without fear that federal agents will indiscriminately assault and arrest them based on the color of their skin or their perceived occupation,” said Franco Muzzio
“The Court’s decision today makes clear that Border Patrol’s lawless practices cannot continue.”
The United Farm Workers and five Kern County residents sued the Department of Homeland Security
The plaintiffs are represented by the ACLU Foundations of Northern California
