LAS VEGAS (KTNV) — A shocking encounter between a Las Vegas resident and city marshals has sparked another federal lawsuit
The lawsuit was filed on the heels of our 13 investigates series exposing City of Las Vegas marshals for allegedly overstepping their jurisdiction

It was filed April 25 by the ACLU of Nevada
alleging excessive force and constitutional violations by a man who claims he was unlawfully detained and assaulted during an illegal traffic stop
Lance Downes-Covington — a City of Las Vegas employee — is suing the city and four of its marshals
who our prior reports show conducting another allegedly illegal traffic stop on the US95 freeway

"City marshal jurisdiction is limited to Fremont Street Experience
"This is a systemic thing that they’re doing
prompting the ACLU to file its lawsuit against the city in general and Marshal Guzman in particular
What does that say," I asked ACLU Executive Director Athar Haseebullah
"It says that there's a serious accountability problem within the marshals office."
Haseebullah was able to watch Marshal Guzman's body camera footage
and “threw (him) face first onto the ground" when he asked why he was being arrested
"If our client can get stopped for a traffic infraction while headed home from the airport
it can happen to anybody in this community," Haseebullah said
all of this during a traffic stop they never should have been involved with."
The traffic stop was near Downes-Covington's home in the area of Simmons St
The lawsuit says a total of seven squad cars arrived on the scene
and that Downes-Covington was eventually told he'd be getting a ticket for not stopping at a stop sign/for emergency lights and that they'd be taking him to jail for obstructing and resisting
"Seven squad cars for one person who allegedly didn't stop at a stop sign," I asked
"The reality is that when you have offices — especially law enforcement agencies that act in a way that avoids all levels of accountability — like in this instance with the city marshals — it sort of is on brand
They routinely end up over-policing specific communities."

then cited and released from custody while at the hospital
"There was no criminal case that ended up moving forward," Haseebullah said
The lawsuit says marshals "Intended to use their power and authority to bully and harass" Downes-Covington with no "justification or lawful reason."
It accuses the city of encouraging "unconstitutional policing" and instructing "marshals to exceed their authority and jurisdiction by conducting traffic stops on city roadways."

"It's telling when you have local governments that are allowing their own offices to act without any accountability
and acting with total disregard for what the law actually looks like," Haseebullah said

the city said it interprets state law as granting them the authority to do traffic stops like those we've reported on
it seems more of a justification of misconduct than it seems to be of 'This is our honest reading that we have duplicative police powers.' Again
it's unclear why the City of Las Vegas would be partially responsible for funding LVMPD if their own police force was supposed to be doing the exact same functions
The ACLU is asking the court to declare that the "Las Vegas city marshals office misinterpreted the scope of its authority..
"We don't want to see this happen to anyone again
They need to understand what their limitations are and comply with the law
It's ridiculous that the city and any other government will continue to ask people to follow the law when they continue to disregard it themselves."
The lawsuit is also asking for at least $1 million in damages
Downes-Covington is now "anxious when driving and when interacting with members of the Las Vegas City Marshals
which he must do" in the course of his job as a city employee
He has suffered migraines and been unable to sleep
(Downes-Covington) saw Guzman at his place of business which caused him to suffer a panic attack and temporarily break from his duties due to the fact that his nose began bleeding due to the mental distress."

In the race for the District 4 seat on City Council
incumbent Chito Vela is facing four candidates
with the two most visible challengers – Monica Guzmán and Louis Herrin – notching their third and fourth races for City Council
Quality-of-life issues are the main concerns expressed by Vela
the three candidates the Monitor was able to interview (Eduardo Romero and Jim Rabuck did not respond to requests for interviews)
The biggest difference among them is the terminology and anecdotes each uses to explain the future of the district
which is located northeast of downtown and generally bounded by Braker Lane
parks and crime were the ingredients peppered throughout conversations with the three

said the city needs to continue its installation of sidewalks funded by recent bond packages for transportation needs
he said the next bond election will need to address local infrastructure

That’s all what I would call micromobility concerns that come up in meeting after meeting after meeting,” he said
“We have seen a number of sidewalks being installed throughout the district
That’s only fair because District 4 had not received its fair share of public resources for decades
We’re playing catch-up right now.” He said the district would likely need additional bond money for more sidewalk construction “as soon as possible.”

Larger transportation needs that impact the whole city are another concern for Vela
who sees Project Connect as a must-have initiative that needs to be completed
despite the legal challenges being made against the funding and administrative mechanisms used to pass it in a 2020 election
Vela wants design and planning to continue while the legal battles continue
and is looking for state leaders who can back any legislation that could negate the legal clouds hanging over the project
If the 2025 Legislature isn’t able to provide that solution
he said the city should consider a bond election that would more easily fund the capital costs that were included in the 2020 tax rate election
“If we get through this next session and we don’t have a resolution
and the court case has not really advanced
and we’re still sitting there with all this uncertainty
may need to go back and try a plan B,” he said
“That bond election would be tax-neutral to the public
but it would just shift the amount and say
but now this amount is for maintenance operations
As a frequent voice in favor of closing the Fayette Power Project coal-powered plant
Vela sees promise in moves by Austin Energy to secure solar contracts from local providers using rooftop systems throughout the city
He hopes those arrangements can bring more price stability for the city while meeting the needs on hot summer days when solar production is at a peak
On the question of housing needs in the district and throughout the city
Vela sees the ongoing decrease in rents as evidence that the move for more apartment construction is gradually helping to solve the ongoing affordability crisis
he said policies such as the HOME and HOME2 initiatives will likely take longer to affect housing prices
I don’t think that the HOME ordinances will have a huge impact on the look and feel of the city
I think they will have a major impact on what the city looks and feels like,” he said
noting that the passage of pro-accessory dwelling unit policy almost a decade ago has only had a modest effect in the district
He also downplayed the concerns over the possible property tax increases some see as a coming side effect of the push for density: “When you do a broad rezoning like that
you don’t really see those concentrated impacts
You tend to see a much more muted impact in terms of property tax values.”

“Lamar and Rundberg is still one of the deadliest intersections in the city when it comes to auto and auto-pedestrian accidents
whether it’s a mixed-use with retail on a first floor and residential above it
“There’s not enough green space for kids to play on
That’s definitely something that we really need
especially with climate change and needing to plan with that
Affordable housing is one of Guzmán’s most serious concerns for the area
She said if elected she’d partner with other Council members representing the city’s Eastern Crescent communities to push for the creation of more housing priced for low- and middle-income households
and so they will stay income-restricted for several years
the owner can flip it to make it all market rate
which would potentially displace the residents who are in there at the time that is done,” she said
have a relationship with the property owners and with management to encourage them to keep it income-restricted in perpetuity
especially the rental properties that are income-restricted.”
Other quality-of-life issues Guzmán wants to see addressed include the creation of neighborhood circulator routes to help residents have better access to the limited number of full-service grocery stores in some areas
She also pointed to the increased visibility of open drug markets and sex workers spreading north on Georgian Drive as an issue that the Austin Police Department and Austin Independent School District need to work together to address
Those issues as well as the needs of those experiencing homelessness tie into Guzmán’s belief that the city should pivot its public safety resources further into community and mental health
with case workers and related professionals able to produce better results than the police officers and paramedics who respond to the bulk of 911 calls
she would like to see the APD budget held flat for at least another year so the money to fund the raises called for by the proposed Austin Police Association contract could be directed elsewhere
“’I’m not saying that the police aren’t needed
but our police are responding to calls for things that should be responded to by other folks who are appropriately trained,” she said
She added that the $80 million Community Investment Budget called for by an assortment of community groups could have easily been funded with a fraction of the police budget
but a drop in the bucket compared to the whole budget
Being told that there’s no money and we’re facing a deficit
yet all of a sudden more than $200 million has been found for use for across five years – it just raises red flags.”

“Even though they’re saying the statistics are going down,” he said

and we have basically a two-way conversation
I don’t see that happening because we’re understaffed.”
Herrin said parks throughout the area need more attention and features to make them family friendly
with neighborhood groups often taking up the bulk of the work to mow and maintain the areas
Herrin said a comprehensive audit of city operations and finances is needed to identify inefficiencies and waste
He pointed to the many levels of permitting and planning approvals needed to build a home as an example of redundancy he’d like to eliminate
“It needs to be independent because I want them to show where we’re duplicating things
and where we’re doing stuff that we shouldn’t be doing,” he said
“One of the things I suspect that will come back is a lot of the city pet projects will be going away
But that is one of the things I think we can probably save money on that big time.”
Herrin doesn’t spare his criticism of the Project Connect mass transit plan
the cost of which he said was lowballed to win support from voters
With the costs increasing and the scale of the first phase shrinking
he said a better approach to transit would have been prioritizing commuter lines into the city from surrounding suburbs to take more long-distance travelers off the road
Herrin said he’d be pointed in his views and wouldn’t join a bloc of similarly minded officials on the City Council dais
“I don’t have a problem calling somebody out when I have a disagreement with them
I will explain my side and I would expect them to explain their side
and it leads to corruption … when somebody’s calling to put a pet project up
because we need to go back to the basics.”

A killer who followed his victim on the Atlantic City Boardwalk has been sentenced to 25 years in prison
admitted guilt in November 2024 to the aggravated murder of 22-year-old Nazir Cintron
according to the Atlantic County Prosecutor's Office
Cintron's body was found on a beach ramp in front of Bally's at approximately 7:35 a.m
the prosecutor's office said in a statement
Warehouse blaze: Cherry Hill man sentenced for his role in arson
Surveillance video showed a man following Cintron on the boardwalk
"making eye contact with him several times and following him onto the boardwalk ramp," the statement said
The suspect left the ramp and walked onto Michigan Avenue less than two minutes later
He then was seen removing a jacket and putting it in a trash can on the sidewalk
Cintron's was pronounced dead at the scene from multiple stab wounds

recently spoke with City & State to discuss how the 2024-25 state budget benefits Pennsylvanians from all walks of life
and how the House Democrats’ Central Pennsylvania Delegation
was instrumental in securing a slate of policy wins during budget negotiations
which evolved out of the House Democratic Caucus’ Southeastern Delegation
is comprised of lawmakers from several counties in the middle of the state who are focused on issues affecting Central Pennsylvania
“We have differences of people within the southeast and central (regions of) Pennsylvania,” he told City & State
“Life is a lot different in Montgomery County than it is in Lancaster County or Dauphin County
that there was a need with the growing number of representatives that we had coming in based off of the new maps – we knew that we would have a good-sized delegation to come in and create this.”
He pointed to Lancaster County state Rep. Mike Sturla as a major advocate for increased basic education funding and said districts throughout central Pennsylvania will benefit as a result
“I really think we left a really big footprint on what this budget looks like
especially when it comes to education,” he said
“The Reading School District where I represent – it’s going to get $41 million back as a base
The Harrisburg School District is going to get $15 million additional
these are additional resources that are going to be at the base level as we continue to address the Commonwealth (Court’s) education opinion
I feel like the central delegation – we have been pretty big winners.”
“If you’re someone that’s facing eviction in the commonwealth of Pennsylvania and you don’t have money for legal representation
Izzy Smith-Wade-El’s bill … now ensures that we have at least $2.5 million from here on out to help those people in the budget,” Guzman said
The Berks County lawmakers also praised the state budget for making more cities eligible for City Revitalization and Improvement Zones
which are economic development zones covering parcels of land up to 130 acres
“We’re taking a 130-acre zone within a respective municipality
and we’re taking the taxes that are generated within that zone
and instead of giving those taxes directly to the commonwealth treasury
those funds are instead re-invested back into the 130-acre zone for things like bond issuance
it’s a revitalization zone that is self-fulfilling in the sense that it’s self-sustaining.”
He added that the cities of Erie and Reading are two locations that could benefit from the expanded CRIZ application process
“That opens up a lot of cities – not just in Central Pennsylvania
but across the commonwealth – and their ability to be able to tap into what I believe is a vital economic program that we have in our toolbox to help cities
especially third-class cities like Reading,” Guzman said
Guzman said the delegation will continue to advocate for increased education funding
along with increased transit funding and opportunities in future budget cycles
He added that the delegation wants to make sure “our presence is felt at the negotiating table
and make sure that our needs are not lost between the Philadelphia and the Allegheny counties that

The issue arises as Keller ISD considers forming a new school district by detaching a portion of its existing territory. Some, like Tarrant County Commissioner Matt Krause
have suggested that a board resolution alone may be sufficient to create the new district
Phil Sorrells and the Tarrant County District Attorney’s Office sought an official opinion from the attorney general on the matter Feb
prompting Fort Worth to submit its own interpretation
Fort Worth’s letter contends that the Texas Education Code explicitly mandates an election when a new district is formed through detachment, whether the process is initiated by a resolution from a school board or by a petition from registered voters.
The letter states that detachment can be “initiated by” a resolution or petition but does not distinguish between the two in terms of procedural requirements
a plain reading of the language of 13.103 allows that the process of creating a new school district by detachment may be started in one of two ways: a petition or a resolution
But if a resolution alone were sufficient to create the new district — whereas a petition may only start the process — then the words ‘initiated by’ would mean two completely different things within the space of a single sentence.”
The letter references historical legislative revisions to the Texas Education Code
detachment was only permitted through a petition process
While the law was later amended to allow initiation by resolution
Fort Worth argues that this change did not remove the election requirement
Guzman points out that no other provisions in the education code allow school districts to unilaterally alter their boundaries without voter input
and the one that ensures parents have a direct voice in such an important decision affecting their children’s education
is the one that recognizes that an election is required,” the letter states
If the attorney general rules in favor of Fort Worth’s interpretation
Keller ISD and any future districts seeking detachment would need to hold elections before proceeding
If the ruling favors the view that a resolution alone is sufficient, Keller ISD would gain autonomy in redrawing district lines.
In a Feb. 28 Facebook post
Fort Worth City Council member Alan Blaylock voiced support for ensuring that voters have the final say in any potential split

stand with our constituents in their deep concerns regarding Keller ISD,” Blaylock said in the post
“We remain committed to advocating on their behalf to ensure the best possible outcome for our residents
We firmly believe that if a split were to occur
the public has the right to vote on the matter and the law supports this interpretation.”
Lauersdorf also emphasized that the issue should not be about exploiting legal loopholes but about following the intent of the law
“We support the issue of law that says this should be put to a vote,” Lauersdorf said
“No district should be able to move forward with a split without taking it to a vote.”
He acknowledged the political complexities surrounding the attorney general’s decision
noting that Paxton is not required to issue an opinion
“With as big of a deal as this is and how this could impact school districts statewide — between that and all the talk of vouchers and everything else — I don’t know if he would pick it up because of everything else going on,” Lauersdorf said
“This could easily become all about politics and not about the people.”
Tarrant County Commissioners Alisa Simmons and Manny Ramirez and state representatives David Lowe and Nate Schatzline have all voiced their support for requiring a public vote on any potential Keller ISD split

"El Moreno" was killed, according to local media outlets
2008 in the parking lot of a nearby strip mall
He was accompanied by his cousins César Ariel Loera and Arturo Meza Cázeres when a rival group opened fire against them
The body of "El Chapo's" son was left laying against the sidewalk alongside hundreds of cartridges
the Guzmán family decided to build a monument in the same parking lot where "El Moreno" was killed back in 2008
special lighting and even a red carpet in remembrance of Édgar Guzmán to celebrate his 16th mournful anniversary
a suspected car was parked near the monument located at the parking lot of a membership-only big-box warehouse club retail store City Club
which made authorities believe the attack was conducted by a vehicle-borne improvised explosive device
although further investigations indicated the car had nothing to do with the incident
the explosion took place minutes after a homicide was reported in the neighborhood of Villa Bonita
less than 10 miles from where "El Moreno's" monument is located
Law enforcement continue to investigate the cause of the explosion and they believe both the explosion and the homicide are related

Abigail Guzman won a special election Tuesday evening for the vacant Ward 4 Gainesville City Council seat
Guzman defeated challenger Devin Pandy with 70.29% of the vote with 100% of precincts reporting
3,494 Gainesville residents voted in this race.
That follows the passing of Longtime Gainesville City Councilman George Wangemann in January at 72.
Guzman spoke with Martha Zoller and Caleb Hutchins for WDUN’s election coverage.
I want to be an example for my children and any child
Guzman expressed gratitude toward the city of Gainesville.
“Gainesville is a community that loves supporting small businesses and seeing them thrive
I had so much help and resources from our city and staff,” Guzman said
“I was so impressed with how far they go for our community
And it was about three years ago that I told my husband one day
Guzman stated what she would like to focus on in her new role.
to be the very first Latino person ever on city council has been a massive accomplishment,” Guzman said
“I feel like our city and staff have done a wonderful job with Gainesville and growth in a meaningful way
I have always loved and this is one of the reasons we chose Gainesville to raise our children is the small-town charm
And I think it's so important to grow in a meaningful way and maintain that small-town charm of Gainesville that we fell in love with.”
Guzman said she would be a resource for citizens on the council.
“When I was in the process of opening Consuelo
I had people that would give me their cell phone numbers and say
we'll find another option,” Guzman said
And to see that and to be able to do that for my community
I'll be the first to say here's my cell phone number call me
Guzman spoke on her experience campaigning.
“I will say that my campaign experience has really been fantastic
I announced in January that I was running so we've been campaigning for four months now
And I have walked away from this experience with a full heart,” Guzman said
“I have gotten to meet amazing people in our community and nonprofits that I wouldn't have had the privilege of knowing on that level had it not been because of this campaign
So I always felt like regardless of the outcome
a full heart and loving our community so much more

the Secaucus girls volleyball program took the Hudson County title back after a considerable nine-year drought
But for a proud and historic program that has done nothing but win for decades
Saturday afternoon was another step toward recreating another Patriots dynasty
Fending off a legitimate challenge from a feisty Union City squad for the title
top-seeded Secaucus went back-to-back by sweeping third-seeded Union City in straight sets
Now 25-1 on a season that included the program’s 1,000th win
Secaucus took home its eighth Hudson County championship and second in a row
The Patriots may not have taken the crown once again if not for a tremendous all-around performance by junior Sofia Guzman
Union City – which was seeking its first title since 2022 and second overall – fell to 17-5 with the defeat
and delivered a key ace in the second set to help the Patriots fend off Union City late
“I’m not so sure how much winning we’d be doing this year without Sofia
“She lives and breathes volleyball and always seems to come up big in a big spot
A pair of Guzman kills parlayed by two Union City errors gave Secaucus a quick 7-3 lead to start
But two finishes by Union City’s Annabelle Ceballos – herself with a terrific game – put the Soaring Eagles ahead 11-9 early
But Secaucus would shoot back with a 6-0 run
powered by a pair of kills by standout middle Olivia Jasiczek and an ace served up by Avalyn Torres
forcing Union City into a timeout at 15-11
The Soaring Eagles would take five of the next six points to level things at 16-16
but Secaucus – in somewhat of a trademark style for them – surged to a 9-3 run to close out the opening set
Jasiczek had two kills and Angelina Fitzgerald added another in that span

I think that was the difference,” said Guzman

Other benefits cited by the county include centralized records management

Mayor Brandon Johnson has four months to erase a $223 million shortfall for the current year and just over a month before laying out his plan to fill a gap nearly five times that size in 2025
No wonder everything is on the table — from layoffs and pay cuts on the cost-cutting side to a property tax increase

… Every option is on the table…We’re looking at every single one of those,” Budget Director Annette Guzman told the Sun-Times on Thursday
“We’re asking everyone for their ideas of how the city can continue to provide services that we’re required to provide and also make investments to help our communities recover and help those who’ve been chronically disinvested in while also ensuring that our revenues can support that.”
Guzman said the mayor met last week with city labor leaders to solicit their ideas on how to solve the crisis
“No asks were put on the table at that time
but the mayor was very clear that this is a shared responsibility,” she said
Why not share the pain by asking every one of the city’s 36,420 employees to take a couple of unpaid furlough days
every option is on the table,” Guzman said
quickly adding: “Furlough days will not get us through a $900 million-[plus] budget gap
So there has to be a series of steps that we’re taking to solve the budget gap that’s in front of us.”

Civic Federation President Joe Ferguson said an “extended hiring freeze,” a multi-year furlough plan and controls to runaway overtime and the “endless bleed-out” legal judgments will all be needed to chip away at the city’s massive shortfall
Ferguson said he trusts Guzman when she says “everything is on the table.” The question is

we devote one of those dollars to shoring up your pensions.’”
Ferguson said it is equally imperative that Johnson confront the “sacred cows” of city government
“The easy one to go to is the manning requirements on fire trucks in a world in which the vast majority of calls to the Fire Department are for emergency medical services that can be handled by ambulances and EMTs — if only we actually staffed the department to align with what the demands are,” Ferguson said
He was referring to the mandate requiring five CFD employees on every piece of fire apparatus

a federal agency’s report will state “we should have full manning — not less manning.” That means there should be no “manning variances” that allow fire trucks and engines to be “running short” of the mandatory requirement for five employees on every piece of fire apparatus
“The National Fire Protection Association standard states that high-hazardous cities such as Chicago should run with five to six firefighters per engine and truck
His members have waited more than three years for a new contract
the city will be required to shell out three years’ worth of retroactive pay raises even before addressing their demand for 20 more ambulances and the paramedics needed to staff them

“We also made clear that we don’t want to see any cuts to the services our members provide,” Lindall said

The all-options-on-the-table statement also applies to compelling Chicago Public Schools to absorb a $175 million pension payment for non-teaching school employees
Guzman argued that a pension reversal is particularly important for CPS to assume its own costs as Chicago makes the transition from an appointed school board to a partially-elected
CPS will be its own … independent governing body separate and apart from the city
… For us to not control CPS or the Board of Education while having dollars that … are collected on behalf of the city go to another source is untenable,” Guzman said
“We are looking at every single option that allows us to … ensure that CPS fully takes on their obligations as we continue to disentangle our financial and operations commitments.”
