Chartwells is a food service organization that partners with schools to help provide nutritious meals to students
The Global Eats Program aims to introduce multicultural foods to students in kindergarten through 12th grade
and Mexico and partners with chefs from each ethnic background to embue each showcase with authenticity
and it’s also a little bit of geography and food history
just to engage students and teach them different foods from different parts of the world,” Tila said
Tila’s family is from China and he is of Thai-Chinese descent

“I think it really just helps them understand that we are trying to bring that same thing into the cafeteria

Tila attributed the spark for his culinary passion to his grandmother
He grew up spending a lot of time in the kitchen as a child
his grandmother showing him step-by-step how to make different dishes while he clung to her hip.
“[My grandmother] was my first and most influential teacher,” Tila said
While his grandmother planted the seed of cooking for the aspiring chef
Tila said his parents’ restaurant in Los Angeles had a vital role in forming his love for cooking
His parents opened the first Thai grocery store in the city and opened the first Thai restaurant in West Los Angeles in 1978.
“Cooking is my contribution to society,” Tila said
“It’s been my vehicle to sustain myself ..
It’s a way I can create experiences for people.”

The case against Vanderbilt was one of four dismissals announced by the CFPB on Thursday under the watch of acting director Russell Vought. Each of these suits were filed during the Biden administration under former CFPB Director Rohit Chopra

a conflict exists when it is impossible to comply with both state and federal law or when the state regulation “stands as an obstacle to the accomplishment and execution of the full purposes of the federal law” (the “obstacle prong”)
The CFPB notes that because state laws rarely or never make delivery of TILA disclosures impossible
impossibility does not figure prominently in the Fed’s precedents and
the Fed’s consideration of preemption typically focuses on the obstacle prong. According to the CFPB
for a state law to be preempted under the obstacle prong
it must “frustrate the meaningful disclosure of credit terms to consumers that TILA and Regulation Z provide.”
The CFPB begins its discussion of California and New York law by observing that both laws require providers to issue disclosures before consummation of certain commercial-purpose transactions. The CFPB contrasts this with TILA’s application to consumer-purpose credit
The CFPB also observes that although California and New York disclosures include a finance charge and APR disclosure
the CFPB does not need to resolve the question of “whether California’s and New York’s respective specifications result in different finance charges and APRs than would be generated under Regulation Z if it were hypothetically applicable
or whether they should instead be viewed as tailoring the finance charge and APR to the structures of certain types of commercial financing arrangements that are not shared by consumer credit transactions.”
With no commenter having suggested that compliance with California and New York laws as well as TILA and Regulation Z is impossible
the CFPB only applied the obstacle prong in its preemption analysis and concluded that the states’ laws do not stand as an obstacle to the accomplishment of TILA’s purposes
the relevant TILA purpose is meaningful disclosure of credit terms so that a consumer can compare available credit terms and avoid the uninformed use of credit
The CFPB observes that TILA achieves this purpose by requiring disclosures for consumer credit and that consumers applying for credit that is primarily for personal
consumer-purpose credit) will continue to receive only TILA disclosures
It states that commenters advocating preemption had not shown “that consumers when shopping for consumer-purpose credit would somehow be prevented from understanding the terms of credit available to them for those purposes by State disclosures provided in different (business-purpose) transactions.” The CFPB also observes that where a potential borrower is shopping for consumer-purpose credit
the borrower would receive TILA disclosures and not the California or New York disclosures
The CFPB’s discussion includes a footnote responding to commenters who asserted that consumers with small businesses and who receive California or New York disclosures when applying for commercial credit “will
distrust the TILA finance charge and APR” because they do not have consistent meanings under state and federal law
The CFPB states that these commenters had not offered any evidence or other support for the assumption that consumers would react with distrust under such circumstances “rather than an understanding that different calculations may be appropriate in the context of different types of transactions.” It also comments that “even assuming this scenario were to occur
the CFPB would not consider the issue to be so significant as to interfere with TILA’s purpose of enabling consumers to compare consumer credit products.”
While acknowledging that a borrower might use proceeds from a primarily business purpose transaction for consumer purposes
the CFPB states that because Congress did not require TILA disclosures “whenever any minor portion of primarily-business credit might be used for a personal purpose…such transactions should not drive an assessment of whether State disclosure regimes interfere with Congress’s purposes.” Also
responding to comments that advertisements for commercial financing that include APRs calculated using California’s or New York’s formulas could cause confusion
the CFPB stated that California and New York do not require commercial lenders to include an APR in advertisements and to the extent they might choose to include an APR
“that is not a requirement of those laws and not a basis to declare those laws’ disclosure requirement to be inconsistent with TILA.”

the Utah law is not preempted for the same reasons as the California and New York laws. As an additional reason

Older generations tend to be more patient with their partners and are also less used to the fast pace of online dating
Younger generations want things to constantly sparkle
I often hear people say they call it quits after one or two dates because the other person isn’t the one for them
But I think having a bit more patience is very important in love
‘I believe we can all learn from each other—young and old
Sharing experiences with an open mind is extremely important
It can help you appreciate (or re-appreciate) your partner and relationship

‘I teach Social Psychology to first-year psychology students

After falling behind on her mortgage payments
the plaintiff entered into a mortgage modification agreement with her lender in 2009 that provided for interest-only payments for a 10-year period followed by payments of principal and interest pursuant to a schedule set forth in the agreement. Following a year of timely interest-only payments by the plaintiff
the lender assigned the mortgage to a mortgage company that refused to accept the plaintiff’s interest-only payments. The assignee claimed that the plaintiff had defaulted on the mortgage and filed a foreclosure action in state court
Select Portfolio Servicing (Select) was the servicer of the plaintiff’s mortgage. In 2015
the state court granted the plaintiff’s motion to enforce the modification agreement and ordered the plaintiff to resume making payments according to the terms of the agreement. The state court also ruled that certain interest and escrow payments
that had either not been made or had not been accepted
would be added to the end of the modified loan term.
Following the conclusion of the foreclosure action
Select sent a number of monthly mortgage statements to the plaintiff
not all of which were the same in terms of format
and amounts. The November 2016 statement
which the Eleventh Circuit called “the most problematic,” included language not expressly required in Regulation Z
or included in the regulation’s Sample Forms of Periodic Statement
The court also described language that was included in the statement
which is expressly required under Regulation Z or included in the Sample Forms
and amounts needed to bring the loan current
The plaintiff alleged that the November 2016 statement significantly misstated the deferred principal balance
and the amount of the interest-only payment that was due
She also alleged that the “delinquency notice” misrepresented that the loan was in arrears when there was in fact no delinquency. In her complaint
the plaintiff alleged that Select had violated the FDCPA and FCCPA by sending her the erroneous mortgage statements which she alleged were harassing
and misleading and by engaging in unfair practices in connection with the collection of a debt. The district court dismissed the plaintiff’s claims with prejudice
ruling that the mortgage statements complied with TILA and Reg
Z and therefore were not communications in connection with the collection of a debt under the FDCPA and FCCPA
the Eleventh Circuit first concluded that the plaintiff had plausibly alleged that the mortgage statements for November 2016 and for July
and September 2017 were communications in connection with the collection of a debt under the FDCPA and FCCPA. According to the court
a communication that expressly states that it is ‘an attempt to collect a debt,’ that asks for payment of a certain amount by a certain date
and that provides for a late fee if the payment is not made on time is plausibly ‘related to debt collection.’” (citation omitted) The court added a footnote stating that “[w]e do not hold that the statements are
communications in connection with the collection of a debt
Our ruling is that [the plaintiff] has plausibly alleged that they are.”
The Eleventh Circuit then considered whether TILA and Reg
Z foreclosed the plaintiff’s FDCPA and FCCPA claims as a matter of law and concluded that under the circumstances alleged in the complaint
they did not. It held that TILA-required monthly mortgage statements can plausibly constitute communications in connection with the collection of a debt under the FDCPA and FCCPA if: (1) they contain “this is an attempt to collect a debt” language
(2) they request or demand payment of a certain amount by a certain date
(3) they provide for a late fee if the payment is not made on time
and (4) the history between the parties suggests that the statement is an attempt to collect on a disputed debt
The Eleventh Circuit also rejected Select’s argument that the CFPB’s 2013 bulletin on the intersection of the FDCPA and the TILA’s monthly mortgage statement requirement. In that bulletin
the CFPB concluded that servicers who are debt collectors subject to the FDCPA are generally not liable to consumers who make a cease communication request under the FDCPA if they continue to send TILA-required monthly statements. According to the Eleventh Circuit
there was nothing in the bulletin indicating that the CFPB sought to provide an advisory opinion excusing all TILA-required mortgage statements from FDCPA coverage regardless of the circumstances
the court was unwilling to read the bulletin to mean that any conduct or communication required by the TILA and Reg
Judge Lagoa indicated that she did not disagree with the majority’s conclusion that a required monthly mortgage statement that generally complies with the TILA and Reg
Z can plausibly be a communication in connection with the collection of a debt under the FDCPA and FCCPA if it contains additional debt collection language. However
this means that a court’s inquiry should focus on the additional debt collection language and the substance of the communication sent to the consumer by the servicer. According to Judge Lagoa
“[t]hat approach is consistent with our precedent
and it is also consistent with the conclusion of other circuits
which have uniformly rejected the legal significance of the ‘attempt to collect a debt’ language.” She stated that “[c]ourts should look at the substance of the communication to determine whether the FDCPA applies
by determining whether the communication uses language typically seen in debt-collection efforts.” Because she found that the statements received by the plaintiff did not contain that type of language
it was her view that the “attempt to collect a debt” language alone could not be the basis for a reversal and that the district court’s dismissal of the plaintiff’s complaint should have been affirmed
This decision should prompt mortgage servicers to revisit the language included in periodic statements
particularly for those sent to delinquent borrowers or for accounts in bankruptcy. Clearly the primary takeaway is to be mindful of disclaimer language stating that the communication is “an attempt to collect a debt”
versus a communication “for informational purposes”
the court notes precedent that a communication can have a dual informational and collection purpose (“we have recognized that a communication can ‘have dual purposes,’ such as providing a consumer with information and demanding payment on a debt”). Accordingly
it is also important to review periodic statements for collection-related language that is not expressly required by Regulation Z or the Sample Forms

Jet Tila is indiscriminate in his love of Asian food
But he certainly has a soft spot for Japanese cuisine
I caught up with him to discover his favourite Japanese dish – a much contested prize at Inside Japan – and pick up a new recipe for our repertoire
In your words you were ‘born into the ‘first family’ of Thai food in Los Angeles
having grown up in your parents’ family restaurants
At what point did you start exploring the distinct flavours of other Asian countries
Filipinotown town and Koreatown I was eating all kinds of Asian food from very young
and I would always help my friends’ moms from different cultures leaning how to cook their food
and working with so many great cooks and chefs throughout my career
I’ve never stopped eating and learning about other Asian foods
what would be your favourite Japanese dish
It’s truly one of favourite things to eat; the dashi married with the egg and meat over warm rice is the perfect food experience
Tokyo was my favourite place because of the variety of foods
In my next life (or when I become wealthy)
I’m going to dedicate a decade to just eating and learning about Japan

This dish is a large bowl of udon noodles with a savory soy broth
A large lidded earthenware bowl is called a nabe
so the title simply means ‘udon noodles cooked in a pot’
It’s an old authentic technique where you make your broth
This develops the flavors of all the ingredients with the broth
Combine all the broth ingredients in a small stockpot and bring them to a boil
The broth will keep for up to 3 to 5 days in the refrigerator
bring enough water to cover the noodles to a boil
Add the noodles and cook them until al dente
In a donabe (Japanese casserole pot) or a medium saucepan
arrange the noodles on the bottom of the pot
Ladle in enough stock to cover the noodles
Cover the pot and bring the contents to a simmer
and simmer about 4 minutes or until egg is cooked but soft in the middle

Tila’s parents arrived separately in Los Angeles in the 1960s as part of the first big wave of immigrants to the U.S
His family would open the city’s first Thai food grocery
The store gave the nascent community a badly needed epicenter
Tila would later spend years working at the business
then packing groceries and eventually operating the butcher’s band saw
Less than a decade after starting the market
the family opened what’s believed to be the first Thai restaurant in West L.A
was designed to appeal to bigger-spending American clientele such as studio employees at nearby 21st Century Fox
“It was the cool studio lunch in the 1980s,” Tila said
My dad’s version of Thai barbecue spareribs was really just barbecue sauce blended with pineapple.”
struggled to emulate his parents’ drive as first-generation immigrants
He couldn’t focus as a student and dropped out of high school his senior year and got a GED
alarm installer and a deckhand for fishing charters
“I never had any aim or direction.” Despite that
he always had the family market to fall back on
“I got 500 calls in the span of a week after it was published,” Tila said. “That’s when the light bulb went off — this is going to be my career.”
Tila enrolled in culinary school and later got a job at a corporate food-service firm cooking for employees at the likes of Google and Yahoo.
“That taught me everything about scale and having a system,” said Tila, who also contributed nearly two dozen articles to The Times’ food section. “I was a high school dropout, but I had to know math. I had to know the food cost, the labor cost and how to prep ahead to feed 5,000 to 10,000 people.”
By 2008, Tila was running his first big restaurant, Wazuzu at the Encore in Las Vegas — an experience he likens to getting an MBA. The exposure to Las Vegas’ celebrity chef scene eventually led him to an offer to battle Morimoto in an episode of “Iron Chef America.” The secret ingredient was seaweed. Tila would lose by only a couple of points, but the experience was unforgettable.
“They tell you before what the three likely ‘secret’ ingredients are going to be,” Tila said. “So you have to write three five-course menus, shopping lists and prep plans. We worked 10 to 12 hours during the day and then trained three more hours after work. It was like preparing for war.”
Within a few years, Tila would become a Food Network mainstay. It’s where he would meet two of his biggest influences: Alton Brown and Bobby Flay. Brown taught Tila how to entertain audiences on TV. Flay had a penchant for sitting Tila down and asking what he was working on and how he could do it better.
“I admire those two men,” said Tila, who credits them for helping him break out of his shell.
“Culturally, being an Asian kid, you don’t want to raise your hand and stand out,” Tila said. “They taught me to go get it. To find my voice. Not to be arrogant, but confident.”
Standing out in an industry teeming with talent is essential, Tila said.
“I learned quickly that I wasn’t just a chef, but a brand — a product that could be licensed, sold and used to promote things,” Tila said. “I wrote recipes and packaged them into concepts. I created a logo that I could apply to my recipes and concepts. That logo meant Chef Jet made that recipe and I had to make sure the recipes were delicious. So when any of my guests in restaurants, campuses or cooking classes made them, there was brand recognition.”
To unwind, Tila fishes regularly in the South Bay with the friends he made two decades earlier as a deckhand. “All those guys are boat captains now,” Tila said. “We chase tuna together.” But mostly, Tila spends his free time with his wife, Ali Tila, 6-year-old daughter, Amaya, and 3-year-old son, Ren, in their Silver Lake home.
“I found my niche as an Asian chef at a time when there was huge demand for my expertise,” Tila said. “People needed to learn how to cook Asian at the home level and the commercial food-service level. I was at the right place at the right time with the right set of skills.”

Celebrity chef and restaurateur Jet Tila has spent his career
around people executing various cuisines from all over Asia
Tila said that from the time he was 10 years old
and on farms that were all a part of the growing business
He said he was essentially raised in the shops as his family couldn't afford another form of daycare
But it wasn't necessarily where he wanted to be as a kid
'It was amazing and full of adventure,'" Tila said of his upbringing
While he wanted to be out playing with friends
Tila said this unconventional training helped him develop a foundation for what has now become a career of his own
"I do believe in the 10,000-hour rule of becoming an expert," he said
"I clocked probably 20,000 hours by the time I was 22."
the Food Network star has found that there are certain benchmarks of Thai restaurants that
indicate whether the people behind the eatery are serving up something delicious.
Tila said the first thing he pays attention to happens before the food even comes out — it's how the table is set
"If a Thai restaurant sets with a spoon and a fork
that's gonna tell me that they're slightly more authentic because the proper way to eat Thai food
While the fork and spoon are a giveaway to him that a restaurant is trying to channel a more traditional Thai style of dining
"If they set automatically with chopsticks
that usually tells me they're kind of pandering more to an American-style restaurant," he said
"I think the bellwethers are how sweet the food is," Tila said
adding that really good measures of a Thai restaurant would be its curry and whether a server or menu offers different spice levels
Tila said a good curry dish should be "nice and thick" with a substantial amount of heat
and that's it's a good sign if someone asks you how spicy you want a dish
'Our hot is really hot,'" he said while explaining what a spice-level ask might look or sound like.
If you're studying the menu and see some dishes that aren't commonly found at other Thai restaurants in America — he listed Khao soi and mango salad as examples — that might be a great sign
"anyone could put a lesser-known dish but still execute it poorly."
you might see something that's not traditionally Thai at all on the menu and think that means the food is bad
While it certainly can be a marker of a confused chef
it can also be indicative of a creative or well-versed one.
"I know some Thai restaurants in LA that make teriyaki
and they're still phenomenal Thai restaurants," he said
this comes down to knowing and trusting your chef
"Pei Wei does serve Korean and Thai and Chinese all at once," Tila said of the restaurant chain he's a partner of
"But I've got the credibility to get you there."
the cookbook author recommends giving any restaurant at least two tries before making a decision about it
unless you have a really terrible experience
But if you're "on the fence" or are unsure about it
he suggests going back a second time.
