New information surfacing and a plea deal have led to federal charges being dropped against a Fruitport man and his former boss in a $2.2 million marketing scam
Christopher Ostrowski and co-defendant Dennis Tubbergen no longer face the conspiracy and wire fraud charges on which they were indicted in August 2016
District Court in the Middle District of Pennsylvania

GTBK will have to pay $300,000 restitution to the victims based on the Department of Justice distribution
The charges against Ostrowski and Tubbergen were dismissed “without prejudice.” That means if GTBK does not comply with the plea agreement or a court order

Tubbergen and Ostrowski – through GTBK – orchestrated a marketing scheme involving the sale of a “patent-pending” financial system known as the Immediate Legacy Program
The program supposedly allowed wealthy individuals to make immediate charitable contributions without incurring costs or taxes by using a system that involved development of a limited liability company and purchase of annuities and life insurance policies
The program claimed “at the death of the donor
the full amount of the annuity used to pay the donor and fund the charitable donation would be paid back to the person’s estate by the life insurance policy.”

The indictment alleges that Tubbergen and Ostrowski made multiple false and fraudulent representations to encourage potential investors to purchase the program and its various products
Those who signed up for the program paid GTBK
The two men entered not-guilty pleas to the charges
The trial was rescheduled several times before the parties reached a deferred prosecution agreement in January
New information came to light following that agreement
so the order on the deferment was reversed and another trial date was set for Oct
Borgula said that more new information submitted by himself and Tubbergen’s attorney – regarding some telephone calls – led to the motion for dismissal of the trial and the plea agreement
“When they initially looked at the evidence
they didn’t have all the phone calls,” Borgula said
Attorney’s Office “felt like they wouldn’t have charged it in the first place,” the attorney said
“The government decided that it was in the best interest of the United States to permit GTBK to enter a plea and dismiss the individual defendants,” Borgula said
Ostrowski has no interest in GTBK and never has

It was as if a bomb just exploded in Van Tubbergen’s world
“It might have been 5-10 minutes after Bill got fired and the phone rang and they were asking Tyler what he thinks and he was just speechless,” Kathy Van Tubbergen recalled about the postgame family pow wow in Van Tubbergen’s college house
“He had a really great relationship with (former WMU quarterbacks coach) Ryan Cubit
That whole situation I think affected Tyler more than anyone really knew because he was waiting for the chance
Tyler said he put the phone down and didn’t know what to say to his family when he learned of Cubit’s firing
“Where do you go from there?” he recalled about his thoughts that night
I wondered how I would adapt to a new system
I realized there was nothing I could do about it
I had to go in and work that much harder.”
Fleck said he devoted a lot of time to talking to the senior
who is the only quarterback on the roster with starting and significant playing experience
The 32-year-old head coach said TVT has grown on him a lot
“I wouldn’t trade him for anyone,” Fleck said
“He does a tremendous job of leading the football team and getting the team to believe in him.”
WMU senior receiver Josh Schaffer said Van Tubbergen has grown a lot from the coaching change
“If you’re doing something wrong he’s in your face
That’s something that I think coach Fleck has brought out of him
about being more assertive as a quarterback
Van Tubbergen has already graduated from WMU with a criminal justice bachelor’s degree
He plans to take the LSAT in December and attend law school after that to become a lawyer
With his thought-out answers and straight-faced look during postgame press conferences
but his parents and teammates say there is much more to him
Schaffer has lived with or near Van Tubbergen since their freshman year at WMU
Schaffer said he usually “works” his roommate in video games and doesn’t get cocky about it
but when TVT wins it is as if he’s won the Super Bowl
“He’ll be running around and screaming,” Schaffer said with a laugh
And then there are the jokes in the huddle that don’t always get a laugh
football is hard and school is hard,” Van Tubbergen said
“You put those two together and there’s a lot that gets thrown at you
If you’re constantly serious all the time you’re going to make it worse for yourself
Van Tubbergen said he’s driven to reach the peak
the goal has to be MAC championship,” he said

“Everybody was given another year of eligibility from the NCAA due to COVID
it was just a year that had a lot of uncertainty about if we were gonna have a season or not which made it very difficult to prepare for something when you don't know if it's going to happen or not,” Van Tubbergen
“It was challenging for everybody this year and we didn't accomplish some of our goals that our team talked about and it's not often that you get a second chance so I think for us we all wanted to take that opportunity.”

“With a lot of our guys making the decision to come back

“Our expectations for our team is high especially with the talent we have and those expectations are championships.”

“I think there is more room to grow as a player as I didn't have as good of a year as I wanted personally and I want to show everybody the type of player that I can be,” he said
“I don't think I was able to do to the best of my abilities this past year
So with all this being said it would've been very difficult for me to move on knowing there was unfinished business left at Grand Valley.”

He is named with former sales representative Christopher Ostrowski in a 10-count federal indictment
Ostrowski could not immediately be reached for comment
Tubbergen said the charges are "without merit."

who purchased educational and support materials from GTBK Marketing
have made allegations regarding the successes of their independent businesses
a business of which I was a partner from 2000 until it closed in 2011
provided support to nearly 23,000 financial professionals nationwide."
"The allegations being made are without merit and I remain committed to fully cooperating with officials."
GTBK has no relationship to his current work at PLP Advisors

GTBK falsely claimed the program was used by the Archdiocese of Grand Rapids
Ivy League schools and high-profile nonprofit organizations
GTBK said the ILP was a financial system to help nonprofits raise funds by allowing wealthy donors to make immediate charitable contributions to their favorite charity at no cost to the donor
It would be accomplished by starting a limited-liability company and purchase of annuities and life insurance
"GTBK claimed at the death of the donor
the full amount of the annuity used to pay the donor and fund the charitable donation would be paid back to the person's estate by the life insurance policy," the indictment said
Marketing materials were sent to financial planners and insurance agents interested in becoming agents or licensees
Tubbergen would preside over multi-day presentations in Grand Rapids

to potential investors around the country to convince them to attend a presentation in Grand Rapids
Potential investors were told they would be exclusive partners in their part of the country with "exclusive relationships with pre-signed nonprofit entities

"It was represented that the Immediate Legacy patented financial strategy produced a net average compensation of $18,169 per case
This was false as no one made any profit from the ILP except the defendants from the money investors made to purchase the ILP," the indictment said
The cost was $35,000 to $50,000 for a license to sell the products
marketing and exclusive relationships with charities and non-profit groups
no one who signed up received any exclusive relationship with any charity that was interested or using the program," the indictment said
Tubbergen is charged with seven counts of wire fraud and attempt and conspiracy to commit mail fraud

The fraud charges carry potential penalties of 20 years in prison

so I am able to attack it is the biggest thing I have learned here," Van Tubbergen said.

He was knocked over by a defender and the ball bounced off the rim and over the head of the defender and Van Tubbergen reached out for it while lying flat on the floor for a stunning offensive rebound.
I had to go get it for my team," Van Tubbergen said

Looking back at it will be something I am very proud of

"Last weekend I hyperextended my elbow it has been sore the past few days," she said
But Van Tubbergen has pushed through the pain
and will continue to do so next week as the Panthers (35-11

"This win set the tone really well," Van Tubbergen said
"We were excited and had a lot of positive energy
We get a rematch against everyone we lost to."
Naber said the way Thursday's match ended was key heading into next week

"We are just trying to build on last year."

To be down in the second half and orchestrate the comeback was pretty special," he said
The Central-Western rivalry is one that often is overlooked in the state with Michigan and Michigan State getting most of the attention
"It is just as big and means just as much to everyone
Sometimes it takes a back seat to bigger rivalries," he said
"It is a great rivalry with a ton of history and a ton of tradition."
Van Tubbergen had five touchdowns and 362 yards passing — which was the 10th most in a game by a Division I quarterback last season — against the Chippewas
And the rowdy Mount Pleasant environment made the feat all the more difficult
"I am lucky to be a part of something like that," he said
With six starts and 11 total appearances last season
Van Tubbergen was 159 of 261 for 1,825 yards
He threw 15 touchdowns and had 11 interceptions
That experience is something Van Tubbergen said has given him confidence as well as given his teammates confidence in him
"It was really beneficial for me and my teammates," he said
"I think I know how to handle certain situations
and everyone knows how I am going to react and what my demeanor is going to be
I am thankful that I got the chance to play."
Van Tubbergen graduated with a bachelor's degree in criminal justice last year and is taking graduate classes while he finishes his final season of eligibility
I would like to go to law school and eventually become a lawyer

Court papers list a 10-count case that includes six counts of aiding and abetting fraud by wire
radio or television; and individual counts of attempt and conspiracy to commit mail fraud
and false declarations before a grand jury
offered a product called the Immediate Legacy Program
which was designed to help nonprofit organizations raise donations
who made presentations to financial planners and insurance agents across the country in an attempt to get them to become GTBK agents
Those interested would pay to travel to Grand Rapids for a multiday presentation made by Tubbergen
Another part of the alleged conspiracy was that the two men promoted the program as being used by former NFL player and coach Mike Ditka; the Grid Iron Greats; the Children’s Memorial Hospital of Chicago; Yale
Harvard and Johns Hopkins universities; various college football programs; the Archdiocese of Grand Rapids
While some of the entities named had listened to a sales presentation
they had rejected the proposal to use the program
Court papers noted those who attended the presentations in Grand Rapids were pressured to sign up before someone else took the position for their area
Those who signed up paid between $35,000 and $50,000 for the license to sell the product and were given a money-back guarantee
They were also told they would get training
marketing and exclusive relationships with charities and other nonprofit entities
which the investors were told were already established and waiting to be contacted
Those who purchased the program received some training and marketing materials
but no one received any exclusive relationship with any charity interested in using the program

Another part of the alleged conspiracy was when purchasers complained about the false representations of the program and tried to get their money back
Their credit cards also continued to be charged
even after they complained and left the program
the defendants would have to forfeit nearly $2.2 million
or substitute property if the funds were not available
Ostrowski joined North Ottawa Community Hospital in late 2013 as the director of fund development
Hospital spokesperson Jennifer VanSkiver said Ostrowski left NOCH on March 23 this year
“It is our corporate policy not to discuss the terms of an employee leaving the organization,” VanSkiver said
She said Ostrowski’s position at the hospital no longer exists
Ostrowski’s Facebook page notes that he is currently employed by Garrison Dental Solutions of Spring Lake
A Linkedin profile shows Ostrowski as owner/president/CEO of a company called Beyond the Ask
The company strives “to make the world a better place by providing charities with a unique skill set that can enhance their fund-raising efforts,” according to his Linkedin profile
Ostrowski was part of the church’s planning committee for the fund-raising campaign for the new school
Attempts to reach Ostrowski or his lawyer were not successful
Tubbergen released the following statement through a public relations company:
“I recently learned that legal action has been taken regarding 14 former financial advisers
with allegations regarding the program they purchased for implementation with their independent businesses
provided support to nearly 23,000 financial professionals nationwide
GTBK Marketing has no relationship to any of my current work at PLP Advisors LLC or PLPs clients
The allegations being made are without merit and I continue to fully cooperate with officials.”

Debra was a woman who showed us that true strength comes from within
Debra's story began on a cool spring day in 1963
in the beautiful beachfront town of Holland
Those were such turbulent times in this country
when Martin Luther King fought for racial equality
There was so much uncertainty in those times
yet for Dave and Mary Van Tubbergen of Holland
they found a little glimmer of hope that spring
as they were expecting a new addition to the family
Debra was later joined by her younger brother Scott in the Van Tubbergen home in Holland
She graduated from Holland High School in 1981
and loved to be out under the sun or stars
where she enjoyed so many sun-kissed days and star-filled evenings
while camping with her beloved mom and aunt
Debra also loved to work in her beautiful garden
lovingly caring for her wonderful flowers she grew or the delicious vegetables she brought to life
and she would cut her vegetables in perfect slices for her Mexican treats
and loved her dogs and her cat she kept for companionship
Debra was blessed with two people she cared about more than anything
and always wanted to be a part of their lives
where she helped others maintain their independence as they dealt with challenges
She was also a member of the Ganges Baptist Church
and her faith and own inner strength helped Debra cope with her own challenges

but the Broncos did not let this one slip away like the last three games
WMU's offense looked nearly lifeless in the third quarter
but was almost unstoppable in the fourth quarter
Senior Eric Monette caught a 24-yard touchdown pass with 2:51 remaining in the game to score the Broncos' winning touchdown
After WMU recovered a fumble on the following kickoff
Dareyon Chance iced the win with a 42-yard touchdown run
Monette caught 11 passes for a career-high 196 yards and a touchdown
Chance finished with 111 yards and a touchdown on 19 carries

The two teams entered halftime with some back-and-forth jawing and a near physical confrontation
The Chippewas came out in the third quarter and stopped the Broncos on their first possession and took the momentum when
Ryan Radcliff threw a deep pass on the money to Titus Davis for a 58-yard touchdown to give CMU a 23-14 lead
The Broncos’ offense showed very little sign of life in the third quarter
but responded in the fourth quarter when Van Tubbergen threw a superb ball to Justin Collins in the corner of the end zone to pull WMU within two points
Van Tubbergen and Collins hooked up for an even prettier pass later in the fourth when Van Tubbergen threw a corner fade pass right on the money to Collins to give WMU a 28-23 lead with 8:51 left in the fourth

The Central Agency for the Reception of Asylum Seekers (COA) has filed summary proceedings against the owner of an Albergen hotel the Cabinet designated as a site for an asylum shelter
The owner is trying to back out of selling the hotel to the COA
claiming the sale was made on incorrect grounds
The court in Almelo will handle preliminary proceedings in the case on Monday at 1 p.m
A ruling could be handed down later that day
The purchase agreement stipulated that ownership of Hotel ‘t Elshuis would transfer to the COA on 29 August
the owners sent a letter saying they were canceling the sale because the COA did not clearly tell them in advance that 150 to 300 asylum seekers and refugees would be housed in the building
The COA says it was clear about this from the first contact in April
"The selling party has indicated that it wants to get rid of the sale," the COA reported on Twitter
"The enormous pressure on COA's capacity means that every placement counts
COA has therefore initiated summary proceedings to proceed with the purchase."
The COA’s main facility for asylum seekers is located in Ter Apel
where 2,000 people can be housed temporarily while their applications are reviewed
for weeks the situation in Ter Apel has deteriorated
with hundreds of people forced to sleep either in chairs in waiting rooms
A tent camp that was set up there was broken down
while many of those sleeping outdoors have to rest on the hard ground without any form of mattress
The report that COA had bought a hotel in the village of Albergen to accommodate asylum seekers there caused a great deal of unrest in the municipality of Tubbergen
The purchase was made without the knowledge of the municipality
The hotel owner and her lawyer could not be reached for comment
