Kotze had considered renting the Postman Rd property to move into with her partner
“On Trade Me the photos look beautiful,” Kotze said
“It looks truly like somewhere we could call home for the next five years.”

She had felt frustrated to arrive and see the property’s state
saying none of the 10 other people viewing the home had claimed it smelled
“No one there tell me there’s bad smells,” Zhou told the Herald
“She needs to prove there is a bad smell,” she said

Average speed safety cameras are set to be installed on a stretch of Auckland road in a bid to curb speeding.
The two cameras, which work in tandem to measure drivers' average speed as they travel between them, will be installed on Pine Valley Road in Auckland's Dairy Flat.
New Zealand Transport Agency (NZTA) said a speed survey on the stretch last year found that 74% of drivers exceeded the 80km/h limit.
"The average speed vehicles were travelling was almost 90 km/h," NZTA Auckland and Northland director of regional relationships, Steve Mutton, said.
Mutton said there had been three crashes on the stretch between 2018 and 2023, which resulted in serious and "potentially life-changing" injuries.
“The types of crashes that happen and are likely to happen on this stretch of road, the volume of traffic, and driver behaviour all tell us that there is a serious risk of people being killed or seriously injured in crashes on Pine Valley Road," Mutton said.
"We also know that risk can be significantly reduced if more people drive to the speed limit. By installing safety cameras here, we can encourage just that."
One camera would be installed near the Kahikatea Flat Road intersection and the other near the Pine Valley Road roundabout.
Drivers would only be ticketed if their average travel speed over the entire distance between the two cameras was over the limit.
"They aren’t ‘pinged’ by a single camera or at a single point where they are over the speed limit," NZTA said.
Mitton said speed safety cameras were more effective at reducing deaths or serious injuries than traditional speed cameras New Zealand has used.
"We expect they will reduce deaths and serious injuries by around 48%.
“Safety cameras will reduce speeding, ensuring that if crashes do happen, the people involved are far more likely to walk away unharmed.”
While construction was set to start next week, the poles and cameras won't be installed until later this year.

Sir John suggested Trump's economic policies could still generally be positive for the US
but the tariffs could be trickier for the global economy
Asked whether he stood by his October comments that Trump would be good for the economy
he said: "Do I think he's going to reduce regulatory burden in the United States
It depends on where things shake down in terms of tariffs."
Sir John acknowledged that for certain industries
Trump's policies could be "a really negative thing"
particularly if the president's proposed 100% tariff on the film industry were to be implemented
"I can't see how it would be cost-competitive to make a movie in New Zealand with a 100% tariff on it," he said
noting that films such as The Hobbit would not have been made in New Zealand without government subsidies

said he had "always been opposed" to Trump's tariff policies but believes they won't be the "dominant part of his economic solutions"
"I don't think it's perfect from New Zealand's point of view
but I don't think we should panic either
and America will still be a very big market for us to sell things to," he said

It's not a great thing from New Zealand's point of view
We've got a very sound economy with lots of options in front of us."

Nobody ever knew where she went or what happened to her
All that changed last week when she was found alive and safe in another state
thanks to the fresh eyes from a deputy who took over the case in February
Detective Isaac Hanson discovered an out-of-state arrest record that matched Backeberg
which triggered a series of investigative moves that led to finding her alive and safe in another state
Turns out Backeberg chose to leave the town of Reedsburg on her own accord – likely due to an abusive husband
safe and secure; And just kind of lived under the radar for that long,” he said
Hanson was assigned the case in late February and
he and other officials met with Backeberg’s family to see if they had a connection with that region
They also started digging through Backeberg's sister's Ancestry.com account
obituaries and marriage licenses from that region
they found an address where a woman was living that Hanson said shared a lot of similarities with Backeberg
including date of birth and social security number
Hanson was able to get a deputy from that jurisdiction to go to the address
"I was expecting the deputy to call me back and say
‘Oh nobody answered the door.’ And I thought it was the deputy calling me
I could sense that she obviously had her reasons for leaving.”
Most of the information he learned during that call he declined to share
saying that it was still important to Backeberg that she not be found
“I think it overwhelmed her of course with the emotions that she had
having a deputy show up at her house and then kind of call her out and talk with her about what happened and kind of relive 62 years in 45 minutes,” he said
Hanson described discovering her safe after more than six decades practically unheard of
And while he doesn't know what will happen next in terms of her family reconnecting
he said he was happy that she can reach out if she wants to
so she has my contact number if she ever wants to reach out or needs anything
any phone numbers of family members back here," he said
"Ultimately she kind of holds the cards for that.”
The government is making it harder to make a claim for pay equity that will cut costs
There have been massive pay equity claims in recent years for nurses and resthome workers
Workplace Minister Brooke van Velden announced the moves to raise the threshold for proving work has been historically undervalued to support a claim
on Tuesday saying changes back in 2020 had created problems
"Claims have been able to progress without strong evidence of undervaluation and there have been very broad claims where it is difficult to tell whether differences in pay are due to sex-based discrimination or other factors."
Claims were concentrated in the public sector
with costs to the Crown of all settlements so far totalling $1.78 billion a year
"The changes I am proposing will significantly reduce costs to the Crown," she said
"The changes will discontinue current pay equity claims."
Van Velden told Midday Report she believes in pay equity but the current thresholds were "a bit too loose"
Asked how she ensure women were not hurt by this
the minister said "I'm a woman and I support women who work"
"I also support removing gender based discriminations from our workforces but what I don't support are muddied laws and unclear laws," she said
"So these changes are better for all women who are working where we can genuinely say hand on heart that what they are finding with their claims is genuine gender based discrimination."
Van Velden told reporters at Parliament any current claims would be stopped and need to restart under the new threshold
to show "genuine" gender discrimination and make sure the comparators were right
She gave a figure of 33 current claims that would be stopped
as the legislation was put through under urgency
"You have librarians who've been comparing themselves to transport engineers
We have admin and clerical staff at Health New Zealand comparing themselves to mechanical engineers."
Social workers had compared themselves to air traffic controllers
"We don't believe we have that setting right."
Any comparison would now be between female employees and male employees at the same employer
"But you cannot go fishing for discrimination across the New Zealand workforce."
All current settled claims would continue but the government was drawing "a line in the sand"
"We're not stopping claims."
The nurse's union has this year had at least 10 pay equity claims in play
The PSA union has said pay equity claims and settlements had resulted in significant improvements in pay and working conditions for many workers
The union said the changes would make it "impossible for people in female-dominated professions to be paid fairly"

That’s because the Dunedin man is not the only Shane William Pritchard in town
While the duo’s shared name and age has sometimes been a handy loophole for one Shane
for the other it has caused problems for 36 years
It’s been years of fearing every knock on the door
Years of wondering if he’ll be hand-cuffed and taken to jail
to be honest,” says Shane William Pritchard

remembers getting quite a shock when her friend called one evening
She'd been acting as a referee for a gun licence for Shane
whose friend informed her that the police had a long list of offences against Shane’s name
Not long after that the police turned up to where Shane was working at the local tannery to arrest him
“You're scrambling in your head to think of ways that you can prove it's not you.”

They were separated by just two weeks and about 50 miles – one growing up in Mosgiel

He was raised in foster care and then boys’ homes

Milton Shane was used to run-ins with police
he got pulled over in his car and asked about his driving licence

Mosgiel Shane became aware of the withdrawal when a scheduled car payment was declined
and when Milton Shane turned up at the bank to withdraw more money
Identity fraud was considered but Milton Shane was legitimately expecting an ACC payment
so the withdrawal appeared to be a genuine mistake and the police couldn’t take any action
'Anything I could get away with
Mosgiel Shane thought the bank incident would have alerted police to the problem
But his nemesis had cottoned on to the advantages of having a second identity to use
Milton Shane acquired a suite of furniture on hire-purchase
Milton-Shane clocked up more driving offences
Mosgiel Shane thought about changing his name but realised he’d have to provide his previous name in the process
the courts and debt collectors such as Baycorp should be able to distinguish between himself and Milton Shane
The police first addressed the issue in the 1990s after Mosgiel Shane went to the media
He was given a letter to carry with him should he be apprehended
He and his parents felt his situation wasn’t being taken seriously
Mosgiel Shane went to the media a second time in the mid-2000s
the police gave their word that a record in their system would stop the misidentification from happening again
This does appear to have worked as far as police action goes
But while Mosgiel Shane was given the same reassurance by the Ministry of Justice
he continued to receive demands from the courts for unpaid fines
He’d also get stopped and questioned whenever he left the country for work trips or holidays
It took a huge toll on Mosgiel Shane’s mental health
not realising the constant stress it placed on his life
John Pritchard says that at times his son felt his life wasn’t worth living
worrying about what he was going to do to himself and that really ate me up.”
he and his son were in tears as Shane admitted he was at breaking point
He described going for days at a time unable to eat or sleep wondering what might happen next
"Am I going to be in a position where they've got me in handcuffs or I've got debt collectors coming to the door?" ...You're spiralling into this black hole." He started taking anti-anxiety medication which helped
And events regarding Milton Shane seemed to settle
Milton Shane was charged for fishing without a licence in Twizel and failing to comply with fisheries officers
But a court registrar incorrectly entered the birth date of Mosgiel Shane in the system
both Shanes were being chased to pay the $1530 fine
It was Mosgiel Shane who spotted the error and rang the court
He also sent a statement from his manager saying he’d not been fishing in Twizel that day
The reply he got was to say he’d been given the wrong form and that they wouldn’t accept his proof
They just wanted to know how I was going to pay the fine.”
The first Milton Shane knew about this was when Fair Go told him Mosgiel Shane had been chased for the fine
He was told to pay up or face the consequences
feeling he shouldn’t have to pay good money to correct someone else’s mistake
But it cost Mosgiel Shane over $5000 in legal fees
and took months of back and forth between him
“Why should anybody have to pay their own money to right somebody else's wrongs and prove who they are
I’m sick and tired of proving who I am all the time.”
He wanted the Ministry of Justice to take responsibility and reimburse him for his legal costs
saying court staff such as the registrar in this case have immunity if they make mistakes such as the one made here
and if I make a mistake and it's affecting my client
that it's going to cost them money to rectify a mistake that I've made.”

Milton Shane told Fair Go he still gets in trouble
but wants the other Shane to know he doesn’t use his birth date anymore
And he had a message for him: “We’ve got to get it sorted for you
so you can have a good life with you and your family because I’m trying to get my life together with my son and my grandson”
He offers to meet to see if they can sort it out together
but I’m not interested in meeting him,.” says Mosgiel Shane
He says he doesn’t hold any grudges and accepts Milton Shane’s apology
And he believes the only way for that to happen is for the courts and the Ministry of Justice to give him a guarantee that mix-ups won’t occur in the future
Fair Go asked the Ministry of Justice to appear in person to apologise and provide reassurance to Shane of its plans to guard against these mistakes
The Ministry declined our request to be on camera saying any comment on an individual case would compromise the independence of the courts as the Ministry operates separately
But it did send a written apology directly to Mosgiel Shane
It also admitted mistakes can occur in clerical records
but said instructions were clear and the importance of getting things right had been emphasised to staff
Mosgiel Shane isn’t totally convinced that’s the end of it
“All I want is for the Ministry of Justice and the courts to do their job
I'd like to live without this hanging over me all the time

Kim Kardashian thought she was going to be raped and killed when criminals broke into her bedroom in central Paris, tied her up and stole more than US$6 million in jewellery.
More than eight years later, 10 people will go on trial in Paris over the robbery, abduction and kidnapping of the media personality and the concierge of the residence where she was staying during Paris Fashion Week the night of October 2, 2016.
Kardashian’s lawyers said she will testify in person at the trial starting Monday and scheduled to run through May 23.
"Ms Kardashian is reserving her testimony for the court and jury and does not wish to elaborate further at this time," they said.
"She has great respect and admiration for the French justice system and has been treated with great respect by the French authorities.
"She wishes the trial to proceed in an orderly fashion, in accordance with French law and with respect for all parties to the case."
In interviews and on her family’s reality TV show, Kardashian has described being terrified as robbers pointed a gun at her.
In a 2020 appearance on David Letterman’s Netflix show, she tearfully recalled thinking: "This is the time I’m going to get raped. I’m like, ‘What is happening? Are we gonna die? Just tell them I have children. I have babies, I have a husband, I have a family.'"
Twelve people were originally expected in the defendants’ box.
One of them has died, and another is seriously ill and can't be tried. According to the investigation, five of the 10 defendants were present at the scene of the robbery.

Kardashian told investigators she was taken to a bathroom next to her bedroom and placed in the bathtub. Her attackers fled on bicycles or on foot and she managed to free herself by removing the tape from her hands and mouth.
She had also removed the tape from her feet and rushed to her stylist’s room. She called her sister Kourtney to tell her about the theft.
Shortly afterwards, Kardashian told investigators that she had not been injured. She filed a complaint, adding that she wanted to leave France as soon as possible to be reunited with her children.
According to her testimony and that of the concierge, at least one of the suspects had a handgun, with which he threatened the victims.
The gangsters stole many pieces of jewellery, including a ring of great value, estimated to be worth more than US$6 million (NZ$10 million). Only one piece of jewellery — a diamond cross on platinum that was lost during the suspects' escape — has been recovered.
Two of the accused have partially confessed to the crime, as their DNA was found at the crime scene.
The alleged ringleader, 68-year-old Aomar Aït Khedache, is one of two suspected robbers who allegedly entered the apartment. Nicknamed "Old Omar", his genetic profile was found on the tape used to gag Kardashian.
He left the hotel on a bicycle, as did two other robbers, then met his son, who was waiting for him in a parked car at a nearby train station.
The second robber said he tied up the concierge with cables but did not go up to Kardashian’s apartment. Yunice Abbas, 71, said he acted as a lookout in the ground-floor reception area, making sure the escape route was clear.
He said he was unarmed and did not personally threaten Kardashian, but admitted he shared responsibility for the crime. Abbas was arrested in January 2017 and spent 21 months in prison before being released under judicial supervision.
In 2021, he co-authored a French-language book titled I Sequestered Kim Kardashian.
Didier Dubreucq, 69, known as "Blue Eyes", is the second alleged robber suspected of entering the flat.
He denies any involvement, although he was filmed by CCTV cameras and numerous telephone contacts with the other co-defendants show his involvement, according to the investigation.
The other defendants are suspected of providing information about Kardashian’s presence in the apartment.
Others are accused of playing a role in the resale of the jewellery in Antwerp, Belgium.

Soundgarden — with the late Chris Cornell as singer — get into the Hall on their third nomination. They follow two other grunge acts in the Hall — Nirvana and Pearl Jam. Bad Company get in having become radio fixtures with such arena-rock staples as Feel Like Makin’ Love, Can’t Get Enough and Rock ‘n’ Roll Fantasy.
The Ahmet Ertegun Award — given to nonperforming industry professionals who had a major influence on music — will go to Lenny Waronker, a former head of Warner Bros. Records who signed Prince and R.E.M., and had a part in records from Madonna, Randy Newman, the Doobie Brothers, Rickie Lee Jones, Paul Simon and Gary Clark Jr.

Police received a report of a motorbike crash on Wilks Rd
A motorcyclist has died in a crash in Auckland’s Dairy Flat last night
Emergency services were called to the area about 9.30pm after reports of a motorbike crash on Wilks Rd
but the rider died at the scene,” police said in a statement
Police said that earlier an officer in the area spotted a motorbike travelling at what was described to be excess speed along Wilks Rd
“The police unit turned around to conduct a traffic stop
police were notified of a motorbike crash on Wilks Rd.”
Inquiries into the full circumstances of the crash are now under way
The only high-reach ladder truck in Auckland broke down last night
Police have seized an array of guns, ammunition, and rifle parts during a search warrant in Dairy Flat
police staff were called to an address in the district
following an alleged dispute that had taken place a week before
Waitematā North Detective Sergeant Peter Law said a firearm was allegedly presented at a person during that dispute
“A 37-year-old man had earlier been taken into custody over that incident
and we have charged him with various firearms and drugs offences,” he said
police staff went to the address where the incident took place so that a search warrant could be carried out.”
“The firearms were in various stages of being re-manufactured when they were recovered,” Law said
in the state we found them in they would be extremely unsafe to operate.”
A 42-year-old man was arrested in connection with the discovery of six firearms
Law said the man would appear in the North Shore District Court on firearms offences at a later date
“We are continuing to make inquiries around the re-manufacturing of the firearms at this address,” he said
“Our team are pleased that this is a further six firearms that have been taken out of the circulation in the community.”

By 4 December 2024 all dairy farms with less than 40 days effluent storage will need a resource consent for applying dairy effluent to land and many farmers will require a consent for effluent storage as well

Auckland Transport re-opened Pine Valley Road in Dairy Flat late last year after a three-month closure to fix an 18-metre slip and damage to a culvert sustained during the severe weather events of early 2023
The road reconstruction work began in September 2024 near 257 Pine Valley Road
and the road was closed to all but residents with traffic detoured via Kahikatea Flat Road and Dairy Flat Road
An 86-metre block retaining wall has been built on the southern side of the road and a large box culvert replacement installed to re-route stormwater beneath the road
Project Manager Jay Badenhorst says the scale of the project meant the road needed to be fully closed for safety reasons and to complete the works efficiently with minimum cost
More than 3000 tonnes of soil was removed during the excavation of the roadway and existing culvert and 15 sheet piles were installed to support a 500+ block Magnum stone wall to support the damaged road
A 2.5m x 2m longbox culvert was then built six metres below the road to direct water from the southern to the northern side of the road
and to prevent erosion and maintain road stability
Large stones called riprap now protect the embankment by deflecting water energy and stopping soil erosion
and power and internet services relocated during the build have been reconnected

Developer Aventuur plans an artificial surf lagoon (pictured)
Spark has secured final resource consent for a huge data centre in Dairy Flat
as part of a green light by the Environmental Protection Authority for a wider development by Perth and Los Angeles-based surf park developer Aventuur
The telco bought a 4ha super-lot inside a 43ha master-planned development that will feature a surf lagoon
using the Wavegarden cove lagoon technology in a set-up similar to that of the renowned UrbnSurf park in Melbourne
accommodation and a farm-to-table restaurant
The solar farm will provide a portion of the data centre’s power and
in what Aventuur project partner Sir John Kirwan calls a “virtuous cycle” and a “world first”
waste heat from the data centre will be used to warm the surf lagoon
Some residents weren’t so enamoured. They raised objections based on noise

Spark recently signed a 10-year deal to purchase all the electricity generated by Genesis’ first solar farm – a 63MW installation under construction at a 93ha site in Lauriston
Energy provided to Spark from the solar farm will account for about 60 per cent of the telco’s annual electricity requirements
with the remaining 40 per cent continuing to be sourced by Genesis from the grid as occurs today under a broader
The cost of the land was accommodated within Spark’s existing capex
Chief executive Jolie Hodson said for the data centre build
“We’ll consider appropriate funding models or partnerships for this investment as we progress those opportunities.”
Spark says initial site works are likely to begin soon

A bulldozer in action at the Redvale Landfill and Energy Park
Auckland’s biggest landfill would need to stay open for seven to eight years longer than expected under a favoured proposal to help ensure the region’s waste can be adequately managed until a new facility is operating in the mid- to late-2030s
But Waste Management New Zealand, whose plans for a new Auckland Regional Landfill at Wayby Valley – between Wellsford and Warkworth and adjoining Dome Valley – have been subject to prolonged legal and court action over consents
“Auckland faces an upcoming infrastructure challenge,” says the company
The proposal is not final; the company is seeking public feedback
which currently manages approximately 50% of Auckland’s waste (around 600,000 tonnes annually)
will stop accepting waste at the end of its consent in December 2028
“Although WM New Zealand is actively developing the Auckland Regional Landfill (ARL) as a permanent replacement
which is still progressing through the consenting process
isn’t expected to be operational until the mid-2030s
This creates a critical 7-8 year period where Auckland needs reliable
sustainable solutions for managing its residual waste.”
Waste Management said it had considered four options including identifying a new
temporary landfill and alternative technologies such as incineration or mechanical biological treatment
But maintaining Redvale was judged the most viable solution based on seven criteria in an independent analysis by Tonkin + Taylor
along with focusing on ensuring Aucklanders minimised waste as much as possible
This recommendation would make “efficient use of existing infrastructure while supporting Auckland’s long-term waste reduction”
said the consultation paper released today
is a long way from the dumps and tips of New Zealand folklore
as Waste Management leaders were at pains to point out to the Herald during a visit to the site
Where once householders might roll up to a tip with a trailer-load of trash - and forage around for “treasure” to remove – these days
monitored and used as an example of an environmental wonderland
The facility takes about half of all the landfill waste produced by Aucklanders
Redvale Landfill and Energy Park is highly engineered – the clue is in its name
About 95% of the methane gas produced by the waste is captured and converted to electricity

which started operating in 1993 under the then requirements of the Resource Management Act
was a pioneer in leading the change from the “bad old days” when New Zealand had more than 1000 tips and dumps in operation
“One of the game changers was the ability to build infrastructure in that gas collection space,” says Maehl
He said emissions from class one landfills in New Zealand had been cut by about 50% between 2005 and 2022
“That’s a combination of closing the old ones and putting good gas capture [in place]
The old scrubby ones that you and I used to go to had no gas capture whatsoever.”
The Redvale site - which is now one of only about 40 class-one landfills left in New Zealand – is 160ha in total

described the Redvale landfill as a “bio-reactor” because of the level of renewable energy
Despite the obvious environmental improvements over the years
Waste Management is expecting to receive strong feedback from the community over the recommended proposal to keep the landfill open for another seven to eight years
There is a need to manage a total of about four million tonnes of waste between the expected closure of Redvale at the end of 2028
until the likely opening of the ARL in 2036
Waste Management says its recommendation to keep Redvale open is based on an independent assessment by Tonkin + Taylor that took into account timing

and completing construction is a complex and time-consuming process
often taking many years,” says the consultation paper
“Landfills are typically long-term investments
This long lifespan helps distribute the costs over the lifetime of the landfill
If a landfill were only required for a short period (such as eight years – 2029-2036)
the investment required may be hard to justify.”
The company says its plan to keep Redvale open for longer
while also striving to reduce waste and recover more
is “understanding community impacts such as traffic
odour and visual effects arising from the increased consented disposal capacity between 2029-2036″
“The combined approach prioritises Auckland’s continued focus on waste reduction and recovery capabilities while acknowledging the ongoing need for landfill disposal,” says the consultation paper
“By continuing to support Aucklanders’ efforts to reduce waste and exploring opportunities to enhance recycling infrastructure
we can progressively reduce the volume of residual waste requiring landfill disposal
rebalancing disposal across existing landfills provides the necessary disposal infrastructure for materials that cannot yet be recycled or recovered
ensuring essential waste management services continue uninterrupted as we transition to ARL.”
Consultation opens today and closes on May 11
As well as the four options already studied
the consultation paper leaves open the possibility that parties might have other options that need to be considered

and those behind the proposed park forecast more than $600 million will be contributed to the Auckland economy during the life of the project

with many potential sites canvassed before the location in Dairy Flat was selected
Aventuur has put plenty of thought into the sustainability and environmental aspects of such a project and is targeting a New Zealand Green Buildings Council green-star rating
while the developers are looking to warm the park’s lagoon with excess heat stored from its data centre
After commissioning an economic report considering the total cost to deliver the park
as well as the increased local spending and greater Auckland stimulus once operational
it was estimated Auckland Surf Park would contribute more than $600 million to the Auckland economy over the life of the project
Speaking to the Herald about the project late last year

who is now working as the surf and sustainability director for Aventuur
said it was the benefits the sport could offer the average Kiwi that most excited him when it came to creating an artificial wave accessible to all

underlay and floorboard that have had a normal surface wet vac clean will not have removed all the faecal coliforms and raw sewage smell in the flooring materials
The tenants lived with the sewage-soaked carpet from May 4
this year — a total of 35 weeks and six days
The family also experienced several other water-related issues across the course of their tenancy
the tenants also claimed that water consistently ran out every one and a half weeks
leaving them without water for between 24 and 48 hours
The tenants told the tribunal they had used tank water before and were sparing with it
They ran out of water frequently because all three properties drew from the same three small 11,000-litre water tanks
a family of two adults and two children requires two 32,000-litre tanks of water to ensure there is enough
The tenants tried to raise the issue with the landlord
who refused to replace them because it was too expensive
The tenants also claimed the quality of the water was poor
saying it was cloudy and "tasted funny." They claimed they were "constantly getting sore stomachs." They said the quality of the water was so bad they were forced to buy bottled water
Photographs sent to the tribunal also appeared to show a 10cm layer of "thick black sediment" at the bottom of all three water tanks
Pollak said: "I am satisfied the tenants have proven they were not provided with sufficient potable water
"It was not reasonable in all the circumstances for the landlord to provide 11,000-litre water storage capacity to three households knowing that each household required far more than that amount of water
"I find the owners intentionally put the tenants to the stress and inconvenience of being without water every 1.5 weeks for up to 48 hours and to having the responsibility for monitoring the water levels daily for three households without an easy way to see the water levels
To save them the costs involved with providing these three households with adequate potable water."
Pollak also sided with the tenants on their claim that the property was unlawful
She found that the properties being rented by the family and others did not meet the building code and did not have the proper consents
She said that on the "balance of probabilities"
the landlord knew this "but decided to rent all three units out to earn money off its investment until it could afford to develop the property it had land banked"
The landlord was also found to have not provided sufficient smoke alarms
The landlord also breached the tenants' right to quiet enjoyment of the property by sending contractors over without warning
Pollak said: "These breaches were prolonged and resulted in the tenants and their family living in cold
damp and potentially mouldy conditions without adequate potable water or access to proper toilet facilities and they experienced considerable periods of stress
and loss of the amenities they are paying rent to enjoy."
She found the landlord had shown a "cavalier attitude" to the tenants
the tenants were awarded $3,585.71 for the landlord's failure to maintain the toilet
a 40% rent rebate of $12,760 for leasing an unlawful property
and the $2200 bond was ordered to be returned
Pollak ordered the tenants to be charged no more than $330 per week in rent until the end of the tenancy on March 2
The landlords attempted to have their names suppressed
but Pollak denied the application and published the address
They have lodged an appeal in the District Court against the tribunal’s decision
arguing it is incorrect and not supported by evidence on a number of counts

An Auckland landlord has been ordered to pay a family more than $30,000 after they were stuck living in an "unlawful" property with a sewage-soaked carpet
The family's experience of living at the Albany Heights unit was detailed in a recently released Tenancy Tribunal decision — where adjudicator Michelle Pollak published its address "as a deterrent to the property owners continuing to rent out any of the three current unlawful dwellings".
The family, comprised of two adults and two children (whose names are suppressed), moved into 310 Dairy Flat Highway in December 2023.
The unit, one of three on the property, was an old farmhouse divided into two households. A third was elsewhere on the property. Ashton NZ Property Ltd managed it on behalf of landlords Lingzhi Yuan and Leiyang Shen. They are appealing the decision.
On April 14, the toilets blocked, overflowed, and flooded two areas beside the bathroom with raw sewage, soaking a carpet. The family contacted the property manager that day but received no reply.
"Out of desperation," they called a plumber who cleared the blocked sewage line. But the toilet clogged and overflowed as soon as it was used again.
Nearly three weeks later, on May 4, the property manager finally replied, asking for photos of the damage. They asked the tenants to rip up the sewage-soaked carpet, throw it away, and clean the flooring.
"The tenants refused to rip up the sewage-soaked carpet as it was the raw sewage that posed a health risk," Pollak said.
A second plumber, called by the property manager, also came that day and unblocked the toilet paper that had blocked up the line, but was unable to clear the grout, which continued to cause a blockage.
The plumber said the pipes were too small and needed to be replaced. Another plumber came on May 8 but couldn't unblock the small pipes or remove the grout. They were also asked to empty the old septic tank to see if it fixed the issue.
The landlord did send other contractors to try find solutions, including a second emptying of the septic tank.
According to the report, the property manager did nothing about the now "unuseable" toilet, and the family arranged for a portaloo to be delivered. The landlord paid for the portaloo, which was used between May 6 and July 10, until the sewage issue was fixed.
On June 20, the tenants complained that their neighbour's raw sewage was coming up through their toilet.
The landlord sent a contractor to drain the sewage from the toilet and unblock a blocked pipe, but the toilet remained unuseable.
The issue persisted as the neighbour kept using their toilet.

"I find the owners intentionally put the tenants to the stress and inconvenience of being without water every 1.5 weeks for up to 48 hours and to having the responsibility for monitoring the water levels daily for three households without an easy way to see the water levels. To save them the costs involved with providing these three households with adequate potable water."
Pollak also sided with the tenants on their claim that the property was unlawful.
She found that the properties being rented by the family and others did not meet the building code and did not have the proper consents.
She said that on the "balance of probabilities", the landlord knew this "but decided to rent all three units out to earn money off its investment until it could afford to develop the property it had land banked".
The landlord was also found to have not provided sufficient smoke alarms. The landlord also breached the tenants' right to quiet enjoyment of the property by sending contractors over without warning.
In her final decision, Pollak said: "These breaches were prolonged and resulted in the tenants and their family living in cold, damp and potentially mouldy conditions without adequate potable water or access to proper toilet facilities and they experienced considerable periods of stress, inconvenience, and loss of the amenities they are paying rent to enjoy."
She found the landlord had shown a "cavalier attitude" to the tenants.
As a result, the tenants were awarded $3,585.71 for the landlord's failure to maintain the toilet, $5,742.86 for the water issues, $1,450 as reimbursement for bottled water, $4,800 for RTA and HIR breaches, a 40% rent rebate of $12,760 for leasing an unlawful property, $750 for insufficient smoke alarms, a $27 filing fee reimbursement, and the $2200 bond was ordered to be returned.
In total, the tenants were awarded $30,615.57.
Pollak ordered the tenants to be charged no more than $330 per week in rent until the end of the tenancy on March 2.
The landlords attempted to have their names suppressed, but Pollak denied the application and published the address.
They have lodged an appeal in the District Court against the tribunal’s decision, arguing it is incorrect and not supported by evidence on a number of counts.

A large fire which caused "significant damage" to a McDonald's restaurant in east Auckland this afternoon is now being treated as suspicious
Emergency services were notified of the fire at around 3pm on Monday
Fire and Emergency NZ said the building was "totally involved" in flames by the time crews arrived
and Papatoetoe were in attendance at the blaze
"Everyone was out at the time and there are no reports of injuries."
FENZ said the fire was being treated as suspicious
"A fire investigator is attending to determine cause and origin."
Pakuranga Rd was closed for nearly two hours in both directions with road users advised to avoid the area
"Investigations into the cause of the fire at the McDonalds are underway," police said
