While the Good Friday rules are pretty clear – almost everything must be closed – it’s Easter Sunday where things get more complex. That’s because Easter Sunday is a restricted trading day, but not a public holiday meaning it’s up to regional councils to dictate what can and cannot open Take Auckland, for example. On the council website there is a list of exceptions to the Easter Sunday rule takeaway food outlets and… “shops on Parnell Road” The council website states that stores along the inner city stretch are allowed to be open from 10am to 6pm Cheryl Adamson from the Parnell Business Association explains that the exemption was applied for by the owners of Parnell Village It wasn’t formally extended to all shops on the street until 1989 Parnell’s main road has been a shopping oasis when other parts of the city were forced to close Parnell isn’t the only very specific area that is able to bypass New Zealand’s historic trading rules. A list of exempt places published by the Herald also includes Market Place in Hamilton Harbour Market in Napier and Richmond Court in Thames presumably due to its popularity with overseas visitors is free to open – but only “whenever Founders Park is open” and only to sell “crafts” What all of these exemptions have in common is that they were first implemented in the 1980s – but are still being adhered to in 2023 a labour inspector from the Ministry of Business Innovation and Employment says the exemptions date back to a now-repealed piece of legislation from 1977 called the Shop Trading Hours Act “[It] provided for a Shop Trading Hours Commission to hear applications for area exemptions This was disestablished on 1 August 1990 when the 1977 Act was repealed in favour of the Shop Trading Hours Act 1990,” he explains “The area exemptions in force at the time the 1990 Act took effect They still apply but there has been no mechanism to update them or mechanism to apply for new exemptions since 1990.” Employment lawyer Sam Houliston says the exemptions were granted to retailers so they could open for tourists Taupō and Queenstown were totally excluded from the regulations – and still are to this day when an amendment was made to the 1990 Act which provided a new mechanism for local councils to create Easter Sunday shop trading policies which allow shops to open within their own districts “The conditions that can be adopted are broad but a policy cannot be put in place without the council undertaking a special consultative procedure,” Houliston says “This requires the council to develop a proposal make it publicly available and provide for interested persons to give a view on the proposal There’s no ability for an individual retailer to apply for an exemption – the retailer needs to fall within the conditions of the policy.” In short, that means that any new exemptions have to apply more broadly and couldn’t be implemented for just a set of shops. It’s why, for example, places like Upper Hutt and Gisborne will be open on Easter Sunday – though it’s up to shop employees whether they actually want to work or not The Parnell Road exemption aside, Auckland does not currently have an Easter Sunday shop trading policy “so retailers that want to open need to ensure they won’t run afoul of the rules in the Shop Trading Hours Act 1990,” says Houliston A “modest” fine of up to $1,000 can be doled out for each breach of the rules Critics of the existing Easter trading rules say they are out of date and have no place in the 21st century The Act Party launched a member’s bill last year calling for shops to be given the option of opening over Easter with no penalty “That’s how a free society should operate,” the party’s small business spokesperson Chris Baillie said at the time Party leader David Seymour says that the current rules are “archaic” and have no place in a “modern and pluralistic society” – but as the MP for Epsom he’s OK with Parnell Road being “exempted from this particular piece of lunacy” “I’d also point out that it hasn’t done Parnell any harm – far from it – and maybe it’s time to extend this common sense to the rest of New Zealand,” Seymour says “It doesn’t take away from some people’s faith and celebration of Easter that others can go shopping or have a drink… New Zealand is so different from what it was in the 1970s Today there are a range of people who come to New Zealand who have a range of views and beliefs and it seems strange we’re still practising as though it’s 1973.” Those on the other side of the debate, including former Auckland mayor Phil Goff, say workers should be promised a few days a year that aren’t “commercialised”. Unless, of course, you work on Parnell Road. A pedestrian has died after a truck accident on The Strand, Parnell. Photo / Alex Burton A pedestrian has died in hospital after an accident with a truck in Parnell, Auckland. The incident occurred on The Strand and a section of the road was closed this afternoon. Hato Hone St John was notified at 2.05pm and transported one person to Auckland City Hospital in a critical condition. In an update, police said the person had died in hospital. A section of The Strand was closed earlier between the intersections with St Georges Bay Rd and Tamaki Drive. The truck at the scene had come to a stop about 50m from where police were laying evidence markers. About five police cars were in attendance, directing traffic and talking with a person understood to be the driver of the truck. Police earlier said the Serious Crash Unit had been notified and would be attending the scene. “Inquiries are ongoing into the crash,” a spokesperson said. “The Strand has since reopened to traffic following a scene examination.” The only high-reach ladder truck in Auckland broke down last night. The award-winning, 47-year-old establishment - which specialised in fine dining using old-fashion-style silver service - shut its doors two weeks ago. The celebrated chef made the announcement on Antoine's website. "We want to thank you all for the loyal support over the past 47 years, but the time has come for us to say goodbye. You will all [be] sincerely be missed, and the memories will live on from all the great times we had which we thank you for," Astle said. "Although this is me signing off for now, there might be something new in the pipeline a bit later so keep your eyes peeled. "Once again, thank you to all," the statement read. Astle, who has been a mentor to some of the country's highest-profile chefs, including Michael Meredith and Simon Gault, told the Herald the closure was not related to Covid. The decision to close Antoine's came following a personal matter, he said, but he would not reveal what that matter was. Astle said he had not yet decided what was next for him professionally. Parnell Business Association general manager Cheryl Adamson said the closure was an end of an era for Parnell. "Antoine's was certainly one of the longest-standing businesses in the area, it was so quintessentially Parnell, it was housed in one of the converted villas and was a true representation of everything Parnell," Adamson said. "It was the old-school fine dining, white tablecloths, silver service, all that attention to detail in terms of the food and the plating. along a grass verge before armed police captured those involved Ronald Neilson was in the front passenger seat as co-offender and fellow 501 deportee Sifa Tevita – booted out of Australia after cutting the throat of a wheelchair-bound man in a murder-for-hire plot – drove the Porsche which by the end of the incident had lost its tyres who got out of the vehicle and relieved himself in front of police before being arrested was sentenced to two years and seven months in jail in November for a swathe of driving and dishonesty offences relating to the April 2023 incident and more that occurred subsequently while he was on electronically monitored bail Neilson learned his fate before Judge Kirsten Lummis in the Auckland District Court She sentenced the 33-year-old to two years and three months in jail for a dozen crimes committed over more than a year including two of burglary and two of using or attempting to use a bank card as a result of the Parnell incident While Neilson wasn’t in the driver’s seat of the Porsche he’d used a $50,000 Land Rover Discovery stolen from the same Parnell property to crash through a security gate The hours-long crime spree began about 2am when Neilson and “an unknown number of accomplices” climbed a fence and then used a ladder to get into the home’s upstairs office as the occupants slept After taking an American Express bank card and using it twice – once unsuccessfully – spending $52 at a petrol station Neilson and others returned to the Parnell home about 4am and took keys for the Porsche and Land Rover “You drove [the Land Rover] at the security gate Neilson was arrested in the passenger seat of the Porsche after the police pursuit The 501’s offending was serious because it’d targeted a home where people were sleeping It was “really concerning” the victim was too afraid to do a victim impact statement “It tells me they are still really scared of what people out there are capable of doing I have no doubt that what happened will continue to play on their mind for years to come.” Judge Lummis also sentenced Neilson for eight other crimes committed following the Parnell incident when he was on bail before being remanded in custody after his most recent offending in August last year to be served concurrently with his jail sentence of two years and three months and a year-long driving disqualification were imposed for the crimes – dangerous driving Because Neilson had been in custody since August 24 he could be eligible for parole in May when he’ll have served a third of his sentence The pre-sentence report showed there’d been “something of a turnaround” while Neilson was in custody “You’ve said it’s something of a blessing in disguise giving you that opportunity to reflect … and really get off all the substances and drugs that have been causing you so much trouble in recent years.” Neilson was working with addiction services to make a plan for staying off methamphetamine once he left prison because “you recognise that is where the fall comes” He’d also shown responsibility by taking on a cleaning role in jail among rehabilitative factors that earned him earlier discounts in jail time along with his guilty plea remorse and the impact of being deported from Australia “It’ll be up to you as to how you continue to behave while you’re in prison and the work you continue to do yourself as to whether or not you’re able to get parole at that first opportunity “But I’d encourage you to … continue to do what you can do to make sure we don’t meet again.” Neilson was kicked out of Australia for committing a “serious bodily harm” crime and Judge Lummis said she could “understand your frustration [with the deportation] But the judge also noted Neilson has a daughter Among those
