In the case of CALDARAR AND OTHERS v. POLAND the Court found  that the applicants’ right to respect for their private and family life had been violated.  This ruling by the Court has drawn renewed attention to the living conditions of Roma in Poland which ECRI recently described as ‘generally deplorable’ It serves as a timely reminder that much remains to be done to close the gap between judgements and justice.  In its 2023 monitoring report, ECRI expressed concern about reports of ‘forced relocations’ of Roma and “deplored efforts by municipalities to terminate or prevent Roma residence in their territories.” ECRI called for more decisive measures and mechanisms to support incite and oblige local authorities to do right by Roma when it comes to housing.  According to Helsinki Foundation for Human Rights Wrocław municipal authorities demolished a Roma camp at Paprotna Street in Wrocław Roma families (adults and children) had been living in the camp since 2009 Application to the ECtHR was submitted at the beginning of 2016 The applicants had not been aware of the demolition plans and that they had not been at the site when the demolition had taken place The camp was torn down after they left their homes in the morning of 22 July 2015 Some inhabitants appeared towards the end of the process Their belongings which had been stored on the site such as household appliances had been either destroyed or dumped.  “stated that the applicants had clearly felt distress hysteria and helplessness when they were ignored by those carrying out the demolition and had not been allowed to retrieve their belongings still remained on the site.” Assurances from police officers that their goods had surely been secured and could be claimed back on the following day Roma residents and journalists followed a truck loaded with their remaining belongings to discover that they were smashed and dumped in a landfill The residents were deprived of any opportunity to challenge the demolition decision or initiate a judicial review of the decision The demolition decision was enforced before the review was complete: the decision from the second instance body was issued seven days after the actual demolition The applicants submitted that following the final demolition of their encampment They had later erected several structures on another site at Kamieńskiego Street They claimed that they had been living there at the time when notice of the present application was given in conditions which did not ensure their safety The applicants complained that the authorities had failed to provide them with an adequate alternative solution which would have respected their way of life and their family and neighbourly bonds and which would have levelled off the inequality of their marginalised group the ERRC described forced evictions of Roma across Europe as one example of antigypsyism a systemic and structural form of racism that has led to the social exclusion and immiseration of Roma In its call for consideration to be given to the element of racial harassment the ERRC stated that the burden of disproving discrimination should shift to the Government; and that people facing eviction must have access to remedies with an automatic suspensive effect The grounds given by the authorities for the demolition were that the cabins had been built illegally and that they did not comply with any construction or safety standards The Government argued that any links that the applicants might have had with the site had only been temporary and therefore did not lead to that site qualifying as their ‘home’ within the meaning of the Convention.  The Court has broadly defined ‘home’ as the place The concept is not limited to premises which are lawfully occupied It is an autonomous concept which does not depend on classification under domestic law The Court has never attached importance to the technical aspects of the dwellings in question makeshift houses or apartment rooms.  Whether or not a particular premises constitutes a ‘home’ which attracts the protection of Article 8 will depend on the factual circumstances namely the existence of sufficient and continuous links with a specific place the essential test in the Court’s assessment of the notion of the right to respect for one’s home in cases concerning unlawful structures has been the applicants’ long and continuous occupation of the site the Court found that the demolition of the applicants’ unlawful settlement at Paprotna Street by the local authorities on 22 July 2015 amounted to an interference with their right to respect for private and family life Site Map | Privacy | Permissions | Copyright © 2025 ERRC The sudden movement of three million Ukrainian refugees to Poland following the war in Ukraine and the floods that impacted Poland’s southwest in the autumn of 2024 are only the latest examples of the multiple crises that cities in Poland must face The City of Wrocław is mobilising resources to prepare for any situation that climate change But how can a city prepare for a crisis situation? We see sustainable urban development as a key towards a resilient future, and an important factor in this is food security. Building on the European Union’s (EU) sustainability framework – particularly the Farm to Fork strategy – Wrocław is developing its first-ever urban food policy Our goal is to enhance food security for all residents – ensuring that everyone has sufficient access to safe and culturally appropriate food – even in times of crisis Food security is also about adapting to future climatic and environmental conditions for food production Wrocław has set up Miejska Farma (City-Farm) the first urban organic farm in Poland where food production for the city’s consumption is combined with an inclusion and training programme for people searching for employment The farm produces 70 tonnes of food annually used in the 16 public kindergartens that are part of the Wrocław Nursery Complex It is also an example of the partnerships needed to run such an interdisciplinary project The City’s Division of Climate and Energy manages the farm in collaboration with Wrocław University It cooperates with six additional organisations to manage the different parts of the operation – from hiring workers to the distribution of the harvest and the on- and off-site educational activities Food security is not a challenge that can be solved in isolation which is why partnerships that involve strong cross-city cooperation and efforts to bring food to the forefront of the policy arena Cities have the tools we need to work on food systems, while EU frameworks support the collaboration and alignment between local national governments must create the right framework to enable cities and communities to work on sustainable food systems for greater food security and resilience This is why Wrocław and many other cities and towns have signed the Aalborg Conditions These clearly state the enabling conditions local governments need now to take effective action towards a climate-neutral and Krakow are joining forces to advance the development of urban food policies and leverage change in national legislation in this regard These activities and partnerships help create an interdisciplinary network of people working across an array of interconnected topics that will help to build a food community in Wrocław While Wrocław has been working on sustainable city development for years dialogue with our national policymakers that could enable policy alignment such as allowing the sale of fruit and vegetables from urban production areas to school canteens is currently one of several food-related priorities in local politics We are also looking to create partnerships in rural areas in the region so that municipalities of all sizes can work collaboratively to facilitate market accessibility (for new opportunities) and ensure food security and a vibrant future for all It is worth including another important context in our thinking. scene in John Milton’s poem Paradise Lost,’ says International Festival Wratislavia Cantans Artistic Director Andrzej Kosendiak as he explains its enigmatically-punctuated 2025 theme wakes up in a sea of fire to find that he is still himself and utters the significant words: “The mind is its own place ‘I think this is the key tounderstanding the message of this year’s festival: humans themselves very often bring hell to earth but it also happens that humans can reveal their greatness and build a paradise here’ it perhaps goes without saying that the 60th edition of this major Polish festival is offering a feast of food for thought is how neatly Kosendiak’s words also act as the key to understanding the festival’s longstanding overall musical and philosophical DNA its dual passion for the importance of text and for music’s power to act as a unifying force Based in the historic city of Wrocław and its surrounding area Wratislavia Cantans was established in 1965 by composer Andrzej Markowski as an oratorio-cantata festival – a remarkable repertoire focus for an era during which Poland was ruled by authorities who neither encouraged religious activities nor the presence of religious music in the official repertoire of artistic institutions Equally remarkable for this time was the festival’s remit to imbed itself in the urban fabric by staging its performances in churches because Poland also had no tradition of organising musical events outside of concert halls the festival welcomed international artists almost from the very beginning; which in the further context of the lack of accessible recorded music meant that it acted very much as Poland’s window onto the world during these years The NFM in Wrocław (credit: Lukasz Rajchert) and Wratislavia Cantans’s 60th edition is still making good use of the many historic buildings at its disposal One highlight will be baroque violinist Théotime Langlois de Swarte and lutenist Thomas Dunford performing in the intimate setting of the Pan Tadeusz Museum which occupies one of the most beautiful tenement buildings on Wrocław’s Market Square is that for those concerts that would sound best in a purpose-build acoustic one of the best concert halls in its part of Europe: the Witold Lutosławski National Forum for Music plus three chamber halls and an exhibition space it’s the result of the 2014 merger between Wratislavia Cantans and the 1945-founded Wrocław Philharmonic which as the NFM Wrocław Philharmonic underpins the current festival programming together with the more recently-created ensembles The latter ensembles were founded by Andrzej Kosendiak while director of the NFM the festival and the orchestra (2005-2024) Having recently stepped across to become instead the festival’s artistic director he’s now quick to cite among this year’s highlights the opening concert led by his predecessor in the role who with his own Baroque band Il Giardino Armonico will be performing Beethoven’s Symphony No 3 “Eroica” and with the NFM choir under its artistic director Lionel Sow ‘You could say that these are musical paradises’ he muses ‘Absolute perfection is revealed in every bar of both works But history also shows that the hopes Beethoven had for Napoleon ended with the transformation of an anticipated hero into a tyrant The NFM Choir gets to sing Beethoven later in the festival in the shape of his sparkling Choral Fantasy alongside two hotly anticipated star visitors and Charles Dutoit conducting the Orchestre Philharmonique de Monte-Carlo Kosendiak himself meanwhile conducts Wrocław Baroque Ensemble in his own orchestration of another work he views as a musical paradise Other Polish artists include singer and musicologist Agnieszka Budzińska-Bennet making her festival debut with her ensemble Peligrina performing one of several settings of Song of Songs the festival also introduces a brand new competition for younger-generation ensembles asking them to propose a programme related to main theme and then awarding concerts to two winning ensembles Aspiring singers meanwhile can attend the oratorio course The orchestras conference is back for a second year too with representatives invited from orchestras from all around the world to discuss the future of music ensembles Conductor Andrzej Kosendiak (credit: Łukasz Rajchert) the festival also continues its fervent championing of contemporary music via the world premiere of a brand new festival-commissioned Requiem by Zygmunt Krauze and setting realist poetic texts rather than being strictly liturgical Indeed conflict has been a very conscious element of the Paradise Lost [?] thinking as war continues to rage on Poland’s eastern border and the final emotive reference to it will be the festival-closing performance of Wagner’s Parsifal starring the NFM Wrocław Philharmonic under its conductor Christoph Eschenbach who was born in Wrocław in 1940 when it was still Breslau and whose father died in action during the Second World War ‘Christoph Eschenbach’s arrival in Wrocław was also a return from hell,’ points out Kosendiak ‘Parsifal was a very meaningful conclusion to this year’s Wratislavia Cantans The final element across the festival’s ten packed days is actual philosophical conversation centred on the main theme ‘There is a hunger for a sense of community within us,’ reasons Kosendiak ‘but we often jump at each other’s throats Social engineers use every pretext to divide people according to the Roman maxim and I think that music has an extremely important role to play here I would like the NFM to be a place where you can meet and talk before and after a concert One suspects that at Wratislavia Cantans this September the answer is this author ‘There are few places in Poland where history calls so strongly for remembrance and at the same time has learnt over the decades to raise people from the ruins – even amid the lingering shadows of the past,’ writes Michał KŁOSOWSKI Uncle?’ my nearly ten-year-old godson asked me the other day How can I explain that this is more complex than a simple apology and a request for forgiveness from one party and an open yet firm attitude from the other but it is the only kind that truly leads to forgiveness reconciliation is not a slogan from a religion textbook or a grand political gesture It is a process that involves a series of specific steps A choice to acknowledge the pain and dress the wound careful not to let it fester and spread to others Wrocław may understand reconciliation better than any other city in Poland .The spiritual history of Wrocław did not begin in 1945 Breslau was one of the most important centres of German culture and the home to figures such as Edith Stein – a philosopher Jewish convert to Catholicism and Discalced Carmelite nun who was murdered in Auschwitz and later canonised as a Catholic saint and patron of Europe Her life in many ways mirrors the city’s history marked by identity struggles and dramatic turns Husserl’s student and Heidegger’s philosophical peer Stein bequeathed us not just philosophical works but also a spiritual testament demonstrating that reason and faith are not at odds but can be united in prayer and suffering Breslau is reminded that holiness can be a bridge instead of a wall Vilnius and Stanisławów were resettled here Many were told by their German hosts that they were coming ‘only for a while’ the returnees brought with them not only their suitcases but also their wounds Wrocław was meant to become the ‘new Lviv’ yet the spirit of the place resisted such simplification The pre-war Protestant churches rang out with Latin liturgy but their history lingered; the city’s scarred architecture bore witness to the destruction long after the fighting had stopped Wrocław became the site of a sometimes challenging but ultimately possible meeting – a meeting with pain between people who were supposed to remain forever divided by war Wrocław brought forth one of the most important voices of the Polish Church in the 20th century the main author of the Letter of the Polish Bishops to the German Bishops which contained the famous words: ‘We forgive and ask for forgiveness’ The authorities of the Polish People’s Republic were furious but it was also a bitter pill for many Poles who still vividly remembered Nazi crimes The fact that Communist propaganda portrayed Germany as the eternal foe certainly didn’t help But the Church understood that reconciliation must come before politics; that it was the only way to avoid repeating the mistakes of the past It contained not only the famous sentence but also a detailed account of sins those words resonate as the spiritual manifesto of Wrocław – a city that has risen from the rubble but is not defined by contempt A city that has turned a foreign history into a shared memory as it hosts migrants from Ukraine and writes new pages of history Today’s Wroclaw doesn’t detach itself from the past but appreciates it in new ways a lecture at a Jewish cultural centre and meditation with the Dominicans but about something deeper – a spiritual coexistence of many traditions It is as if the refugees from the Polish Borderlands had brought with them what matters most: the spirit of a Poland built not only by Poles but by all who chose the Republic as their home Wrocław is becoming not so much a centre of religion as a place of religious trust It does not produce doctrines but fosters relationships; it makes the philosophy of dialogue a city-wide reality oversimplified slogans and fierce polarisation Wrocław may offer a lesson not only for Poland The people who make up this city show that reconciliation doesn’t mean giving up the truth It is not silence in the face of injustice but to try to abandon old patterns and weapons Religion is not merely a backdrop to this process Wrocław – the city of Edith a white-on-white early 959 that’s still owned by Porsche The early F-body 911 behind it provided a beautiful look into the similarities and differences between the purest and most extreme versions of the basic air-cooled 911 shape The all-black 959 on the catwalk had my heart entirely though it’s not as pretty as a Ferrari F40 and a Jaguar XJ220 is my guilty pleasure but the understated menace of a black-on-black-on-black 959 is to die for in my eyes and its ability to crush continents with ease a pretty little Porsche 904 parked at the ‘Bar U Rycha’ (‘Rycha’s Bar’ in English) The rest of the
