Kennedy, Jr. v. Braidwood Management, Inc. It was initially filed in 2020 when several Christian businesses and conservative employers challenged the Affordable Care Act, which requires private insurers to cover certain preventive care services the case focuses on how to appoint a task force that decides what should be covered A lower court decided the United States Preventive Services Task Force violates the Appointments Clause in the Constitution because the president does not decide who sits on the task force Court of Appeals for the Fifth Circuit upheld that decision the question is whether the Supreme Court will also support the lower court’s decision “If the Supreme Court were to up uphold the decision that was made by the appeals court late last year, it would set a precedent that could jeopardize these services that we’ve become so accustomed to,” said Molly Guthrie, vice president of policy and advocacy at the Susan G. Komen Breast Cancer Foundation. sight to see students on electric scooters cruising the red brick sidewalks of Elon University as they head to class or the dining hall when Matthew Van Komen arrived this summer and began to scoot around campus It’s quite a sight to see a 7-foot-4 guy with a mullet and a mustache on a little scooter who is the tallest player to ever put on Elon’s maroon and gold has grown accustomed to constantly being watched whether he’s on campus or at the grocery store but sometimes I like the attention,” Van Komen said having traveled from the Pac-12 to the WCC to Division II and now to Elon injury-riddled career can culminate in success on the court at the DI level who is 6-foot-1 and played basketball at BYU says Van Komen has “gotten attention from day one.” She remembers when she took him to the doctor for a check-up and all the nurses gathered in the room where he was being measured to gawk at his size He came home upset from the first day of kindergarten because he couldn’t fit in any of the seats and the teacher had to go to a sixth-grade classroom to get him a chair As he grew to over seven feet tall in middle school he towered two feet over most of his peers describing himself as “skinny and awkward.” He preferred to explore the local Utah terrain going camping in the mountains with his friends “Basketball wasn’t something I practiced on my own Van Komen garnered plenty of attention from high-major coaches Prestigious basketball programs such as Gonzaga admittedly naïve to the recruiting landscape didn’t know how to handle the barrage of phone calls and information “I never really watched a lot of basketball and I didn’t really know who these schools were.” Van Komen committed to the University of Utah he found himself buried on the depth chart as the third center so he consumed daily protein shakes and “gorged himself in the dining halls.” He said he arrived on campus at 217 pounds was listed on the official team roster at 240 and he claims he got as high as 270 pounds an astonishing 53-pound gain in nine months Van Komen saw action in just nine games his freshman year including 12 in one game—an NCAA-record 94-point victory over Mississippi Valley State “The struggle’s not unusual,” said Larry Krystkowiak the former NBA player who recruited and coached Van Komen at Utah “I always talk to our young kids about how hard it is and how it’s kind of a rite of passage It’s pretty rare to come in as a freshman or sophomore and play.” “My parents were expecting me to be starting and so was everyone else Frustrated by the lack of playing time and not seeing a path to change that in future years Van Komen put his name in the Transfer Portal as the COVID-19 pandemic enveloped the country schools were not allowed to host recruits on visits “It was interesting picking a school purely off what the coaches had to say.” Van Komen whittled his list of finalists to St He visited the California schools on his own sometimes touring the campus while on a FaceTime call with the coach of the school he was visiting a West Coast Conference program that had won at least 20 games for 13 straight seasons and had produced NBA players such as Brian Shaw and Patty Mills Van Komen had injured his foot late in his freshman season at Utah but the severity of the injury was unknown at the time he transferred he learned that he had a fracture of his navicular bone in his left foot that would require surgery It’s an injury that has plagued some of the tallest players in the NBA Van Komen is convinced that the added weight he put on during his freshman year contributed to the injury Foot surgery meant that he was out of commission from the time he arrived at St Mary’s in the summer until the beginning of the season That lack of practice time made it difficult to crack the rotation and Van Komen again found himself watching more than playing He saw action in only 13 games for 34 total minutes in his sophomore year Van Komen prepared for an important offseason with hopes of earning minutes in his junior year as he broke the navicular bone in his right foot in the first workout of the spring and another summer and fall of sitting on the sidelines instead of improving his game and earning playing time Van Komen never considered hanging up his sneakers doctors told Van Komen that his right foot wasn’t healing properly and would require a second surgery ensuring he wouldn’t play at all during his junior year Rather than focusing on returning quickly to play Van Komen looked at the long-term picture for rehabilitation throughout the winter and spring He was finally healthy in the summer before his senior year as the Gaels went to Australia for a two-week foreign tour in August as he fractured the fourth metatarsal in his left foot during the team’s first game down under the injury happening at the end of the summer meant that it would be another wasted season for Van Komen “I maybe could have started playing in December but just slowly came back because I wasn’t trying to have anything else happen,” he said despite having been in college for four seasons Van Komen still had three years of basketball eligibility remaining due to his injuries and the COVID-year waiver granted by the NCAA to all student-athletes Mary’s coaches informed him his career would have to continue elsewhere “But they told me they’d help me find a place if I wanted to continue playing basketball.” Van Komen put his name in the Transfer Portal for a second time He quickly discovered a limited market for a player coming off multiple foot surgeries and who essentially hadn’t played basketball in three years The only Division-I school that showed any interest was Detroit Mercy which ended the 2023-24 season with an NCAA-worst 1-31 record “Being in Hawaii was hard to say no to,” Van Komen said While the HPU staff hoped he would stay for at least two years Van Komen’s intention was always for a one-year stop on his way back to Division I “To get my feet under me and prove myself again.” He quickly realized that he was a long way from the charter flights and packed gyms he was used to at Utah and St “Living in Hawaii was like living in a foreign country,” Van Komen said “We had no AC in our practice gym or in our house I’d leave the weight room with rust on my hands from the weights We had four or five rows of pull-out bleachers like a high school gym.” Van Komen went from being on a team that had won NCAA Tournament games in back-to-back years to playing games in front of as few as 57 fans But he realized he had an important opportunity in a picturesque setting “At the end of the day it’s just basketball,” he said “As long as you have a court and a couple of hoops His main priority would be something he hadn’t done in the past three years: to stay healthy While he made it through the year with no foot injuries Van Komen’s time on the islands wasn’t without its own physical challenges injuring his wrist and sidelining him for a month of practice While most of his teammates rode mopeds around the island Van Komen found the engine couldn’t support his weight as he tried to go up any sort of incline leaving the left side of his body bloodied While he didn’t miss any time on the court as the team played the University of Hawaii the next day Van Komen was “writhing in pain” every time another player hit his left forearm as he sat in a hotel room in California in between games on a road trip A trip to the hospital resulted in having his appendix removed He missed seven games and lost his spot in the starting lineup Van Komen accomplished his primary goal: to play basketball again he played over 500 minutes across 22 games averaging just over seven points and seven rebounds a game “He’s such a presence inside,” HPU head coach Jesse Nakanishi said “There were some games that he was extremely impactful.” nearly doubling its win total from the year before Van Komen hoped his performance was enough to get him back to the Division-I level and he put his name in the Transfer Portal for a third time He was one of over 1,000 players looking for a new home “Recruiting in the Transfer Portal is really unique because there’s so many names so many prospects,” Elon head coach Billy Taylor said (Assistant coach) Greg Herenda brought his name to me ‘This kid is pretty good!’ As we studied the film we thought this kid has a chance to be a really good player It was such a great fit once he came out here.” Van Komen boarded a plane to Elon to visit campus “This place felt like home as soon as I got here,” he said Living in North Carolina has been an adjustment for someone who’s lived his entire life west of the Rocky Mountains Van Komen is looking forward to finally having a meaningful role in some high-profile games I’ve never played against a team like UNC that I’ve had a big role in actually doing something,” he said “I definitely have some nerves but also a lot of excitement.” Taylor anticipates Van Komen having an important role from the opening tip “He’s played for some very good basketball coaches and been taught the game extremely well,” Taylor said “We’re counting on him to be someone that can protect the rim for us to be someone that can compete on the glass for rebounds and give us a paint presence in terms of being able to score and finish.” Van Komen is now 24 years old and pursuing a second graduate degree “We helped the freshmen move in this summer But the life of a graduate student isn’t so bad He is currently taking two classes that each meet once a week in the evenings and on the days he doesn’t have class he will head back to the gym for some extra shooting before he and his teammates play Call of Duty into the wee hours of the morning “The culture of the team here is really friendly,” the center said It’s not like the cliquey groups like I saw at other places especially in the training room after practice Having that time together outside of practice really brings the team together.” The Elon program is hopeful that their camaraderie will lead to newfound success on the floor The Phoenix has only reached .500 six times since moving to Division I in 1999 and a trip to the 2013 College Insider Tournament remains the program’s only DI postseason appearance This year’s squad was picked by the CAA coaches to finish 12th out of 14 teams in the league’s preseason poll both by his injuries and by what other people may say “Other people’s expectations don’t really matter,” he said “I can only control what I can control at the end of the day Taylor has noticed the impact that Van Komen has had on the Phoenix “Twelve of the 16 players were freshman and sophomores to add an older player like Matt who’s been around is a big advantage for us in helping some of our young guys continue to grow and develop He’s so easy to get along with and easy to talk to that I think guys have really been
