Kiliya cautioned against misleading comparisons between auctioneering in Nigeria and other countries
asserting that local realities and regulations differ significantly
“Some claim we should practice like the USA
It’s like asking the Nigerian president to preside over another country,” he remarked
Alhaji Kiliya also warned against illegal auctioning practices
highlighting that some organizations have faced legal action for improper activities
He reassured the public that the NAA operates strictly within the framework of the law and urged Nigerians to avoid falling victim to unauthorized entities claiming to train or organize auctioneering programs

Imin Matkurban bought some vegetables before returning home
Through forests of desert poplars and rose willows
the car carried Imin over countless sand dunes to his home in the middle of the Taklimakan Desert
It took about seven hours for the 39-year-old shepherd to get home
even though Yutian is no more than 300 kilometers from his home in Daliyabuy township
Vegetables are difficult to find in the Taklimakan
which was why Imin spent 50 yuan ($7.45) buying them in the county seat

What is the difference between open competitive bidding auction
Nigeria was colonised by the British and we are giving three guidelines on procurement and disposal which are financial
These are the guides we are conversant with in Nigeria and it is still the best and decent way of disposing of public properties
We can not jettison our training which is open competitive bidding auction sales where all potential buyers can see what they are buying and win by highest bidder
most buyers of these unserviceable store items

but because they don’t have the knowledge of the online auction (e-auction) they need to see things by themselves to ensure what they are buying
even the regulation stipulate that buyers are allowed to see what they are buying before auction sales take place and that’s why we use to advertise the auction in the Newspapers so that people from far and near can come and see what they want to buy and this open competitive bidding generate more money because it a system of auction that has a competitive way of selling
Most buyers want to see before they buy and not to go for online bidding that is a borrowed system
Nigeria is not yet mature for it to take shape
it is not backed by law and not recognised by the Bureau of Public Procurement policy and not in the Act of BPP neither Financial Regulations
A system of auction that is not approved by the National Assembly cannot be adopted in Nigeria
We are not used to it and if the government wants to introduce it and implement it
it should be backed by the law because what is not backed by the law is an illegal practice
Online auction or e-auction has a lot of challenges because most of the people who participate in it always complain of buying something and at the end not seen what they buy because of scammers
Scammers are penetrating into the system and in most cases it ends up in litigation
they are misleading people and my opinion as the National President of Nigeria Association of Auctioneers
online auction in Nigeria is an illegal auction and those propagating online auction practice do so for their selfish reasons because it is not backed by the law
How about disposal of government properties by allocation is it legal
Anything unserviceable cannot be allocated by anybody but there are exceptional cases either to the Department of Antiquity or Technical Institutions where those unserviceable items can be for studies or practical use or archives
Something that has been used by our precious leaders
we take it to archives for history but anything that should be sold can not be by allocation because allocation is under declaration
Government has the right to buy brand new vehicles to give to Ministries
MDAs also spend money to follow it up to a conclusive end to ensure their proper disposal when they are beyond economic repairs
Allocation is a wrongful way of disposing of government properties and anybody who does allocation of Government properties is under-declared the properties but anything that should be sold for transparency and accountability must be by open competitive bidding sales of Auction system
Considering your wealth of experience in the auctioneering business and as the National President of NAA
what provisions have you made for the young inexperienced and new auctioneers to learn
Auctioneering profession has rules and regulations guiding the sales of government properties and when you want to sell government properties
you have so many legitimate duties to provide and not only to ring a bell
When I became the National President of Nigeria Association Auctioneers
I made an effort and affiliated the auctioneering body with some institutions for training and retraining of my members in the business to equip themselves with the certificate and relevant knowledge
Institutions like Ahmadu Bello University (ABU) Zaria and South African College of Auctioneering
that is why public services engage us to dispose of the unserviceable to be their guide as we protect the interest of the general public and the image of the government
We are certified from South African College of Auctioneering which is a world standard auctioneering institution that can enable any of our members to practice in any part of the world
I also have a Diploma of Auctioning from the South African College of Auctioneering and I attended several Courses during the time of my engagement with Government as a public servant in the defunct North-West State/Sokoto State
The Nigeria Custom Service (NCS) and other security agencies seized goods including vehicles and many other items
Have they been engaging your members in the disposal of these items
the Nigeria Custom Service use to engage our members in the disposal of those seized items but along the line when their is a change in hierarchy and position in Customs
they don’t do as they use to do before but we have written a letter to their Controller General for a Courtesy call so that we can robe minds and find the best way forward to ensure they follow the rightful way for the disposal of public properties and this is because they have a lot of items for disposal and some of the items are perishables
Some of the items have short life span and as a result of delay in disposing of them
the government is greatly losing instead of revenue to be generated for national funding
This question on Custom has also brought up the issue of an imposter who is going about the media houses claiming to be the National President of Nigeria Association of Auctioneers
He has rights like every other Nigerian citizen to his own opinion on issues bordering Customs or any other government agency but he should not be doing that in my capacity
He has a court order restraining him because he was never elected
he has committed a contempt of court standing order
Sometimes you don’t have to allow people to mislead you
the media houses granting him interviews are supposed to do a fact check on him to determine the authenticity of his claim but they are not doing that
Imagine someone claiming my position and even trying to spoil the image of an institution as big as Nigeria Custom Service
He doesn’t have the basic auctioneering knowledge to talk about Customs matters

You advised the Federal Government against using a committee for the disposal of recovered assets, what are your reasons?
Also, auctioneers that are appointed to dispose the assets can keep record of each item sold, within and outside Nigeria. This is because any time an auctioneer does business of disposal he must keep record for future reference. Auctioneering business has legal implications. It is not all cases that every auctioneer can handle; hence he must be appointed according to the rules and regulations of auctioneering business and the Bureau of Public Procurement (BPP) act.
Between secret and open competitive bidding, which one is better?
A secret bidding is a hidden agenda; very few people participate and benefit in it, but in an open competitive bidding, the public will witness and put their interests according to what the regulation states. The highest bidder gets it and government generates more revenue. Secret bidding is like an under-declaration of government’s properties. In secret bidding, government is always losing while it is gaining in open competitive bidding.
The Bureau of Public Procurement (BPP) is the regulators for procuring and disposal, therefore, public servants, including auctioneers, must comply with its policies. There is the need to ascertain the capability of the auctioneer and whether he has all the relevant documents and experience. Therefore, ministries and parastatals must comply with the policy of the BPP before appointing an auctioneer; if not, they would be violating the public procurement act.
In the course of your business, do you sometimes experience a situation where public servants indicate interest in some of the items declared for auction?
We have a good understanding because we are stakeholders. Whenever we see anything going contrary with the BPP act, we draw their attention. They also checkmate auctioneers who are appointed to dispose items.
As you do your business, how do you ensure that government is not cheated, and how do you protect the interest of the public?
Government will not be cheated if the prescribed assignment is carried out properly. An auctioneer must ensure that he pronounces auction items to the nation widely for interested buyers. He ensures that the sale is transparent and based on laid down procedures.
What is the role of the judiciary in the sale of recovered assets?
The judiciary is the institution that recovers assets. Auctioneers are principal partners to the judiciary because we are the only recognised body that can dispose items in a way that both the government and the public will be protected. Whoever does an auction sale without engaging the services of auctioneers is doing so at a great risk.
There are complaints that most of the recovered assets are defected by different circumstances, how can the auctioneers assist the Federal Government to recover part of the lost values?
It is true that some of the recovered assets are overdue for disposal. It is due to the long standing litigation on some of the items. The items become defected as a result of wear and tear. It is the responsibility of auctioneers to sell the items through open competitive bidding so that government will generate more revenue, and values can be salvaged.
Are government institutions and agencies engaging the services of auctioneers?
Many government institutions and agencies are currently working with us, and we are very happy with them for doing the right thing.
I am advising government to stop secret bidding. They should engage the services of auctioneers who are professionals.
Government should consider so many items that are abandoned in some ministries and parastertals. For example, the Nigerian National Petroleum Corporation (NNPC) has some hazardous materials that can be sold back to manufacturers. And we are ready to assist government to pinpoint areas where there are loopholes.

Kiliya is the national president of the Nigerian Association of Auctioneers (AAU) and a certified consultant to the Bureau of Public Enterprises (BPE)
Kiliya who has spent 46 years in the auctioning industry
said the federal government can generate over N4 trillion from the ongoing efforts to auction recovered assets by the presidential inter-ministerial panel
What role did your association play to get to this stage of auctioning of recovered assets
when the federal government wanted to seek foreign loans
we started agitating for auction of recovered
I also made calls to Mr President through press statements that the funds generated from the auctions would be enough to fund their projects rather than borrow
I continued to make similar calls to Mr President and I did not get the attention at that time
I made the same call that all recovered assets be sold and used to fund the budget of 2019
the president formed an inter-ministerial committee that looked into all these matters
The committee has various government agencies participating
We thank the honourable Minister of Justice who has given his time to ensure that the president has carried out what he promised
the committee started the work inviting all auctioneers that expressed their interest to come and submit their bids
We were also invited as stakeholders to participate as observers to show our experience and to guide and see how the work will go forward as experienced auctioneers in the field
How much do you anticipate could be generated from the auctions
There are so many ways of generating revenues in auctions
it is going to be given to auctioneers to invite potential buyers from far and near
The competitive sales would generate more revenue
what they are anticipating may be even more than that
From what I have seen from the recovered and forfeited items
What advice do you have for the committee and the 2,000 firms that applied for the auctioning
It is good that the committee as well as the ministry are going forward with the exercise
It is also good that most of the stakeholders were invited to come and witness how the process would begin
But my advice is that this is a special auction that needs experienced people to participate in and involves a lot of special materials
It is good to safeguard the exercise from any litigation when experienced auctioneers handle it in the way that is provided by the Bureau of Public Procurement policy
the president would achieve the objective he is looking for from the disposal
It is good that the government has centralised these jobs within the premises of the ministry to be the custodian of whatever may come up
Once the laid down procedures for the disposal are not followed
there is every tendency there would be issues
We are thinking that as these things are being handled by the Federal Ministry of Justice
they would try their possible best to ensure that the auctioneers comply with the laid down procedure to avoid litigation
They would use experienced auctioneers who have been long in this business and know the technicalities involved so that the objectives would be achieved
What plans do you have for the teeming unemployed youth who may be interested in this business
We are affiliated with the Bayero University’s Department of Business so that they can host training for our members both old and new on the disposal of public property
Not everybody has knowledge in the disposal of government property but many are interested

The Nigeria Association of Auctioneers has conducted a plaza auction in a move hailed by bidders for its transparency and fairness

to confirm the property’s readiness for use

“We have court judgements from the high court in our favour and the Court of Appeal in judgment delivered on May 8
FCT/CV/481/16 which Musa Kura and others appealed the judgment and their case was dismissed by the Court of Appeal and a standing order was issued
“I was made to understand that he has been talking about the Nigeria Customs Service in the media
If he has an opinion as a citizen of Nigeria who likes to comment on issues
he has the right to exercise his fundamental human rights and not to pose as an impostor by claiming the position he is not
We are the authentic body that has the right to talk about what the Nigeria Customs Service is doing about auction sales,” he said
has issued an interim injunction on October 24
suspending any planned election or meeting by the Nigeria Association of Auctioneers
The injunction was granted based on a motion ex-parte filed by Alhaji Aliyu Kiliya
who sought to halt electoral and administrative activities by members and committees within the association
Kiliya’s petition claimed that certain individuals were operating under unauthorised roles
representing themselves as the association’s constitution review and caretaker bodies
Justice Nwite’s order restricts these members from conducting elections
although it allows them to continue identifying as committee members
pauses the electoral process pending the outcome of a Motion on Notice
which is scheduled for hearing on November 6
The case underscores ongoing internal disputes within the Nigeria Association of Auctioneers
with various factions questioning the legitimacy of the current committee structures
The court’s ruling seeks to ensure procedural compliance and maintain order until a more permanent resolution is reached
