Andrew Forde appealed a conviction for common assault on Brian Carron near Coalisland in 2020. Mr Carron is one of several people charged with attempting to murder John Caldwell in February 2023. Mr Caldwell was shot multiple times by two gunmen at a sports complex near Omagh after a youth soccer training session. Mr Carron, who is on remand in Maghaberry Prison, is currently facing charges of attempted murder and membership of the New IRA. The ex-PSNI man appealed an original conviction, which included a fine and compensation order, earlier this month. The Court Service has confirmed that on appeal the County Court “ordered that the conviction be affirmed but that the order be varied” with a 12-month conditional discharge. It is understood the assault occurred after Mr Carron was approached by police as he sat with his 12-year-old son at a filling station near Coalisland in October 2020. During an exchange police said they were going to search the child, which Mr Carron objected to. Mr Carron’s solicitor Gavin Booth, of Phoenix Law, said his client’s “position has been vindicated”. “Actions like this only serve to undermine confidence in policing and should be dealt with swiftly,” he said.
