Andrew Forde appealed a conviction for common assault on Brian Carron near Coalisland in 2020.
Mr Carron is one of several people charged with attempting to murder John Caldwell in February 2023.
Mr Caldwell was shot multiple times by two gunmen at a sports complex near Omagh after a youth soccer training session.
Mr Carron, who is on remand in Maghaberry Prison, is currently facing charges of attempted murder and membership of the New IRA.
The ex-PSNI man appealed an original conviction, which included a fine and compensation order, earlier this month.
The Court Service has confirmed that on appeal the County Court “ordered that the conviction be affirmed but that the order be varied” with a 12-month conditional discharge.
It is understood the assault occurred after Mr Carron was approached by police as he sat with his 12-year-old son at a filling station near Coalisland in October 2020.
During an exchange police said they were going to search the child, which Mr Carron objected to.
Mr Carron’s solicitor Gavin Booth, of Phoenix Law, said his client’s “position has been vindicated”.
“Actions like this only serve to undermine confidence in policing and should be dealt with swiftly,” he said.
A spokesman for the PSNI said: “We can confirm that the individual is no longer employed by the Police Service of Northern Ireland.
“As such, we will not be commenting on this matter.”

An 18-year-old man who died following a crash in Co Tyrone has been named locally

The single vehicle accident happened on the Coalisland Road near Dungannon
said: “Police received a report shortly after 10.50pm
that a black Peugeot 207 had been involved in a collision
alongside our colleagues from partner emergency services
The driver of the vehicle was taken to hospital where he sadly passed away
“The Coalisland Road remains closed at this time
“Collision Investigation Unit detectives are investigating the circumstances of the collision
and would like to hear from witnesses or anyone who may have captured dash-cam or other footage which could assist with our enquiries.”
Sinn Fein MLA Linda Dillon said: “News of this tragedy has shocked the community of Coalisland
“It is a terrible tragedy and I want to pass on my condolences to his family and friends at this devastating time
"I also understand the PSNI are looking for witnesses to the accident or anyone who may have captured dash-cam or other footage to come forward and I want to echo this appeal."

Barrack Hill Quarries, which acquired the former coal and clay pits in Coalisland in 2022
has formally entered the planning process with its proposals for the 188-acre site
has notified Mid Ulster District Council of its plans for a “major recreational development”
includes a mixed-use scheme featuring light industrial unit and business or office units
alongside retail space and a residential development
The pre-application phase will see the developer seek public feedback
with proposals due to be presented at Coalisland’s Cornmill building in November
The event is scheduled for 3pm on November 12
A full planning application is likely to be submitted in early 2025
Barrack Hill Quarries was contacted for comment
The new proposals come seven years after Manna Developments secured planning approval for the Lake Torrent motorsport project
involved redeveloping the clay pits into a world class race circuit
The British Touring Car Championship was also linked to the 3.6km circuit
But the £30m Lake Torrent project collapsed just weeks later, when Manna fell into receivership.
The site went up for sale in 2019 and was eventually snapped up by Galbally-based developer Barrack Hill Quarries.

A man needed hospital treatment after being shot in Co Tyrone
The incident happened in the Coalisland area yesterday evening
The PSNI condemned the incident and said there is no place for “this type of vigilante justice”
Detective Inspector Ryan said: “Shortly after 7pm
we received a report that a man aged in his 40s had attended hospital with a suspected gunshot wound
"He stated that while sitting in a vehicle
he was approached by two men who he believed to be local to the area
A suspected firearm was put through the window of his vehicle and he was shot to his arm
the injuries he received are thankfully not thought to be life-threatening or life-changing."
Detective Inspector Ryan continued: "It's appalling that anyone should be attacked in this way
especially in the early evening when the area would have been busy with shoppers and commuters
"There is no place in our society for this type of vigilante justice and we are fortunate that the outcome was not much more serious
“Our enquiries are at an early stage and we would appeal for anyone with information in relation to this incident to contact us

Suspected firearms discovered in Co Tyrone

The suspected firearms were discovered hidden under a bath at a home in Co Tyrone
Pictures released by the police from the Coalisland home show some of the suspected guns hidden under the bath panel
with other guns found in the property including what appears to be a shotgun type weapon and rifle
The seizure comes following a reported shooting in the area last week
a 34-year-old man and a 43-year-old woman arrested in connection with the shooting have now been charged with firearms offences
They will appear before Strabane Magistrates Court on Thursday November 7
all charges will be reviewed by the Public Prosecution Service
A police spokesperson said: "Detectives have been carrying out numerous searches in the area yesterday and today
and located a number of suspected firearms
They have been seized and will be sent for further testing
"We would like to thank the community for their patience over the last couple of days.”
