CT (WFSB) - Fire crews responded to a house fire in Avon early Friday morning that forced several people from their home
Firefighters were dispatched to 32 King Richard’s Ct
they reported that they saw flames coming through the roof of the home
Everyone who was inside made it safely out
The American Red Cross was said to be assisting those affected
and there were no road closures in the area
Firefighters said preliminary information indicated that a lightning strike was to blame
Ohio — The Avon community is in mourning after 18-year-old Jeremiah Kelly unexpectedly died at his home last Tuesday

Kelly even excelled in the classroom by earning enough high school credits to graduate early and start his journey at the University of Cincinnati this past January to pursue a master’s degree in psychology and suit up in a Bearcat uniform
only Kelly’s memory will grace the field and Avon High School’s 2025 graduation stage
after the community learned Kelly unexpectedly died on April 22
“A lot of people don’t get to know that they’re loved
There was nothing left unsaid,” said Chiniqua
Although Kelly is no longer physically here
those who loved him encourage the community to never let his light fade
say nothing at all but if you see someone being unkind
you should always speak up for them,” said Chiniqua

Avon Mayor Bryan Jensen was one of the first speakers
“With the number one pick in this year’s heavenly draft
Kelly was a powerhouse on the football field
but the person he was off the gridiron is how people have been remembering him
Avon head football coach Mike Elder coached Kelly for years
“A remarkable man who just did everything right
and he made everyone feel special,” Elder said
Elder said Kelly made everyone around him feel valued and respected
And I think we’ve turned that question into why are we still here
And then how can we live more like Jeremiah,” Elder said
“I take comfort in knowing that all the talks that we had
reflected in every interaction he had with people throughout the community,” she said
She said if people can take one thing from the way her son lived his life
to always make sure everyone is seen,” she said

It happened after a football game this past season
“He stood right outside this locker room and waited for every marching band member to walk by
thanking them for playing and sticking around

The Avon Fishing Pier will open for the 2025 season on Thursday
the Avon Fishing Pier had a late start to the season because of damage from nor’easters or hurricanes
despite last-minute repairs due to an early spring waterspout
the pier was able to stick to its scheduled May 1 opening date
We had to replace 30 feet of handrails and decking boards
and we just got finished with repairs last week,” said Keith Matthews
“It was just one of those unexpected things
The Avon Pier will also once again host Hatteras Island’s Independence Day fireworks
and which will be launched from the end of the pier on July 4

The driver of a vehicle that crashed through a row of metal barricades and flipped on its roof near Walmart has been hospitalized but is doing OK
Avon Police Chief Greg Daly confirmed on Tuesday
The only other occupant in the vehicle was the driver’s cat
on Monday and not much information was available as to how it happened
“We are suspecting there may have been a medical-related issue
so at this point in time we’re not currently issuing any ticket regarding it
but we’re still investigating it,” Daly said
The incident happened at the south end of the Walmart/Home Depot parking lot in East Avon
where a row of metal fencing creates a barrier between Yoder Road and a steep embankment that flanks the Union Pacific’s dormant railroad tracks below
the vehicle — a Ford Econoline van with Florida licence plates — flipped onto its roof
breaking the vehicle’s windows and scattering the occupant’s belongings about the area

Avon has dealt with challenges regulating the speed at which travelers — namely
bikers — move on its paved pedestrian paths
the town will take a new tactic to encourage people to slow down
Instead of the dismount zones the town has employed for the last two summers in Harry A
which ask cyclists to dismount and walk their bikes for a stretch on the north side of the park
the town will implement a number of slow zones.
along the Main Street Mall and Eagle Valley Regional Trail within town are set to become slow zones this summer
following Town Council direction at its April 22 meeting
Avon is leaning on the county’s definition of slow zones
which includes traveling at the appropriate speed for the path and yielding to fellow trail users by slowing down
The town did not put an official speed limit on “slow” travel.
Avon contains about 7.5 miles of paved trails
bicycles and class one and two e-bikes — which include pedal assist and/or the use of a throttle up to 20 miles per hour — are permitted to travel on these trails
members of Town Council and town staff have heard concerns over the speed at which some cyclists travel on these paths
said he heard concerns about bike-related safety on the town’s paved paths about a dozen times last summer
ECO Trails has also struggled with establishing and enforcing a speed limit

“Although verbal warnings and reeducation were given all last summer
we’re back before you really wanting to discuss what is going to make the most sense from a user standpoint as well as from the town’s standpoint on how to best enforce and promote safest park use on multi-use paved paths.”
Though the town has not conducted any formal studies on the effectiveness of the dismount zones
Labagh said from what he personally witnessed
adherence to the dismount zones was about “50/50
I’d see families walking with their bikes responsibly and following the rules
It’s hard to tell when we don’t have full oversight in the park.”
Avon town staff does not have the capacity to patrol Harry A
Nottingham Park or the rest of the paved trails all day
and there are no surveillance cameras pointed specifically at the park’s dismount zones
Avon’s trails and parks are the domain of the town’s recreation department
But when enforcement is needed in these areas
that responsibility falls to the Avon Police Department’s code enforcement officers
first hired in late 2023 to oversee the town’s new parking management program
While Avon’s code enforcement officers are responsible for monitoring the town’s parks
from conducting animal welfare checks for off-leash dogs to enforcing dismount zones
they also have a wealth of other responsibilities
Labagh recommended the town replace the dismount zones with a wealth of slow zones
in which signage indicates to travelers that they need to control their speed and be aware of others on the path
“I think it would provide us a clear path forward for a good balance between enforcement and responsible education and use by the community,” Labagh said
The council gave Labagh direction to implement slow zones instead of dismount zones

AVON — A fire in a trash compactor attached to the Walmart Supercenter in Avon caused smoke to enter the store
leading to the temporary closure of the store

"Members of the Avon Fire Department quickly responded to this smoldering fire and did a great job of getting it under control
while mitigating the potential for additional smoke damage

Rob was united in marriage to Margaret “Maggie” Rotherham on October 3

Rob was an incredible salesperson in his career
it was joked that he could “sell ice to an Eskimo.” Before retiring early due to his illness he worked for a brief time at Molyneaux Insurance and American Bank and Trust.
He was involved in many local organizations during his career including teaching Junior Achievement
He coached his girls through Dad’s Club softball and soccer and volunteered with the Challenger Little League
Rob organized fundraising efforts with the Holy Family Booster club to raise funds for a new gymnasium floor

Rob was always willing to jump in and help whenever it was needed.
Rob always had a smile on his face and loved to make people laugh
he had a way of making you feel right at home
even during his long battle with Parkinson’s
He adored his “girls” and his face lit up every time he was with his grandkids

and their children Baileigh and Charlie; and Annie Avon (Tyler Nicely)
Iowa and numerous nieces and nephews.
He was preceded in death by his parents and stepfather

Kates was last seen in the New Braunfels area
and the National Center for Missing and Exploited Children (NCMEC) issued an alert asking for public assistance in locating him
A missing persons report was initially filed in February

More than two months after the final implosion at the Avon Lake Power Plant
a group of neighbors is bringing their concerns over the demolition to court

Avon Lake Mayor Mark Spaetzel appeared for a hearing in Lorain County Probate Court
It was his first appearance since a group filed a lawsuit calling for his removal from office
The so-called “Ohio Citizens for Honesty Integrity and Openness in Government Ltd.” presented their allegations during a city council meeting on February 24

The 31-page lawsuit alleges the mayor violated city ordinance and his duty to serve Avon Lake residents when he did not delay the planned implosions at the former Avon Lake Power Plant
A small blast in July and a larger implosion in December had sparked concerns over the potential health and environmental consequences
Spaetzel has previously called the claims “false and baseless.”
Tuesday’s hearing did not address the allegations
but turned into procedural sparring over venue
“This is a chicken and an egg kind of situation,” Lorain County Probate Judge James Walther said during the hearing
He explained it was the first case of its kind he had presided over in his position and the statute giving Ohio probate courts authority over removal from office cases was written in 1871
Walther raised questions about the role of Gerald Phillips
the attorney who filed the lawsuit and presented himself as representation for the seven other plaintiffs in the case
The judge said the statute calls for the city law director to prosecute such cases
Phillips filed a motion to disqualify Avon Lake Law Director Gary Ebert from the case because he was appointed by the mayor and may have a conflict of interest in the case
He also asked to disqualify Spaetzel’s attorney Kevin Butler because of his ties to the city
Ebert and Butler argued their representation and any conflicts are irrelevant because the case should not be in probate court at all
Both said Avon Lake’s city charter already outlines a procedure to remove a mayor
It requires city council members to vote on removal or a referendum by residents
There’s no conflict of interest when we all agree that a case should be dismissed and that’s what’s happened here,” Butler told News 5 Tuesday
Judge Walthers did not rule on the motions presented Tuesday
He set a tentative trial date for March 14
but told the court he would make several decisions before then
he plans to issue rulings whether to disqualify any of the attorneys and will decide whether to dismiss the case entirely
Phillips said his group would appeal a dismissal

A spokesperson for Whole Foods Market confirmed Monday that an Avon branch is in development
“We look forward to serving the Avon community with high-quality natural and organic products and an unparalleled grocery shopping experience,” the spokesperson said in a statement
The Whole Foods Market will be part of a project that is scheduled to break ground in spring 2026
The developer, Kensington Development Partners
did not respond to multiple requests for comment from the Vail Daily but has released a brochure for the project
The Whole Foods Market will be included in the first phase of Kensington Development Partners’ development on a 40-acre stretch of land within Traer Creek on the northeast side of Avon across from City Market
The first phase covers 5 acres and is designed to include 91 apartments
the Whole Foods Market and multiple retail spaces
labeled “Whole Foods” in the development’s brochure
There will be 192 parking spaces in a surface-level lot
one 4,500 square feet and one 3,500 square feet
across the parking lot from the Whole Foods Market
The residential building will have additional parking for residents in an underground garage
and another 42 underground parking spaces for those visiting the retail properties
The brochure for the development also shows plans for a second phase with more apartment buildings
later phases of the development may include a lake with lakefront condominiums
some townhomes and two hotels were also drawn into the draft plans

Avon does not have construction noise laws. As a result, the town relies on the state’s noise abatement law, Colorado Revised Statute 25-12-103
which limits the maximum level for construction to 80 decibels from 7 a.m
Avon staff reached out to Prime West Development and recorded sound levels at the project’s property line
“We were contacting the developer within minutes … when we got complaints
“That’s generally how we try to operate.”
Avon’s code enforcement officer used a decibel meter on the north perimeter of the Piedmont Apartments
and measured an average reading of 75 decibels or below
Shaw Construction also monitors the pile driving’s noise levels daily with its own decibel reading device to ensure the sound remains within state-regulated levels
“What they’re doing is not in violation of the state noise abatement statutes,” Heil said
“I think they’re trying to do what they can
but we’ve got bad soils in the valley all over and around Avon
I’m going to expect are going to have some amount of pile driving like this
and that’s the nature of construction where we live,” Heil said.
There is nothing Avon can do right now to enforce the state’s noise law
the state statute says an individual can go file in district court,” Heil said
Avon staff is currently working on drafting a construction noise law. Vail’s law limits construction noise in residential
industrial and public premises to 90 decibels from 7 a.m
Avon staff plans to bring the law to the Town Council for first reading on April 8
Heil expects it will be aligned with the state’s law in sound and hour limitations but enable local enforcement and the engagement of the municipal court

The Prime West Development team said the pile driving part of the construction project is expected to run for another four to seven weeks
which would mean an end date in late April or mid-May

“It is to our understanding that there has yet to be any solutions that might be readily implementable to dampen the noise
but that’s something that’s still being looked at with Shaw and the subcontractor,” Farmer said
“They say when they typically do this kind of thing
as long as they are conforming to the state levels and as long as they are operating during the prescribed hours
that is fairly customary and they don’t usually implement anything further,” Schlichting said
“We’re still challenging them to continue to think about it.”

When the space known as Columbine Bakery for over 30 years recently became available
Romanin jumped at the opportunity to take it over
“We saw the opportunity to have a place to cook with all the amazing ingredients we had at R Farmers’ Market and offer a culinary mecca
a gastronomic kitchen for the locals and guests,” Romanin said
“We wanted to create a community where people can know where their product comes from and understand how it’s being prepared and talk to the chefs and really get some inside scoop on the truth behind the product.”

(WHAM) — A man is charged with manslaughter after allegedly pushing another man down a flight of stairs during a confrontation early Sunday in Livingston County
and charged him with one count of manslaughter following the incident
The circumstances surrounding the incident are still unclear at this time
BACKGROUND: One person found dead in Avon; man charged with manslaughter after incident
The Livingston County 911 center received a call about a person in medical distress following a fall at a location on West Main Street in Avon
Law enforcement on the scene requested emergency medical services for an "intoxicated male who fell down the stairs," according to scanner communication from Broadcastify
Avon police found evidence of an altercation at the scene
Mills "intentionally and knowingly" pushed a man down a flight of stairs out of anger following a confrontation at the top of the staircase
“Law enforcement is reporting possible strike to the head," according to scanner audio from Broadcastify
"Visible laceration and unconscious now."
Court paperwork said Mills "orally admitted" to watching the victim fall down the stairs head first after pushing him
The victim was transported to Strong Memorial Hospital
Police said Mills lives where the incident occurred
It's unclear at this time why the victim was in the building
Police added the investigation into the facts and circumstances is ongoing and additional charges may be filed
The identity of the victim is being withheld pending family notification

Avon has strengthened its ability to charge those living in town without a home
On Tuesday, Feb. 11, the Avon Town Council unanimously approved updates to its laws that limit camping on public and private property
The old version of the laws had not seen a revision since 1979
and Avon police officers found their tenuous language difficult to enforce.
The update comes in the wake of the U.S. Supreme Court’s ruling on the City of Grants Pass, Or. V. Johnson et al. in June
which permitted all municipalities to charge those sleeping in public places with a criminal offense
municipalities without alternative housing options
were not allowed to implement camping bans
Eagle County does not have alternative housing options
and the cost of housing is notoriously high
there were just 25 homes sold for under $500,000 countywide
This is a dramatic decline from 2020 when there were 451
Avon has made the cultivation and development of a range of community housing options a priority
The nearest locations to Eagle County with adequate resources to assist people who need housing are in Grand Junction and Denver
Eagle County has a small Homeless Services team
but there are little to no local housing options in which to place people
The council’s approval of the revised camping laws comes after it reviewed the 45-year-old laws in August and again in January
Chief of Police Greg Daly emphasized that allowing unhoused people to live in Avon helps no one
this is a very harsh climate for someone to try and live in a tent,” Daly said
“We’re genuinely concerned about their health and safety.”
We have so many available housing challenges for the people who live and work here,” Daly said
“To try and accommodate other people
we’re just not big enough to do that.”
Avon’s updated laws prohibit camping on public property “within any park
open space or other Town property,” including public streets
without permission from the town manager or chief of police
Camping is defined as “resid(ing) or temporarily dwell(ing) in a place
with shelter.” Banned forms of shelter include “a tent
vehicle or any other form of protection from the elements other than clothing.”
Camping on private property in Avon requires the consent of the property owner or authorized agent and is only allowed for a maximum of two nights within one month
The updated laws — as well as the old laws — include van dwelling as a prohibited form of camping
Community member Elizabeth Niotis urged the Avon Town Council to reexamine the ordinance and permit van dwellers to camp in some areas of town
Niotis suggested the town look into Summit County’s more permissive van camping laws
which support the community’s residents and workers who cannot afford housing due to the exorbitant costs of home ownership
is that Avon’s public parking areas are too small to host a community of van dwellers
“You just don’t have that property in Avon,” she said
“There is no public place where vans would be able to congregate.”
“I’m sympathetic to van life,” said Eric Heil
I really don’t see a place on town property where we’re going to be able to allow it where it’s not going to have issues.”
The most likely locations where the town might allow van dwellers — parking around Harry A
the Avon Public Library and Avon Town Hall — are all small lots or bays that could not easily accommodate an overnight community
Most of the private companies that own the larger lots around town are also averse to overnight parking
I just don’t see a place in Avon where we would give private property our permission
or it would work on land that the town owns,” Heil said
If the town were to designate a certain area for van dwellers
it would need to be formulated like a campground and include toilets
the town’s community development department will work with Williams’ firm to learn more about Summit County’s efforts
Council member Lindsay Hardy asked for there to be a discussion in the future after town staff has time to communicate with Summit County about its laws for van dwellers
