WASHINGTON (7News) — The federal government admits it made a mistake when it deported a Prince George’s County resident to his native El Salvador
even though an immigration judge had granted him protection from being deported six years ago
Immigration and Customs Enforcement (ICE) official said that
the man should not be sent back to the U.S
was sent to a notorious prison in El Salvador last month
although ICE was aware of his protection from removal to El Salvador
Abrego Garcia was removed to El Salvador because of an administrative error,” said a court document filed by Robert Cerna

Cerna’s document accused Abrego Garcia of being an MS-13 gang member with a “prominent role,” something Abrego Garcia’s attorney contends police and the government have offered little evidence for
outside of that he was dressed in a Chicago Bulls hat and a hoodie when picked up by police in 2019
And also that a confidential informant had identified him as a member of an MS-13 group
Abrego Garcia was not charged with a crime at that time
the government said he was found to be a danger to the community in 2019 because of his alleged gang affiliation
They also said in a 2019 filing that the source that accused Abrego Garcia of being in MS-13 was “proven and reliable.”
Cerna also argues that Abrego Garcia’s attorney has failed to meet several other standards that would immediately reverse his deportation and that the U.S
federal court now lacks jurisdiction over the case because Abrego Garcia is no longer in U.S
government must do everything in its power to immediately get Mr
Abrego Garcia back to his family in the United States as quickly as possible," Maryland Congressman Glenn Ivey wrote to several Trump administration officials
"If the government has evidence of wrongdoing by Mr
then such evidence should be presented in an American court
Abrego Garcia is legally entitled to his day in court prior to any detention or removal."
A court document filed Monday by Kilmar Abrego Garcia’s attorney seeks to force the U.S
government to immediately request his return from El Salvador
an immigration judge granted Abrego Garcia an order that prevented him from being deported from the U.S
unless the federal government was able to reopen his case and convince a judge to reverse the decision
“But Defendants found those legal procedures bothersome
so they merely ignored them and deported Plaintiff Abrego Garcia to El Salvador anyway
ripping him away from his U.S.-citizen wife and his disabled U.S.-citizen child,” the document filed by Abrego Garcia’s attorney states
"[The federal government] sent Plaintiff Vasquez Sura to El Salvador knowing that he would be immediately incarcerated and tortured in that country’s most notorious prison; indeed
Defendants have paid the government of El Salvador millions of dollars to do exactly that,” the document goes on to state
“Such conduct shocks the conscience and cries out for immediate judicial relief.”
But a statement by Cerna in his court filing counters that although Abrego Garcia’s removal was an “oversight” and the result of an administrative error
“the removal was carried out in good faith based on the existence of a final order of removal and Abrego-Garcia’s purported membership in MS-13.”
The document filed by Abrego Garcia’s attorney states that before being sent to his native country of El Salvador
with his wife Jennifer and their five-year-old son
who has “hearing problems” and “is intellectually disabled and has a speech disorder.” The family includes two other children and both Abrego Garcia and Jennifer have full-time jobs
Abrego Garcia was driving with his son in the backseat when he was pulled over by ICE officers and detained
he was allegedly taken away without explanation
"In the case this is not an isolated incident and Mr
Abrego Garcia is not the last to be deported under these circumstances
what are an individual's rights in this scenario?" reporter Lianna Golden asked
"Well what should’ve happened here was after he was picked up
he should’ve been taken appeared before an immigration judge
probably should’ve gone back to the judge who was supervising him already and let them make a decision," Ivey said
The document indicates Abrego Garcia was transferred to several detention centers
and Jennifer last heard from him on March 15
when he called and said he was being sent to CECOT prison in El Salvador
one of the largest and most notorious prisons in the world
The court document states that in the days that followed
Jennifer identified Abrego Garcia in pictures of prisoners sent from the U.S
Abrego Garcia came to the United States illegally in 2011
It states he was fleeing gang violence in that country and that starting around 2006
and threatened him to get his parents to give in to extortion demands
“This story is very indicative of what we’ve been seeing and hearing from the Trump administration,” said Cat Jackson, policy director with the immigrant advocacy group CASA. “I think if we don’t act quickly, at every level of government, including at the state level, we’re going to continue to see atrocities like this happen.”
On Tuesday, the Trump administration made new allegations against Abrego Garcia.
“The individual in question is a member of the brutal MS-13 gang — we have intelligence reports that he is involved in human trafficking,” said Assistant Homeland Security Secretary Tricia McLaughlin in a statement emailed to 7News by the Department of Homeland Security. “Whether he is in El Salvador or a detention facility in the U.S., he should be locked up.”
“Foreign terrorists do not have legal protections in the United States of America anymore, and it is within the president's executive authority and power to deport these heinous individuals from American communities,” said White House Press Secretary Karoline Leavitt at a briefing Tuesday.

Concept founded by Justin Ferguson is differentiated in its approach to destigmatize the cannabis buying experience and provide one-on-one consultation and education to influence product decisions
Lumos Dispensary intends to open among the first dedicated adult recreational dispensaries in Prince George’s County
Maryland with the signing of a full-building 8,500 square foot lease at 10701 Baltimore Avenue in Beltsville
and CEO of the company is planning a highly-differentiated cannabis buying experience which destigmatizes the purchasing process
and provides one-on-one private consultations with medical professionals
who intends to quickly expand and franchise the brand
expects the store to be operational this summer
MacKenzie Commercial Real Estate Services Vice President Craig Kates represented the tenant and MacKenzie Senior Vice President Adam Nachlas represented the landlord
Ferguson aims to deviate from the stereotypical image of cannabis facilities shrouded in secrecy which present the appearance of a “shady operation” with the replacement of an interior that he describes as an “interactive museum” with an upscale consumer buying experience
He explains that the concept will feature an “express” section where consumers that know exactly what they want or are just looking for the strongest-working or least expensive product can visit
A separate area will be staffed by medical professionals standing by to guide consumer purchases by explaining precisely what a particular product does and how it works
“The objective is to add precision to plant medicine
and alter the way consumers think about purchasing cannabis
nootropics and other similar products,” explained Ferguson
“Product education comes first,” he explained
“We want consumers to completely understand their options and make decisions based on information presented
This approach will help destigmatize the cannabis buying experience and provide full transparency.”
Ferguson adds that cannabis can be used for many other purposes besides its stereotypical image including aiding and prolonging quality sleep
Other benefits include neuroprotection which safeguards the body’s nerve cells
providing anti-inflammatory effects that reduce swelling
mood stabilization which can help with anxiety and depression
and stimulating appetite for those patients that need to gain weight during chemotherapy treatments
“We are building an interactive experience in which consumers know virtually everything about a particular product and its impact on their body,” he said
10701 Baltimore Avenue features roadside frontage and visibility from US Route 1
with more than 45,000 vehicles passing the site daily
with a median household income exceeding $125,000
reside within a five-mile radius of the site
The building is situated just north of the University of Maryland
College Park and is close to Interstates 95 and 495
I am extremely familiar with the greater Beltsville area and targeted this section of Prince George’s County for our flagship location,” Ferguson explained
“We intend to utilize this space as our incubator with plans to expand and subsequently franchise the concept.”
“There is a scarcity of appropriately-zoned properties in Prince George’s County
but 10701 Baltimore Avenue satisfied every real estate requirement including its immediate availability
prominent signage and placement on a major thoroughfare,” said MacKenzie’s Kates
“Rather than opt for the no-frills utility of more standard warehouse options
we were able to target and secure a location marrying functionality
such as multiple at-grade overhead garage doors
with key retail elements such as generous parking and exceptional visibility.”

A spokesperson with the management team said that the original chiller broke down due to negligence by the maintenance contractor
They claim that they will go after them legally
they said they have been urging residents to keep all receipts for any fans or A/C units that have been purchased or hotel stays
said communication has been difficult at best
One kid was about to faint yesterday,"said condo owner Elsabet Mengistu
"Nothing is working and we stayed two days in a hotel
We are going to die and then the A/C is not working
and we are paying our condo fees every month without any delinquencies."
original 4,000-ton chiller will be repaired and turned on either Tuesday or Wednesday morning
or a second temporary rented unit will be brought in
Metropolis wrote an update letter to residents saying
“Innovative Mechanical Systems and the Association's insurance company are diligently working to get the Association's chiller up and running as soon as possible
We understand that while the rental chiller is operational
many units are not experiencing the desired cool air they were expecting.”

Residents at the Cherry Glen Condominiums said their entire complex has been without air conditioning for months
"This is serious," said 30-year resident Denise Joyner
You’re talking about 'be patient.' We’ve been patient for three to four years."
Joyner and her neighbors said they've been sweating it out
and watching their thermostats go up well over the 80s inside their homes
"It might be 90 degrees inside," said 15-year resident Janet Johnson
"It might be cooler outside than it is in here."

Those living in the complex became even more heated this week after a meeting with the board of directors
They said despite consistently paying their homeowners association fees
they've been told there's nothing that can be done to acquire a chiller needed to repair the air conditioning system
"I can’t do this," said another resident
"We pay a lot in condo fees," said Johnson
"We shouldn’t have to suffer like this
I want to be comfortable in my own home."
Residents said they made their concerns known to the board of directors
"Someone mentioned calling Seven On Your Side and one of the board members spoke up and said 'No not just yet
We don’t need that kind of attention at this community,'" said a resident
With temperatures set to climb into the 90s
