for Criminal Possession of a Weapon in the third degree and Criminal Mischief in the second degree
a Trooper responded to the area of Medical Park Drive in Malta
for the reports of a woman damaging a vehicle with a bat
The investigation determined Durkin was involved in a road rage incident on I-87 in Saratoga County with the victim. Durkin reportedly followed the victim to the location
and used the bat to cause more than $1,500 worth of damage to the victim’s vehicle. Durkin was unknown to the victim
who was not injured during the altercation
Durkin was arrested at the scene and transported to SP Saratoga for processing
where she was released on her own recognizance

The criminal contempt charge was elevated to a felony due to a previous conviction for the same offense within the last five years
Banks is accused of committing a specified offense under the statute
having been convicted of a similar offense within the preceding five years
Banks was arraigned and has been remanded to the Saratoga County Jail pending further proceedings

According to the Office of Children and Family Services database
the daycare had inspections on January 22 and 24th days after the abuse was reported
One of the reports showed violations relating to corporal punishment including physical restraint
it found the daycare was not in incompliance with children who are unable to sleep being offered a quiet place to play instead of being put in a crib
The company tells CBS6 that while it shows violations
they stress that the violations "occurred because an individual teacher failed to follow those policies
not because the center was out of compliance."
