(Court TV) — A judge granted a request from Donna Adelson‘s defense team to delay her upcoming trial Adelson, 74, is charged with first-degree murder, conspiracy, and solicitation in the 2014 death of her ex-son-in-law, Dan Markel who appeared at a Wednesday hearing via Zoom was scheduled to go on trial beginning June 3 Donna Adelson appears in court for a pretrial hearing on Feb The defense sought a continuance because they say they need more time to review new discovery they’ve obtained through wiretaps and over 80,000 e-mails They also told Judge Stephen Everett that they’re waiting on discovery they’re entitled to under the rules of governing jailhouse informants that they have not yet received This includes whether anyone has been given favorable treatment in exchange for testimony as well as statements the prosecution wishes to elicit Judge Everett issued an order delaying the trial without setting a new date “No further continuances shall be granted without good cause presented.” Markel, an FSU law professor, was gunned down in his garage in what was eventually revealed to have been a murder-for-hire plot. Assistant State Attorney Sarah Kathryn Dugan told Everett that prosecutors got a “lead” last fall that led to “this new discovery” in the Adelson case “We conducted this investigation and followed that investigation to its conclusion,” she said “That obviously has resulted in some new discovery in these wire calls.” Dugan added that the wiretap "went down" on Feb 21 and that law enforcement intercepted about 30 phone calls “The state likely likely plans to use maybe one or two at trial and believes that the two months that the defense had from the time it was discovered to the time of trial in June should be sufficient to prepare for that portion of the trial.”  Zelman countered that more than 32 hours of calls were captured by the wiretap and that the defense hasn’t had time to review even two hours of the calls “There’s not enough time for us to analyze this new information, synthesize it and prepare appropriate motions,” he said. “We’ve spent the last three weeks dealing with this, as opposed to finalizing motions in limine.” Everett asked Dugan whether the state would suffer any prejudice were the trial to be delayed conspiracy and solicitation in the 2014 contract But Zelman said some of the emails could pertain to Donna Adelson’s decision to try to fly to Vietnam in 2023 shortly after her son Adelson was arrested at Miami International Airport as she tried to board the flight with her husband Dugan mentioned during the hearing that the state had subpoenaed Harvey Adelon’s account on Zelle a noted Tallahassee defense attorney and former federal prosecutor said the new investigation marked a significant development in the case and would likely lead to a continuance an informant or someone gave the state information that there was maybe obstruction tampering with a witness or other crimes involved He noted that a judge signed off on the wiretap after prosecutors filed affidavits explaining that they couldn’t get the information any other way privileged attorney-client conversations are supposed to be filtered out the judge is going to have no choice but to give a continuance,” Jansen said “Because when (the defense) tells the judge we can’t be prepared and we can’t file motions that’s a lack of due process for the defendant the 1st District Court of Appeal ruled against the defense in its attempt to boot Everett off the case The defense last month filed motions in state court to disqualify Everett the defense appealed that decision to the 1st DCA The appellate court on April 28 ruled against a motion to determine confidentiality calling it “overly broad.” The court allowed the defense to file an amended motion signed an order during Wednesday's hearing to unseal documents and recordings from the wiretap for 850-599-2180 As City Council members probe allegations surrounding an “illegal gun registry” at Jacksonville City Hall the Mayor’s Office is declining to speak after being asked to appear voluntarily What is known: There has been a requirement since 2023 for people carrying guns into Jacksonville’s public buildings to put their names addresses and identifying information on what critics are dubbing a gun registry What isn’t known fully: who was responsible for said registry The Mayor’s Office isn’t saying much And City Council members want to probe it internally The City Council Rules Committee explored that question The General Counsel talked to legislators about the registry which allegedly was maintained for nearly two years at both City Hall and the Yates Building by First Coast Security Rules Chair Nick Howland cited Florida Statutes 790.335 noting these actions could lead to a third degree felony and a $5 million fine General Counsel Michael Fackler noted potential “serious consequences” for breach of the law and said the Mayor’s Office was made aware of the issue on April 21 of this year A day later, subpoenas were served on the Mayor’s Office’s outside counsel at the Bedell Firm, which employs his father-in-law Hank Coxe Fackler believes it is an investigative subpoena because criminal lawyers were needed for “the full panoply” of possibilities “There are potentially significant sanctions as a result of the investigation,” he said Matt Carlucci wondered if the “tough little Mayor” was “guilty” and if Deegan initiated the registry; Fackler noted the investigation is “ongoing.” “I don’t get the feeling that this is something she blindly went into to enforce,” he said “I had a feeling there was no guilt yet because the due process of law hasn’t been exercised yet.” He believes it’s “extremely unfair” that people say Deegan is guilty because she hasn’t “had a chance to prove her innocence,” and urged people to be “careful” before blaming her for a practice underway for nearly two years since her inauguration saying the city charter allows for Council subpoenas a salient fact given that the Mayor’s Office did not voluntarily attend the meeting “We clearly have the ability to investigate this,” Salem said likening it to the JEA sale attempt that was probed half a decade ago who has been at odds with legislators since soon after they confirmed him in 2023 urged the City Council not to investigate the issue Jimmy Peluso said he was disappointed that Howland talked to the media saying a “shade” meeting was more appropriate a shade "one of the things that Donna tries to do is make 'em cry right away which is easy to do after winning the Kentucky Derby."
