A Louisiana judge this week set aside the first-degree murder conviction and death sentence of Jimmie Chris Duncan, whose 1998 conviction for killing his girlfriend’s 23-month-old daughter was based in part on bite mark evidence that experts now say is junk science
The decision comes after a Verite News and ProPublica investigation in March examined the questions surrounding Duncan’s conviction as Gov
made moves to expedite executions after a 15-year pause
of the 4th Judicial District in Ouachita Parish
pointed to new testimony during a September appeals hearing that such bite mark analysis presented by a once-heralded forensics team is “no longer valid” and “not scientifically defensible.”
The original analysis came from forensic dentist Michael West and pathologist Dr. Steven Hayne, whose longtime partnership as state experts fell under legal scrutiny after questions emerged about the validity of their techniques
nine prisoners have been set free after being convicted in part on inaccurate evidence given by West and Hayne
Duncan was the last person awaiting an execution based on the pair’s work
which Sharp said in his ruling appeared “questionable at best.”
Other expert witnesses said that Hayne’s autopsy and his findings were “sloppy in practice” and “inadequate overall.”
“It is worth noting that the qualifications of Dr
Hayne were lacking in certain ways to an extent that called into serious question” the pathologist’s “expert designation,” Sharp wrote in his ruling
Sharp also stated in his ruling that he found “very compelling” the September testimony of an expert medical witness who said that the child’s death was not the result of a homicide but of an accidental drowning
It remains unclear when — or if — Duncan will walk free

Tew did not respond to requests for comment
Louisiana has a long record of convicting and sentencing to death people later found to be innocent. In the past three decades, the state has exonerated 11 people facing execution, among the highest such numbers in the country, according to The National Registry of Exonerations
has maintained his innocence for more than three decades
while prosecutors continued to insist that Duncan committed the murder and should be executed without delay
He said he had left her alone in the bathtub while he washed dishes
he said he heard a loud noise from the bathroom
he found her floating face down in the water
While Duncan claimed it was a tragic accident
authorities charged him with first-degree murder after Hayne and West examined the girl’s body and determined there was evidence she was sexually assaulted and intentionally drowned
After about two weeks of testimony in 1998
the jury found Duncan guilty and sentenced him to death
Duncan’s post-conviction attorneys uncovered evidence that was not presented at trial that
This includes a jailhouse informant who wrote to prosecutors offering to share Duncan’s confession to the crime in what the defense claims was an exchange for leniency (the informant later recanted his trial testimony); past head injuries Haley suffered that might explain her death; and a video in which West can be seen grinding a cast of Duncan’s teeth into Haley’s body
which the defense says the forensic dentist manufactured
West did not immediately respond to requests for comment on the ruling
West has previously said he was simply using what he called a “direct comparison” technique, in which he presses a mold of a person’s teeth directly onto the location of suspected bite marks because it provides the most accurate results, according to a 2020 interview with Oxygen.com
West said he no longer believed in bite mark analysis in a 2011 deposition in a different post-conviction appeal
“I don’t believe it’s a system that’s reliable enough to be used in court” and admitted to making mistakes in previous cases
But he told The New Republic in a 2023 interview that his methods are valid because other people have used them
Sharp also noted the September testimony of Detective Chris Sasser
no cleaning rags and no cleaning agents” in the bathroom or house where the alleged crime occurred
This undermined the state’s assertion that there was “massive blood loss,” the ruling said
Sharp pointed to a witness who testified that Scott failed to “investigate or present evidence that was available at the time of the trial,” that he did not “develop a coherent theory of defense,” and that he failed to disclose a conflict of interest
Scott’s wife told Verite News and ProPublica that he has suffered significant health problems including memory and speech impairment and declined to comment on the judge’s ruling
Duncan is among 55 people on death row in Louisiana
though until very recently he and the others were not in imminent danger of being executed as the state hadn’t put anyone to death since 2010 due to the unavailability of execution drugs
Landry has made clear his intention to carry out these death sentences as soon as possible
having recently approved the use of nitrogen gas
a controversial method allowed in only three other states
This cleared the way for the state’s first execution in more than 15 years, as Jessie Hoffman was put to death on March 18 using nitrogen gas

“Never in a million years could I have imagined that,” King said
The chance encounter has perhaps rewritten the history books on live music in the Chicago suburbs
turned what could have been another sad closure of a beloved historic venue into a revitalized musical and entertainment powerhouse
With what one employee called the couple’s “new-kid energy,” they set out to keep all the good parts — like the Wisconsin supper-club decor and vital relationships with a stable of American roots musicians — and improve upon everything else
The 100-year-old stage has seen thousands of bands including American roots legends such as Marcia Ball and Clifton Chenier
The backdrop was painted in 1992 for a scene shot in the movie “A League of Their Own”
the three-building campus in the western suburbs is bursting at the seams with a staggering variety of music
a side of BBQ from their restaurant next door and offbeat entertainment like storytelling
Its newly renovated free outdoor patio — which just opened for the season and is flowing with live music
food and drink — will be a destination this summer
the club has 150 musicians and events on the calendar at both the main club and in the Sidebar next door
sells out four days of performances by 50 different artists and draws audiences from across the United States
But getting here has taken a leap off a cliff of debt
some solid hospitality experience and targeted capital improvements
but soon after the couple signed the papers on March 15
and Duncan was giving up a fat check and profit-sharing from his employer
King worked on a Chicago public school salary
To come up with the $1.7 million purchase price
they did a cash-out refinancing on their home
secured loans totaling about $1 million from the Small Business Administration and coaxed eight investors — friends
family and colleagues — to throw in another half-million of equity
pregnant with their second child and studying for her master’s in educational leadership
she visited their new property for the first time
She saw the former owner’s pontoon boat parked in the middle of the sprawling
King still remembers her incredulity: “I was like

JB Pritzker ordered all indoor venues closed for COVID-19 protections
“We just figured Will would walk in and keep everything going that was already going,” King said
She came up with putting bands in the back of a 1984 Chevy pickup and driving around neighborhoods to do truck shows
When outdoor gatherings were allowed that summer
the two fast-tracked a plan to convert the boat-parking space between the buildings into an outdoor patio
“They got very creative and never let it get them down,” retired former owner Bill FitzGerald

“It forced us to keep coming up with ideas and hustle
and [that] honestly made Fitzgeralds a better place because of it,” King said
The patio was converted into a free public gathering place that quickly became one of the club’s most popular features
Carpenters just put the finishing touches on a $250,000 pavilion (financed with more business loans) that will keep the sun and rain off and the crowds spending
she decided it was time to leave the public schools
ditch her salary and benefits and go to work as the venue’s marketing manager
“We honestly never thought about failure,” Duncan said
King’s engaging photos and social media posts fuel a lively online presence, and she was the driver behind the club earning a spot on the National Register of Historic Places. Besides some possible tax benefits, the owners wanted to send a message that the club was here to stay for another 100 years.

everything is expensive: supplies and wages for owners and ticket and food prices for customers
having a house full of people is no guarantee of success
who learned the business at popular Chicago spots like the Empty Bottle and Longman & Eagle on the North Side and The Promontory in Hyde Park
“It is shockingly easy to do a lot of business and not be profitable at all,” he said
King added: “It is sometimes down to a handful of tickets as to whether we will make a profit on this show.”
“You can thrive if you know what you’re doing,” said Duncan
which closed as a cabaret and rebranded as a nightclub earlier this year
the new owners benefit by being their own landlord; they own the whole shebang
including three buildings with 71 separate doors
Duncan and King decided to own and operate the restaurant
but it’s essential to the financial and hospitality synergy
Private parties and off-site catering bring in additional revenue
the couple has been able to pay themselves a modest salary and distribute some profits back to investors
But they are also slowly broadening the musical menu to appeal to the changing demographics of the neighborhood — and to younger crowds
with indie bands and Latin music nights on Thursdays
The folk-rock fan has been a regular at Fitzgeralds almost since the beginning
sometimes without even knowing who’s playing
Eric is a familiar face to what Jackson calls the “community” of staff and customers there
“To have a place where he feels at home and comfortable is special,” he said
“It’s a friendly and welcoming experience.”

After completing his Bachelor’s Degree
serving as a medical assistant in the US Army medical clinic
he loved the people there and built relationships that would continue throughout his life

“The Dedication to a Vision of Hope and Healing” will feature community leaders sharing the story about the creation of the park and plans for the Center for Hope & Healing

He saw it for the first time with his uncle and cousin the first summer it came out

Jenkins collected his first item in what would become a burgeoning collection: A trading card of Darth Vader’s spaceship
“It's a trading card from Wonder Bread,” Jenkins says
“It still has my initials where I wrote on it so it wouldn't get lost when I took it to school.”
Each card was once tucked into a specially-marked loaf of Wonder Bread

was a wedding gift from his mother and his wife
“It was an item that he had been looking for for years and didn't think he would ever find
so it was really special to surprise him,” his wife
“We had a friend who was also a 'Star Wars' collector and I heard through the grapevine that he owned this action figure.”
“I put out some feelers to see if he would be interested in parting with it
and persuaded him that it was going to a good home,” she says
which opens May 2 at the National Museum of Toys and Miniatures
Fans from as far away as Australia and Korea have come to see his collection of X-wing starfighters
Jenkins has an entire vintage section of action figures in their original packaging set around three walls, organized chronologically and alphabetically by country — starting with toys from Australia and ending with Ewoks cartoon figures
The museum looks much like a vintage toy store but nothing is for sale
which occasionally confuses younger visitors
“We had an open house and a family was getting ready to leave,” Jenkins says
“They asked their little kid if he was ready to go and he said he hadn't decided what to buy.”
The parents had to explain it was a museum
“He was very disappointed,” Jenkins remembers
Jenkins is always on the hunt for the items he’s missed along the way

One item he covets is the so-called “Holy Grail” of action figures — the 1979 Kenner Boba Fett, which broke auction records last August

As for Jenkins’ success acquiring such an enviable collection
everybody was collecting everything because there just wasn't as much,” he explains
“but as it became just this overwhelming behemoth of stuff
and I guess I was crazy enough to keep at it,” he says
admitting nostalgia is a big part of his motivation for collecting
“Sometimes I'll get a piece and it just instantly takes me back to being 10 years old and just having that awe of the movie again.”

On Monday, at midday, I was on the phone with my boyfriend when it unexpectedly cut off. I continued walking down the street in Granada, where I live, not thinking much of it.
Oblivious to the nonfunctioning traffic lights, I arrived at my local deli. The shop lights were off.
"Apagón," a frustrated woman behind the counter said. "Power cut."
Granadians are famous for being a little grumpy, but this was different; she looked alarmed. In a flurry of Andalucian words, I picked out "No hay luz," which translates to "no power," and "fatal," which is self-explanatory.
Although it would be many more hours before I would find out, a power cut had struck all of Spain and Portugal, and hospitals switched to emergency generators. Pedro Sánchez, the prime minister of Spain, declared a national emergency.
In the hot deli, delicious cheeses, homemade stews, and expensive meats, usually refrigerated, were sweating and sagging. The card machine wasn't functioning. I found a 2 euro coin in my pocket and bought the last baguette.
Walking out to the street, there was an unsettling buzz. Granada is usually peaceful and sleepy, but people seemed on edge. Heading into the local fruit store, I found the same scene: no card payments, lights, or fridge, along with tense shopkeepers and alarmed customers.
I used my change from the bread to pay cash for an avocado and hurried home. I Googled what had happened, but a blank screen stared back at me.
I tried calling my boyfriend, but I couldn't get through. I knew he was at his office and wondered if he could be trapped inside the electric doors. A latent SMS had arrived: "You ok??" I couldn't reply. No matter how often I switched my SIM card, I couldn't get more than a second of glitchy signal. Another one came through: "This is scary."
I sat in my small loft apartment, smearing avocado on untoasted bread. Questions sprinted through my mind: Should I go looking for my boyfriend? How could I contact my clients about deadlines due today?
Most importantly, how much of this bread and avocado would I need to save for us for dinner, because there was nothing else and I only had 44 cents left?
I was working in London when I met my Andalucian boyfriend about six years ago. I started working as a freelance writer, and over time, we decided we'd have a better life in Spain.
We've lived in Granada for a year and a half, and my freelance work hadn't been affected until Monday. Fourteen hours of zero electricity unraveled my income faster than the pandemic, Brexit, or loss of clients.
When I heard my boyfriend's keys in the door, I was relieved. He told me the only news was coming from car radios. Sánchez had instructed people to use the emergency services sparingly. Cars were backed up at petrol stations.
Together, we walked into the city. Most shops were closed, and their staff sat outside on park benches — if not, they were taking cash payments and writing receipts by hand. The proprietor of a chain of ice cream stores frantically ran between shops as his profits melted down the sides of nonfunctioning freezers.
Our big local supermarket was accepting card payments using an emergency generator. Shoppers loaded their carts in a hushed frenzy. Under the fluorescent lights, it felt like something out of "Black Mirror."
The fridges and freezers were all closed. Everyone was hunting for food that didn't need cooking or storing in a cold place. Items like bread and candles were long gone, and the canned goods shelves were getting bare.
People were also loading up on water and toilet paper as rumors spread that the power cut was a Russian attack and World War III was here. Carrying our bags home, my boyfriend translated conversations he overheard. A competing theory was that the climate crisis was finally striking.
As an immigrant with just 44 cents in my pocket and no way to earn an income, I felt increasingly vulnerable. But my boyfriend reassured me, "Andalucians share. Communities look out for each other. We'll be OK."
He was right. The panic in the streets was also interspersed with neighbors singing and clapping together. Walking back to our loft, we saw locals meeting in the squares around our block. Where we live in Granada is famously alternative; a few people blasted car radios or brought out guitars. Flamenco jams carried on long into the night, illuminated by car lights.
I fell asleep admiring the stars through the open window, more visible than I'd ever seen them in Spain. When the power returned at 2 a.m., I was woken up by the crowd's roar, swiftly followed by my boyfriend flipping the light on.
The next day, schools reopened and traffic flowed, almost like nothing had happened.
But people looked tired, and many businesses stayed closed to take stock of their losses. Picking up my daily coffee, the barista looked distracted. She told me that she'd been able to save most of her baked goods from the heat but couldn't sell hot drinks yesterday.
I'll work this weekend to make up some of the time I lost on Monday, but I am also making changes. A 20 euro note is in my purse, where it will remain as a new emergency fund. Tins of sweet corn, chickpeas, and hummus are also in the cupboard.
I am also going to reevaluate my income. At the moment, it's too dependent on the internet. I'm considering offering English lessons or transforming the guest room into a makeshift Airbnb.
One thing is for sure: I am not leaving Andalusia. Even at its worst moments, this place offers a sense of community and warmth that no power cut could ever put out.

He took his job more seriously than many surrounding him in the NBA space were prepared for
