Millcreek’s new city center has continued to take shape throughout 2024

Cottonwood Residential’s Richmond, located at 1280 E. Villa Vista Ave., will bring 328 studio, one-bedroom, and two-bedroom apartment homes to the area. Rent will start at $1,350 for a studio and go up to $2,875 for a two-bedroom
Brick Lofts by PEG Development has begun its Phase II
which includes a two-story parking podium and five floors of apartments
an office-to-residential conversion of the adjacent building
This phase adds 89 apartments and 148 parking stalls

Utah — Millcreek residents say they filed a report with the Unified Police Department on Halloween night after finding property damage and several marbles on and around their property
"Apparently this was target practice for a paint gun or a marble gun
I don't know what they're using but it's doing quite a bit of damage," said Millcreek resident Rebecca White
residents along 700 East in Millcreek have been discovering damage to their houses
and then finding a white marble not too far from it
"I looked up and I saw that my window right here has a crack in it
there's a marble right there," said fellow Millcreek resident Dustin George
George filed a police report with the Unified Police Department Millcreek Office
"It's nonsensical for someone to be doing something like that
It's a quiet neighborhood; I've been here since 2019
Never had a problem with anyone and then suddenly got some dude shooting marbles out of a paintball gun," said George
has lived in her home for more than 20 years
She stressed that they've never had issues like this
so I looked over and this window has a star in it
I thought initially it had been hit by a BB
and then I looked down and there was a white marble on the ground below," said White
Both of the residents hope the police will take action so this can be stopped
I started noticing some dings on my car," said George
White said her neighbors a few doors down also had damage to vehicle windows that were parked on their property
"Her windows have been shot out three times
And she's got white marbles all around the car
We just want to catch this guy and hold him accountable
It's costing me $1,800 to replace one window," said White
Some residents are worried about people getting injured
especially with many kids and pets in the area
"You get cars — we're on a busy street — but other than that it's quiet and it sucks to have one person come in and ruin all of that," said George
They encourage others who are dealing with this situation to contact the police

When Elizabeth learned that Jack’s intuition was correct
Growing up as the big sister to three younger brothers
Elizabeth had dreams of being a mom to a daughter for as long as she can remember
she eagerly anticipated seeing her daughter’s face and helping her achieve joy and success in every aspect of her life
Elizabeth was informed that there were significant complications with Bianca’s most vital organs including her heart and brain
Conflicting information and recommendations from various medical professionals followed
finding a new level of faith in prayer and priesthood blessings
and a resulting conviction that she needed to carry on
the most serious complications that concerned the doctors resolved themselves and both Elizabeth and Bianca were given a clean bill of health
the night before Elizabeth’s own birthday
She was born just a few days shy of her due date and weighed a healthy 6 pounds 13 ounces
When Bianca was first laid on Elizabeth’s chest
Elizabeth could tell something was not quite right
Bianca’s cries were soft and she appeared to struggle for breath
Elizabeth immediately asked for help for her baby and the incredible team of doctors and nurses at Intermountain Health rushed to provide Bianca aid in breathing and life-saving support
showing her strength and determination with each punch and kick she gave her doctors and nurses
Although she was beautifully perfect on the outside
the particular anatomical anomalies that existed inside her body—ones that had gone undetected—made Bianca’s mortal life unsustainable
Only two hours after she came into the world
Yet her beautiful presence continued to be felt by Elizabeth
and visitors for the hours and days Elizabeth was able to hold Bianca after her passing
While Bianca’s time on earth may have been brief
Members of her medical team expressed feelings of honor for being entrusted with her care and of gratitude for having felt the influence of her spirit
The impact Bianca is having on her family—including her dad
and Jack (2)—is only just the beginning
The boys were each thrilled to be getting a sister
Even though they met her after she had already passed
they felt her strong spirit and her love for them
and their love for her has been obvious as well
Elizabeth is immeasurably proud to be Bianca’s mom
She cherishes the time she was able to have with Bianca
Elizabeth feels it was an honor and privilege to carry and deliver a spirit who didn’t require all the training
and tests of this life to be perfected in Christ
She has since found new meaning in the scripture “For [men and women are] spirit
receive a fulness of joy; And when separated
[they] cannot receive a fulness of joy” (Doctrine and Covenants 93:33-34)
She has also found comfort from the words of the Savior: “I will not leave you comfortless: I will come to you
and the world seeth me no more; but ye see me: because I live
ye shall live also.” (John 14:18-19)
Despite the heart-wrenching reality that Elizabeth’s many hopes and dreams for her baby girl will go unrealized on earth
she finds great peace in knowing that they will once again be reunited
The promise of their relationship lasting beyond the grave has brought Elizabeth peace amidst the tragedy of their separation
Bianca’s brief life has inspired Elizabeth—and undoubtedly many others—to strive for their best selves
Bianca will be buried at Kaysville Cemetery with her maternal great-grandmother
a remarkable woman in Bianca’s family line who worked as a labor and delivery nurse
A viewing and funeral services will be held Wednesday
July 17 the East Mill Creek 12th Ward,,3103 East Craig Drive
All are welcome to come honor Bianca’s beauty
and strength at the church building from 10:30 to 11:15 a.m.

the 419th Fighter Wing will fly over 17 cities to participate in each city’s Independence Day celebrations
and circling back to West Jordan at 10:50 a.m

MILLCREEK, Utah — New video has been released that shows a truck suspected to be involved in a deadly hit-and-run accident that killed a 20-year-old woman in Millcreek over the weekend

Lindsey VanOrman was struck and killed early Saturday after she got out of her own vehicle to check on a cat that had been hit near 3051 South 2300 East
VanOrman was a block away from her home when she was hit
She was taken to the hospital in critical condition
and died from her injuries on Saturday evening
the Unified Police Department released new surveillance video that captures the suspected truck that hit VanOrman
a silver Nissan Titan with a broken front headlight is shown driving on 2700 South and 2000 East minutes after the incident
Police are asking who has information on the truck or incident to contact the department

Utah Department of Transportation officials stated westbound and eastbound lanes were closed at3300 South and 900 East
The estimated clearance time was approximately 5:20 p.m
Photos at the scene showed several vehicles may have been involved
were not immediately provided by law enforcement
KUTV has reached out for more information and has not heard back as of Saturday evening
EAST MILLCREEK — An East Millcreek neighborhood was in shock Thursday after two known members of their community shot and killed each other in a deadly confrontation in the street
both died after shooting each other at very close range
who grew up in the area and whose parents still live close to where the fatal double shooting occurred
had developed a reputation as a troubled person who had frequent run-ins with the law
when Bruner apparently tried to force his way into Jacobs' house
Bruner started banging on Jacobs' door as if he were attempting to break the locked door open
either by kicking it or using his shoulder to ram it open
grabbed his revolver and went to the door to investigate
Whether he cracked the door open or just spoke to Bruner through the closed door was not immediately known Thursday
It also wasn't known whether Jacobs knew he was talking to Bruner
The confrontation remained heated as Bruner continued to try and force his way in
Bruner ran off and Jacobs chased after him
Jacobs' 18-year-old son followed after his father
After the two had gotten about four homes down the street
Bell said detectives were still trying to determine Thursday who fired first
But based on statements from neighbors who heard the exchange of gunfire
police believe Bruner turned around as he was running and fired his sawed-off single-round shotgun first
The son was believed to be only a couple of feet behind his father and witnessed the shootings
not only was the victim's son at the scene when this occurred
but also the wonderful residents of this neighborhood came out and attempted to resuscitate this victim," Salt Lake County Sheriff Jim Winder said
Family and neighbors rushed outside to the street and attempted life-saving first aid for both men
One of the first neighbors who rushed outside is a doctor
but when he couldn't find a pulse on Bruner
together with paramedics from Unified Fire Authority
"We are all saddened by the tragic loss of Russell Jacobs
His death is a great loss," said Wes Smith
a neighbor and family friend who acted as the family spokesman Thursday
Jacobs worked as a wealth management adviser and a graduate of the University of Utah's David Eccles School of Business
Employees at Cambridge Financial Center in Salt Lake City confirmed Jacobs was an employee there but declined further comment
Jacobs was also a youth leader in his local LDS ward and reportedly led their youth activity over the summer
Because he was known by so many young adults in the neighborhood
the Granite School District sent crisis counselors to nearby Skyline High School Thursday morning
Jacobs' 18-year-old son graduated from Skyline in the spring
Salt of the earth," said neighbor Jonathan Diaz
"They're the family that put on the neighborhood block party and got everybody together to get everyone to know each other better
Rusty was easily one of the nicest guys I've ever met."
Diaz said it would probably take a few days for the impact of Jacobs' death to really sink in
"The thing I remember most about Rusty was how genuine and nice he was," he said
"This is a loss we're all going to feel for a long time
I can't believe this is happening."

It was not known Thursday why Bruner went to Jacobs' house
Bruner grew up in the Millcreek area and with his distinguishing facial tattoos was known by most residents
Investigators believe Jacobs knew of Bruner
but whether the two were acquaintances or had spoken to each other in the past was not immediately known
police believe Bruner had been sleeping on the couches of different friends in the area each night
Friends of Bruner also took to social media to mourn the loss of the man who they said had been like a brother to them
You always had my back (through) everything
Always talked me up and truly loved me like a brother
You lived an amazing life," wrote one man
"Jesse Bruner died today in a gun battle
It is a sad day for everyone involved," wrote another man
A friend who has known Bruner for more than 15 years said that growing up together
Bruner was a fun and generous friend who was always willing to listen to someone in need
Bruner was a father who loved his daughter and was passionate about drawing and his work as a tattoo artist
said he and Bruner lost touch several years ago when Bruner fell deep into an addiction to drugs
"He made a lot of bad decisions," the man said
but even their best efforts didn't seem to have an impact
Bruner and his friend spent time together a few years ago when
was putting his life together and was working as a tattoo artist
when the two saw each other at a party a month ago
the man said he sensed his friend had returned to his old ways
"He seemed like he wasn't doing too well," the man said
the man said all were surprised to learn that Bruner was carrying a gun when he showed up at the Jacobs home
"No one is saying he was an angel by any means
but I would say this wasn't characteristic of him," the man said
but I'm 100 percent convinced drugs were involved
and I would assume it was because of drugs
Maybe he was high or was trying to get high."
While expressing grief and sympathy for the Jacobs family
the man emphasized that many were mourning Bruner's death
there are a lot of people who tend to see someone like (Bruner) as just a terrible person," he said
"He was loved and will be missed."
A search of Utah state court records indicates Bruner had a criminal history dating back to age 18
when he pleaded no contest to a reduced charge of threatening to use a weapon during a fight
He faced the same charge and pleaded guilty to a class A misdemeanor a year later
Bruner was convicted of a felony in 2001 when he pleaded guilty to forgery
Since 2012 he has also been convicted of misdemeanors including possession of a controlled substance
intoxication and unlawful possession of a weapon
He was mostly recently charged in August with possession of drug paraphernalia and a warrant for his arrest was issued when he didn't show up for his first hearing in the case
Court records indicate Bruner's wife filed for divorce earlier this month
who a friend said had been separated from Bruner for quite some time
Bruner listed himself as a tattoo artist and MC
There were several clips of him freestyle rapping and many examples of his tattoo work
as well as pictures of his own numerous tattoos
Friends say he worked at several tattoo parlors in years past but recently had been freelancing
Bruner announced he had just been released from jail and asked his followers to call him if they need a tattoo
Salt Lake County Jail records listed more than 30 tattoos on Bruner

Investigators are asking anyone who may have seen Bruner in the past few days to help them re-trace his steps and contact the Violent Crimes Unit at 385-468-9820

They both were dedicated to their faith and their family
Mamo was a ray of sunshine in the lives of those around her
She had a deep love for celebrating every occasion
Mamo always made the effort to be a part of every family gathering and create opportunities for everyone to come together
Traditions became the central theme in her family’s life
The most notable of which had to be the annual beach house trip to Capistrano Beach
Mamo not only provided a fun-filled week at the beach
but also established familial bonds that would last for generations
She had a remarkable ability to know each person on an individual level
Another tradition was her “12th Night Celebration”
She was sad to see any vacation or holiday come to an end
so her discovery of the European tradition of Epiphany helped make Christmas last into January
Her posterity (or the ones who were paying attention) should all know the names of the Three Wise Men and the words to “The Twelve Days of Christmas”
Family was the cornerstone of Mamo's life
She cherished her role as a grandmother and showed unconditional love and support to her grandchildren
Mamo's love extended beyond her immediate family
making them feel like part of the family.Mamo prepared for each upcoming birthday or holiday with special gifts or cards
etc.) could expect a treat bag or card with a little cash
Mailing them to out-of-town families was also part of her preparations
Mamo's faith in God was an integral part of her life
She was a member of The Church of Jesus Christ of Latter-day Saints and lived her faith with unwavering devotion
Her love for God and her belief in the importance of keeping the faith were evident to all who knew her
One of her favorite callings was serving with the Young Women and also teaching in Relief Society.She loved singing with the 12th Ward Choir for many
She was part of quartets and singing groups (The Schubert Singers) throughout college and her early married years
as well as spending time with her family and friends
and she treasured every moment spent with her loved ones
Her dedication to creating a strong family culture and the bonds she formed with her family members will forever be cherished
She’s very proud of knitting argyle socks for the guys at school
Her sewing creations were evident throughout the early years of raising her family
Each season her 4 girls would wear matching dresses made for that particular occasion
She enjoyed working part-time for many years after her girls were mostly grown-up
Michigan were a highlight as she went there to be trained in reading tests
which she then administered in numerous local elementary schools
She later worked for the State Department of Workforce Services processing unemployment compensation returns
She had a job share arrangement which allowed her to alternate 2–3-day work weeks
She made many friends at Job Service and worked there for over 14 years
She will be remembered by her friends as very fun-loving and sociable
she was invited to join a group of ladies and they named the group the “Welcome-Mona’s”
Initially they got together to chat and work on mending
Chatting and parties soon took the place of the mending
After settling in the East Millcreek area and raising her family
a group of friends got together and named themselves “The Golden Girls”
Many birthday lunches and Christmas parties followed over the years
She is survived by her loving daughters Lisa Smith
her 14 grandchildren and 19 great grandchildren
and unwavering faith will continue to inspire all those who were fortunate enough to know her
She will be deeply missed and forever remembered as a beacon of light in the lives of her family and friends

She loved the wide open spaces of the country where she loved to get with her friends
Venez and Beverly and ride horses for hours
Utahna attended Millard High where she played the French horn in the marching band
The Millard High band came to Salt Lake often to march in the July 24th parade
After Utahna graduated from Millard High School
While attending the BAC in 1947 in Cedar City
Gary and Utahna were married on December 26
They were later sealed in the Salt Lake Temple
After Gary graduated from BYU in Accounting
Gary and Utahna made their home in Cedar City
during which time their three children were born (Valerie
When Gary was offered a great job in Salt Lake working as an industrial engineer for Kennecott Corporation
it was a very difficult decision to make since they loved Cedar City and southern Utah so much
Moving to the big city with so many unknowns was a bit terrifying
and they visited there often to see Gary’s parents
Utahna was a very devoted and loving wife to Gary
and was very fortunate to have travelled with Gary to many beautiful places around the world
She said that “dance lifts my spirits and helps me stay happy and healthy.” In her younger years
Utahna danced and performed with her best friend
in the small town of Holden every chance they could get
she became a member of the “Clogging Grandmothers.” She danced with them for 7 years
They would practice for 90 minutes twice a week
and performed for care centers around the valley
the Dickens Festival and the Festival of Trees
The ultimate experience was when they entertained at the 2002 Salt Lake Winter Olympics
She began sewing clothes for herself and others from her early teens to when her eyesight started failing due to macular degeneration
and she even designed and sewed her own wedding dress
and would use any left-over fabric to sew clothes for their dolls
Utahna designed and sewed their prom dresses
She sewed Halloween costumes for the grandchildren
nighties and even coats for the granddaughters when they were young
Utahna designed and sewed many of the Clogging Grandmothers’ outfits
an amazing seamstress with an eye for quality and detail
Utahna was a life-time member of the Church of Jesus Christ of Latter-Day Saints
She held various church positions over the years
Her favorite calling was working with the Merry Miss girls
She would have the girls over to her house to teach them different dances
She also loved teaching Primary classes with Gary
They would spend hours preparing the lessons
Utahna appreciated and loved the visual and performing arts
Gary and Utahna would frequently attend the ballet
It was very important for Gary and Utahna to expose their children to the arts as well
symphony concerts and theatrical performances as a family
and was genuinely interested in their lives
and could remember the details of people’s lives
Utahna developed macular degeneration in her later years
and just kept living her day to day life making adaptations along the way
For Gary’s last 2 years before his passing
and it became increasingly difficult to care for him
She was a devoted wife who endured to the end
Utahna was preceded in death by her father

MILLCREEK, Utah — Nearly a week after a 20-year-old woman was struck and killed in a hit-and-run incident in Millcreek
Lindsey VanOrman got out of her vehicle near 3051 South 2300 East to help a cat
when a passing driver hit her and left the scene
VanOrman was taken to the hospital in critical condition where she later died

the pickup truck was located Tuesday in a Murray apartment complex with its nose next to the building
An investigation into the truck showed front-end damage "consistent with anautomobile/pedestrian collision."
After the truck was towed from the apartment complex
with police saying there had been efforts to "clear or destroy evidence." In addition
a small piece of plastic found at the accident scene matched a section damaged on the Titan
Family shares memories of 20-year-old woman killed in hit-and-run:
Lyman was determined to be a suspect and the possible driver after interviews with two witnesses who said they had seen the truck shared in surveillance videos and photos
One said they saw it drive away with no damage Friday evening
only to see it again Saturday with the front-end damage
Police arrested Lyman as he was sitting in another vehicle outside the apartment complex
Lyman said he had no knowledge of the Nissan pick up truck and wasn't at the apartment either Friday or Saturday
But when told witnesses saw him at the location on both nights
Despite originally waiving his right to an attorney
when told investigators could use his phone data to put him at the location relative to the truck
Our beloved Debra Jean Smith Livingston passed away January 27
at the age of 72 under the loving care of her family in Salt Lake City
Debbi was born to Russel Lynn and Lois Robb Smith on July 5
While growing up she loved spending time with her 3 brothers
uncles and cousins on the family farm in Duchesne
graduated from Highland High School in 1969
and graduated from Steven's Henager Business College
Debbi and Roger Alan Livingston were married on August 26
Together they raised five children and love doting on their 13 grandchildren
Debbi loved spending time with her children in classrooms
She loved music and singing and enjoyed being part of the A'Cappella choir at Highland High School
She taught her children to love music; nothing brought her greater joy than watching her children and grandchildren perform be it singing
Once her children were raised and she had a little more time she was part of the Mountain Jubilee women's barbershop choir
performing and competing around the United States
She even found time to be in a couple community theater productions and loved getting to share the stage with her family
Debbi and Roger have lived in the East Millcreek area for over 44 years and have many precious memories and friends
Debbi loved serving in the Primary and Young Women's organizations and as Relief Society President where she developed a great love for all the sisters in the ward
She cherished her time serving an inner-city mission with Roger and had a special love and bond with those she served
She never doubted the truthfulness of the Gospel and her faith is one her gifts and the greatest legacy to leave her family

Millcreek and two other elementary schools were recommended to close under a proposal by the Granite School District
Faced with dwindling student enrollment, Granite School District moved Tuesday night to close three elementary schools.
The district’s board of education decided unanimously on Twin Peaks, Spring Lane and Millcreek elementaries
That came after the fall student population report showed the district losing 1,255 kids across all grades
The pushback from parents has been swift and loud
Several moms and dads accused the school district of bias
saying it intentionally picked schools that have large minority and low-income populations
Others said they were worried the consolidation would overcrowd their kids’ current school
A few named other schools they wanted shut down instead

The school district acknowledged that it’s not pleasant for anyone to close schools and said it specifically tried not to impact already vulnerable populations with the closures

the president of the board said Tuesday: “We have listened to all groups and all sides
It’s just a tough vote that we have to take tonight.”
The district previously closed three elementary schools in 2019. And it shuttered Granite High in 2009. The population in its boundaries is aging, and many families are electing to go to charter schools instead.
Here’s a breakdown of the demographics at the three schools being closed — as well as two others that were on the list for consideration.
• Address: 5325 S. 1045 East, Salt Lake City
• Enrollment decline since 2017: 141 fewer students
Twin Peaks has a student body that is 57% minority and 43%, specifically, that is Latino.
Based on family income, 59% of the students are considered economically disadvantaged.
Additionally, of those who live in Twin Peaks’ boundaries, only 51% are choosing to go there. That means half of the kids in the neighborhood are selecting to go to other schools instead.
The school, along with Spring Lane, was recommended for closure in all three of the plans put forward by the district’s population study committee.

• Enrollment decline since 2017: 262 fewer students
This elementary has 40% students of color and 14% who are Latino.
Its student body is 44% from low-income families.
Those living in the boundaries of Spring Lane is the same as Twin Peaks, at 51%.
Most students now attending Spring Lane would be moved to Oakwood Elementary; the Chinese dual immersion program currently operated at Spring Lane would continue at Oakwood.
• Enrollment decline since 2017: 160 fewer students
Millcreek Elementary has 52% of students who are from racial and ethnic backgrounds, including 38% who are Latino.
Of the three schools, it has the highest percentage of those who are economically disadvantaged, at 60%.
At the same time, Millcreek has the smallest percentage of students living in boundaries for the school. Only 48% of those in the neighborhood attend the elementary.
It is also the oldest building of the schools being considered. The elementary was built in 1955. And it has the smallest square footage of the spaces looked at.
The dual immersion program there would be combined with the existing Spanish program at William Penn Elementary, where Millcreek students who go with the closure. This was a major spot of contention for parents.
But Hogan said that 100 of the 127 families in the dual immersion program at Millcreek have said they will move to Penn.
“Penn already has the teachers and structure and support in place,” he added.
The district also looked at possibly closing Moss Elementary and Lincoln Elementary.
Moss, in Millcreek, has 470 students and 73% are students of color. Of its population, 74% come from low-income households.
Lincoln, in South Salt Lake, has 408 students this fall. It has a minority population at 79%. The students who are economically disadvantaged there account for 70% of those enrolled.
That makes both of them more diverse than the schools being closed.
The district has also said that closing Moss and Lincoln would require adding more buses to existing routes to transport students to their new elementaries.
Additionally, more of the students who attend Moss and Lincoln live within their school’s boundaries than do at Twin Peaks, Spring Lane or Millcreek elementaries. Moss has 90% of kids in boundaries; Lincoln has 78%. That’s a strong indicator of continued enrollment with the families in those neighborhoods.

and was remembered as "salt of the earth" and "wonderful." The other grew up nearby
was cast as "the life of the party," but was also a man with "demons" and a criminal past
and both died on a street near the shadow of Skyline High School from gunshot wounds
"We are all saddened by the tragic loss of Russell Jacobs," said Wes Smith
who called Jacobs "a beloved father and husband" and a "dear friend and neighbor."
Unified Police say Jacobs responded to a man bashing his front door

Jacobs left the home and followed Bruner down the street
A neighbor told his mother he heard eight gunshots
including a doctor who lives on the street
Jacob's teenage son was with his father
"There really are no words to express how saddened we are for the families
adding Jacobs was "trying to protect his family and his home."
He was said to be an aspiring rapper with a tendency for angry
He has also spent the last 15 years in trouble with the law
charged with seven felonies including drugs
In 2013 police were called to report Bruner was waving a gun around a tattoo parlor where he once worked
owns a tattoo shop on State Street and he said he recently hired Bruner as an artist but had not seen him in the shop for the whole week
He said Bruner told him he was recording music and would return to work Friday morning
He said they spoke Wednesday night at 9:30 p.m.
Gomez says he didn't sound distressed at all
just normal Jesse; didn't sound like he was in trouble or anything," said Gomez
said she hung out with Bruner and that he had an alias: "Jesse James."
"I can say I personally never saw him do drugs
but other people say -- by the way he acted -- it was obvious he was on something," she said
"What did you think it might be?" 2News asked
Bruner may have been living with his parents in the neighborhood

The court fight over masks at the Millcreek Township School District is headed to a hearing in early August
setting up a timeline that makes a decision possible before students return to classes for the 2022-23 academic year
The school district has not required masks since March
But a ruling in the case has the potential to squelch or embolden the lingering pockets of discontent over pandemic-induced restrictions in some schools in Erie County
They could be required again by school districts
whose health and safety plans use the number of local COVID-19 cases as a prompt for mandatory masking
Erie County Judge Erin Connelly Marucci has scheduled the hearing in the Millcreek case for Aug
She will hear arguments on a petition of a parents' group to remove all but two of the Millcreek school directors over the Millcreek School Board's decision to require masks and quarantining for the district's approximately 6,400 students through much of the COVID-19 pandemic
The parents sued the Millcreek school directors on April 25
and the district on May 5 responded with a request that the case get tossed
Connelly Marucci will hear arguments on the dismissal request as well
The petitioners want the judge to pick replacement school directors
Petition filed:Parents' group sues to remove Millcreek school directors over previous mask requirements
Connelly Marucci is also assigned the North East case
but had not scheduled a hearing for it as of Wednesday
How she rules in the Millcreek case is all but certain to affect the North East case
Companion casesThe petitioners who filed the respective lawsuits did so under the auspices of a group called Erie County PA Parents Protecting Children
according to news releases from the organization

Prozan and Beckes are contending that the respective school directors should be ousted because
they followed a September state Department of Health edict that the Pennsylvania Supreme Court ruled invalid in December
and the state Supreme Court never said that school boards were prohibited from requiring masks

The petitioners are also claiming the requirements for masks and quarantining violated a number of rights under the state and federal constitutions
including — regarding quarantining — the Eighth Amendment right against cruel and unusual punishment
The petitioners claim the quarantining was tantamount to solitary confinement
Several other school districts statewide are facing similar lawsuits over masks
Of the 13 public school districts in Erie County
only the Millcreek and North East school districts are facing suits

He filed a request on June 8 that the North East suit get tossed

The school districts are arguing that the mask mandates reflected the law as it existed at the time
and that the Pennsylvania School Code empowers school boards to take action to protect student health — as the Millcreek and North East school directors said they did in requiring masks to reduce the spread of COVID-19
The North East School District lifted its mask mandate on Feb
Sennett in court records has called the removal actions politically-motivated "nonsense." He is also arguing the courts are not the proper place to determine the fates of elected school directors

The petitioners are claiming that the School Code
though it authorizes school boards to regulate a wide range of student behavior
does not specifically give school boards the power to require masks
"Considering the magnitude of the power to force students to wear masks in public school buildings and quarantine students as a result of someone being exposed to COVID-19
the General Assembly would have clearly set forth such power in school districts if it exists," Schnee
the petitioners' lawyer in the Millcreek case
In response, the Millcreek school directors reaffirmed their initial arguments about the lawsuit's shortcomings. They also said the petitioners in the Millcreek case misread the section of the Pennsylvania School Code under which they are suing — Section 3-318
which allows for removal of school directors who fail to perform certain duties or neglect their duties
said in a June 9 court filing that the Millcreek school directors could not have violated Section 3-318 because they acted to protect students but never failed to act
What's next?:Some Erie County schools will mask, others won't if COVID-19 community level rises
"Requiring students to quarantine and wear protective face coverings was a historic measure triggered by a historic catastrophe
which sparked strong feelings from citizens of all political stripes," Sennett said in the filing
"But the proper venue to express disagreements regarding COVID-19 protective measures is not this court and certainly not an action under 3-318."
The North East suit seeks the ouster of all nine school directors
The Millcreek case seeks the ouster of seven of the nine school directors
leaving untouched a director who favored optional masking and a director who is new to the board
they must pay the respective school districts' legal fees
according to Section 3-318 of the School Code
The Millcreek and North East school districts are seeking the imposition of litigation costs

Keep their $2.50 Tuesdays in mind as well – all nigiri is just $2.50/2 pieces

Utah (KUTV) — Residents of a Millcreek neighborhood recently received an anonymous letter notifying them of a proposed new development
“The area has always been residential," he added
“I would like to see businesses developed in this area that support the Holladay East Millcreek area.”
The letter was from a developer who shared their vision of a Porsche dealership on the southern four acres and mixed-use purpose on the northern two acres of the vacant land sandwiched between Wasatch Blvd
“Many people only get riled up when they see change," he said
The developer is linked to Denver Broncos NFL Hall of Fame Quarterback John Elway and his Elway Dealership Group
though requests for comment were not returned
The city of Millcreek asked the developer to host a meeting
A Millcreek official said the developer has not submitted a re-zoning application yet and have until July 21 to do so
followed by a Millcreek Planning Commission meeting on Aug
The city council would then have to vote on the re-zone
with the earliest possible vote in the fall after several public hearings
Request for comment from the property owner and the Elway Dealership Group were not returned

Among the infinite tragedies buried within this tragedy is that although you ended her life, you never met my mother. I could fill every page in this newspaper for a year with stories of things she did for others. When she died, she had only begun to learn how to do nice things for herself. She had tickets to Andrea Bocelli the next day.
For the rest of us, the canyon you ripped in our hearts remains. The abundance of love and support we’ve received cannot fill it. My pulse races at crosswalks. I listen to “Con te partirò” on repeat. I wonder what I’ll tell my future children about their grandmother’s death.
I’m sure you have your own canyon. You drive cautiously now. You feel eyes on you. You can’t shake how a streak of cranberry sauce in a bowl reminds you of the blood you wiped off your bumper when you got home that morning.
My mother adored the holidays and the seasons. Her final social media posts were flush with fall colors. When I left the intersection, I sat for a while and listened to the delicate crunch of leaves falling atop each other in Wasatch Lawn. I understood why she loved walking there. No graveyard ever looked so gorgeous in the glow of an Autumn morning.
Every holiday season, my mother honored the tradition of going around the table and giving something we were thankful for that year. Please, to help repair the canyons in all of us, give us something to say to each other now. Give us someone to forgive.
