EVANSVILLE — An Evansville police officer was placed on leave and arrested Friday after detectives accused him of pointing a handgun at a fellow officer while intoxicated was booked at the Vanderburgh County jail Friday morning on one count of criminal recklessness with a deadly weapon Stephenson later secured his release after posting a $500 bond Stephenson’s arrest traces an April 25 incident at the Fraternal Order of Police lodge where he attended an event honoring several officers who had recently completed their first year of service for the city according to Evansville Police Department spokesman Sgt whom Aussieker described as being “highly intoxicated,” reportedly sought to convince several of his colleagues to “continue the celebration by going to another bar” after the event at the FOP lodge wound down He was off duty and out of uniform at the time The police union lodge at 801 Court Street in Downtown Evansville features an on-site bar “When one of (the) three officers decided to leave Stephenson pulled a firearm from a holster and pointed it at him,” Aussieker wrote in a news release “The firearm involved was not Stephenson’s department-issued firearm.” Aussieker said he placed multiple phone calls to witnesses including a recorded call in which Stephenson “100% owns up to it." EPD administrators were made aware of the incident the following morning and Stephenson was placed on paid administrative leave pending the outcome of a criminal investigation That investigation substantiated the allegation that Stephenson pointed a handgun at a fellow officer “Nearby surveillance videos captured some of the incident,” the release states “The incident did not occur directly in front of any of the cameras but the footage was able to confirm witness accounts of the incident.” The EPD brought their findings to the Vanderburgh County Prosecutor’s Office which moved to charge Stephenson with one count of criminal recklessness with a deadly weapon Friday morning “When probable cause was established to charge Stephenson his leave was updated to unpaid administrative leave,” Aussieker wrote “The Police Merit Commission will vote to determine Stephenson’s punishment court records did not yet state when Stephenson would appear before a judge Houston may be contacted at houston.harwood@courierpress.com EVANSVILLE — The man accused of fatally shooting 23-year-old Kevion K Mann last year will serve nearly 17 years in prison after he pleaded guilty to one count of voluntary manslaughter prosecutors agreed to dismiss the murder charge Keymontai Madison Vanderburgh County Superior Court Judge Wayne Trockman sentenced Madison to serve 17 years and 182 days in prison though Madison will receive about nine months' credit for time served voluntary manslaughter occurs when a person kills while acting under "sudden heat," a condition that would cause a person to experience anger resentment or terror sufficient to obscure their ability to reason Evansville police arrested Madison on Aug. 5, 2024, one day after Mann was shot outside the Kennedy Towers public housing complex The Vanderburgh County Coroner's Office said Mann died from a "gunshot wound of the head." Detectives accused Madison of firing the fatal shots Mann was born in Newburgh and attended Bosse High School before going on to work at an Evansville warehouse, according to his obituary "Kevion (Mann) enjoyed basketball and track and just recently started fishing," his obituary states "He loved spending time with his siblings and family and enjoyed playing video games and going to the gun range." Police arrested a second man in connection with Mann's killing identified in court papers as 26-year-old Mark A for allegedly acting as a getaway driver for Madison Dow faces one count of assisting a criminal in the commission of a murder Dow has pleaded not guilty and is still awaiting trial While Madison’s decision to plead guilty means prosecutors have yet to present all of the state's evidence during a trial police affidavits provide an account of the fatal shooting When officers arrived at Kennedy Towers just after 3:30 p.m they found Mann lying on the sidewalk suffering from "multiple gunshot wounds," Dow's arrest affidavit states Paramedics transported Mann to Deaconess Hospital Surveillance footage recovered by investigators showed Mann approaching a group of men in Kennedy Towers' parking lot prior to the shooting Detectives said the footage appeared to show the prelude to an altercation Mann was seen taking several steps toward Madison Crime scene technicians would later recover three 9mm shell casings not far from where Mann fell Dow was reportedly standing near Mann when he was shot and Dow's arrest affidavit states that he was captured on surveillance footage driving Madison away from Kennedy Towers in a white Chevrolet sedan "Dow parks in the middle of (Cherry Street) and waits for the suspect who shot the victim to run over to his vehicle," the affidavit reads "The suspect then gets in the back seat and Dow flees the area as the getaway driver." Before Madison is alleged to have gotten into Dow's car detectives said surveillance footage showed Madison entering and then exiting his own vehicle A search of Madison's car turned up an "extended" handgun magazine loaded with the same 9mm ammunition recovered near the scene of the shooting a trial in Dow's case has not yet been scheduled Dow is to appear in court May 21 to discuss his attempts to retain a private defense attorney Houston Harwood can be contacted at houston.harwood@courierpress.com EVANSVILLE — The full scale of the financial crimes perpetrated by one highly placed Vanderburgh County judicial employee has emerged in acts referenced — but unnamed — in court papers A Courier & Press investigation into the facts behind the wire fraud charge to which former Prosecutor's Office Finance Director Regene Newman will plead guilty July 31 found Newman has admitted to more than misappropriating $90,408 from that office The bulk of that money — more than $60,000 — was spent in unauthorized purchases with a debit card connected to My Goals a nonprofit for at-risk youth started in 2011 by then-Prosecutor Nick Hermann The Courier & Press discovered Newman also is pleading guilty to misappropriating $10,725 from Vanderburgh County drug treatment court programs (drug court, therapeutic work release and electronic home detention), whose books she oversaw as business director of Vanderburgh County Community Corrections Community Corrections had hired her away from the prosecutor's office in 2021 More: Former Vanderburgh County prosecutor's finance director pleads guilty to wire fraud The treatment court programs were named only as Victim 2 in Newman's plea agreement which didn't explain how Newman misappropriated the $10,725 too — one that also isn't named in the plea agreement Newman signed with the U.S Attorney's Office for the Southern District of Indiana in April according to its articles of incorporation is to "assist in providing rehabilitative treatment to those addicted to drugs." FAIR isn't seeking restitution because Newman settled the debt out of court the supervising judge over Community Corrections said he commissioned a private audit that identified the misappropriated FAIR funds He discussed those losses with evident disgust "We use the FAIR account to help do things for our (treatment court program) participants that we can’t use public money to do — maternity clothing for pregnant participants incentives for when people are doing well," Trockman said did not respond to a request to speak about the case Trockman would not release the private audit of FAIR or disclose how much Newman is believed to have misappropriated from the nonprofit Attorney's Office confirmed Friday that $125,063 is the amount Newman gained from the wire fraud scheme it charged but it is pursuing a money judgment and restitution order only for $101,133.55 for two victims Trockman said FAIR settled with Newman using her accrued termination pay after she was fired from her $74,977-per-year Community Corrections job in March 2023 Vanderburgh County records obtained by public records request indicate Newman More: Community corrections fires former prosecutor's aide over nonprofit spending (Newman's settlement payment to FAIR) was more than that — but she paid it," Trockman said What did Newman spend the money on? Trockman wouldn't say, but he noted Courier & Press reporting in 2023 that bank statements for My Goals showed ATM and bank withdrawals and thousands of dollars in purchases at fast food restaurants pharmacies and supermarkets and out-of-town shopping sprees "It was all consistent with what was found and reported through the not-for-profit at the prosecutor’s office (My Goals)," the judge said Community Corrections provides therapeutic services such as drug and alcohol treatment a GED program and other services for sentenced defendants At the time of her firing Newman was in charge of the roughly $3 million program's financial affairs But Trockman had not known until the Courier & Press told him that Newman was pleading guilty to misappropriating $10,725 from Vanderburgh County drug treatment court programs He said that was confirmed to him on Wednesday by Assistant U.S which also didn't explain how Newman misappropriated the $10,725 The losses had been identified in an independent Indiana State Board of Accounts (SBOA) audit that Trockman says the Federal Bureau of Investigation arranged after Community Corrections contacted the FBI with suspicions about Newman But SBOA "never reported it to me," Trockman said After talking with SBOA Chief of Staff Jennifer Gauger on Wednesday he still doesn't know the details of Newman's thefts from treatment court programs "When I see that State Board of Accounts report I’ll know and you’ll know when I know," the judge said and she said it’s confidential until the sentencing." Attorney Miller also wouldn't shed any light on the matter The Courier & Press asked Gauger about the audit and got the same answer "This matter is currently part of an ongoing investigation so I am not at liberty to provide any updates or information at this time," Gauger said by email Trockman admitted it's galling that the Superior Court judge supervising Vanderburgh County's treatment court programs wasn't apprised of the results of a state audit of those programs and can't obtain it now Trockman said the federal prosecutor told him Newman plans on making a significant payment toward restitution before sentencing on July 31 Current Prosecutor Diana Moers, who defeated Hermann in a 2022 Republican primary election plans to show up at Newman's sentencing hearing in July to make a victim impact statement Moers took a special interest in cooperating with authorities investigating Newman's crimes even though Newman was long gone when she arrived The prosecutor's office could have used the money Newman stole for crime prevention and anti-drug programs "I’m going to push for a harsh sentence," the prosecutor said Moers prosecuted violations of the Indiana Securities and Loan Broker Acts earlier in her career as a lawyer for the Indiana Secretary of State’s Office "I feel like a lot of times the amount of money they steal versus the amount of time they get — it doesn’t match up," she said Maybe it’s worth it.' morning prompting Evansville police to arrest the alleged gun owner for child neglect and other offenses Officers arrested 26-year-old Antonio Harrell hours after he and the boy’s mother rushed the child to an Evansville hospital for treatment of a gunshot wound according to a sworn affidavit drafted by an Evansville Police Department detective Harrell dropped the child off with the child's mother at Deaconess Hospital and allegedly returned to the scene of the shooting an apartment in the 1400 block of Dresden Street where police say he removed a firearm and a spent shell casing from the apartment before he spoke with investigators Harrell faces two preliminary counts of child neglect one charged as a Level 3 felony and the second charged as a Level 6 felony; one count of obstruction of justice and one count of unlawful carrying of a handgun is reported to have shot himself with what EPD Detective Paul Klein described as a “pistol-caliber carbine.” pistol-caliber carbines fire handgun ammunition and are typically larger than a standard pistol but smaller Officers met with the boy’s mother just after 10 a.m where doctors said the boy was undergoing treatment Witness testimony would help piece together what happened inside the Dresden Street apartment earlier Sunday morning The boy’s mother reportedly told investigators that she and her three children awoke around 8:30 a.m After she and Harrell walked into the apartment’s kitchen they heard the blast of a gunshot reverberate from the living room When the woman rushed to the source of the blast she discovered that her 3-year-old son had been shot The woman’s 5-year-old son was also in the living room at the time of the shooting Harrell picked the child up and rushed him to the hospital they reported finding a hole in the living room sofa and a projectile lodged in the frame of the couch Officers photographed blood droplets in the kitchen and living room he told me that the victim had been shot by his dad’s gun,” the affidavit states Harrell is not the biological father of the 3-year-old victim and after the boy was transported to the hospital Harrell would go on to tell the boy’s mother that he was at his uncle’s home in the 200 block of South Grand Avenue and that the authorities could find him there they said Harrell was cooperative and in tears Harrell’s uncle led detective Klein into the home and directed him to the weapon Harrell is alleged to have brought there after the shooting Klein identified the firearm as a Freedom Ordnance 9mm FX-9 pistol-caliber carbine During a police interview at EPD headquarters Harrell provided investigators with his account of what happened Harrell said he had been drinking with friends Saturday and that he spent the night at the Dresden Street apartment “(Harrell) said he needed the firearm for protection and slept with it on the sofa in the living room,” Klein wrote he had the barrel of the gun pointed toward his head in case it was to accidentally go off it would only hurt him and not anyone else in the home.” Harrell said that he woke up Sunday morning and walked into the kitchen to speak with the boy’s mother leaving the firearm unattended and partially covered up by a blanket Harrell said he heard a gunshot ring out from the apartment’s living room teeing up a scramble to transport the now-injured 3 year old to the hospital Detectives allege that Harrell improperly handled evidence in the aftermath of the shooting namely a spent shell casing that officers failed to recover during a sweep of the apartment “When I asked (Harrell) if he had removed the shell casing… he initially hesitated,” Klein wrote “He then admitted that he had picked up the shell casing after returning from the hospital he told me that it was probably somewhere in the van that he drove or near his grandmother's or uncle’s houses.” Harrell reportedly told police he had not sought to tamper with evidence Court records An Evansville couple is facing child neglect charges after deputies say their young child was found outside Deputies say they were called to Ohara Drive They say a young child was found naked on neighbor’s porch and when the neighbors picked up the child they say she smelled badly and there was no supervision in sight Deputies say the door to the home the child came from was standing open They say they knocked and announced themselves several times Deputies say there was a strong odor of urine coming from the home They say Colbert told them he believed his little girl was asleep in her room They also learned there was an open DCS case from the same thing happening in November and on the way to the child’s room they saw a dirty diaper with dried feces They say the child’s bed had toys all over it who deputies say also had the same overwhelming smell as the younger child and deputies say one of them was treated for bed bug bites at the hospital Deputies say there were also dangerous items in reach of the children and visible cockroach activity in the home Jessica Colbert were booked into jail Thursday EVANSVILLE – Former Evansville mayoral candidate "Honest Gabe" Whitley was sentenced to three months in prison this week after pleading guilty to making false statements to the Federal Election Commission The charge stemmed from fake contributions Whitley claimed on various campaign finance reports between 2023 and 2024 during his failed run in the Republican primary for Indiana's 7th District congressional seat According to the initial complaint filed in U.S Whitley made up the biographical details of dozens of people and claimed over $200,000 in false contributions on quarterly and year-end reports for “Honest Gabe for Congress.” Whitley also falsely claimed to loan his own campaign $100,000 All the while he acted as his own treasurer and certified in official records that the contributions and reports were “true correct and complete” to the best of his knowledge Sweeney sentenced Whitley to three months of incarceration in the custody of U.S as well as a year of supervised release afterward The judgement recommends Whitley "serve his term of imprisonment at the lowest security level deemed appropriate" and undergo a mental health evaluation Whitley wasn’t listed in the Bureau of Prison’s database Calling himself "Honest Gabe," Whitley inserted himself into Evansville right-wing politics starting in 2018 he declared his candidacies for everything from Vanderburgh County Commissioner to the Indiana Statehouse to Evansville mayor usually dropping out before any vote took place launched in 2022 and ended several months before the 2023 Republican primary The sentencing comes more than two years after an investigation by the Courier & Press’ Tom Langhorne found that multiple people listed on different Whitley campaign finance reports claimed to have never heard of him Whitley denied falsifying the reports at the time He went on to file a lawsuit against Langhorne the Courier & Press and USA Today in federal court Whitley has also filed federal complaints against the FBI And those are just a few of the multitude of court cases involving Whitley in recent years In November, a Marion County Superior Court Judge ordered him to pay $400,000 to Indianapolis attorney and journalist Abdul-Hakim Shabazz after blog and X posts reportedly authored by Whitley accused Shabazz of pedophilia and theft Shabazz has never been charged with any such crime and he vehemently denied the accusations The two are also embroiled in criminal court.
