(CBS12) — Dog lovers who are looking forward to a night out drinking with their four-legged best friends are going to have more trouble doing so in Florida
The judges backed the state Department of Health's effort to stop a dog-friendly bar from allowing pups inside their two locations
The First District Court of Appeal rejected the claim by Pups Pub that the agency could only prevent dogs from being near the bar
The lawsuit was filed after Pups Pub owners tried opening a second location in Orlando in 2022 and were told that live animals are not allowed in food service establishments
When their first bar opened in Tampa two years earlier
health officials only required them to place a gate between the bar where drinks were prepared and the seating area where the dogs would hang out
After the Orlando location opened in July 2022
both it and the original Tampa spot were reinspected and found to be in violation of that restriction
saying they had been following an unadopted rule based on what they were originally told about installing the gate
The administrative law judge agreed with their arguments
the owners contended that the Florida Department of Health regulations about live animals being barred from food service establishments would only apply to where the food and drink were prepared
They argued the agency regulation did not extend to other parts
The appellate judges rejected that argument and said the rule and the statute behind it do not limit the Department of Health’s authority in this case
and the applicable law is clear in its prohibition
the lower court ruled incorrectly and the previous instructions by health officials were not an unadopted rule

This sensory-friendly showing is tailored for children and adults with autism and other sensory sensitivities
Audience accommodations include lowered volume
and a relaxed environment where attendees are welcome to move

Survey results are weighted across key categories
and final ratings are based on survey performance and the institution’s success in meeting benchmarks for student retention
and loan default rates — both for all students and specifically for student veterans

the national director of the family-friendly policy networking organization Best Place for Working Parents
Allen shared the story of how her company successfully integrated a functioning childcare facility into their company to help support employees with young children during COVID
Allen offered several pieces of advice to the audience for integrating childcare
such as not trying to address every need for employees at once and not being afraid of the possibility of pushback
Allen said maintaining empathy for an employee’s needs was a major part of moving the project forward
we wanted to stay positioned to make human centered decision making a priority,” Allen said
“It was really important for me to relate and to empathize with everyone.”
Allen shared that businesses shouldn’t underestimate the impact even the smallest of efforts can have for supporting employees with families
“That low-hanging fruit for you may be the easiest problem to solve
it may be the least expensive problem to solve
it may be the quickest problem to solve,” Allen said
Don’t sacrifice the 1% solution because you cant’ get a 100% solution in place.”
Funk’s speech took the audience beyond childcare and explored other strategies that businesses can use to support employees with families in ways that help retain workers and boost their productivity
Even if employers are not able to provide childcare directly
there are more affordable options for supporting those workers
“I think it’s important for employers to understand that childcare really isn’t the only path,” Funk said
there’s a lot of low and no-cost solutions that are available
some sort of hybrid...getting schedules that are three weeks in advance rather than the week of can really help caregivers put the child care needs in place for them that they feel safe and secure about
overall reducing their stress both at home and at work but then also making them a more reliable employee.”
The spotlight was also provided to a number of childcare providers local to Douglas County who shared stories and advice relating to the successes and obstacles of operating rural childcare facilities

said one piece of advice she had for organizations stepping into childcare is to have a thorough understanding of the needs of families in a particular community
“I think being a community partner is probably the most essential to make sure that you are sustainable

But getting there's not particularly easy or intuitive

this goal is in the same camp for me as learning to sew my own clothes
play the cello or speak French conversationally — I love it in concept
but the reality of actually accomplishing those goals is beyond daunting
The latest season of Marketplace’s “How We Survive” podcast examines the rise and fall of ESG investing, or investments that consider environmental, social and governance factors. The last episode focuses on reducing your carbon footprint by examining the investments in your retirement portfolio
“It turns out that moving your investments to a climate-friendly investment option is the single most impactful thing that the average American can do for climate change,” Alex Wright-Gladstein told Marketplace’s Amy Scott
Wright-Gladstein is the founder and CEO of Sphere
a company focused on climate-friendly investing
That line got me thinking about my own retirement account
I am by no means rich — no one goes into public radio to become a millionaire — but my retirement savings are the single largest sum of money I’ve invested at the ripe old age of 26
So I want to feel good (and secure) about it
So I went out on a personal quest: To more closely examine what investments my 403(b) — the nonprofit version of a 401(k) — held
interrogate the environmental impact of those investments and see how easy it would be to change them
One of the trickiest parts about trying to green your retirement portfolio is first learning all of the investments in it
Many retirement accounts are target-date funds
a mix of investments set to get more conservative in risk as you near a goal retirement year — in my case
it’s depressing to read that written out.)
I have a target-date fund hosted with Vanguard
Checking out the specifics of what exactly is in VLXVX
The online investment profile displays sectors my portfolio includes
consumer cyclical (totally know what that means)
Specific companies and their impact on the environment
So, I decided to ask someone who did all this hard work before me: journalist Alison Takemura. She wrote an article a few years back about divesting her own retirement account from fossil fuels
“You're starting from this place of uncertainty,” she said
is there information about what stocks are held in that mutual fund
If it's a target-date fund — which a lot of retirement funds or retirement programs offered by employer organizations will funnel you into — these target-date funds don't give any indication.”
If it seemed like acquiring a conversational capacity for French was a toughie
imagine how daunting investigating the environmental impacts of each of the more than 3,500 companies that a portion of my retirement account included seems
I simply do not have that many hours to spare
I probably would have had a minor panic attack
“[FossilFreeFunds.org] really makes it transparent what different mutual funds hold
and they update that data on a quarterly basis
and then they grade it,” Takemura explained
My fund invests close to $800 million in fossil fuel across major companies like ExxonMobil
Here’s the thing: I want to have kids someday
And I want them to inherit an Earth that’s habitable
But … I also want to be able to retire someday
And energy companies make money — that’s why people invest in them
I’ve considered divesting my retirement portfolio from fossil fuel companies
But when I brought up divestment to Witold Henisz
vice dean and faculty director of the ESG Initiative at Wharton
“It's really important to think about the implications of a divestment strategy, as opposed to what's called an ‘engagement strategy.’ And it might make you feel good to divest
it might make you feel like you've done something really concrete
But another word for ‘divestment’ is ‘disengagement,’” he said
but it's really what you're doing when you divest.”
If the folks who care about the energy transition divested from companies that invested in fossil fuel production
who would be left holding those stocks or buying them up
How do you know those investors won’t push the company to invest more in fossil fuels
“I'm certainly more on the camp of active ownership and exhibiting voice and trying to influence these companies from within,” Henisz said
He added that investors should look into the specific initiatives and investments that energy companies are putting forth
if we're thinking about carbon capture
it's reasonable to think that some of those innovations are going to come out of the fossil fuel companies,” he said
Alison Takemura takes the opposite view of Henisz. She divested from fossil fuel funds using what’s called a tethered brokerage account
she sold the assets in her retirement account
then opted to invest them in a fund that more closely aligned with her values
It shows you funds that receive an A grade in terms of fossil fuel investment
You can also parse how well each fund does in relation to other morally dubious sectors
like private prisons or tobacco and e-cigarette manufacturing
Another route folks can take? Take advice from friend of Marketplace Molly Wood: Contact your company’s benefits manager and encourage them to offer climate-friendly retirement funds
For Takemura — like for me as I’ve started this process — taking a more active role in her finances seemed daunting
she made calls to her financial services provider: Did this make sense
“I was secure in knowing that the money wasn't going to disappear,” Takemura said
“I could use the money in the brokerage account to get shares of a different fund that I actually aligned with.”
Another option that Takemura explored was using a financial adviser who could help her align with her investing — and ethical — goals
The ones offered through her company’s plans and others she found with pre-consultation calls just didn’t quite fit the bill
So she decided to take matters into her own hands using a tethered brokerage account
She didn’t switch everything over all at once — she started with new contributions
she eventually sold and moved her older retirement funds
she looked at funds that had better grades on fossil fuel investment
as well as in the other categories she cares about
Many of the asset managers who receive top grades from an environmental perspective are smaller asset managers
relative to the big-time players like Fidelity or Vanguard
But it’s really the switching of funds that feels like the scariest part
You can view past performances of specific funds — like any investment
past performance does not guarantee future results — and weigh that against your values
she’s content with how her retirement fund has grown
“My investments have generally tracked the market,” Takemura said while cautioning that she is not a financial advisor
“It's grown as the market has seen kind of unprecedented growth
I don’t think [my investments] have outperformed the market
but I don’t think they’ve done that differently either.”
I’ll be honest: I haven’t switched any future or current investments — yet
“I think you should always be attuned to the time horizon in which you need you know to pull out your capital and the time horizon in which you're more confident in an investment,” said Wharton’s Henisz
If you’re investing in companies that prioritize the green energy transition
and those risks may not pay off in the short term.”
I also recognize that the people who manage retirement funds probably know more about the market than I do
It’s nice to have faith in them and not take on more work
and I’d like to know that where my money goes is not doing active harm — to the planet
to the health of the consumers who buy products being made
who has transitioned several retirement accounts resulting from multiple jobs
The fear that comes with touching this large sum of money gets easier to swallow
And the weight of knowing that her investments aren’t working toward a bleaker climate future is something that she takes solace in
“It's a personal action that you can take in your own life
and it's just been incredibly rewarding,” she said
“I think people try to optimize on just one dimension
They're trying to optimize for profit
Life is about joy and freedom and awe and nature and safety for you and your loved ones and so much more — and climate change threatens all those things.”
And how I’m thinking about my own investments may differ from someone looking to retire in the next five or 10 years
I’ve still got decades to add to my resume before I retire (if I’m ever able to)
So I haven’t adjusted the investments in my retirement account or wholly divested yet
it seems a little less daunting now that I’ve learned my options
it seems more doable than learning conversational French

ChatGPT's overly effusive style is being toned down as OpenAI rethinks a recent update
ChatGPT really, really likes you a lot. And that's a problem
titled "Sycophancy in GPT-4o: What happened and what we're doing about it," says
"the update we removed was overly flattering or agreeable — often described as sycophantic."
Developers noticed a problem earlier this month with ChatGPT's tone becoming increasingly accommodating and flattering. One user in OpenAI's developer community forums, Adyan.2024, wrote
I'm not looking for an AI that acts like a friend
and neutral — not emotionally expressive or overly friendly."
OpenAI CEO Sam Altman posted about the update multiple times on social media. On April 27, he posted on X
"the last couple of GPT-4o updates have made the personality too sycophant-y and annoying (even though there are some very good parts of it)
ChatGPT is estimated to have about 800 million active weekly users
Preventing ChatGPT from trying to be your best friend ever is about more than creating a good experience for users
Users who are trained to treat the tool like a person may end up costing OpenAI money simply by using "please" and "thank you."

For users who are seeking facts instead of accommodation or agreement
there are ways for people who use ChatGPT and other AI tools to personalize the experience and set the tone by being specific in their prompts how they want questions answered

neck and torso so riddled with bullets that it was difficult to tell
a 27-year veteran of the district attorney’s office
held a press conference Wednesday to announce the results of the more than two-month-long investigation into the hostage situation and shooting at the West Manchester Township hospital
described in as much detail as he believed he was permitted to do under the law and within the strictures of decorum
the events that led to the death of Duarte and Archangel-Ortiz
Barker made it clear that Archangel-Ortiz was the author of this tragedy
entered UPMC fully prepared to take hostages and kill people,” Barker said
he would have faced charges of first-degree murder and attempted murder – the murder charge related to Duarte’s death
Even though the suspect did not fire the fatal shot
It would have been what Barker described as “a no-motive prosecution” – the law doesn’t require prosecutors to prove motive

Archangel-Ortiz's last day on earth began when he took an Uber to the Walmart Supercenter in West Manchester Township
His Uber driver told investigators that he didn’t notice anything strange about Archangel-Ortiz
The driver also didn’t think there was anything amiss when he dropped his passenger off at UPMC at 10:35 a.m
Surveillance video at the hospital showed he was wearing black pants
Inside the backpack was a 9mm Taurus handgun
The semiautomatic weapon had previously been reported as stolen in Manor Township in Lancaster County in 2017
Archangel-Ortiz was prohibited by law to possess the weapon
his Second Amendment rights rescinded under the law by a robbery conviction in the 1990s
He went to the hospital’s ICU on the second floor and used the phone at the entrance to call the desk to ask to enter
The supervising doctor met him at the door and escorted him to a room to talk to him
As they talked about his girlfriend’s passing
Archangel-Ortiz complained of nausea and bolted from the room
the suspect was brandishing his silver handgun
“This is what we’re going to talk about.”
Archangel-Ortiz fired two shots at the doctor
One round pierced the doctor’s jacket and didn’t strike him
Archangel-Ortiz then grabbed a staffer who was hiding underneath a desk and gave her a bag of zip ties
instructing her to zip-tie the other staffers
The first call to 911 was placed at 10:43 a.m
tried to the enter the ward and Archangel-Ortiz took a shot at him
“I’m going to go room to room and start shooting people.”
UPMC security officers then entered the ICU
Archangel-Ortiz fired at them and told them that if anyone entered the room
The UPMC officers retreated and waited for police to arrive
Archangel-Ortiz shot one of his zip-tied hostages in the leg as she lie on the floor
Duarte and another officer arrived at the hospital
Duarte was on duty in neighboring West York borough and responded to the call to assist West Manchester Township Police for what was dispatched as “an active shooter.”
Police from departments all over York County – including members of the Quick Response Team
a SWAT team composed of officers from different departments – gathered
Officers from all over the county responded
The response included state police troopers and wardens from the state Game Commission
As police gathered outside the ICU – other officers fanned out and secured the hospital and established a perimeter – Archangel-Ortiz told a hospital staffer
Tell them they have until 11:25 or there are going to be bodies.”
Archangel-Ortiz called his brother and told him to clean out his apartment in West York and take his jewelry
The hospital staffer who had been shot in the leg saw an opportunity to get away and made her way to a bathroom in a patient’s room
decided to open the doors to assess the situation
The first officer to enter would have a ballistic shield to provide cover for the others
He held a hostage as a human shield and threatened to “blow her head off,” Barker said
An officer tried to talk to Archangel-Ortiz
Having no clear line of sight to shoot Archangel-Ortiz
posting on either side of the door while discussing what to do next
And those with medical training were assigned to stand by should that become necessary
one of the hostages was able to snap the zip ties binding her hands
Archangel-Ortiz pointed his gun at her and pulled the trigger three times
Hospital staffers later told investigators that Archangel-Ortiz banged the gun against his hand
Police officers lining the hallway on both sides of the door backed up
looking for “a clear and present opportunity to strike the actor and not strike the hostage,” Barker said
The bulk of the blast struck Archangel-Ortiz on his right shoulder and back
A stray pellet struck an officer holding a ballistic shield on the other side of the door
who was standing diagonally behind the officer holding the shield
hitting Archangel-Ortiz between 15 and 20 times in his head
“It was hard to be precise due to the nature of the injuries,” Barker said
Police later recovered 22 spent cartridges from the hallway
“The hostage was not struck once,” Barker said
“would not have discharged their firearms if they thought they would strike the hostage
Another officer was wounded in the leg by pellets from the shotgun
officers told the hostage to run and when she did
causing what Barker described as a “serious injury” to her head
Duarte retreated around a corner and told other officers that he had been hit
He then returned to the ICU entrance and bent over to hold the hand of the officer who had been wounded
An officer with advanced emergency medical training tended to him
Other officers with medical training tended to the other wounded officers
applying tourniquets to stanch the flow of blood
Duarte was declared dead at WellSpan’s York Hospital
Barker declined to identify the officer who fired the shot that killed Duarte
He also declined to describe the cause of his death as “friendly fire,” a term of art that he said carries no legal weight
When a police officer picked up Archangel-Ortiz's gun
he cleared to it to make sure it was safe to handle
something officers had no way of knowing when he appeared outside the ICU door
Barker choked up when he spoke about police
“showed what it means to lay down your life with sacrificial love for all of those you serve
They were willing to lay down their lives for every single person in that hospital.”

Barker and investigators met with her and told her their findings

to be shot and know that he was facing death
“I wish I could ask him what he felt in that moment,” she said
She has saved one of her son’s shirts from his dresser

After a thorough investigation was conducted by law enforcement regarding Archangel-Ortiz' mental health
it was determined that there was no evidence that would suggest Archangel-Ortiz was planning to commit the tragic shooting
Barker emphasized that all shots fired from Archangel-Ortiz happened prior to law enforcement arriving to the ICU
officers arrived at multiple entry points around 10:51 a.m
— treating the situation at this point as a hostage scenario
healthcare workers in the room with Archangel-Ortiz saw him shoot multiple staffers before attempting to shoot a worker in the head
that's when Barker said the gun clicked three times and was out of ammunition — a detail unknown to officers who
were lined up in teams outside the ICU doors
When opening the doors to attempt de-escalation
Archangel-Ortiz told authorities to "back the f*** up" and to "close the f****** door
The two teams on the left and right sides of the ICU doors then closed them
Barker also reported that Archangel-Ortiz called his brother
"this is how I'm going out."
Archangel-Ortiz then took a healthcare worker as a human shield and "burst" through the ICU doors
created what he called a "reactionary gap" and backed up from Archangel-Ortiz and the staff member
After seeing the best line of sight to open fire without harming the hostage
an officer on the left side of the doors reportedly shot first using a shotgun —hitting Archangel-Ortiz from behind
A ricocheted pellet from the shotgun hit an officer with a protective shield in the hand
Among those teams at the door stood West York Borough officer
who Barker stated was unintentionally shot by law enforcement twice — one round hitting him in the left arm and across his chest while the other round went into the left side of his chest where his tactical vest would not have covered him
Barker confirmed Archangel-Ortiz was shot 15-20 times
Barker relayed that Duarte attempted to move one of the two officers hit by gunfire
before eventually passing away from his injuries
The hostage that Archangel-Ortiz used as a human shield was not hurt in the gunfire
Archangel-Ortiz' firearm was later found after the incident and was discovered to have no ammunition in it
Barker emphasized that there were multiple variables that officers could not have known and that there are some variables out of law enforcement's control
he spent his final moments helping a downed colleague

Pups Pub first opened its Tampa location two years earlier and health officials only required them to place a gate between the bar and the seating area.
When the Orlando location opened, both spots were inspected and found to be in violation.

a free family-friendly festival featuring colorful costumes
returns to Frenchtown for the sixth time on Saturday
“The Hatch is a moment to come together with friends
“All are invited to participate by dressing up as a bird
and imagining the change you wish to hatch into the world.”
The Hatch is a biennial festival established in 2016 celebrating the founding of ArtYard
an arts center dedicated to incubating new work
as well as a nod to the location’s 20th-century history as an egg hatchery
This year’s festival is inspired by Emily Dickinson’s poem
The festival starts at 2:00pm with the “cracking” of a towering 14-foot steel-welded egg perched on the edge of ArtYard’s riverside courtyard at 13 Front Street
Colorful flocks of human birds and giant bird puppets will emerge
and 25-person Brazilian drum corps will lead the procession to Sunbeam Lenape Park and through the borough’s idyllic downtown
ending in a lively dance party back at ArtYard
Viewers will not want to miss this fast-moving performance so arriving with plenty of time to park and arrive at 13 Front Street is recommended
The festival features performances by Day Day Juicy Couture, featured on HBO Max’s reality voguing series Legendary; Orquesta La Sagrada Concepcion, a New Brunswick brass band; Mariachi Nuevo Amanecer, of Queens, NY; Batala Philly
an all-percussion community band; and crooner Eric Mingus
son of legendary jazz musician Charles Mingus

Drivers heading west to return to Pennsylvania can follow detours north to Milford or they can travel south to cross the river in Stockton.

This quiet, sandy beach on southern Whidbey Island has views of the snow-topped Olympic mountains and plenty of space for pups to roam. Dogs can run off-leash for miles on this beach — and as a bonus to their paws, the sand is softer than most beaches in the area. At Pacific City Beach, there’s a variety of terrain for on-leash dogs to explore, from sandy shorelines to sand dunes to rock formations. As a bonus for humans, the neighboring town offers a variety of dog-friendly breweries and wineries. Pacific City Beach is another winner of the four-way tie, with a satisfaction score of 9.62 — and it won’t break the bank, with an affordability score of 9.19.

Traveling back down south, a stay at this Jackson County, Mississippi beach is a steal, with an affordability rating of 9.62 and an average nightly stay of $78.46 during the summer season. Leashed dogs are allowed on the beach. Its shallow waters and soft, white sand make it a great place for a stroll with a pup.

Aaand...back to the good ol’ PNW. Along with Brandon and Pacific City, Rialto Beach in Olympic National Park has a high visitor satisfaction score at 9.62. Dogs are allowed in certain areas as long as they’re leashed, and only during daylight hours — sorry, no camping here. This beach isn’t one to miss; it’s famous for its driftwood piles, gorgeous rock columns, and variety of marine wildlife.

Down in Melbourne, Florida, Canova Dog Beach welcomes on-leash dogs. The water’s calm in all seasons, perfect for a pup who wants to splash around but isn’t quite the athletic swimmer. Dogs are welcome as long as they are kept on a leash.

with a focus on animal welfare and the future of meat.President Donald Trump’s first 100 days in office have been a gift to a sector of the economy that gets little attention but has enormous social and economic consequences: the US meat industry
While Congress and both Republican and Democratic administrations tend to do what meat companies want — in part because those companies tend to give a lot of money to politicians and intensively lobby them — Trump has been even friendlier than most
the Trump administration has behaved like traditional anti-regulation conservatives
It’s quickly taken a number of actions that directly benefit the meat industry
Pig slaughter lines are already allowed to process as many as 1,106 hogs per hour, or roughly one pig every 3.2 seconds, while poultry operations are allowed to slaughter up to 140 birds per minute. Yet in March, the US Department of Agriculture announced that it was drafting a rule to allow pig and poultry slaughterhouses to operate even faster
Labor advocates say the new regulations will further endanger slaughterhouse workers, who already work one of the most dangerous jobs in the country, suffering high rates of injury from the repetitive cuts they must make to animal carcasses for hours on end
“Increased line speeds will hurt workers — it’s not a maybe, it’s a definite,” the president of the Retail, Wholesale, and Department Store Union, which represents over 15,000 poultry workers, said in a press release
Animal advocates also worry about how this will impact the billions of animals that move through US slaughterhouses every year
“With fewer protections and higher pressure
animals will endure even more suffering on the already cruel live-shackle slaughter line,” Michael Windsor of the animal protection group the Humane League told me in an email
The USDA didn’t respond to an interview request for this story
The Biden administration aimed to prevent more than 10 percent of the 1.35 million salmonella infections Americans suffer from each year. But that won’t be happening. The National Chicken Council, the industry’s leading trade group, opposed the rule when it was proposed; in April
In February, the USDA shrunk a farm animal welfare research team from five scientists to just one, Sentient’s Grey Moran reported
The unit’s research aimed to better understand “the gruesome mutilations and injuries routinely suffered by farm animals
including the pain experienced by livestock during and after castration (the removal of the testicles to prevent further breeding); the far-ranging psychological and physiological impacts of heat stress on farm animals and methods to increase cooling
and ways that farm animal stress is passed down to their offspring,” according to Moran
The USDA unit also worked with livestock producers to improve animal welfare and had conducted research on pain endured by female breeding pigs kept in tiny cages, a common practice in the pork industry. That work informed California’s farm animal welfare law prohibiting extreme confinement of pigs
JBS has also long been implicated in deforestation, and last year, New York state’s attorney general took the company to court for its “net zero” climate claims
More than half of the nearly $2 billion the US has spent on this outbreak has gone to cover poultry companies’ losses. According to a recent report by advocacy group Farm Forward
around one-third of payments to poultry companies — some $365 million — have gone to 67 “repeat offender” operations with two or more outbreaks

Although many consumers don’t know it, and politicians do little to address it, agriculture is a massive polluter — it’s the largest source of US water pollution

In early April, a leaked USDA memo revealed that the Agricultural Research Service, the USDA’s in-house scientific research department, could no longer use 110 words and phrases
That’ll only make it harder for anyone to understand and ameliorate the meat industry’s social costs
although a separate issue from factory farming
could represent a major reduction in a type of animal suffering that has long been unchallenged by both parties
But when it comes to the industry that’s by far more responsible than any other for hurting and killing animals
the Trump administration has been even more deferential than his recent predecessors
Its positions on meat and the animals who suffer for it could be summed up as simply as “kill
