The latest foreclosure threats came to light days after Dickinson City Council voted Feb. 25 to avoid potential litigation by delivering public improvement district fees collected from Bayou Bend Estates homeowners directly to a lender that asserted Karam had missed agreed payments
A commercial foreclosure occurs when the borrower hasn’t kept up on loan payments or violated other terms of a commercial mortgage
which loaned JMK5 about $550,000 for the waterfront homes

Months of conflict over activity on a 40-acre plot that racked up millions in fines by the Galveston County Consolidated Drainage District against Tannos Development Group has landed in federal court
The district slapped Tannos Development with more than $3 million in civil penalties and won an injunction halting work on a the proposed residential project at 30 Wilderness Trails in west Friendswood
The district asserts Tannos engaged in construction activity without having an approved drainage plan
argues construction for the residential project hasn’t begun and activity at the site was merely stockpiling dirt
The prominent Friendswood development group in February filed a lawsuit in U.S
District Court against the district and each of its five board members

Tannos also asserts he was not afforded due process during the civil penalty hearing
“I don’t know where in the world you have two commissioners giving evidence and giving pictures and then voting to fine me,” Tannos said
“You can’t give evidence and then sit on a convicting and fining of a person
That’s a violation of every due process rule in the world.”
District officials followed proper procedures during the hearing
“We at the drainage district took the hearing extremely seriously,” Bailey said
so it does not necessarily follow all of the rules of a court of law.”
noting the asserted violations closely align with facts in the case decided in the 122nd District Court

The district asked the federal court to send Tannos’ lawsuit back to the state district court where it began
The lawsuit seeks a permanent injunction preventing the district from taking any action to enforce the $3.4 million fine
“I’m going to bring this in front of a federal court with impartial people that are going to see how ridiculous this is,” Tannos said
Tannos said he just wants the development to move ahead
“They’re acting like they’re going to do all this to me and it’s just going to go away
or I’m just going to go away,” Tannos said
I’m going to make this development happen.”
The drainage district wants a good project and the holdup is on the developer’s end
“For their submittal of the preliminary plans
and we’re still waiting on them to resubmit with the changes that are required for our regulations,” Bailey said
“We’re in a waiting game as far as the actual development goes because it’s on them to provide the next submittal with the changes that are required
