A Hubbard-based excavator who built and operated two controversial waste pits on Marion County farmland is being sued by one of the property owners charging to accept waste from industrial vacuum excavation companies Both sites temporarily halted operations in 2024 after the Oregon Department of Environmental Quality threatened fines and began pushing the property owners to clean them up Hubbard site property owners David and Susette McDonald say Wing lied about having proper permits for the project dumped contaminated countertop waste without their permission and took advantage of their advanced age creating so much stress that David McDonald had a series of strokes Wing and the property owners have maintained they are simply filling in low-lying land to use it for farming Wing has denied the allegations and filed a crossclaim against the McDonalds’ grandson and local excavator Dark Horse Construction Wing says Jake McDonald was aware of and gave permission for his activities at his grandparents’ property which did some work on the dump pit after the McDonalds terminated their relationship with Wing is responsible for any damage to the property the McDonalds nor Dark Horse Construction responded to the Statesman Journal’s interview requests the McDonalds say their relationship with Wing began in April 2020 from an excavation job at North Marion High School Wing then began delivering dry vactor truck waste from another pit he operated to the McDonalds’ property The McDonalds were not paid to take the fill Wing later proposed building a pit on the McDonalds’ property paying them $50 to $100 per load of vactor truck waste dumped there The lawsuit alleges Wing falsely said he had received all necessary permits for the pit Wing then proposed allowing him to dump remnants from cutting countertops Wing said the countertop waste would be used to create road beds and enhance the pit the countertop waste was dumped in an unstable pile on an unstable slope.” Additional countertop waste was dumped in the pit The McDonalds weren’t paid to accept the countertop waste after the McDonalds terminated their relationship with Wing in November 2023 Wing “maliciously” tore down a berm in the pit that prevented its contents from flowing into a neighboring wetland The McDonalds were forced to hire another excavator to make emergency repairs DEQ issued a preenforcement notice to the McDonalds finding they were responsible for five violations of Oregon environmental law The violations included operating a wastewater disposal system without a permit placing waste where it could reach waters of the state failing to obtain DEQ review and approval of plans to construct a wastewater disposal system and two instances of establishing a solid waste disposal site without a permit DEQ asked the McDonalds to immediately stop accepting waste and to provide DEQ with records showing the source and nature of the waste accepted It also asked them to either apply for a solid waste disposal permit submit a plan to remove the waste from the property or demonstrate that the vactor truck waste is clean fill and exempt from requirements DEQ has given the McDonalds four deadline extensions The state’s enforcement efforts at the other Marion County farm pit have stalled In March, DEQ issued a formal order to Denise Burnham who owns the property at 21875 Butteville Road in Aurora DEQ gave Burnham until April 29 to submit plans to either properly reconstruct the pit or properly decommission it saying the pit’s berm was at risk of failing and polluting nearby Ryan Creek denying nearly all of DEQ’s findings and conclusions the case will be heard before an administrative law judge Tracy Loew covers the environment at the Statesman Journal. Mrs. Grace Jones Norris Hubbard, 91, passed away peacefully Sunday morning, April 27, 2025, after an extended illness. Her loving family was by her side, She was born Oct. 15, 1933, the daughter of the late James Felton and Thelma Faircloth Jones of Clinton. In addition to her parents, she was preceded in death by her husbands, Paul Norris and Dr. Hampton Hubbard, sister Gladys Jones Matthews and brother James Jones, all whom she loved dearly. A funeral will be held Thursday at 2 p.m. at First Methodist Church, Clinton, where she was a member, with the Rev. Matt Seals officiating. Burial will follow in the Clinton Cemetery. The family will receive friends an hour before the service in the church fellowship hall. Arrangements are by Crumpler-Honeycutt Funeral Home.
