The first-term Democratic supervisor took office in 2024 after defeating incumbent Republican Rory Fitzpatrick Among the allegations in the report is that Evans responded to the staffer complaining about how people don’t take her seriously because she appears young by saying she reported he told her that other town employees “think we’re boinking,” commented on her “schoolgirl outfits,” and made regular references to her physical attributes The staffer claimed Evans also regularly invited her to go out for drinks or come over for dinner When she complained about the issues in last August he allegedly retaliated against her by stripping her of job responsibilities — including removing her prepared public remarks from speeches and taking control of a government email she was tasked with A second staffer also complained of similar retaliation after they allegedly attempted to intervene in Evans’ actions towards the first staffer Evans said he had not yet seen the investigation report and thought it was a political ploy “The Town Board is trying to force me to resign without offering me any information.” Evans could not be immediately reached for comment Tuesday morning the Irondequoit Town Board released a statement calling for Evans to resign "We feel heartbroken for the individuals who have been impacted by the Supervisor’s incredibly inappropriate behavior," the statement reads "We believe the best path forward for our staff and Irondequoit residents as a whole is for Supervisor Evans to resign immediately "Delaying in doing so is a further offense to the good people serving our residents each and every day and stalls incredibly important work we must be doing for residents town wide," the statement continues Evans said that the staffer had originally grown combative with him after an incident in July in which a person using a wheelchair flipped over outside the town community center Evans told the staffer he wondered if the accident was a scam to which the staffer referred to him as a “typical toxic male.” He alleged their relationship deteriorated after that incident “She just stopped talking to me,” Evans said Evans also described the staffer's complaints as “gibberish” and said he declined to apologize because he believed she was misconstruing his actions “She's just saying (what) her perception is I'm thinking I can't help her perception,” Evans said she's asking me to change because of what she perceives So how can I address the changes if the perception’s in her mind?” Evans also blamed issues the staffer experienced on “her mental health condition.” The staffer resigned from her position in September The report also outlines multiple previous incidents in which Evans allegedly made women feel uncomfortable due to sexual innuendo the report outlines a 2024 Fourth of July event where hot dogs were being served prompting Evans to allegedly comment to a group of women “I have a big sausage for you.” Another incident occurred with a plastic skeleton at a Trunk or Treat event in October 2024 “He literally takes the bones that are dangling in front of his groin area and jingles,” a redacted interviewee reported The Irondequoit Town Board launched its investigation in October and completed it in November On Friday, board members held a special meeting where they issued a statement acknowledging the completion of the investigation but declined to offer any insight into what it was about The statement also said the town had “decided to temporarily suspend any further action.” “The town board continues to evaluate relevant legal issues raised by the investigation and intends to ensure due process and protect the interests of all parties involved,” the statement continued “including the privacy and confidentiality of the complainants Evans had insinuated that the Town Board intended to push for a replacement Democratic candidate to take the office a joint statement from Democratic Congressman Joe Morelle called for the Irondequoit Democratic Committee to suspend any vote for party designation until the full report was released “As elected leaders who live in and represent Irondequoit we are deeply troubled by the Town government’s handling of an investigation into a Town official,” the statement reads “The lack of transparency surrounding this complaint is inconsistent with our values and a disservice to the families we represent.” Who might be considered to replace Evans on the ballot remains unclear Monroe County Democratic Committee Chair Stephen DeVay said Monday that no one had thrown their hat in the ring to challenge Evans had challenged Fitzpatrick in the 2021 election a year in which the supervisor seat was open after David Seeley stepped down now executive director of Unions and Businesses United in Construction (UNiCON) said Monday that he was not interested in running for the office “I tried my hand at that once and it didn’t work out,” he added Evans has remained steadfast that he is seeking re-election Monroe County District Attorney Sandra Doorley has filed a petition to remove Irondequoit Town Supervisor Andrae Evans from office The petition was submitted to the State of New York Appellate Division, Fourth Department and seeks a judgment under Public Officers Law §36 which allows for the removal of certain municipal officials for "misconduct or malversation in office." Elected justices of the peace are excluded under the statute According to the DA’s Office, the petition follows a referral from the Irondequoit Town Board and the Irondequoit Police Department. The DA's Office reviewed findings from an initial investigation and conducted its own independent review to determine if criminal charges or other penalties were warranted the office decided that filing the petition was "the most appropriate course of action." A scheduling order from the Fourth Department is expected in the coming weeks The petition stems from allegations made by a former town employee who accused Evans of inappropriate behavior The Irondequoit Town Board hired an independent law firm to investigate the claims The investigation concluded there was credible evidence to support the woman’s allegations The report found her account was supported by other town employees who said Evans had made sexually suggestive comments and gestures that made them uncomfortable the Town Board is not legally authorized to remove an elected official While they have publicly called for Evans to resign he has refused and has announced plans to seek re-election later this year Evans filed a lawsuit against the Town of Irondequoit and the Town Board seeking to stop a resolution that would censure him The resolution stemmed from the same investigation which reportedly concluded that Evans sexually harassed the employee and retaliated against her Evans argues in court filings that the resolution unlawfully limits his authority as the town's chief executive officer denies him access to his personal property and violates his privacy morning for a motions argument Julio Pimentel Soriano is accused of killing two children and their parents in their home on Knapp Avenue on Aug Irondequoit Police have been investigating ever since finding their bodies in the basement of the home when responding to a fire is also accused of the murders but hasn’t been caught yet A motions argument happens before a major trial can get underway She also claimed Evans made remarks about former President Bill Clinton and Monica Lewinsky She told investigators she said she might go to the gym to sit by the pool after work one day and said Evans responded by saying “Don’t tempt me" to join in The accuser said she was uncomfortable enough after that remark that she began seeking advice from peers about how to handle the situation and she became overcome at times with anxiety the staffer met with Evans in August to tell him about her concerns regarding his behavior The report said Evans chose to remove himself from interacting with her The woman claims Evans took job responsibilities away from her as retaliation and was not communicating Evans claimed the staffer wasn’t showing up for critical meetings also alleging she made similar sexual harassment allegations on prior jobs The accuser said she resigned because of the work environment after nine months on the job The report also said the credibility of the allegations is bolstered by accounts of other town employees who reported Evans made other sexual innuendo-type comments that have made them uncomfortable One example included an inappropriate comment allegedly made at the 4th of July festival about a hot dog and parts of Evans’ anatomy MORE: Irondequoit board, residents react to sexual harassment report against town supervisor Witnesses said Evans can be “touchy” with colleagues when it comes to hugs Some though calling his hugs “weird,” according to the report Others claim they have never felt “a drop” of sexual harassment from Evans Other witnesses claiming Evans and other male employees engaging in “locker room comments.” Evans admitted to making some of the comments — but others he denied or recalled them differently There were no witnesses to support a number of them The finding also said Evans more than likely “does not have an understanding of appropriate workplace boundaries.” the investigation supports the determination that Evans violated the town's anti-harassment and sexual harassment policies regarding one complaint and one of two allegations of retaliation Evans told 13WHAM he can't comment on the report The Irondequoit Town Board called Tuesday for Evans to resign Evans indicated he would be running for reelection (WHAM) — It was a packed room at Irondequoit Town Hall Friday as residents were expecting updates involving the suspected investigation into Town Supervisor Andraé Evans There were all kinds of rumors floating around regarding Evans' possible resignation — rumors that Evans shot down explaining it had retained a law firm to investigate a complaint regarding the actions of an elected town official saying that the investigation is now complete "The town board hoped to come to you today with a resolution," read Deputy Supervisor Peter Wehner from a statement the town board regrets to inform our community that we have decided to temporarily suspend any further legislative action related to this investigation at this time." It also retained another law firm as special counsel to advise the board with respect to the findings of that investigation The cost of that investigation was not expected to exceed $7,500 "The town is dedicated to fostering an environment where all employees feel valued and protected," added Wehner "We recognize the importance of addressing these issues promptly and effectively and we are committed to accountability and transparency throughout this process." Wehner then said the town board would not be taking any questions we asked Evans about the nature of the investigation I have been asked not to say anything concerning this investigation and that's at the core of my heart — it's that dignity," Evans explained "But I am very excited to talk about all the work we've done here in Irondequoit how much we are helping all the citizens — that's what's important The board hired a law firm for a workplace investigation back in November The deputy supervisor said the town would provide updates as appropriate when the situation allows
