heard me say this over and over Anthony closed its doors because of a serious decline in enrollment and because of ever-rising costs associated with a Catholic school education For those who had any kind of association with the school Friar High was a place where many kids came to get off the streets because as the school’s marketing slogan — which became a documentary and a rallying cry — The Street Stops Here Countless kids who otherwise would not have had a chance — at anything — got that chance But it all went away when the school closed One of the major reasons — some might say the only reason — why St Anthony survived for as long as it did was because of one man Hurley was the coach of the team for nearly 40 years an incredible number of state championships and several players who went on to play in the NBA and Major League Baseball More than 100 players he coached played Division I college basketball He was inducted into the Naismith Basketball Hall of Fame in 2010 He had but you will get better by accident if you play every day.” Belleville and Lyndhurst’s most noted landlords — among many other properties in North and Central Jersey — could be in some serious trouble with the law Platkin and the Division of Consumer Affairs have filed a lawsuit against property management software company RealPage (“RealPage”) and 10 of New Jersey’s largest landlords Platkin alleges collusion in a rent-raising scheme that violated state and federal antitrust and consumer protection laws and forced tens of thousands of New Jerseyans to overpay for rent month after month RealPage and the landlords — one of whom is Russo Development Belleville and Lyndhurst —  allegedly agreed to set rents for multifamily housing properties statewide based on RealPage’s algorithmic pricing software and to exchange sensitive non-public information to align their prices and avoid competition that would otherwise keep rent prices down filed partially under seal April 23 in the United States District Court for the District of New Jersey alleges the defendants engaged in multiple violations of the federal Sherman Act the New Jersey Antitrust Act and the New Jersey Consumer Fraud Act (“CFA”) “The defendants in this case unlawfully lined their pockets at the expense of New Jersey renters who struggled to pay the increasingly unlivable price levels imposed by this cartel,” Platkin said “Today we’re holding them accountable for unlawful conduct that fueled the state’s affordable housing crisis and deprived New Jerseyans of their fundamental right to shelter.” Platkin notes average rents in New Jersey are among the highest in the nation and the state currently has a shortage of over 200,000 affordable rental homes where a significant amount of the alleged activity occurred developers were issued Payments in Lieu of Taxes — commonly known as PILOTs — as an incentive to build here and to clean up what was once considered blighted properties Half of low-income renters are cost-burdened Platkin says — meaning they pay more than 30% of their income on rent — as are nearly a quarter of middle-income renters Renters in locales throughout the state face a highly concentrated market where individual landlords control thousands of apartments in the state demand for multifamily housing is highly inelastic the demand for rentals remains relatively constant: renters need someplace to live and cannot forgo the essential human need of shelter the complaint names Russo Property Management LLC; Morgan Properties Management Company LLC; AvalonBay Communities Realty Operations Group LLC; Greystar Management Services LLC (“Greystar”); Aion Management LLC; Cammeby’s Management Co Inc.(“Veris”); and Bozzuto Management Company (“Bozzuto”) (collectively who collectively own and manage at least tens of thousands of rental units statewide The complaint also references additional New Jersey landlords as unnamed co-conspirators These are landlords owning or managing multifamily rental properties who are believed to have also unlawfully colluded to raise rents by collectively setting rents based on RealPage’s software and unlawfully agreed to exchange competitively sensitive information (collectively“participating landlords”) The investigation into the alleged conspiracy is ongoing and additional defendants may be named at the heart of the price-fixing scheme is RealPage’s Revenue Management (“RM”) Software RealPage offers three RM products to landlords — YieldStar AI Revenue Management (“AIRM”) and Lease Rent Options (“LRO”) The products are functionally similar in that they automate pricing of multifamily units using algorithms fueled by RealPage’s vast data repositories these products employ statistical models that use data — including proprietary non-public data —to estimate supply and demand for multifamily housing that is specific to particular geographic areas and unit types and then generate a price to charge for renting those units that maximizes the landlord’s revenue RealPage charges the landlord an initial setup fee and then a monthly fee for each multifamily residential unit participating landlords compensate RealPage by providing their valuable proprietary data agree to share their non-public information with competitors and know that their competitors’ information is being used to generate the rents they charge a “One Master Agreement” with RealPage expressly obligates the landlord to provide RealPage with “correct and accurate” data and acknowledge that RealPage may use that data to operate its products (including the RealPage RM Software) The complaint asserts the RealPage software is anti-competitive by design because it restricts meaningful price reductions and facilitates collective action to push rents higher RealPage enforces strict adherence by landlords to its prices using tools like automatic price acceptance and direct oversight by RealPage employees to ensure landlords stay in line In the rare instance when landlords do deviate they risk corrective action—both from RealPage and from their peers in the cartel The landlords using RealPage’s RM Software not only agreed to use RealPage’s anticompetitive RM Software and impose its artificially high — or “supracompetitive”— rents but they also collaborated directly with one another secret shops and industry meetings where they coordinated tactics and reinforced their collective commitment to the scheme And they worked actively to recruit other landlords into the scheme knowing broader participation would drive rents even higher the most inexpensive apartment available was a 515-square foot studio fetching $1,936 in rent The most expensive was a 1,267-square-foot two-bedroom unit fetching $3,358 per month Not mentioned in the complaint — but apparently a result of these alleged actions — is what has happened to rent prices elsewhere or rental prices not controlled by these landlords which over the last 10 years have skyrocketed a three-bedroom apartment in Kearny was going for up to $2,500 per month two-bedroom apartment was going for $3,200 per month the most expensive rental in Kearny was $1,300 for a three-bedroom apartment the asking price for a two-bedroom apartment was $1,500 the complaint also asserts in some instances landlords’ employees may disclose the use of RealPage’s RM Software but they misrepresent the nature of the algorithm to renters these employees mislead consumers to believe that the RM Software merely determines what the “market rate” is RealPage’s RM Software does not merely determine a “market rate,” but instead generates a supra-competitive price designed to push the entire market higher the complaint alleges the defendants violated the Sherman Act and the New Jersey Antitrust Act by engaging in conduct that includes: The complaint also alleges the defendants violated the New Jersey Consumer Fraud Act by engaging in commercial practices that violate state and federal antitrust laws which constitute unlawful commercial conduct under the law Each violation of the Sherman Act and New Jersey Antitrust Act constitutes a separate unlawful practice and violation of the New Jersey Consumer Fraud Act The complaint also alleges RealPage engaged in “unconscionable commercial practices and acts of deception,” including: the complaint alleges certain landlords engaged in unconscionable practices acts of deception or misrepresentations under the Consumer Fraud Act the complaint alleges that the defendant landlords officer was injured by a fleeing thief late last month and the criminal has been charged with numerous offenses police were called to a repeat shoplifter at the Passaic Avenue Shopping Plaza the suspect filled large garbage bags with merchandise while his car idled in the fire lane outside the suspect was confronted by police but refused to comply with orders to stop An officer attempted to arrest him and a physical struggle ensued which ultimately resulted in the suspect running the officer with his accelerating vehicle The suspect fled over the Clay Street Bridge the involved officer’s injuries were determined to be non-life threatening with the assistance of the Newark Police Department the vehicle was located in the Clinton Hill neighborhood of Newark It was seized and the suspect was arrested and transported to the Kearny Police Department causing injury while driving with a suspended license operating vehicle during period of suspension (second or subsequent violation) reckless driving and eight various traffic summonses The owner of the vehicle was also charged with permitting a revoked-license driver to operate their vehicle Holt was transferred to the Hudson spanning four towns has been solved by the Kearny Police Department’s Detective Bureau The investigation led to criminal charges being levied against Juan Hernandez multiple vehicles were targeted for will replace him on the council the Democratic Party’s County Committee has 15 days from the resignation to gather three names of potential candidates a choice must be proffered as the nominee for the seat The committee was expected to meet Tuesday But here’s where the biggest problem rests — with the fractured council the likelihood of finding a consensus candidate the second person of the original three would face an up or down vote the third person of the original three would face the same up or down vote If none of the three get the required five votes — and there is no reason to expect anything but that happening — we’re hearing the next step would fall into the hands of Doyle who could either select a Second Ward Democrat to take the post or leave the seat open until robbed of his jewelry by a suspect on a bicycle near the intersection of Halstead Street and Kearny Avenue then disposed of his bicycle and outer layers of clothing Officer Wilson provided a detailed description of the suspect crossing Belgrove Drive and ending up on Passaic Avenue Bryan San Martin and Anthony Nunez quickly spotted the suspect who immediately changed direction and began to run but the suspect was ultimately captured by Officer Sean Wilson and East Newark Sgt yielded the victim’s jewelry and a knife Kearny officers also recovered the suspect’s bicycle his discarded clothing and an airsoft pistol from which the orange tip was removed Town of Kearny camera footage proved to be instrumental in the course of this rapidly evolving incident four counts of weapons offenses and two counts of obstructing the administration of law “Outstanding work by our officers in apprehending this robbery suspect,” Macfie said “Criminals should know — if you break the law in this town we will of the four wards on the Town Council Seeking re-election will likely be Mayor Carol Jean Doyle First Ward Councilwoman Marytrine DeCastro Third Ward Councilman Fred Esteves and Fourth Ward Councilman Jerry Ficeto all five would have run on the same ticket Esteves and Ficeto will run on a ticket that would include a newcomer in the Second Ward Based on how things have gone over the last year-plus So this then opens up the possibility the Democrats could have slate of five candidates it’s anyone’s guess who the candidates could or would be Would anyone who formerly sat on the council consider running again Could a former mayor or mayors consider a run He rode the “red wave” that allowed Donald Trump to win Kearny’s vote And considering next year is a gubernatorial election it would make complete sense if the GOP ran a full slate of candidates — something that has not happened in Kearny in decades just last a few weeks ago in an interview with The Observer but we’d be stunned if he wasn’t on some ticket There have also been rumblings a former Republican mayor of Kearny could throw his hat in the ring Could you even begin to imagine if that were to happen next year is already shaping up to be one of the most memorable local elections in a long time It’s going to be a very interesting — and likely long and exhausting — ride Several officers were promoted to higher ranks in the Kearny Police Department in swearing-in ceremonies at Town Hall March 25 Kevin Arnesman and Christopher Levchak were elevated from lieutenant to captain Michael Gonzalez ascended from sergeant to lieutenant and Thomas Sumkowski were promoted from patrol officers to sergeant Mayor Carol Jean Doyle administered the oaths of office for all the newly promoted spoke of all the newly promoted after each too their oaths • “Chris Levchak joined the Kearny Police Department in 2009 after spending a year at the Hudson County Sheriff’s Department Chris was promoted to sergeant and in 2023 Chris spent his career in patrol division and is looking forward to beginning administrative role the department Chris is the son of retired Kearny police Lt He is married to Sophia and has two children Chris has two siblings that are also nurses and his  brother Chris wanted me to mention that growing up • “Kevin Arnesman joined the Kearny Police Department in 2013 He graduated bachelor’s degree from Montclair State University and started his career in law enforcement as a class two special with the Essex County Sheriff’s Department He logged over 2,000 hours of volunteer service with them in a the patrol unit until he became a detective in 2009 Michael was named Police Officer of the Year on two occasions the Hudson County Regional SWAT team was formed with Mike taking a leadership role from its inception He has received over 30 commendations in his career and is currently assigned to the Records Bureau while also serving as the department’s range master Mike is the son of Pablo and Miriam Gonzales Mike recently completed his bachelor’s degree from Farleigh Dickinson University and is joined tonight by his daughter • “Richard Poplaski is a third-generation Kearny police officer The family has dedicated 67 years of service to the town of Kearny so far Rich says his greatest influence has been his mother Richard has attended almost as many training schools as Mike Gonzalez With rarely at the forefront of conversations before or during this season the idea of this year’s Kearny boys basketball team becoming a division champion has been in a constant in the back of their minds for months preseason goals turned into late-season reality on Feb 3 when the Kardinals defeated University Charter to clinch a share of the HCIAL National Division title It is Kearny’s first division title in boys basketball since 2016 “I think it meant a lot,” head coach Marc McCaffrey said “It was one of our goals in the beginning of the season and the team worked really hard to get there It certainly was satisfying to reach that goal.” After hitting a rough patch in mid-January Kearny enters this week’s Hudson County Tournament with wins in four of its last five games the
